OF THE PLANNING COMMISSION OF THE
CITY OF CHOLA VISTA, CALIFORNIA
August 18, 1958
The adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held on the above date at Council Chambers, Civic Center, at 7:30 P.M. with the
following members present: Sparling, Calkins; Stewart, Bendickson and Culnan.
Absent: Members Crear and Adams. Also Present: City Attorney Kugler and Principal
Engineer Harshman. '
APPROVAL OF MINUTES'
It was: moved by Member Bendickson, seconded by Member Calkins and carried that the
minutes of the meeting of August 4, 1958, be approved, copies having been mailed to
each member.
PUBLIC HEARING - Request for Rezoning - West of Woodlatim, Between "D"i and Chula Vista
Extended
Chairman Stewart opened the hearing and asked that the application be read requesting
rezoning of property from R-3, Multiple Residential, to M__I. Industrial, west of
Woodlawn between "D" and Chula Vista extended. A map was: presented and a petition
submitted signed by 34 persons protesting the granting of the zone change.
Mr. Hal Johnson stated that he only leases the property, that the owner had thought
the property was zoned M-1 until very recently,
Protests were heard from Mr. Leonard Moe, 77 Woodlawn, and Mr. Edwin Deuchler, 91A
Woodlawn Avenue.
There being no further comment, Chairman Stewart closed the hearing.
It was moved by Member Cu]nan, seconded by Member Bendickson and carried that because
the Planning Commission does, not find that the facts- are present necessary for a zone
change as outlined by the ordinance--public necessity, convenience, general welfare
or good zoning practice--and because of the .number of protests from neighbors, that
the request for change of zone be denied.
PUBLIC HEARING - Request for Rezoning - Southwest Corner Fourth and "E"
Chairman Stewart opened the hearing and asked that the application be read requesting
rezoning from R-1, Residential, to C-13 Commercial, of the two corner lots on the
southwest corner of Fourth and ."E"a A map was presented and a letter was read
approving the granting of the zone change from Lloyd E. Ellis, Minister of Church of
Christ. Mr. Connolly presented a map showing percentage of neighbors who had signed
his application for rezoning®
Member Culnan stated that he could see no objections to these two lots being rezoned
because one is used as a business and the other is adjacent to a business and there
were no objections from neighbors.
Chairman Stewart stated that he feels that granting the rezoning for the reason that
it abuts commercial property would be establishing a precedent because the owner of
property next to Mr. Connolly would then have the same conditions and would request
rezoning; and so on west on "E".
Mr. DuVall, owner of two lots west of Mr. Connolly, stated that he has no objections
to the rezoning and would not request rezoning for his property.
Member Calkins stated that when the rezoning of "E" was previously considered, the
city had accepted the recommendation of the Planning Consultant which was that "Ell
Street should not be rezoned. Mr. Connolly stated that this is already a business
corner and should not be considered with rezoning of all of "E't Street.
Chairman Stewart closed the public hearing.
It was moved by Member Sparling and seconded by Member Culnan that the application
for rezoning the southwest corner of Fourth and "E" from R-1 to C-1 be approved and
recommended to the City Council for the reasons that three of the four corners are
now used commercially and Mr. Connolly' s property, adjacent to one which has a zone
variance, is substandard in width and because it would not be materially detrimental
to other properties in the same area. The motion failed to carry by the following
vote, toawit:

NOES: Members Calkins, Stewart and Bendickson
ABSENT: Members Crear and Adams
PUBLIC HEARING - Request for Approval of Trailer Park Location - 600 Block of "G" Street
Chairman Stewart opened the hearing and asked for the reading of the application for
location of a trailer park. Plans were presented showing location of buildings and
trailer spaces. Chairman Stewart asked the Engineering Department whether or not an
extended Woodlawn Avenue would abut this property. Engineer Harshman stated that the
centerline of an extended Woodlawn would follow the east line of Mr. Krausets property
but that it is his opinion that the cost involved in condemnation and improvements:
would not be worth the benefits. derived from having the street.
Chairman Stewart asked whether or not it has been agreed as to location of sewer lines
through this property to run north to serve the area on "E" Street. Engineer Harshman
stated the details were being worked out. Mr. Krause stated he would like to know,
within 30 days where the city would need to put the lines through his property.
It was moved by Member Culnan, seconded by Member Bendickson and carried that because
the Planning Commission desires a study made as to the feasibility of providing for
Woodlawn Avenue between "'F"' and "G't and because the study for location of sewer lines:
has not been completed, that the matter be held over until the meeting of Sept. 2, 1958.
AREA VARIANCE - Buford-Morgan - Northeast Corner "K" and Madison
The application was read requesting a reduction in setback on "K" and on Madison
Avenue from 25 to 20 feet for the purpose of constructing apartment unity in this
R-3; zone.
A letter was read from Mr. and Mrs. Loney Kempel protesting the granting of the variance.
It was moved by Member Bendickson, seconded by Member Calkins and carried that the
request for reduction in setback from 25 to 20 feet on "K" and Madison be granted

because property north on Madison is developed with a. 20 foot setback and west on
11K11 is- developed with 20 foot setback' that the variance is necessary to preserve a
substantial property right and. it will not be materially detrimental to properties in
the area.
AREA VARIANCE Archie Montgomery - 28 "J" Street
The application was read requesting permission to divide the- property so as to build
two houses on the rear of the 29011ot, via an easement to "J" Street. A letter was
read from the Fire Chief stating that they would have no objections to the dividing
of this lot into two .additional building sites;, if the easement to serve them is- @f
a minimum 20 feet width.
Mr. Montgomery stated that there are three deep lots at that general location and
they have attempted before to develop'their properties jointly' but have not succeeded.
Pictures were presented showing the immediate neighborhood and indicating the depth
of the property which cannot be used in an R-1 zone without such a variance being
granted®
Mr. Lee Raitt stated that in a similar position, property owners are working together
and are proposing to serve rear properties on a. culAde-sac.'
Member Culnan stated that it is not possible to get a street into these properties:
from Hilltop. He further stated that there are many similar situations and the
Commission will be called upon to grant the same variance so that property can be
developed.
The-Commission directed that the applicant 'get together with,-his neighbors and
attempt to work out a way by which they can develop the rear of their lots by bringing
a. street in from "'J" Street and that Mr. Montgomery notify the Planning Office when
they are ready to appear again before the Commission for decision.
REQUEST FOR' EXEMPTICN FROM CONSTRUCTION OF PUBLIC IMPROVEMENTS - 998 Corte Maria,
The applicant's letter was read requesting that he be exempt from constructing public
improvements� on his Moss Street frontage, which is an unimproved street going west
from Corte Maria, providing for the possible development of the Country Club. Existing
public improvements: extend across the right-of-way of Moss at its. intersection with
Corte Maria. Engineer Harshman recommended that the request be granted.
Member Culnan moved, and it was seconded by Member Calkins, that the request be
granted with the condition that when there is a need for improving Moss, these
improvementa be constructed.
APPROVAL OF TEMPORARY CHURCH LOCATION - 672 Third Avenue - Baptist Church
A letter was read from Rev. Wm. Bray asking Planning Commission approval of conducting
church services in a dwelling at 672 Third Avenue, for a period of 7 months. Letters
were read from the Fire Marshal and the Building Inspector approving the temporary
use of the building with certain stipulations.
It was moved by Member Culnan, seconded by Member Sparling and carried that the church
be granted permission to hold services; in the dwelling at 672.' Third Avenue, subject to
the following conditions:
1. All exterior doors shall be made 'to swing outward and shall be equipped with
school-type locks.

2. That the tenure of occupancy be restricted to seven months.-
3. That occupancy be limited to first floor only. _
4. Occupancy of- the building be restricted to 75 persons, at any one time.
5. That a UL-approved 22 gallon water-type fire extinguisher be provided.
6, That all drapes, hangings, curtains and decorations be. maintained in a
flamegproofed condition.
7. That smoking be eliminated during periods of public assembly.
EXTENSION OF "J"' STREET EAST . To "J" Street School Annexation
The Principal Engineer presented a map showing the proposed extension of "J" Street
east to serve the school property. It was shown how topography dictates that the
street curve to the south. Engineer Harshman stated that the Engineering Department
had studied several alternate Alignments for "J'° Street but had concurred that the one
presented, prepared by Harold Foster, Civil Engineer$ with minor changes, as to curve
radii, etc.' is the most desirable and the most feasible. Dr. Lauderbach stated that
plans for this school, including plans for the street, must be ready within another
8 months .to take advantage of the grant of federal funds for school purposes.
It was moved by Member Bendickson, seconded by Member Calkins and carried that the
tentative plan dated July 23, 1958, drawn by Harold Foster, Civil Engineer, for the
extension of "Jt1 Street east be approved as shown to extend to the east line of the
school property and that grading be subject to approval of the City Engineering
Department.
DEVELOPMENT OF JAMUL STREET EAST FROM MONSERATE - Baptist Church Property
It was noted that the Planning Commission approval for a, church site on property at
the east end of Jamul Street would be affected by a lr lot held by the City at the
easterly end of Jamul. The plan approved by the Commission provided for a private
road entering and serving church property from Jamul, crossing the It lot.
It was moved by Member Culnan, seconded by Member S'parling and carried that a, letter
be submitted to the City Council reporting the Planning Commission action, and
recommending that the 11 lot held by the city be dedicated for street purposes, so
that the private road might enter church property from Jamul Street. Member Bendickson
abstained from votingo
PROPOSED STREET OPENING - Center Street East from Fifth Avenue
It was reported that Fred Ross, Purchaser Analyst, had been successful in obtaining
dedications for 16 feet for street purposes on the south side of Center Street, east
of Fifth Avenue, in accordance with recommendations from the Planning Commission.
Chairman Stewart asked that the Engineering Department make a study and recommendations
as to what dedication would be needed for a cul-de-sac at the easterly end of the street.
PROPOSED AMENDMENT TO M-2 ZONING CLASSIFICATION
Attorney Kugler reported that he has prepared, as requested, an ordinance which would
amend the M'2 zoning classification to allow specifically, among other uses, the steam

generating plant now under construction by the gas; and electric company in the M-2
-zone, and which would further amend sections referring to height limits for accessory
buildings, so that accessory structures necessary for technological reasons to spec-
ifically permitted uses, would be allowed to exceed the maximum height limit.
Member Sparling moved, Member Calkins seconded the motion and it was carried that the
proposed amendment to the zoning ordinance be set for public hearing on Sept. 2, 1958•
PROPOSAL FOR AMENDMMENVT TO ORDINANCE REGARDING CLASSIFICATION OF TRAILER PARKS
It was reported that the City Council had received the letter from the Commission
recommending that an emergency ordinance be adopted changing the zoning classification
of trailer parks from M-1 and M-2 to C-2 and that because it was felt that it would
not warrant an emergency ordinance.,.-the Council had referred it back to the Planning
Commission for public hearings. It was further stated that the question was raised
as to whether C-2 would be the proper classification.
Mr. Lee Raitt stated that around Apri]! of 1953, the city had adopted a resolution
restricting the location of trailer parks.
The Commission directed that the matter be held over, that the resolution referred
to by Mr. Raitt be found and that other. citiest ordinances with regard to trailer
park zoning be obtained, if possible, for reference. It was further directed that
Mr. Whitnall be asked for recommendations for. the Planning Commissionts next meeting
as to zoning of trailer parks.
REQUEST FOR CHANGE OF ZONE A, Portion of "J" Street Annexation - Myron Dalseth
An application for change of zone from R-1 to R-3 of a portion of 11P Street
annexation was read. ,
It was moved. by Member Culnan, seconded by Member Bendickson and carried that the
application be referred to Mr. Whitnall for recommendations prior to the setting
of a; public hearing.
REQUEST FOR EXTENSION OF TIME ON A SETBACK VARIANCE - Fifth and Flower - Florence Rehfielc
A letter was? read from Miss Florence Rehfield requesting she be granted an extension
of time on a variance granted previously for the -reduction of setback on Fifth and
Flower Streets, Miss Rehfield stated that a: series of accidents has prevented her
from completing construction contemplated when the variance was: granted.
It was moved by Member Calkins, seconded by Member Bendickson and carried that Miss
Rehfield be granted an additional year to use the setback reduction granted for
construction of multiple units on the southeast corner of Fifth and Flower. Miss
Rehfield was granted a reduction from 30 to 20 ft. on Fifth and from 301 to 15, on
Flower Street.
FIRST MEETING IN SEPTEMBER
It was noted that because the first Monday in September is a holiday, the Commission
shall have its regular meeting on Tuesday, September 2, 1958®
