OF THE PLANNING COMSSION OF THE-
CITY OF CHULA VISTA, CALIFORNIA
Held Mondays December 3, 1951
The Planning Commission met in the Council Chamber at City Hall on the above
date at 7:30 P.M. with Chairman Wulff presiding.
Present: Members Poulter, Drew, Ramage, Stewart, Smith, Halferty, Wulff.
Absent: None.
Also Present: City Planner Wagner, City Attorney Boyer, Asst. City Engineer Wheeler.
APPROVAL OF MINUTES
It was moved by Member Poulter, seconded by Member Halferty, and carried, that
the minutes of the meeting held November 19, 1951, be approved, copies having been
mailed to each Member.
SECOND PUBLIC HEARING - Rezoning. of Quarter Sections 164 and 165 from
M-2 to R-3
The Commission held the second public hearing on a::proposed amendment to
Zoning Ordinance 398, whereby portions of Quarter Sections 164 and 165 would be
rezoned from D--2 to R®3. There were two protests voiced from members of the
audience. Mr. Edwin Campbell,, representing Mrs. Elma Nelson, spoke in protest to
the rezoning, stating that Mrs. Nelson did not wish her property, between f°II"
Street and "Lt° Street, included in the rezoning because her property abuts the
M-1 zone in the County. . Mr.1. Eichenlaub, representing the San Diego and Arizona
Railroad spoke in protest to the rezoning, stating that in his opinion, it "is
not good planning to put a residential zone adjacent to a railroad. He requested
that a 500 to 600 foot strip be zoned M-2 along the railroad. It was moved by
Member Smith, seconded by Member Stewart, that the Ordinance be approved as
originally submitted and that the Secretary be directed to certify a copy of the
Ordinance to the City Council; and that the Chairman be directed to make a .,Report
of Findings.. Summary of the Hearings, and the recommendation of the Commission to
the City Council. Member Drew amended the motion, with a second by Member
Poulter, to exclude Mrs. Nelson°s property, which is now M-2., from the R-3 strip,
and change it to M-1. The amended motion failed to carry by the following vote,
to-wit:
AYES: Members Halferty, Drew, Poulter.
NOES: Members Smith, Stewart, Wulff, Ramage.
ABSENT: None.
The original motion by Member Smith was carried by the following vote, to-wits
AYES: Members Smith, Stewart, Wulff, Poulter, Ramage.
NOES: Members Halferty, Drew.
ABSENT: None.
RESOLUTION OF INTENTION - To rezone M-2 strip between "C" Street apd °'J"
Street to R-3.
It was moved by Member Halferty, seconded by Member Stewart, and carried,
E" that the City Attorney be instructed to draw up a Resolution of Intention to rezone
the M-2 strip easterly of the Railroad right-of-way between "C" Street and "J11
Street, to R-3,and that the first public hearing be held on Monday, January 7, 1952.
FINAL MAP - Kuehler Terrace #5 - Harold Foster.
It was moved by Member Stewart, seconded by Member Ramage, and carried, that
the Final Map and improvement plans of Kuebler Terrace #5 be approved.
FINAL MAP - Zurcher Tract #2.
It was moved by Member Ramage, seconded by Member Stewart, and carried, that
the Final Map and improvement plans of Zurcher Tract #2 be approved.
TREE REMOVALS
Mr. J. E. Johnston, 575 Casselman, requested permission to remove and replant
three acacia trees. it was moveU by Member Smith, seconded by Member Drew, and
carried, that the three trees be removed at the owner's expense, and replaced with
two suitable trees as recommended by the Park Superintendent.
Mr. Stephen Talnadge, 364 TMG" Street, requested permission to remove two
acacia trees. It was moved by Member Halferty, seconded by Member Ramage, and
carried, that the sidewalk be repaired and that the request be denied.
Mr. Allen Ohlfa, 563 First Avenue, requested permission to remove one acacia
tree. It was moved by Member Stewart, seconded by Member Poulter, and carried,
that the request be granted, and that the tree be removed at the owner's expense,
with no replacement necessary.
Mr. Burt F. Raynes, 671 Fourth Avenue, requested permission to remove one .
pepper tree. It was moved by Member Ramage, seconded by Member Drew, and carried,
that the request be denied.
ZONE VARIANCES
Mr. Otis L. Gray, 159 "D" Street, requested a variance to allow the construct-
ion of an ad itional unit Fat e rear of his property in an R-1 zone. It was
moved by Member Stewart, seconded by Member Halferty, and carried, that the
application be tabled until the next regular meeting pending a study of the whole
block for rezoning to R-2.
Mr. William 0. Smith, 350 National Avenue, requested a variance to allow the
._construction of a-trailer park in an M-1 and R-3 zone. It was moved by Member
Stewart, seconded by Member Ramage, that the application for use variance for R-3
property be granted for the reasons stated in the application, subject to a
twelve month's time limit for presentation of improvement plans, at which time, a
new application for use under Ordinance 342 shall be submitted. The motion was
carried by the following vote, to-rdt:
AYES: Members Halferty, Smith, Stewart, Ramage, Poulter, Wulff.
FOES: Member Drew.
ABSENT: None.
Mr. Lawrence Kuebler, Fourth Avenue and "G" Street, requested a variance to
allow the construction of two 4 unit_ colift in an R- zone. It was moved by
Member Smith, seconded by Member Drew, and carried, that the variance be granted
for -the reasons stated in the application.
Mr. J. D. bight, 387 Vance Street, requested a variance to change the front
yard setback rom 201 to 18181P. It was moved by'Member Halferty, seconded by
Member Ramage, and carried, that the requested be granted for the reasons stated
in the application.
Mr. T. R. Olsen, 464 Minot Avenue, requested a variance to change the side
yard setback from ' to 39219 or the construction of a car port. It was moved by
Member Smith, seconded by Member Stewart, and carried, that the request be granted
for the.reasons stated in the application,
Mr. H. S. Drake 717 National Avenue, requested a variance for a front yard
setbacc 1n�an zone of l09 instead -oT-251 in order to construct a Model Home.
It was moved by Member Drew, seconded by Member Stewart, that the variance be
granted for the reasons stated in the application. The motion was carried by the
following vote, to-wit:
AYES: Members Drew, Stewart, Smith, Ramage, Halferty.
NOES: Members Poulter, Wulff,
ABSENT: None.
RECOMfENDATION OF CITY PLANNER
Mr. Wagner presented a letter to each of the, Members, in which he recommended
that the rear yard setbacks in the C-1, C-2, M-1 and M-2 zones. shall be the same
as required in the recommended R®3 zones, and that off-street parking must be
provided by all commercial or industrial structures, churches, theatres and public
places of assemblage. It was moved by Member Poulter, seconded by Member Smith,
and carried, that the recommendations be added to the Resolution of Intention to
amend Ordinance 398, being drawn up by the City Attorney.
RECOMMENDATION TO CITY COUNCIL
It was moved by Member Halferty, seconded by Member Stewart, that the
Planning Commission recommend to the City Council that "E« Street from Fourth
Avenue to National Avenue be posted as "No Parking At Any Time" on both sides of
6 _ "E" Street. fihe motion was carried by the following vote, to wit:
AYES: Members Halferty, Stewart, Smith, Ramage, Wulff.
NOES: Members Poulter, Drew.
ABSENT: None.
ADJOURNMENT
It was moved by Member Ramage, seconded by Member Poulter, and carried, that
the meeting adourn until Monday, December 17, 1951.
