OF THE PLANNING COLRMISSION OF
THE CITY OF CHULA VISTA, CALIFORNIA
Held Monday - October 2, 1950
The Planning Commission met in the Council Chambers on the above date at
7:30. P.M. with Chairman Eckhart presiding.
Present:. Members Eckhart, Halferty, Ramage, Drew, Wulff, Poulter, Smith.
Absent: . None.
Also Present: City Attorney Boyer.
It was moved by Member Halferty, seconded by Member Wulff, and carried,
that the minutes of the meetings held September 5th andl8th be approved as
mailed.
Zone Variances
Safeway Stores, Inca - 100 block on Third Avenue.
Mr. Herman A. Bischoff, representing the Safeway Stores,appeared before
the Commission to request a variance on a portion of Lot 6 in Quarter Section
138, for the purpose of a parking lot in connection with a proposed store.
Said property is now located in a R-3 zone. Notices having been sent to all
property owners within 300 feet, and there being no objections either by-mail
or in the audience, it was moved by Member Poulter, seconded by Member WulffI
and carried,that the variance be granted for the reasons stated in the applica-
tion.
. 'A. Nazikian - 480 E Street.
Mr. Nazikian requested a side-yard set back on the Elder Avenue side of
his property from 301 to 141 . It was moved by Member Wulff, seconded by Member
Poulter, and carried, that the variance be granted in accordance with the plot
plan attached to the application and for the reasons stated in the application.
Leslie H. Hendren - 696 Third Avenue.
Mr. Hendren requested a variance to construct and maintain a combined
chapel, residence and mortuary on property how located in a R-3 zone. The
Secretary read the variance application presented by Mr. Hendren along with,a
petition attached to the application signed by 5 property owners within the
3001 area. Mr. Hendren also presented a petition signed by 41 residents of
Chula Vista approving the granting of this variance. A petition disapproving
the granting of the variance signed by 28-property owners and lessees in the
City of Chula Vista, 11 of which were within the 300 feet area was also read
and filed. Discussion from the audience was as follows:--
Mr. Keith Atherton. Mr. Atherton, representing Mr. Hendren, stated that some
of the objections were from individuals who would like to see the. neighborhood
zoned for commercial use, but that they would like to dictate what type of busi-
ness should go there. He stated that he felt that it would be much better from
a traffic stand point to have a mortuary located at the requested place than to
put it;on Landis or Church Avenue where mortuaries are allowed and have congested
traffic in the down-town area.
Augustus'F. Crowley - 695 Third Avenue. Mr. Crowley stated that he had bought
his home because it was zoned for residential use, and thought that the proposed
planning should be maintained. He stated that he would object to any commercial
use.
Mrs. Walter R. Carrey - 624 Third Avenue. Mrs. Carrey objected on the grounds
that mortuaries Tr-ea C-2 use according to the zoning ordinance, thus changing
the zoning of the neighborhood two classes from R-3 to C-2 use. She stated that
although Churches held funerals, that they would be different than mortuary
services. Iulrs. Carrey felt that it would conjest traffic because of the great
amount of traffic caused by Rohr Aircraft along this area.
Mr. Hooper (on behalf of Mr. Dave Headington - 703 Third Avenue). Mr. Hooper
stated that Mr. Headington favored the granting of the variance. He stated that
he felt it would increase the value of his property.
Mr. Edmond E. LaCasse - P. 0. Box 512, Chula Vista, California. Mr. LaCasse
stated that he felt that if this variance was granted, it would establish a pre-
cedent if any one else in the area should request a variance. Mr. LaCasse stated
that he did not propose to keep a nice growth on his property adjoining the pro-
perty in question to enhance Mr. Hendren's mortuary. Mr. LaCasse asked if the
tax payers would be expected to pay for a policeman to direct traffic when there
is a funeral. .
Member Smith of the Planning Commission asked Mr. Hendren if he had control of
the time o funerals. Mr. Hendren stated that he did, and would not allow a
funeral at a time when Rohr traffic is heavy.
Mr. Luces Dilbeck - 667 Third Avenue. Mr. Dilbeck gave three reasons for disap- .
proving the variance. (1) Does not want a business in that district. (2)
Thinks it will devaluate the homes. (3) Feels that the majority of the neighbors
do not want it and wants to go alohg with their feelings.
Mr. Merritt E. Lord - 696 Third Avenue. Mr. Lord stated that he bought his home
for the specific reason that it was for residential use only. He definitely op-
poses any changes in the Ordinance permitting. a business.
Mr. Walter Carrey - 634 Third Avenue. Mr. Carrey objected to the granting of
the variance because it establishes a precedent.
Mr. Mark Money - Mr. Money advised the Commission that 20 years ago there was
one mortuary; there is still only one, consequently, business is leaving Chula
Vista. It is his belief that it is for the good of the community to have more
than one business of the same type. Mr. Money recommended that the Commission
give very much consideration to this variance.
Mr. Keith Atherton - Mr. Atherton advised the Commission that the proposed build-
ing would be an architecturally nice looking building, and that there would defi-
nitely not create so much .of a traffic hazard as would a mortuary location in a
down-town location. He asked that the Commission give the variance application
serious consideration.
Mr. Robert M. Griffith - Mr. Griffith advised the Commission that he would-like
to recommend that they give careful consideration to the granting of this variance
request, stating that he felt that it is a good location and believes that busi-
ness is going to buildsolid along 3rd Avenue to K Street. Mr. Griffith advised
that there was some of the same objections when Hubbard mortuary wanted to move
to E Street many years ago.
Mr. Howe - 329 J Street - Mr. Howe stated that he had lived there since 1894, and
that he had felt or a long time that Third Avenue would have to be opened for
business. He stated that he had no personal objections. He stated that he
thought the Commission should consider whether or not the granting of this var-
iance would be for the good of the Community, and not consider only a 'few groups
of people.
Mr. Roy Hoole - Mr. Hoole stated that he had had the experience of living for 18
_ months where a mortuary was located across the alley from his residence and a
church was located across the street and that he had found nothing depressing in
any way.
The Chairman asked if there was any more who wished to speak or offer evi-
dence either for or against'.the variance. There being none, it was moved by Member
Ramage, seconded by Member Smith, and carried, that the hearing be continued to .
the next regular meeting to be held November 6, 1950.
Raymond R., Gardner - 153 Brightwood Avenue. Mr. Gardner requested a variance to
permit a carport to be constructed 51 from the front property line instead of
the required 201 . It was moved by Member Poulter, seconded by Member Ramage,
and carried, that the variance be tabled until the next meeting or until such
time as Mr. Gardner submits a different and more complete plot plan, and obtains
signatures from neighbors next to the effected property.
Eugene L. Boyd - 828 Country Club Drive.-
Mr. Boyd requested a variance from 51 to 41 side-yard set back for the pur-
pose of constructing a residence and attached garage. It was moved by Member
Ramage, seconded by Member Smith, and carried, that the variance be granted for
the reasons set forth in the application by the following vote, to-wit:
AYES: Members Ramage, Halferty, Wulff, Poulter, Smith, Eckhart.
P10ES: Member Drew.
Louis G. Solomon - 76 Caklawn Avenue.
Mr. Solomon requested a variance to build 1211 from the front property line
instead of the required 201 . It was moved by Member Ramage, seconded by Member
Wulff, and carried, that the variance be held over until the next meeting to allow ,
all the members to view the site.
Procedure.
It was moved by Member Drew, seconded by Member Wulff, and carried, that the
City Attorney prepare a new resolution determining the area that must be notified
on applications for set-back and area zone variances.
Proposed Ordinance - Regulating junk yards and places for sale of second hand
merchandise.
It was moved by Member Wulff, seconded by Member Smith, and carried, that
the Ordinance as presented to the commission, be recommended to the City Council
for acceptance.
Adjournment.
It was moved by Member Halferty, seconded by Member Wulff, and carried, that
the meeting adjourh to 7:30 P.M., October 16, 1950.
