OF THE PLANNING COMMISSION OF THE CITY OF
CHULA VISTA, CALIFORNIA
Held Monday, September 17, 1951
The Planning Commission met in the Council Chamber at City Hall on the above
date at 7:30 P.M. with the following Members present: Wulff, Poulter, Drew, Ramage,
Stewart, Halferty.
Absent: Member Smith.
Also Present: City Planner Wagner, City Attorney Boyer, Asst. City Engineer ::. .:• ;,
Wheeler.
In the absence of Jean Steele, Secretary of the Planning Commission, Mr. Fred
Wagner acted as Secretary for the meeting.
ZONE VARIANCE
Dr. John D. McCausland, 275 "F" Street, requested a variance to allow an 18,
rear yard instead of the 251 required, for the purpose of constructing a six-unit
apartment building. At the hearing the applicant requested that the front yard
be reduced to 121 instead of 15' and that no variance be granted as to the rear
yard. It was moved by Member Halferty, seconded by Member Drew, and carried, that
the request, as amended and requested at the hearing, be granted for the reasons
stated in the application, as amended, and provided that the address be changed
to Lots 42 and 43 of Dyer Tract and that the front yard setback line up with the
next existing building to the east, and that off-street parking be provided at
the rear of the apartment house for four cars.
- ` ZONE VARIANCE PROTESTS
Mr. Oscar F. Weissgerber, 317 Kimball Terrace, was present to protest a zone
variance granted to Mr. Herb Davies of 40 Third Avenue to construct and operate
a florist shop for retail only, in an R-1 zone, approved April 2, 1951. Mr.
Weissgerber stated that he was not properly notified by postal card and would
- -have protested at the time, had he known of it. Members Halferty and Stewart,
acting as an investigating committee had previously recommended that the variance
be granted, but that the zone remain R-1. Chairman Wulff suggested that Mr.
Davies file a new application at no cost to him to be called an amended applica-
tion. It was moved by Member Drew, seconded by Member Ramage, that Mr. Davies
be requested to resubmit his application at no cost to him and that it be pro-
cessed in the usual manner with notification to all property owners within
300 ft. The motion was carried by the following vote, to writ:
AYES: Members Drew, Ramage, Stewart, Halferty, Wulff.
NOES: Member Poulter.
ABSENT: Member Smith.
City Planner Wagner stated that Mr. Raymond H. Bachman of 238 Fourth Avenue
had protested to him that in granting a variance to J. H. Tompkins at the S.W.
corner of Fourth Avenue and "E" Street, the proper notification had not been
given. City Attorney Boyer suggested that an affidavit of mailing of notices
be signed for each variance.
DISCUSSION OF FUTURE PLANNING
In a general discussion of future planning problems and procedures, the
following points were stressed:

1. Need for Major and Secondary -Street Plan,
2. Need for rezoning some sections of the City.
3. Need for study of General Community Plan.
4. Tree Removals to be placed at the beginning of the agenda.
5. That Ordinance No. 137 be amended to delete the duties of the
Planning Commission and transfer those duties to the Parks and
Recreation Commission.
6. Need for a memorandum of procedures for zone variance applications.
7. Need for more information to be supplied by applicant for zone variances.
TREE REMOVAL
It was moved by Member Drew, seconded by Member Ramage, and carried, that
Ordinance No. 137 be amended to delete therefrom the duties of the Planning Com-
mission and transfer those duties to the Parks and Recreation Commission.
ADJOURNMENT
It was moved by Member Poulter, seconded by Member Halferty, and carried,
that the meeting adjourn, sine die.
