HomeMy WebLinkAbout1951-11-05 PC MINS MINUTES OF A REGULAR M'CETING OF THE PLANNING COTUTISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Held Monday, November 5, 1951 The Planning Commission met in the Council Chamber at City Hall on the above date with Chairman Wulff presiding. Present: Members Ramage, Smith, Stewart, Poulter, Halferty, Drew, Wulff. Absent: None. Also Present: City Planner Wagner, City .Attorney Boyer, Asst. City Engineer Nheeler. APPROVAL OF MINUTES It was moved by Member Smith, seconded by-Member Stewart, and carried, that the minutes of the meeting held October 15, 1951 be approved, copies having been mailed to each Member, TENTATIVE MAP - Zurcher Tract #2. It was moved by Member Smith, seconded by Member Stewart, and carried, that the Tentative Map of Zurcher Tract #2 be approved, with the following recommendations: that the radius in the turn around be- cut to 35- ft. from center line to curb, with asphalt concrete paving in the turn around; and that Lots 3 and 6 be increased to 7,000 sq. ft. FINAL t:TAP - Wesley Park #1 Y' It was moved by Member Ramage, seconded by Member Halferty, and carried, that the Final Map and improvement plans of Wesley Park „{1 be approved. APPROVAL OF COUNTY COURT HOUSE LOCATION Mr. Barney, representing the County, appeared before the 'Planning Commission to present-the preliminary plans for the proposed Municipal courthouse. City Planner Wagner presented a plot plan showing proposed "location of the court house in relation to the present City Hall. It was moved by Member Halferty, seconded by Member Ramage, and carried, that the preliminary placement of the County court house 15 feet south of Davidson St. and 20 feet west of Guava Ave., be approved, provided that the County improve an adequate off-street parking space, on City property, for their own needs, Member Drew stated that, as a citizen, he does not approve of the City donating land to the County. ZONE -VARIANCES Ralph Fogerty, 164 National Ave., requested a variance to construct and operate a .trailer park in an R-3 zone. It was moved by Member Drew, seconded by Member Smith, and carried, that the variance be granted for the reasons stated in the application for a trailer court, provided the westerly end of the property-be maintained in an open condition to provide ingress and egress between National Avenue and Jefferson Avenue. On motion of Member Poulter, seconded by Member Ramage, and carried the fol- lowing Resolution was duly adoptbd: Resolved that the use of the proper y"described -2- in the application of Ralph Fogerty for an automobile trailer park be and the same is approved, and that the plan submitted and filed -rith the Commission for the im- provement of said property for an automobile trailer park be approved, provided that the westerly end of the property be maintained in an open condition to provide in- gress and egress between National Avenue and Jefferson Avenue. Berger A. Indseth, 181-187 Jefferson Ave:, requested a variance to construct and operate a trailer park in an R-3 zone. It was moved by Member Drew, seconded by T,Tember Poulter, and carried, that the variance be granted for the reasons stated in the application, provided the easterly end of the property, be maintained in an open condition to provide ingress and egress between National' Ave. and Jefferson Ave.; And provided that approximately 20. feet of land be ,deeded to the City on the westerly property line for future widening of Jefferson Ave. Berger A. Indseth, 631-639 "E" St., requested a variance to construct commercial buildings in an R-3 zone. It was moved by Member Poulter, seconded by Member Smith, and carried, that the variance be granted for the reasons stated in the application, provided that C-2 use does not exceed a depth of 75 feet; and provided that 5 feet of -land be deeded to the City on "E" Street for future street widening. Frank Fasano, 649 "G" St., requested a variance to construct and operate a trailer park in an R-3 zone. A discussion followed, in which several property owners adjacent to the applicant appeared in protest against the request, and a written pro- test was presented by Mr. H. E.. Reice, signed, by several other property owners, it was moved by Member Halferty, seconded by Member Smith, that the request for permission to construct a trailer court be approved. The- motion failed to carry by the following vote, to wit: ®� AYES: , Members Smith, Stewart, Halferty. NOES: Members Poulter, Ramage, Drew, Wulff. ABSENT: None. William N. Armstrong, 488 Minot Ave., requested a variance to retain a car port in violation of_ Ordinance 398 and the Building Code of. the City of Chula Vista. The Secretary read a letter from Mr. Cord, Building Inspector, explaining his action in the matter. It was moved -by Member Smith, seconded by Yember Ramage, that the variance be denied,, "--and that Mr. Armstrong comply with the Ordinance 398 and the Building Code. The motion was carried by the following vote, to-wit: AYES: Members Smith, Ramage, Stewart, Poulter, Halferty, Wulff. NOES: member Drew. ABSENT: None. P. J. Balestreri, 575 Second Ave., requested a variance from the side yard pro- vision of Ordinance 396 to maintain a fence in violation of Ordinance 398. The Secre- tary read a letter from Mr. Cord, Building Inspector, explaining his action in the matter. It was moved by Member Halferty, seconded by member Stewart, and carried, that the request for variance be granted for the reasons stated in the application. Herb Davies, 40 Third Ave. ,.presented an amended'request to construct and operate a florist shop in an R-1 zone. -There were some adjacent property owners present to voice an oral protest to the variance, stating generally. that, in their ,opinion, the City should beautify the property, since it will be a main entrance to the City; that they did not sp'cifically object to a florist -shop, but, did object to any other busi- ness being allowed in the vicinity. It was moved by Member Poulter, seconded by =3- Member Stewart, and carried, that the request be granted for the reasons stated in the application. I,.4abel Williams, 276 Whitney St., requested a variance to erect a duplex in an R-1 zone. Several property owners appeared before the Commission to oppose the granting of the variance, stating that the neighborhood was losing its original status as a strictly R-1 zone. It was moved by Member Poulter, seconded by Member Smith, that the request for variance be denied for the reason that the applicant had not established the jurisdictional facts required by the Ordinance. The Notion was carried by the following vote, to-wit: AYES: Members Poulter, 'Smith, Stewart, Ramage, Drew, Illulff, NOES: Member Halferty. ABSENT: None. Carl Stengritt, 841 National Ave., requested a variance to construct multiple units in an' R-1 zone abutting an M-1. zone.' After a brief discussion, it was moved by Member Drew, seconded by Mlember Stewart, and carried, that the matter be tabled and continued for further and better information. Glenn VT. Cox, 706 Del Mar Ave., requested a variance to maintain a rental unit in an R-1 zone on which a preirious variance limited to two years had been granted. It was moved by Member Smith, seconded by Member Halferty, that a permanent variance be granted, for the reasons stated in the application, for R-2 use in an R-1 zone. The motion was carried by the following vote;. to-wi.t: AYES: Members Smith, Halferty, Ramage, Drew, Poulter, Drew, NOES: Member Wulff. i � ABSENT: None. Leonard P. Moe, 77 Vdoodlawn Ave., requested a variance to do jewelry engraving in his residence in an R-3 zone. It was moved by T:Jember Stewart, seconded by Member Halferty, and carried, that the variance be granted, for the reasons stated in the application, through the calendar year 1956. The motion was carried by the following vote, to-wit: AYES: Members Stewart, Halferty, Ramage, Smith, Poulter, Vfulff. NOES: Member Drew. ABSENT: None. RESOLUTION NO. 19 = Resolution of Intention to Amend. Orainance 398. It was moved by Member Poulter, seconded- by Member Stewart, that the resolution be adopted. The motion was carried by the following vote, to-wit: AYES: Members Poulter, Stewart; Halferty, Smith, RapAge, 71ulff. NOES: Member Drew. ABSMIT• None. INVITATION TO ATTEND COUNTY PLANAiING MEETING The Secretary read a letter from Dr. Vdillis H. Miller, Director of County Planning, inviting Chula Vista to send a representative to a meeting on highway planning to be held November 16, 1951. It was moved by Member Halferty, seconded by Member Ramage, and carried, that Mr. Wagner attend the meeting. The Secretary was instructed to answer Dr. Willisl letter. -4- RECO78TENDATION OF CITY PIANAIER I Air. Wagner presented a preliminary recommendation for lot areas and lot coverages in R-2 and R-3 zones. It was moved by Member Poulter, seconded by Member ,Smith, and carried, that the recommendation be tabled for further study and that the Secretary prepare copies for each Member.
