THE PLANNING COMKISSION OF

Held Monday - February 6, 1950 °
The Planning Commission met on the above date at 7:30 P. M. in the Council
Chambers of the City Hall:
Present: Members Davis, Irey, Lincoln, and White.
Absent: Members Melton, Fisher, and Cloyed.
Motion was made by Member Irey, seconded by IYiember 110hite, and carried, that
the minutes of the meeting held January 4th be approved with the exception of
the paragraph entitled "Guava Manor - Tentative Map". This part was corrected
to read as follows: ? r. .Harold C. Foster presented the tentative map for Guava
Manor, being a portion of Lots 11 and 12 of Quarter Section 150. After discussion,
it was moved by Member Irey, seconded by I4iember White, and carried, that the ten-
tative map showing 25 lots be approved which were laid out with ten 100 foot depth
lots on the east side of Guava Avenue, assuming that a 10 foot wide strip could be
acquired from the rear of the lots adjoining the tract on the east.
It was further approved that nine 90 foot 'aepth lots on the east side of
Guava Avenue would be satisfactory if the subdivider was unable to obtain the 10
foot wide strip.
Chula Vista Hills - Tentative Map.
Mr. Tohn F. Covert presented the tentative map for Mr. S. R. Scott, being a
proposed Subdivision of Lots 4, 5 and 12, Quarter Section 123 of Chula Vista. It
was recommended that the Street names be changed to names of streets in line with
those in this subdivision in other parts of town. It was also recommended that
Vance Street be extended to the line of the Subdivision leaving one foot to be
dedicated to the City in case this street should ever be extended at any time.
IVtr. Scott requested that the Commission approve a combination rolled curb and side-
walk. The Commission refused for the reason that it had not approved this type :
of curb and sidewalk in the past. It was moved by Member White, seconded by Member
Irey, and carried, that the tentative map be approved subject to the above changes.
Zone Variances
L. C. Kuebler - Lot 4, Thompson's Subdivision.
Mr. Kuebler requested a. variance.from a R-3 zone to a C-1 zone for the pur-
pose of having a parking lot for a proposed market to go on the lot immediately
adjoining Lot 4. There being no objections, and for the reasons expressed in the
application, it was moved by Member Lincoln, seconded by Member tYhite, and carried,
that the variance be granted.
C. R. Hanan - 206-212 Garrett Avenue.
J,rr. Hanan requested a variance for the purpose of remodeling an existing build-
ing located 8 feet from the alley line of said Lot 10 into a dwelling; said variance
to permit construction of a dwelling with a 18 foot rear yard rather than 25 foot
rear yard and with side yards of 1' on one side and 2' on the other side. Mr.
Lincoln and Mr. White had been appointed to investigate the circumstances and re-
port back to this meeting. Mr. Lincoln reported that they had found no real objec-
tions to the building proposed, he and Mr. 11hite were of the opinion, that since
Mr. Hanan owned the property on either side, of the proposed building, he was the
only one that would be harmed. Mr. Lincoln stated that they would be interested
in knowing what the objections were.
Mr. George -Lee stated that if he were allowed to build as close to the pro-
perty line as requested that it. would be in violation of the Building Code.
Mr. Harry McCrea stated that another building on Kr. Hanan's property is in
violation of the set-back ordinance. Mr. Davis advised them that the Commission
was not considering the existing-violation. Mr. Hanan stated that he did not
realize that he was in violation at the time he built his dwelling.
The City Attorney advised that since Mr. Hanan owned contiguous three lots,
his property lines were actually the most Northerly line of the North lot and the
most Southerly line of the South lot, and that, for this reason, a side yard var-
iance was not necessary.
Mr. Cord reque!�ted what was to prevent Mr. Hanan from selling off lots next
door then building would be on the property line?
It was moved by Member White, seconded by Member Irey, and carried, that the '
variance be granted for the reasons stated in the application.
Miles & Dalseth - Portion of Lot 12, Quarter Section 150.
Messers Miles and Dalseth requested a variance from the required 7,000 sq.
ft. minimum in a R-1 zone to not less than 6,000 sq. ft. It was moved by llember
Irey, seconded by Member Lincoln, and carried, that the variance be granted.
George F. Snyder - 167 Guava Avenue.
,Mr. Snyder requested a variance to build a garage 5' from the side property
line instead of the required 51. It was moved by Member Irey, seconded by Member
i White, and carried, that the variance be approved.
Alice ff. Chessman - 567 Fourth Avenue.
Airs. Chessman requested a variance for tha purpose of operating a photo finish-
ing dark room in the garage in a R-3 zone. Notices having been sent to all property
owners within 500 feet and there being no objections, it was moved by Member Nh.ite,
seconded by 15ember Irey, and carried, that the variance be granted for one year with
the stipulation that there be no advertising signs displayed on the property. The
variance was granted for the reasons stated in the application.
T. A. Anderson - 478 Minot Avenue.
Mr. Anderson requested a variance for the purpose of building an addition to
an existing house 3'9" from the side property line instead of the required 51 . It
was moved by Idember .Irey, seconded by Member Lincoln, and carried, that the variance
be granted. .
Glenn C. Bryant - 254 Shasta Street.
Mr. Bryant requested a variance to build an addition to his existing house 3'
from the side property line instead of the required 51 . It was moved by Member
Lincoln, seconded by Member White, and carried, that the variance be. granted.
H. 0. Sheldon - 146 K Street,
Mr. Sheldoh requested a variance to build an attached garage 3' from the side
property line instead of the required 51 . It was moved by Member Irey, seconded
by Member White, and carried, that the variance be granted.
L. T. Brewer - Portion of Lot 4, Q. S. 148.
1,1r. Brewer requested a variance to build garages 3' from the side property
line instead' of the required 5' for 19 houses in a tentative subdivision presented
at this meeting. After study and recommendations on the proposed subdivision, Mr.
Brewer withdrew his variance application.
La Playa Vista Annex - Tentative Map.
Mr. Harold C. Foster, representing Mr. L. T. Brewer, presented the tentative map
of La Playa Vista Annex, being a subdivision of the E ! of Lot 4, Q. S. 148, exc.
the Sly. 1001 of the Ely. '132.51 . It was moved by Member Irey, seconded by Member
Lincoln, and carried, that the tentative map be approved with the following excep-
tions. That Smith Avenue be widened to 501 instead of 401 as shown on the map, and
that a 151 set-back be observed on Smith Avenue.
Lot 3, Quarter Section 148. - Tentative Map.
Mr. Harold C. Fotter, representing Mr. Macy L. McBgil in, presented the tenta-
tive map of Lot 3, Q. S. 148- for approval. After discussion, it was moved by
Member White, se2onded by Member Irey, and carried, that the first 10 lots of the
tentative map be approved with the following exceptions. Smith Avenue be widened
to 501 instead of 401 as shown on the map; that a 251 set-back be observed on 5th
Avenue, instead of 201 as shown, and. that the alley be 161 instead of 151.
Kuebler Terrace No. 3 - Final Map.
Mr. Harold C. Foster, representing i1r17r. Lawrence C. Kueble r, presented the final
map of Kuebler Terrace No. 3. It was moved by Member Lincoln, seconded ,by Member
Irey, and carried,that the final map be approved and recommended to the City Council
for acceptance.
Guava Manor - Final Map.
Mr. Harold C. Foster, representing Miles and Dalseth, presented the final map
of Guava Manor, It was molted by Member Irey, seconded by Member Nh.ite, and carried,
that the final map be approved and recommended to the City Council for acceptance.
_ Highland Acres - Tentative Map
Mr. Hobert M. Griffin and Mr. Henry Algert presented a tentative map of the
Vi2 of the Easterly 2 of Lot 1, Q. S. 125 for approval. After discussion, it was
moved by Member Irey, seconded by Member Lincoln, and carried, that the tentative
map be approved with the following exceptions: That the portion' of D Street border-
ing the South side of the proposed subdivision be widened to 501 ; that the require-
ment of curb and sidewalk be waived as to the South side of D Street only; that the
requirement of a 50 foot radius for dead end streets be reduced to 40 feet on re-
commendation of the City Engineer; that approval of the map be conditioned on the
developer's being able to work out a suitable, surfaced approach to the proposed
subdivision.
Francine Park - Tentative Map
After discussion, and approval by the City Engineer, it was moved by Member
White, seconded by Member Irey, and carried, that the tentative map be approved,
and that the required 50 foot radius of the cul-de-sac be reduced to 40i for the
reason that there are only. 8 lots in the subdivision, and the area is such that
it would not -be practical to have a 501 cul-de-sac, and for the further reason that
the proposed 401 radius would be an improvement over existing conditions.
Francine Park - Final Map.
It was moved by Member Irey, seconded by Member White, and carried, that the
final map of Francine Park be approved and recommended to the City Council for
acceptance.
_ Chula Vista Heights - Final ?dap.
The changes having been made as suggested by the Commission when the tentative
map was presented, it was moved by Member mite, seconded by Member Lincoln, and
carried, that the final map be approved and recommended to the City Council for
acceptance. Mr. Buford advised the Commission that there were about 5 trees on
the north side of. the proposed subdivision that are growing above the sidewalk and
curb level. The Commission recommended that the trees be removed.
Lisa Park - Final Map.
It was moved by Member Lincoln, seconded by Member Irey, and carried, that the
final map of Lisa Park be approved and recommended to the City Council for acceptance.
Tree Removal
The Secretary read a letter from Mr. G. A. Little requesting the removal of a
tree growing in the parkway in front of his property at 372 G Street. It was re-
commended by the Park Superintendent that this tree be removed. Mr. Little having
made the necessary $5.00 deposit required by Ordinance to- assure the replacement
of the tree, .it was moved by 11,6ember 1.7h.ite, seconded by Member Lincoln, and carried,
that the tree be removed.'
Resolution No. 7 - Proposed changes in Ordinance No. 398.
The Secretary read Resolution No. 7 in full. After discussion, it was moved
by Member White, seconded by T,dember Irey, and carried, that Resolution No. 7 be
adopted and the public hearings be set for February 20th and March 6th.
Petition for changes in Ordinance No 398.
The Secretary read a petition for change of zone on: lots 1641 and 4-D, Q.S.
149, signed by Donald F. Morrin, Oliver E. Underwood, James Connolly and Edna Con-
nolly. After discussion, the matter was tabled.
Correspondence.
A letter was read by the Secretary from the National City-Chula Vista Realty
Board, expressing their willingness to cooperate with the Commission in the plann-
ing and zoning of the City. The Secretary was directed to write a letter of thanks
to the Board.
A letter from the District Engineer of the Division of Highways was read to
the Commission. The subject of the letter was a decision by the Supreme Court'-
concerning the constitutionality of a requirement that a subdivider dedicate, land
for street and highway purposes.
. Two letters from the County Planning Commission were presented to the Commission,
along with maps of proposed subdivisions within one mile from the City Limits of
Chula Vista for the Commissionts inspection and comment.
Adjournment.
It was moved by Member White, seconded by Member Irey, and carried, that the
meeting adjourn to 7:30 P. M. February 20th, 1950.
