CITY OF CHULA VISTA, CALIFORNIA April 7, 1958 The regular meeting of the: Planning Commission of the City of Chula. Vista wa..a, held . on the above date in Council Chambers at Civic Center, at ?:30 P.M., with the following members present: Armstrong, Calkins, Stewart, Bendickson and Culnan. Absent: Member Byron. Also present: City Attorney Kugler and Principal Engineer Harshman. APPROVAL OF MINUTES: It vra.s• moved by Member Calkins, seconded by Member Bendickson and carried that the.- minutes he:minutes of the meetings of March 10 and 17 be; approved, copiesshaving been mailed to each member. ZONE VARIANCE - Daniel and Pauline Marks_ - 708 "H" Street The application requesting permission to continue construction of a trailer park started when the area. was; zoned M-1 and requesting permission to operate a parking area for Rohr employees, M-1 and C-1 uses in an R-3 zone, was read. Chairman Stewart asked that the City Attorney review the entire matter and bring in a report .for the next meeting. ZONE VARIANCE - Dana. Nation - 650 Chula Vista. Mr. Nation's application requesting permission to operate a lawn mower sharpening service, in.his garage in an R-3 zone was read. A letter was read from Mr. C. IV... Labadie, 86 Madison Avenue protesting the granting of the variance, and it was. noted that there were 26 signatures approving the variance. It was; moved by Alember Bendickson, seconded by Member Culnan and carried that the; application be denied because no evidence was. presented to indicate a hardship within the meaning of the zoning ordinance. ZONE VARIANCE - Hardy and Ursula Rothschild - 1 .71 "E" Street The application requesting permission to operate an art gallery as. a. secondary use of the residential building was, read and Mr. John Ronus, attorney for the Rothschilds, spoke in favor of the variance referring to a substantial petition submitted, approving the variance. It was noted that the petition_ was signed by people all over the city interested in an.art gallery rather than just in the immediate area. Letters; protesting the variance were read from J. S. Stewart, Roscoe and Anita Johnson, Ernest and Alice Parkin and Mr. and Mrs. George Snyder. Oral protests were heard from Bill Ramage, Alice Parkin, Elizabeth Galligan, H. Farris, Ben Herren, Don Byrn, Harold Morgan and Mrs. Metzner. It was moved by Member Culnan, seconded by Member Calkins and carried- that the. variance application be denied for the reason that there are no unusual or unique; hardships about the property making it impractical to maintain a.s zoned. ZONE VARIANCE. - David and Elsie Epstein - N. W. Corner of Second and Davidson The application was read requesting permission to construct & dental clinic on the property with a reduction in setback from 25 to 5 feet on Davidson and Second, and an artist's sketch presented. Protests were heard from Mr. Lansley, Wilson Seaeord, John.Lighthart and Wayne Copp. It was moved by Member Armstrong, seconded by Member Culnan and carried that the application be denied for the reason that no evidence was; presented showing a hardship within the meaning of the ordinance. SETBACK VARIANCE - Lillian and Helen Kennedy - 7217hitney The application asking permission to construct al single family dwelling on the lot with a reduction in rear yard setback from 25 to 12 feet was. read. Mr. Underation, 69 ,Whitney, asked the size of the house to be constructed. It was: moved by Member Culnan, seconded by Member Bendickson and carried that the application for setback variance be approved according to plans submitted. Chairman Stewart asked that the ordinance provisions for setbacks on corner lots: be checked to determine the flexibility, if any. SETBACK VARIANCE - Frank Redman — 169 Glover Mr. Redmants application asking for a, reduction in rear yard setback variance: from 15 to..5.5 feet for the construction of multiple units., was-: read. A. letter protesting the granting of the variance tvas. read from Mr. Earl Cowherd, 160 Garrett Avenue. Mrs. Fern Emerson, 167 Glover and Mr. Mickelson on Garrett, protested the variance. Mr. Walkland, property owner of 154, 156 and 160 Glover, spoke in favor of the variance. .It was moved by Member Calkins, seconded by Member Culnan that the variance be, granted. The motion failed to carry by the following vote, to-wit: AYES: Members Calkins, Stewart and Culnan NOES: Members Armstrong and Bendickson ABSENT: Member Byron APPLICATION FOR SERVICE STATION - Lee J. Raitt - Third and "It' A letter was! read from Mrs. Camille Moreau asking permission to construct a service station on the southeast corner of Third and "It'. Plans were submitted by Mr. Lee Raitt, for Mrs. Moreau. _ . . Chairman Stewart asked Attorney Kuglerts opinion as to whether or not Mr. Raitt had followed the correct procedure in applying for permission for a service station in a, C-1 zone. Attorney Kugler stated that he and Mr. Boyer concur in the opinion previously give.n, that the phraseology giving the Commission the prerogative to allow service stations in a C-1 zone without establishing standards would be declared unconstitutional if taken to court, but that it must be presumed that the ordinance is valid. The opinion previously given was that the proper procedure would require the filing of a variance application as required by the original ordinance. Attorney Kugler stated that the attorney's opinion could be. accepted or rejected, that if the Commission feels the amendment is valid they can grant permission without a variance* It t-ra.s, moved by Member Bendickson, seconded by Member Culnan, and carried that the Planning Commission approve plans for a. service station as submitted at the. southeast corner of Third Avenue and "I"' Streets, a C-1 sone, subject to approval of the Building Department and Engineering Department as to building and engineering spe cif icitions and the recommendations of the Safety Council. SETBACK VARIANCE - Lee J. Morgan - 865 Fairway Court Mr. Morgan's application was read asking for permission to construct a house on the R-1 lot with a, reduction in rear yard setback from 25 to 9 feet. Member Culnan moved, Member Bendickson seconded and the motion carried that the request be granted, that because of theshape of the lot and the-. 20 foot setback on two sides along Fairvray Court, a hardship is oreatted as to available building area., that a. reduction in rear yard setback from 25 to 9 feet be granted. SETBACK VARIANCE - Raymond and Patricia Scala - 148 Sierra Way Mr. Scala,is application wa . read requesting a; reduction in rear yard setback from 25 to 12 feet for the purpose of adding a. room onto the house* It was moved by Member Calkins, seconded by Member Armstrong and carried that because the plans indicate it is the most logical manner to add to the house, and the additional room is needed by the family, that the Planning Commission find a hardship within the meaning of the ordinance is present and the applicant be granted a reduction in rear yard setback from 25 to 12 feet as indicated on plans submitted* EXTENSION OF TI19E ON ZONE VARIANCE - Wilbur and Carol Blink - 188 Fifth Avenue A letter tiarasread from-Mr. Wilbur Blink, 188 Fifth Avenue, requesting that the.: time on a. variance granted to them. in 1957, which will expire soon, be- extended so that they might continue operating & small repair business for store: mannequins, etc* It wa.s moved by Member Bendickson, seconded by Member Culnan and carried, that Mr* and Mrs* Blink be granted an extension of time for their operation, said extension to expire on February 4, 1960* REGO MANOR SUBDIVISION - Final Map - Ea;stt of Second Avenue, North side of Montebello The final map of Rego Manor Subdivision wa& prezented showing all changes= or amendments required by the: previously approved tentative map* The Engineering Department recommendations were read and noted. It wa& moved by Member Culnan, seconded by Member Calkins and carried that the: final map of Rego Manor be approved and forwarded to City Council, subject to the Engineering Department final. check* JUDSON RESERVOIR ANEEXATION - South of Cairns Manor and Bella. Vist& Subdivisions A map showing the proposed annexation to Chula Vista. of.Judson Reservoir Lands- was presented and letter approving boundaries: from the San Diego County Boundary Commission noted* It was, moved by Member Bendickson, seconded by Member Calkins and carried that the Planning Commission recommend to the City Council that th& Judzon ]Reservoir- Annexation be.. accepted® APPLICATION FOR TRAILER PARK - Hal Johnson - Between Flower and "D", west of Iffoodlawn An application vias read from Mr. Hal Johnson for location of a trailer park in the M-1 zone, west of Woodlawn between."D" and Flower Streets. A plot plan of the area, was submitted. The Planning Commission directed that the matter be set for public hearing, as required by Ordinance No. 4.72, for Monday, May 5, 19580 ADJOURIZIENT: The meeting vias adjourned to April 21, 1958.
