OF THE PLANNING COI KISSION OF'THE
CITY OF CHULA VISTA, CALIFORNIA
February 17, 1958
A regular adjourned meeting of the Planning Commission was held on the above date in
Council Chambers at Civic Center at 7:30 P.M. with the following members present:
Armstrong, Calkins, Stewart, Bendickson, Byron and Culnan. Absent: none._ Also pre-
sent:, City Attorney Boyer, City Attorney Kugler and Principal Engineer Harshman.
APPROVAL OF MINUTES:
It was moved by Member Calkins, seconded by Member Byron and carried that the minutes
of the meeting of February 3, 1958, be approved, copies having been mailed to each
member.
PUBLIC HEARING - Proposed Rezoning of the proposed Garrett Park Subdivision
This being the time and place as advertised, Chairman Stewart opened the public hearing
and asked for the reading of the petition for rezoning of that area from R-1 and C-1
to R-3.
Mr. James Patton spoke stating that he feels the proposed rezoning is good planning
becauseit would act as a buffer between the existing C-1 zone on Third Avenue and "J".
and the R-1 zone near Fourth Avenue.
Mr. Carl Stahlheber, representing his father with property adjacent to the proposed
development spoke stating that if the Commission would favorably consider a request
for rezoning of the property west, that they would not object to the rezoning to R-3
of the proposed Garrett Park Subdivision.
Protests to the zoning were heard from Mr. Harry Awalt, Kenneth White, Fred Briggs,
Mr. Glenn and Mr. Robert Greenwald. It was stated that development to R-3 would cause
heavy traffic on Garrett Street and the Garrett and "I" intersection which is the only
entrance to the area.
Mr. James Patton stated that the street is not particularly narrow and that all the
surrounding-property being either R-3 or C-1, the proposed subdivision is not suited
to R-1 development and that the correpponding acres west of the proposed subdivision,
if developed in the same manner, could have access to "J" Street.
It was moved by Member Bendickson, seconded by Member Culnan and carried that the
application for rezoning of the area from R-1 and C-1 to R-3 be denied.
GARRETT PARK - Tentative Map - East of Garrett, South of "I"
The revised map of Garrett Park, showing changes recommended by the Department of En-
gineering at a previous meeting, was presented to the Commission.
It was moved by Member Calkins, seconded by Member Bendickson. and carried that the tenta-
tive map of Garrett Park be approved, for R-1 development, subject to the following:
1. That 1' lots A and B be dedicated as shown on the map.
2. That lots Land 2 be re-arranged so that each has the minimum R-1
lot area.
3. That a bond be posted guaranteeing public improvements in front of lots
8 and 9 in the event the temporary turn-around is removed and the
street continued to "J" Street.
REQUEST FOR REZONING - Area West of Proposed Garrett Park Subdivision
A petition was read from 5 owners of property west of the proposed Garrett Park Sub-
division, requesting -that their property be rezoned to R-3 and a map was presented
showing the property involved and the vicinity.
It was moved by Member Byron, seconded by Member Calkins and carried that a public
hearing be set for the second meeting in March unless the:..-application is withdrawn.
REQUEST FOR EXEMPTION FROM PROVISIONS OF ORDINANCE NO. 543 - 111-115 Minot
A letter was read from Mrs. Joseph Giantonio requesting that they be exempt from
installing sidewalk in front of new construction at 111-115 Minot as required by
Ordinance No. 543.
It was moved by Member Culnan, seconded by Member Byron and calmed that in view of
the fact that it is unlikely that sidewalk will be installed on Minot in the 100 block,
that the Planning Commission finds that it is impractical to construct sidewalk in this
area, and as authorized by Ordinance No. 543, the applicant be exempt from such require-
ment.
REQUEST FOR EXEMPTION FROM PROVI_SIONS .OF ORDINANCE NO. 543 - 385 Second Avenue
Mr. Clarence Close' s letter was read requesting that he be exempt from constructing
shoulder paving in front of his new home at 385 Second Avenue at this time. The Engineer-
ing Department's statement reflected that °shoulder paving should be installed at this
time to protect the existing curb, gutter and sidewalk.
It was moved by Member Culnan, seconded by Member Bendickson and carried that in view of
the Council' s policy with regard to shoulder paving and because no evidence was presented
showing that it would be impractical or create a dangerous situation, that the request
be denied and *the applicant be required to construct shoulder paving as required by
ordinance.
REQUEST I+'OR EXEMPTION FROM PROVISIONS OF ORDINANCE NO. 543 - 336 Kimball Terrace
Mrs. Anderson' s letter was read requesting that they be exempt frorm installing curb at
their new home on 336 Kimball ,Terrace. The Engineering Department report states that no
engineering problems are involved in constructing any of the required public improvements.
It was moved by Member Culnan, seconded by Member Bendickson and carried that because no
evidence was presented showing that it would be impractical or that it would create a
dangerous situation to' construct public improvements, that the request be denied and
that the applicant shall construct all improvements as required by Ordinance 543.
CLARIFICATION OF PLANNING COM1-TISSI_ON ACTION
Mrs. Irene Parker, who was granted a variance in January for a reduction in setback at
153 "E" Street requested Planning Commission clarification of the action. She stated

that they had requested a 25 to 18' reduction in setback on Minot so that the proposed
construction would be in line with the existing house and that the action taken by the
Commission would not bring the proposed and existing mouses in line.

The Commission asked that the minutes be read which indicated that the applicant re-
quested 25 to 18 foot setback reduction on Minot and that the Commission had granted
that specifically. Chairman Stewart ruled that it appears the action taken and recorded
reflected the thoughts and opinions of the Commission; therefore, the minutes granting
a reduction in setback from 25 to 18 feet are correct and shall stand.
PLANNITNG COMMISSION PROGRESS REPORT
The report was read of the Planning Commission's activities for the fiscal year 1956-1957
and it was explained that a copy would be submitted to the City Council, the San Diego
County Planning Congress for annual publication and to the State Local Planning Office.
It was moved by Member Calkins, seconded by Member Byron and carried that the report
be approved and a copy forwarded to the City Council, San Diego County Planning Congress
and the State Local Planning Office.
SPLIT-LOT ORDINANCE
Chairman Stewart discussed the need of Chula Vista for a split-lot ordinance and
explained the provisions of one being used in El Cajon. Because the information from
El Cajon was not sufficient, the Commission directed that the secretary determine the
administration of the split-lot ordinance, how they provide access to resulting lots
and to obtain copies of other cities' split-lot ordinances 'or discussion at the next
meeting.
