THE CITY OF CHULA VISTA, CALIFORNIA
May 5s 1958-
A regular meeting of the Planning Commission of the City of Chula Vista was held
on the above date at 7:30 PoMe in Council Chambers at Civic Center, with the
following members present: Armstrong, Calkins, Stewart, Bendickson, Byron and
Culnan. Absent: none. Also present: City Attorney Kugler and Principal En-
gineer Harshman.
APPROVAL OF MINUTES::
It wa.s moved by Member Culnan, seconded by Member Bendickson and carried that the
minutes- of the meeting of April 21, 1958, be approved, copies having been mailed
to each member.
PUBLIC BEARING - Approval of Location of Trailer Park
This being the time and place as' advertised, Chairman Stewart opened the, hearing
on an application for approval of the location of a trailer park on the west side
of Woodlawn Avenue between_ the extended Flower and "D" Streets, submitted by Mrs
Hal Johnson. Chairman Stewart explained-that this property is zoned M-1 which is
the correct classification of.a trailer park under our zoning ordinance and that
the function of the Planning Commission is to make their findings as to whether
the application complies with requirements of the location of a. trailer park under
the trailer park ordinance.
Protests were heard from 111re Leonard 11oe, 77 Woodlawn, and Mr. Aubrey Slicte. The
Planning Commission explained-that they were desirous of obtaining an additional
20 feet dedication for Woodlawn. Avenue so that there would be sufficient streets
to service the areas
It was moved by Member Byron that the matter be held over until the next meeting
to give Mr. Johnson an opportunity to ask for the street dedication from the San
Diego and Arizona Eattern Railway, the: owners of the property. Mr. Johnson pro-
tested that he would rather the Commission take some action. Member Byron with-
drew the motion.
It was. moved by Member Culnan, seconded by Member Bendickson and carried, as:
follows:
(a) That the application for location of a trailer park west of
Woodlawn, between "D" and Flower Streets extended, be approved
with these conditions:
1. That an additional 20 feet be dedicated for street on the
westerly side of Woodlawn for the entire length of the
property.
2. That this 20 feet be improved to city specifications.
3. That curb, gutter and sidewalks be constructed on Woodlawn.
4o That the right-of-way of "D" Street be left free of any
type of construction.
5e That if the San Diego and Arizona Eastern. Railway does; not
dedicate the 20 feet needed for completion of Woodlawn, that
Mr. Johnson come back before the Commissions
(b) Pei-mission is granted for these reasons--that it will not materially
affect the immediate neighborhood or the community, that it will not
create a dangerous traffic situation if Flower Street is dedicated
to its full width, and that the property is zoned for this use..
PUBLIC HEARING - Prohibiting Parking Within Setbacks
This being the time and place as advertised, Chairman Stewart opened the public
hearing on amending the zoning ordinance so that required off-street parking in
residential areas be prohibited within the prescribed setbacks along dedicated
streets. There being no comments, either for or against, the hearing was; closede
Chairman Stewart explained that the proposed change should have been heard at a,,
public hearing during the last meeting along with a proposed change with regard
to establishing standards for service stations in C-1 zones.
RESOLUTION N0. 102 - Recommending To City Council Amendment To Zoning Ordinance
Prohibiting Parking Within Prescribed Setbacks Along Streets:
And Establishing Standards for Service Stations in C-1 Zones..
Offered by Member Calkins, passed, adopted and approved, by the following vote,
to-wit:
AYES: Armstrong, Calkins, Stewart, Bendickson, Byron and Culnan
NOES: none
ABSENT: none
JUDSON ESTATES SUBDIVISION - Tentative. Map - East of Hilltop, South of Oxford.
The tentative map of Judson Estates Subdivision, located within Judson Reservoir
Annexation was. presented for consideration. The map has approximately 495 lots:
And is proposed for R-1 use.
It was. moved by Member Bendickson, seconded by Member Calkins and carried that
the tentative map of Judson Estates be approved and recommended to City Council,
pending annexation, subject to the.- following:
a. Street namesbe changed as. shown on map in red.
b. Dedication of 1' lots A through H inclusive.
ce A minimum of 7000 square feet in area per lot.
d. Compliance -with Engineering Department requirements.
CORTEZ SUBDIVISION N0. 1 and 2.- Tentative Map - Between "I" and "J" and 3rd and 4the
The tentative map of Cortez No. 1 and 2 was presented to the Commission. There
are approximately 45 lots, proposed for R-1 use. A letter was: read from property
owners on Third Avenue asking if provision would be made for a street at the rear
of their lots, along the eastern boundary of the proposed subdivision. Recommend-
ations were read from the Department of Engineering. Mr. Lee Raitt explained to
the Commission that every effort had been made to service any land-locked property
in the block but that it would be impossible to give street frontage to all the
property. He stated that if the property owners on Third Avenue would be inter-
ested in dedicating and paying their share of the improvements for a street to
serve the rear of their properties, that he would be very happy to work with them
in the effort. The zoning of those Third Avenue lots which would face on that
street and on lots within the proposed subdivision would have to be adjusted*

Chairman Stewart stated that in order for the owners on Third Avenue to have an
opportunity to contact Mr. Ra.itt to attempt to work out an agreement in putting
a street at the rear of their properties, the map could be held over until the.
next meeting. Mr® Raitt stated that he did not wish the map held over for that
reason because the people on Third had made no effort up to this time to contact
him, even though they knew of the project.
It was moved by Member Armstrong that the tentative map not be; accepted. The
motion carried by the following vote, to-wit:
AYES: Members Armstrong, Calkins, Bendickson, Byron and Culnan.
NOES: MemberStewart
ABSENT: none
REQPEST FOR REZONING - Third and "K" Streets.
An application for rezoning the southeast corner of Third and "K" from M-1 and R-1
to C-2, was presented to the Commission with a plot plan of the are& proposed for
rezoning.
It was moved by Member Culnan, seconded by Member Calkins and carried that a public
hearing be set for the la--&t meeting in Junee
ZONE VARIANCE. - Chester Thomas - 3445 "K" Street.
lire Thomas' Application, held over from the April 21st meeting, was read requesting
that.he be allowed to develop the rear portion of his .property, zoned R-1, with a
continuation of the M-1 use on the front of his f5roperty, which is zoned M-1.
Letters were read from Ja-Thar Cabinet Shop, Dawson°s Nursery, M. Ee Laubmeyer,
Reid's Plumbing & Heating, and Matthews & Company approving the granting of the::
variance. Protests, were heard from 1:1r. Crixton and Mrs Kenneth Copeland, living
on Garrett Avenues
It was moved by Member Culnan, seconded by Member Calkins and carried as follows:
That Pairs Thomas be granted a variance to extend the M-1 use on the front of his.
property to the rear portion of the lot, zoned R-1. That the proposed warehouse
building be located adjacent to the existing warehouse building and the northern-
most part of the lot be used for parking and loading areas,. That the applicant
construct a suitable wall, of maximum height, along the northern property line®
That this variance be granted for the reasons that the rear of Mr. Thomas' property
is land-locked and can not be used for residential property without street frontagep_
that the variance will not materially affect the master plan of the city nor adjacent
properties and that the variance is necessary for the preservation of a substantial
property right®
ZONE VARIANCE - Salvatore: Albo - 555 Roosevelt Street
Mrs Albots application was read requesting the following: (a) That he be, granted
permission to erect on his property, an R-2 zone, an apartment building, an R-3:
use., and remove the. existing non-conforming three single units. (b) That he. be..
granted permission to sell products of a plastic lamination company, using his
home address for the business license and (c) That he be. granted permission to
do actual laminating on the premises, for special jobs, using only a press.
Protests to the laminating work on the premises were heard®
It was, moved by Member Byron, seconded by Member Bendickson and carried that

Mr. Albo be granted a variance to construct an apartment building after removal
of the three existing units, subject to the f ollowi.ng: (a) Compliance with all
building requirements, (b) provision for off-street parking for each unit, said
spaces, not to be located in thesetback along Roosevelt and Smith, (c) that all
public improvements on Roosevelt and Smith be constructed That this variance:
be granted because of the changing circumstances of the area, surrounding property
being developed in a near R-3 manner.
'It was moved by Member Armstrong, seconded by ;, ember Bendickson and carried that
the request for limited lamination work be denied for the reason that no hardship
is indicated.
It was moved by Member Byron, seconded by Member Calkins and carried that the,
request for selling plastic lamination products as a distributor for a manufacturer
be; denied because no hardship is indicated®
ZONE VARIANCE - Ruth May Scull - 912 Helix Avenue
Mrs. Scull' s application was read, requesting that she be given permission to con-
duct lessons in ballet, ballroom and tap dancing in the carport of her home during
specific hours. Comments were heard favoring the granting of the variance, stating
that it was a. neighborhood convenience and that it did not affect adjacent properties..
It wasmoved by Member Culnan, seconded by Member Bendickson and carried that the-
petition for teaching dancing be granted for a period of one year and that the
classes be restricted to 20 classes a. week, to be held during the hours stated in
the application.
SETBACK VARIANCE - He Wallace and Nancy C. Hartin - 75 E. San Miguel
Mr. Hartints application was read, requesting permission to reduce the required
west side yard setback from 5 to 2 feet for the purpose of adding a garage-utility
room combination to the existing house. A protest was heard from Mr. R. Be Riggan,
property owner on the west. A letter was read from the Building Inspector that he:
is of the opinion that requiring an attached garage to setback from the property
line the same as a. main dwelling is not the intent of the ordinance and that he
has intended proposing an amendment to the: zoning ordinance �rdausting this, require-
ment.
It was moved by Member Armstrong, seconded by Member Calkins and carried as follows:
that it would be a hardship on the owner if the variance is not granted because. he
needs additional room and it appears that his request conforms to the intent of the:
ordinance, that he therefore be. granted a reduction in sideyard setback from 5 to
-2 and 1/12. feet for the length of. the proposed addition with a maximum 12 inch
overhang, no windows on the wall adjacent to the property line and a gutter installed
to control drainage.
ZONE VARIANCE - Joseph and Bonnie OtReilly - 122_ Corte.. Maria
Mr. O'Reilly's request was. read that he be allowed to rent the guest house on his
property, an.R-2 use in an R-1 zone. It was explained that the guest house had
been there for quite some time and was.. constructed originally for the owner's
family. UVhen the house was sold, it was sold as. a rental unit® Protests were.
heard from Dale Rector,'6ordon Bixler, William Anderson, Mrrs. Larson and Clarence-
Ritter. The Commission asked whether it was possible that the breezeway connecting
the guest house and main house be removed and the property split, so that it would

result in two R-1 lots: Mr. O'Reilly stated that the lot area and street frontage
is sufficient for such a split, but that he is not certain that there is enough
footage between the buildings to provide the required 5 feet side yard for each
resulting unit.
It was moved by Member Bendickson, seconded by Member Culnan and carried that the
request for an R-2 use in an R-1 zone be denied because no evidence indicating
hardship within the meaning of the ordinance was presented.
SETBACK VARIANCE - Howard and Lulu Price - Northwest Corner of First and "K"- Streets
The application was read requesting that the applicant be granted a reduction in
setback on "K", from 30 to 20 feet and a rear yard reduction from 20 to ]- feet.

It was moved by Member Culnan, seconded by Member Byron and carried as follows:
That the applicant be granted a reduction "n setback on "K" from 30 to 20 feet and
a rear yard setback reduction from 20 to feet, as indicated on plans submitted.
That the variance be granted for the reason that the shape of the lot and the two
prescribed setbacks do not leave sufficient room to construct a dwelling.
NEED FOR AMENDMENT TO ORDINANCE
Member Bendickson moved, Member Armstrong seconded and the motion carried that the
recommendation previously made by the Building Inspector as to setbacks for attached
garages be incorporated in a proposed amendment to the Zoning Ordinance and brought
back to the Planning Commission at the next meeting.
BROAIRTAY ZONING
Member Culnan moved, Member Calkins seconded, that the Planning Commission request
the City Council to refer the proposed rezoning of Broadway back to the Planning
Commission for further study. The motion carried by the following vote, to-wit:
AYES.: Members Armstrong, Calkins, Stewart, B yron and Culnan
NOES: Member Bendickson
ABSENT: none
