HomeMy WebLinkAbout1950-01-04 PC MINS 1VMTUTES OF A REGULAR MEETING OF THE PLAMT NG CON4ISSION OF _ THE CITY OF CHULA VISTA, CALIFORNIA Held Wednesday - January 4, 1950 The Planning Commission met -on the above date at 7:30 F. M. in the Council Chambers of the City Hall. Present: Members Davis, Welton, Fisher, Lincoln and 11Wte. Absent: Members Irey and Cloyed. In conformance with the new City Charter, the members were sworn in by the City Clerk. Member Davis and Member Lincoln were nominated for the position of Chairman of the Commission. Vote was taken and Member Davis received four votes and Member Lincoln received one vote. Thereupon, Member Davis was declared elected as Chairmen and thereafter presided over the meeting. ___� The Members of the Commission then drew lots for term of office: They Frere as follows: Ralph R. Fisher - - - - - - Tuly 1,. 1954 Motion was made by Member 1,7elton, seconded by Member Fisher, and carried, that the minutes of the meeting held December 5th, 1949, be approved. Clairevista - Unit "Bt' - Final Map It was moved by Member Welton, seconded by Member Fisher, and carried, that the final map and improvement plans of Clairevista Unit 'fB" be approved and recom- mended to the City Council for acceptance, subject to the further check and recom- mendations of the City Engineer. Clairevista - Unit "C'f - Tentative Map Mr.,E. L. Freeland presented the tentative map for Unit f'C" of Clairevista, and requested the Commission's approval. After discussion, it was moved by Member JVhite, seconded by Member Lincoln, and carried, that the tentative map of Claire- vista, Unit "C" be approved subject to all improvements required by Section 7 of the Subdivision Ordinance. Chula Vista Heights - Tentative Map Mr. Henry Algert presented the tentative map for Chula Vista Heights, being a portion of Lots 1 and 8 in Quarter Section 123 of Map No. 505. After discussion, the question came up as to the possibilities of certain lots, not a part of this Subdivision, having no access to a street other than G Street,. Mr. Buford was di- rected to contact the two owners of this property and subject to their approval, it was moved by Member Welton, seconded by Member Fisher, and carried, that the tentative map be approved and recommended to the City Council. Member Irey arrived at this time. Lisa Park - Tentative Map Mr. Henry Algert presented the tentative map for Lisa Park, being a portion of Lot 4 of Quarter Section 122. After discussion with regards to the further development of Lots A and B of this section, it-was moved by Member Irey, seconded by Member White, and carried, that the tentative map be approved subject to Lots A and B not being a part of this Subdivision. Kuebler Terrace No. 3 - Tentative Map This subdivision having been presented at the last meeting and it having been recommended that Mr. Kuebler contact the property owners to the north of this proposed subdivision to see if they would be in favor of dedicating and improving a street at the rear of their property, was brought- before the Commission again. Mr. Leslie H. Hendron, owner of part of the affected property stated that he was willing to put up bonds necessary to guarantee his portion of the improvements. Mr. G. A. Little, also the owner of part of the property affected stated that he was not willing to participate in the lot now owned by Mr. Ash who is not will- ing to go along, and therefore such expense would have to be absorbed by the other property owners, but that he was willing to improve the street in the rear of his own lots. Mr. Black stated that he was willing to go along to help improve the street. After discussion, it was moved by Member Irey, seconded by Member Fisher, and carried, that both tentative maps submitted by P,dr. Kuebler be approved and re- commended to the City Council. I - Guava Manor - Tentative Map Mr. Harold C. Foster presented the tentative map for Guava Manor, beinga portion of Lots 11 and 12 of Quarter Section 150. After discussion, it was moved by Member Irey, seconded by Member White, and carried, that the tentative map showing 25 lots and allowing for the lots to be set back 101 so as to make Guava Avenue a 601 street. - The subdivider then presented a plan deleting one lot in the subdivision giving the remaining lots a wider frontage and less depth, which alternate plan was also approved. Zone Variances Lawrence C. Kuebler- Lots 1, 2 and 3 of Thompsons Subdivision Mr. Kuebler requested a variance for.the purpose of building a Commercial Building in the C-2 zone on the property line instead of the required 101 there- from. It was moved by Member Welton, seconded by Member Fisher, and carried, that the variance be granted. A. R. Veth - Lot 14 of Country Club Mecca Mr. A. R. Veth requested a variance from the set-back Ordinance from 301 to 201 as the lot in question is of a peculiar shape and would be impossible to..ob- serve a 301 set-back. It was moved by Member Irey, seconded by Member Fisher, and carried, that the variance be granted. J. W. Stonebarger - 561 Twin Oaks Avenue Mr. Stonebarger requested a variance from the required 251 rear yard set-back to 171 , for the purpose of making a two room addition to the existing house. It was moved by Member White, seconded by Member Irey, and carried, that the variance be granted. Martin 1. Nerborig - 271 I Street Mr. nTerborig requested a variance from the required 51 side yard set-back for the purpose of an addition to an existing garage now setting 11 from the pro- perty line. It was moved by Member Fisher, seconded by Member Welton, and car- ried, that the variance be granted. Charles L. Coleman - 182 Fifth Avenue Mr. Coleman requested a variance for the purpose of constructing a fireproof three room dwelling on the rear property line. It was moved by M mbar Fisher, seconded by Member Welton, and carried, that the variance be granted. It was further suggested by Member White, that in the future that a sketch accompany applications for a zone variance showing the adjacent properties and the location of the buildings on them. This suggestion was adopted by the Commission as a part of their regular procedure, for the future. Charles W. Tappy - 291 Alvarado Street Mr. Tappy requested a variance from a C-1 to a C-2 usage for his property. The City Attorney advised the Commission that to re-zone property, procedure would have to be taken under Section 17, rather than Section 16, the variance section of the Zoning Ordinance, and that this would necessitate a resolution of intention to change the zone, public hearings, then reference to the City Council for public hearing and adoption of an Ordinance. He advised that a variance under Section 16 might be applied for from any of the regulations of a 'C-1 zone, but not for a re- zoning. Several members of the audience spoke regarding the granting of such a variance and objected to the application as submitted. It was moved by Member Fisher that the Commission file its resolution of in- tention to rezone the property to a C-2 zone. The motion failed to carry by the following vote to-wit: AYES: Members Davis, Z!Ihite; Fisher. NOES: Members Lincoln, Irey, Welton. ABSENT: Member Cloyed-. It was. moved by Member Fisher, seconded by Member Irey, and carried, that the application for a Zone Variance be denied without prejudice to a further applica- tion for a variance for a specific use. William E. Wise-- 724 Twin Oaks Avenue Robert C. Upchurch - 465 Parkway William H. Steinmetz - 53 K Street Mr. Ries, cohtractor for the proposed homes of the above three properties, re- quested variances from the side yards of 41 instead of the required 51 as they have plans approved by F. H. A. on a 421 house and all the lots above mentioned are 501 lots. It was moved by Member Irey, seconded by Member Welton'. and carried, that the variances be granted. Roy B. Peters - 330 H Street Tar. Peters requested a variance to build on a 471 lot instead of a 501 lot as required by.the Zoning Ordinance. It was moved by Member White, seconded by Member Lincoln, and carried, that the variance be granted. C. R. Hanan - 206-212 Garrett Avenue Yr. Hanan requested a variance to construct a dwelling 181 from the rear of the property instead of the required 251. Inasmuch as there were some objections to the variance, the Commission directed that the variance be published and pro- perty owners within 500 feet be notified. Mr. Davis .appointed Members White and Lincoln to investigate the matter and report back to the Commission at their neat meeting. Chairman Davis advised that in the future, a dead-line be set on when 'the agenda is made up and nothing is to be- added after Thursday before the regular meetings of the Commission. Britton Turner - 181 G Street Mr. Turner requested permission to erect a garage with a one-hour fire wall 1' from the side property line instead of the required 51. It was moved by Member Irey, seconded by Member TNelton, and carried, that the variance be granted.
