THE CHULA VISTA PLANNING COMNESSION
! Held September 6, 1949
The Planning Commission met in regular session on the above date at 7;30
P. M. in the Council Chambers of the City Hall with Chairman Davis presiding.
Present; Members Davis, Fisher, 71elton, Irey and Guest. Ex Officio Members
Absent: Member Cloyed. Boyer and Foster.
Motion was made by member Melton, seconded by Member Fisher, and carried,
that the minutes of the last meeting held August lst be approved.
Zone 'Variances
Frank E. Dawson - 711 Del Mar Avenue
111r. Dawson requested a variance be granted so that he could operate a land-
scaping business in a "R-1" zone.
Mr. Keith Atherton of 654 Del Mar Avenue stated that he was of the opinion
that the Commission should either enforce the Zoning Ordinance strictly, or throw
it away, and that if this variance is allowed, then it would be almost compulsary
for the Commission to grant a variance allowing a business to be opened in any
residential section of town. He stated that the noise was very loud at early hours.
Mrs. G. MacGregor of 235 "T" Street told the Commission that .she had written
a letter stating her opinion in the matter, she stated that she and others within
500' had not been approached with the petition by 11r. Dawson.
Mrs. Randolph of 725-A Twin Oaks told the Commission that she objected to the
business in a residential zone.
Mr. Knowlson of 692 Second Avenue stated that he had no personal feeling with
regard to l!Tr. Dawson, but felt that the City should strictly comply with its zon-
ing Ordinance.
Mr. Dawson stated that his business license had been taken out for a land-
scaping and nursery business. He stated that all he was asking, was that he be
allowed to park two small trucks, store leaf mold, plants and small hand tools.
He stated that later on he planned to build a home on the corner. He felt that
he had removed all the unsanitary, fire hazard, noise and other objectionable
conditions within the last 60 days. He also told. the Commission that he was open-
ing up a business office at 783 Third Avenue, and the business license would. be
issued to that address.
The Secretary read letters from I4xs. Esther N. Mcl,Tahan, Harold F. Bournan,
H. C. 77atkins, Goldie E. MacGregor, and Toseph D. Codington, objecting to the zone
variance being granted, which the Chairman ordered filed with the documents per-
taining to this hearing.
Mr. Davis stated that YLr. Dawson was even in violation with the 1927 Ordinance.
It was moved by Member Irey, seconded by Member Guest, and carried, that the var-
iance not be granted.
The Planning Commission recommended that the penal provisions of the Zoning
Ordinance and also the Licensing Ordinance be strictly enforced if Itis. Dawson hasn't
removed his business within 60 days.
Mrs._ IVfarvin Blanchard - 380 Parkway, Unit No. 1
Mrs. Vi-i. Blanchard requested a variance from the required side anal rear yard
set-back of 5' for a proposed garage. It appeared that there was a 10' "easement
to the public" reserved by the grantor in the rear of Mrs. Blanchard's premises
for public purposes. Mrs. Blanchard stated that she would be glad to take the
responsibility of any later difficulties that might come up with regards to the
easement, and if requested by the City cte Utility Companies to remove her improve-
ments, she would do so, if issued a building permit. It was moved by Member Fisher,
seconded by Member Welton, and carried, that the variance be granted with the under-
standing that any construction on the easement was wholly at Mrs. Blanchard's risk,
and subject to removal on demand at Mrs. Blanchard's or her assigns expense, the
garage on the side line' to have a four hour fire wall.
Doyal L. Fipps - 186 "I" Street
Mr."-Fipps requested a variance from the required 7,000 sq. ft. in an "R-l"
zone to 6,000 sq. ft., due to the fact that he had the- lot purchased, plans drawn,
and an F. H. A. approved plan and loan before the new building ordinance was known.
According to the plans drawn and approved, the side yards could only be 41 , instead
of the required 51 . It was moved by Member Irey, seconded by Member Welton, and
carried, that the variance be granted.
Claude Yager - 3342 Del Mar Avenue
-Mr. Yager had previously had a variance permitting him to develope and print
photographs in an 11R--3" zone. Application was made for the-variance -to be extended
to December 31, 1950. It was moved by Member Welton, seconded by Member Irey, end
carried, that the variance be granted with the understanding that there be no ad-
vertising signs of the business on the property.
Arthur Iohnsen - 458 Minot Avenue
- Mr. Johnsen requested a variance from the required 5' side yard set-back to
216" for a garage. His foundation slab and driveway was laid- and inspected before
the new Ordinance became effective. It was moved by Member Fisher, seconded by
Member Guest, and carried, that the variance be ,granted.
Hobart Homes, Inc. - Marie M. Hatz Subdivision
Hobart Homes made application for a variance for the purpose of locating
houses 4' from the side yards. on Lots 11, 12, 13, 14, 16, 17, 22, 25, , and 26 of
the Marie M. Hatz Subdivision. The lots having already been subdivided, houses
designed, loans approved by F. H. A. and veteran's Administration before the Ordi-
nance became effective, it was moved by Member Irey, seconded by Member Welton,
and carried, that the variance be granted.
Residential Sign Ordinance - Recommendation .
Mr. M. S. Hooper had appeared before the Council requesting that an Ordinance
be passed eliminating "for sale" and similar signs in residential districts. The
Council referred the matter to the Planning Commission for study. After discussion,
it was moved by Member Irey, seconded by member 'Guest, and carried, that the Planning
Commission recommend to the Council that such an Ordinance not be considered. It
- was found that an Ordinance of this type would not benefit the community or property
owners. The City Attorney advised that he had great doubt as to its validity.
Changes in Zoning Ordinance
Chairman Davis requested that the Co*uission "be prepared to consider changes
in the Zoning Ordinance at the next meeting.
Purchase of McCausland Property
It was moved by Member Irey, seconded by Member 1,1elton, and carried, that the
Planning Commission recommend to the City Council that the City purchase the Dr.
McCausland property for $13,500. for use of the City as part of the Civic Center Site.
Record of Survey - Tentative
City Engineer, Harold C. Foster, presented a record of survey for 8 houses
between Second Avenue and Twin Oaks and Cypress Street and F Street. It was moved
by Member Melton, seconded by Member Irey, and carried, that it he approved.
Record of Survey - Final
It was moved by Member Welton, seconded by Member Irey, and carried, that
the final record of survey mentioned above be approved and recommended to the City
Council for acceptance.
Special Meeting
Mr. Davis requested that an adjourned meeting be held for the purpose of going
over the new Civic Center Plans. Member Welton questioned whether or not it was re-
quired that a licensed architect draw up plans for a public building. Attorney
Boyer was instructed to look into the matter. The date for the meeting was set for .
7:30 P. M. , September 12th, 1949.
City Engineer
Chairman Davis stated to the Commission that inasmuch as- this was Mr. Foster's
last day with the City that a letter be written to Mr. Foster thanking him for the
splended job done and for his cooperation given to the Planning Commission in every
respect. It was moved by Member Irey, seconded by Member Guest, and carried, that
such a letter be sent.
Dedication of Street
A petition was handed to the Planning Commission signed by Mr. and Mrs. A.
Dieterle, Mr. Henry T. Waters, and Mr. and Mrs. Toseph T. Erreca, petitioning that
the City of- Chula Vista accept .for Street Purposes, the Westerly 15* of Lot 8,
Eitzen Tract, the Westerly 15' adjacent to and adjoining the Westerly 15' of Lot 8
Eitzen Tract, and the Easterly 15' adjacent to and adjoining -the Westerly 15' of
Lot 8, Eitzen Tract. This 45' being located between: First Avenue and Hilltop Drive,
intersecting "T" Street and extending South therefrom approximately 3001;. Mr. Davis
informed the petitioners that this was_an improper approach to get the street ac-
cepted and -suggested that the petitioners contact Mr. Boyer, City Attorney, and the
City Engineer to find out the proper proceedure.
Tree Removal
Mr. Albert G. Berger, owner of Al's Trailer Haven, requested that a large
Eucalyptus tree south of Al's Trailer Haven be removed. After discussion, it was
moved by Member Irey that I-Ar. Berger be granted permission to remove the tree at
his own.expense and according to the applicable Ordinance; that at the same time,
notice be served on Mr. Berger to move his fence now on City property, and to abate
all other violations of the Trailer Ordinance. That matter was referred to Mr. Bryant.
Adjournment
It was moved by Member Irey, seconded byyMember Fisher, and carried, that the
meeting adjourn to 7:30 o'clock P. M. , September 12, 1949.
