HomeMy WebLinkAbout1958-04-21 PC MINS MINUTES: OF A_REGULAR AI?JOURNED MEETING OF THE PLANNING COMMISSION OF THE CITY OF_CHULA VISTA, CALIFORNIA April 21, 1958• The regular adjourned meeting of the Planning Commission of the City of Chula Vista wa.s. held at 7:30 P.M. on the above date in Council Chambers. at Civic Center, with the following members present: Bendickson, Calkins, Byron and Culnan. Absent: Members Armstrong and Stewart. Also present: Associate Engineer Manners and City Attorney Kugler. APPROVAL OF MINUTES' It ur&s moved by Member Bendickson, seconded by Member Byron and carried that the minutes: of the Meeting of April 7, 1958, be: approved, copies having been mailed to each member. PUBLIC HEARING - Rezoning of Broadway Frontage. From M-1 to C-2 - Establishing Standards for ServiceStations in C-1 Zone - Prohibiting Off-Street Parking Within Front Yard Setback Proposed Rezoning of B roadway This being the time.: and place as= advertised, Vice Chairman Calkins opened the public hearing and submitted a map showing the proposed zoning from R-1 and 11-1 to C-2, the depths as; indicated on map, for both sides of Broadway from "C" to "L"- streets. Protests were heard from residents: on the West Side of East Manor Drive. of Bay Manor Subdivision, who stated that the deed restrictions would prohibit commercial development. Mr. Clint Matthews commented that the merchantsson Broadway were interested mainly in getting the frontage rezoned so that they would encourage rather than discourage new commercial development. Standards for Service Station in C-1 Zone Attorney Kugler stated that, in his opinion, reasonable standards to guide the Planning Commission in granting & "special exception" for a-. service. station in a. 0-1 zone would be. (a) that it will not be. materially detrimental to the adjacent properties., (b) that it will not create a traffic hazard in the immediate vicinity, and (c) that it will not be a fire hazard and further that the Commission may establish reasonable conditions with the granting of such "special exception". Prohibiting Parking Within Front Yard Setback ice Chairman Calkins explained that there had been an error in the legal advertisement for the public hearing and that the hearing would be held on the 5th day of May There being no further comments on the above, Vice Chairman Calkins closed the hearing. It was moved by IViember Culnan that inasmuch as public necessity, convenience., general welfare and sound City planning require a. change of zoning on Broadway because the frontage is not adaptable to M-1 zoning and because adjacent areas are being developed residentially requiring commercial services on Broadway, that the Planning Commission recommend to City Council that the frontage on Broadway, to a depth indicated on map submitted, be rezoned on the east and west sidea from "C" to "L" Streets from M-1 and R-1 to C-2. The motion carried by the following -vote, to wit: AYES:- Members: Bendickson, Calkins, Byron and Culnan. NOES: none ABSENT: Members: Stewart and Armstrong TENTATIVE SUBDIVISION MAP - Judson Reservoir Estates. The Vice Chairman stated that the size of the subdivision merits cons-iderable attention and that the matter would be held over until the May 5th meeting for discussion with the subdivider, the City Engineering and Planning Departments; and the Planning Commission on the layout for the entire areae DISCUSSION - Regarding Industrial Lands Annexation Zoning Mr. Gabriel Berg, speaking for Marie Carter, owner of property within the proposed Industrial Lands Annexation, requested that the Commission give an opinion as to the zoning in the proposed annexation. Attorney Kugler stated that the Commission could not commit themselves. at this time, other than to express individual opinions. Member Culnan stated that from information available at this time and because industrial zoning in that area would conform to existing Chula Vista zoning, he feels there will be no trouble on the matter of zoning after the annexation. Member Bendickson stated that he would not commit himself until after the hearing, but that from the facts presented he is of the opinion that it should be zoned industrial. Member Byron stated that he is of the same opinion, that until hearings are held he could not commit himself but from information avail- able it appears that M-2 zoning is best. ZOIE VARIANCE - Daniel Marks - 708 "H" Street. In response to the Commission's request for an opinion as to the status of the: Bison_ Trailer Park, Attorney Kugler stated that the existing trailer park is a. non-conforming 11-1 use in an R-3 zone and that to complete construction or to add any other use not allowed in an R-3 zone, would require permission from the Planning Commission through a. zone variance. The Chairman explained that a, variance has been applied for and the hearing scheduled for this date. Letters of protest were read from Paul Donohoe, Leonard Kelly and Mrs. J. C. Haney and a letter approving the granting of the variance from the Garrett Trailer Park. It waa moved by Member Byron, seconded by Member Culnan and carried that inasmuch as the. Planning Commission finds that a. hardship would be created if Mr. Marks is denied permission to complete development, permission be- granted to complete, construction of the trailer park according to original plans approved, and that tha construction be completed within one year@ Further, that the request for var lance to operate a. parking lot in the R-3 zone be, denied for the reason that no hardship is indicated. ZONE VARIANCE - Ronald Young - 230 Broadway Mr. Young's application was: read requesting permission to develop his property, part of which is zoned 14I-1 and the balance R-3, with a motel, a. C-2. use. Plans submitted indicate that a part of the property will not be. developed immediately® It was moved by Member Culnan, seconded by Member Bendickson and carried, that tha, application be approved for a motel at 230 Broadway for the reason that it would create an unnecessary hardship if the. applicant were not given permission to use the entire depth of his property. ZONE VARIANCE - Chester Thomas 315 "K" Street. Mr o Thomas' application was; read requesting permission to extend the 114-1 use on the front of his: property (z.oned H-1) to the rear of his property which is zoned R-l. A. plot plan was_ reviewed.showing the construction of a new warehouse building close to the present M-1 zone and the use of the balance of the property for off- street parking and loading zones. It was; explained that the property cannot be.. used for a single family dwelling because it does not have street frontage. A petition was read signed by seven property owners protesting the granting of then variance. A letter wasread from Mr. Harold 'Starkey protesting any additional DI-1 zoning in the area.. Protests were heaTd from both Mr. and Mrs. Copeland, 778 Garrett and from Mr. Thayer,764 Garrett. Dr. Fields spoke in favor of the variance.. Mr. Culnan stated that the rear of the. propBr-i7y will be land-locked if not used with the frontage, that the zone boundary divides. his property,. thus not allowing for expansion, that the property nearest the objectors would be; used for parking rather than any new warehouses, and that the development should be an improvementa. to the property. Member Culnan then moved that the variance. be.; granted for these reasons. Members Byron and B endickson stated that they would like to have the matter held over for further study. Member Culnan withdrew his motion.m It was. moved by D!ember Bendickson, seconded by Member Culnan and carried that the; matter be. held over for further study. APPEAL ON DENIAL OF VARIANCE TO HARDY ROTHSCHILD - 471 "E"- Street. The appeal to the City Council of Planning Commission action in denying & use variance to Hardy and Ursula Rothschild for an art gallery at 471 "E" Street was read. The secretary read the findings of the Planning Commission on,the. denial of the variance® It was moved by Member Bendickson, seconded by Member Byron and carried that the findings be approved and forwarded to the City Council, ADJOURIMENT The meeting was adjourned sine die.
