M. in the Council Chambers of the City Hall with Chairman Davis presiding. Present: T�embers Davis, Fisher, Felton, Guest, Irey, Cloyed. Lx Officio Members Boyer and Gierlich. Absent: None. Motion was made by Member Irey, seconded by T'Iember Cloyed, and carried, that the minutes of the meetings held September 6th, 12th, and October 3rd be approved. Tree Removals The Secretary read a letter from Tar. J. E. Smith, 303 Fifth Avenue, request- ing that the trees be removed from the corner of his property. The request having been approved by the Park Superintendent, it was moved by Member Cloyed, seconded by Member 1,7elton, and carried, that the trees be removed in accord with the appli- cable Ordinance. The Secretary read a letter from E. Irvin Leaman, Pastor of the Seventh-day Adventist Church, requesting the removal of trees how growing in the parkway in front of the church property located on Fourth Avenue. After discussion, it was moved by Member Irey, seconded by Member Guest, and carried, that the matter again be referred to the Park Superintendent to get the exact number of trees requested to be removed, and for him to determine whether or not it would be feasible to re- move these trees. Also Mr. Norman is to contact hx. Lehman and see if they will be thrilling to replace with other trees, and what amount of space they consider necessary for an adequate passenger loading zone. A petition signed by five property owners along the North side of Flower Street between Jefferson and 17oodlawn was read requesting that the trees in the middle of the Street be removed while the street is .being torn up for the laying of sewerage pipes. After discussion it was suggested that the matter be investi- gated to ascertain the plans of the new school. Zone Variances Theo Gregor - 728 Al-pine Avenue Thr. Gregor requested a zone variance to build on a 42 foot lot instead of the required 50 foot lot. The Secretary read two letters objecting to the granting of the variance, and a petition signed by 9 property owners within 500 feet objecting to the granting of the variance. After discussion, Member Cloyed and Irey were appointed by Mr. Davis to investigate the matter and report back to the Commission at the next meeting. Leslie H. Hendren - 696 Third Avenue Mr. Hendren requested a variance from a fro-319 usage to a "C-2" usage for the purpose of constructing and. maintaining a combined chapel, residence and mortuary on the above mentioned property. The Secretary read two letters objecting to the granting of the variance and a petition signed by 18 property ovmers within 500 feet objecting to the granting of the variance. One letter from 1r. F. H. Turgon of 721 Third Avenue was read recommending that the variance be granted. Discus- sion from the audience followed. Ib?. Edmond E. LaCasse, P. 0. Box 512 stated that he approved of this property being zoned for business but not for a mortuary. Tudge Lowell Howe spoke on behalf of his mother who lives at 329 T Street and stated that she approved the granting of the variance. Member Tlelton asked if anyone from the Commission could tell if there were any objections to the Hubbard 11ortuary which is located close to a residential district. There were none known. Mrs. Headington of 703 Third Avenue stated that she approved of the variance. Mr. D. A. Higgs stated that the City of Chula Vista had needed a zoning ordi- nance for quite some time and had worked on it for a great length of time. At the time this particular section was zoned, it was zoned to be suitable for a 11R--311 usage. Unless there is a special reason why this variance should be granted, under the rules of the Ordinance, a variance should not be granted. Tyr. L. E. Dilbeck of 667 Third Avenue stated that he opposed to the granting of the variance. Idir. A. F. Crowley of 695 Third Avenue requested who may submit a petition. The City Attorney stated that the petition could be submitted by the owner or lessee, but the main question was whether the proposed variance would result in obtaining the highest and best use of the property in question. Member 1.7elton stated that people often get the idea that a certain thing is going to operate to a certain end when experience may prove they were i,rrong in their presumption. Member 71elton also stated that competition was good for a busi- ness and with the growth of Chula Vista a second mortuary is in order. Member Guest stated that the property was zoned 11R-31' and she knew of no rea- son to change it. Mlr. M. Money stated that although this section was zoned for a It-R-311 usage and doesn't specifically state a mortuary in its usage, that he felt w'nen a gentle- man of a knovrn good character comes and offers to put X50,000 investment in a nice building it should be considered with the greatest of care. That a hospital or sanitarium could be built there under the present zoning and would be just as much a detrement to the property as a mortuary. He said that he felt that the town will cease to grown if business is discouraged. Mr. LaCasse stated that a mortuary was depressing besides being a hindrance to increased value of property. Some of the property owners may have to move out and take a loss on their property. Mr. Dilbeck stated that he had talked with approximately 50% of the people within 500 feet and they objected to the corner being zoned for business, not nec- essarily a mortuary. r,Ir. LI. E. Lord of 697 Third Avenue objected, stating that he doesn't care to live across the street from a mortuary. He feels •that it will depreciate his pro- perty and is definitely opposed. Mr. LaCasse stated that under the present zoning he could build an apartment house on his property adjoining the property in question. If such an investment were made, he probably couldn't rent nearly as easily due to the fact a mortuary was on the adjoining property. Also,the mortuary would conjest traffic in the neighborhood. It was moved by TTlember Cloyed, seconded by Member Guest, and carried, that ' the variance be denied by the following vote to-writ: AYES: I:Iember Davis, Guest, Irey, Cloyed. Safeway_plans 1)1r. *Tuir representing Safeway Stores, Inc. appeared before the Commission to request that instead of the store building being 751 x 1351 as shown on the plot submitted with the zone variance granted August 1, 1949 , a plat be substituted to show a building 751 x 1501 . Mr. and 11rs. Francis A. Smith were present and stated they had no objections. It was moved by Member Irey, seconded by I.Iember Welton, and carried., that the -original plat be modified to meet the request. Covanillo Unit !�;o. 2 - Final leap It was moved by Member Irey, seconded by I;i�ember Cloyed, and carried, that the final map of Covanillo Unit No. 2 be approved and recommended to the City Council for acceptance. Vista Del Sol Subdivision - Tentative Map Mr. Henry Algert presented a tentative map for the Vista Del Sol Subdivision. After discussion it 4was moved by Mlember Irey, seconded by ylember Guest, and carried that the tentative map be approved. Vista Del Sol Subdivision - final Map I,ir. Henry !_Igert presented a final map for the Vista Del Sol Subdivision. It was moved by 1`-ember ;';elton, seconded by I:"ember Fisher, and carried, that the final map be approved and recommended to the City Council for acceptance subject to the approval of the City Engineer. Easement - Twin Oaks avenue, north of Davidson Street Yr. lCarl Offerman appeared before the Commission to request that they approve the Easement of Twin Oaks Avenue, north of Davidson Street so that a residence can be constructed on his property there. After discussion, it was moved by Member :7elton, seconded by Member Irey, and carried, that the easement be approved. Resolution No. 5 - Granting Zone Variance and side yard set back variance to Glenn 17. Cox Resolution Igo. 5 was read in full, and on motion by IQember Cloyed, seconded by i,"ember Irey, and carried, was passed, adopted, and approved. Changes in Zoning Ordinance After discussion of suggested changes ih the -Zoning Ordinance, it was moved that Member Davis, Attorney Boyer, and Bill ?.,]heeler study the subject of side and rear yard set-backs, and report back at the next meeting.
