PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
September 2, 1958
The regular meeting of the Planning Commission was held on-the above date in Council
Chambers at Civic Center at 7:30 P.M. with the following members present: Crear,
Sparling, Calkins, Stewart and Culnan. Absent: Members Bendickson and Adams. Also
Present: City Attorney Kugler and Associate Engineer Manners.
APPROVAL OF MINUTES:
It was moved by Member Culnan, seconded by Member Calkins and carried that the minutes
of the meeting of August 18, 1958, be approved, copies having been mailed to each member.
PUBLIC HEARING - Request for Change of Zone from.R-3 to C-1 in the 200 Block of "E"
This being the time and place as advertised,' Chairman Stewart opened the hearing and
asked for the reading of the application requesting the above rezoning, as shown on map
submitted.
Mr. Robert Brown., speaking for Dr. Haig C. Merigan, explained that it was not intended
that the existing apartment units would be razed in the immediate future; that it was
felt the rezoning would be necessary for possible future development. Protests were
heard from Mr. Colmar of 2112 Del Mar, Fred 29isley of 197 Tmin Oaks Circle, A. Lansley
of 198 Lansley Tray, R. Runde of 2211 Del Mar, D. Meyer of 211 "E"., R. Cleeland of 191
Twin Oaks Circle, Frank Barger of 229 "E" and Mrs. Eitzen of 228 Del Mar. A show of
hands indicated that a total of 16 persons protested the granting of the zone change.
Mr. Brown asked that the hearing be continued to the next meeting so that Dr. Merigan
could be present. It was moved by Member Crear, seconded by Member Sparling and carried
that because the hearing had been requested, advertised and held accordingly, that the
request.for continuation of hearing be denied.
There being no further comment, Chairman Stewart closed the hearing.
It was moved by Member Culnan, seconded by Member Calkins and carried that the app-
lication for rezoning property on the south side of "E" in the 200 block, from R-3 to
C-l. or C-2 be denied for the reason that evidence presented does not indicate that
either public necessity, convenience, general welfare or good zoning practice require
the change of zone.
PUBLIC HEARING - Request for Change of Zone - 746 Church Avenue
This being the time and place as advertised, Chairman Stewart opened the hearing and
asked for the reading of the application requesting a change of zone from R-1 to 0-1 of
the property at 746 Church, as shown on plans submitted.
.A. letter was read from Mrs. Kavanaugh, owner of property at 732 Church, approving the
zone change. Comments favoring the zone change, and/or a change of zone for the entire
block, were heard from Mr. J. D. Perkins, 728 Church and Mrs. T,Tary Harmstead, 740 Church.
There being no further comment, the hearing was closed,
It was moved by. Member Calkins, seconded by Member Culnan and carried that the petition
for change of zone from R-1 to C-1 for the property at 746 Church be denied for the
reason that evidence was not presented indicating that public necessity, convenience,
general welfare or good zoning practice require the change.
PUBLIC HEARING - Amending M-2 Section to Allow Specific Uses
This being the time and place as advertised, Chairman Stewart opened the hearing and
asked for the reading of the proposed amendment to the Zoning Ordinance, which would
list some of the uses to be specifically allowed in the M-2 zone and appurtenant uses
which would exceed the height limit in the zone.
Mr. Frank DeVore thanked the Planning Commission for consideration of the problem of
the San Diego Gas & Electric Company in developing the steam generating plant in the
Industrial. Lands annexation. There being no further comment,. the hearing was closed.
RESOLUTION N0. 108 - Recommending to City Council an Amendment to Ordinance 398
Which Will Allow Specific Uses In The M-2 Zone and Pertinent
Accessories To Exceed The Height Limit Specified By Ordinance
Offered by Member Culnan, read in full, passed, adopted and approved by the following
vote, to-wit:
AYES: Members Culnan, Crear, Sparling, Calkins and Stewart
NOES: none
ABSENT: Members Bendickson and Adams,
TENTATIVE MAP - Delbro Tract - North from Alvarado, East of Safeway
The tentative maps of Delbro Tract, proposed for development of a land-locked parcel.
east of Safeway Market on Third Avenue, were presented to the Commission and a letter
from the Fire Department, approving the map, was read. A letter was read from the
Engineering Department approving the map with certain conditions.
It was moved by Member Crear, seconded by Member Culnan and carried that the tentative
map of Delbro Tract be approved and recommended to the City Council subject to the
following conditions:
1. That the cul-de-sac have a 50 foot radius.
2. That a 10 foot building setback be observed around the cul-de-sac.
3. " That Engineering Department requirements be complied with.
FINAL MAP - Delbro Tract - North from Alvarado, East of Safeway
The final maps of Delbro Tract were then submitted and Associate Engineer 10anners stated
that the engineering check is near enough completed that they would recommend approval
of map subject to final engineering check.
It was moved by Member Culnan, seconded by Member Calkins and carried that the final map
of 'Delbro Tract be approved and recommended to City.Council subject to the follovdng
conditions:
1. That the cu]-de-sac have a 50 foot radius.

2. That a 10 foot setback be maintained around the cul-de-sac.
3. All Engineering Department requirements be complied with.
4. If the Council. requires changes on the tentative map, that the final
map be returned to the Planning tCommission.
FINAL MAP - Dalseth Hills #3 - East End of "J"
As final maps were not complete in all. details, no action was taken.
ZONE VARIANCE - J. W. Spangler - 2nd Lot East of Thrid, North Side of "Dir
The application was read requesting a variance from R-T to R-2 of property located'
approximately 150 feet east of Third on the north side of "D" Street.
Mrs. Spangler and Mr. B. H. Moore spoke favoring the granting of the variance.
It was moved by Member °Culnan, seconded by Member Crear_and carried that because
evidence was not presented indicating a hardship on the property, making a variance
necessary for the preservation of a substantial property right, that the variance be
denied.
ZONE VARIANCE - S. Tavolacci - 150 Broadway
The petition was read requesting that the applicants be allowed to develop the west 475
feet of his property, zoned R,-32 with a motel which is a permissible use for the east
125 feet of his property, zoned C-2. Plans were submitted showing the proposed develop-
ment and the applicant requested that they be, granted 365 days before the variance expires.
It was noted that the property in question will be land-locked if not used with the
frontage, and that there is a trailer park on one side of the property and a car wash
on the other.
Mr. J. H. ldcMurry and Mr. Clint lviatthews spoke favoring the granting of the variance.
It was moved by Member Sparling, seconded by Member Calkins and carried that the
applicant be granted permission to construct a motel on the property on Broadway, a
C-2 use, extending the development into' the rear 475 feet of the property, which is
zoned R-3; further, that the applicant be granted 365 days for use of the variance
rather than the 180 days provided by ordinance; that the variance be granted for the
reasons that the property will be land-locked if it cannot be used in connection with
the frontage, that because a zone boundary divides the property, it cannot be used to
its: best and highest use and it will not be ,detrimental to adjacent properties.
SETBACK VARIANCE - M. O.'Ferguson - 398 Hilltop Drive
Mr. Ferguson's application was read requesting permission to construct a house on the
corner of Hilltop and "G", using a 15 foot setback on Hilltop rather than the 30 foot
setback required by ordinance. The architect, H. Leibert, stated that the house will
front on "G" Street and that the application is made necessary because of the fact,
that two large setbacks along streets are required.
It was moved by Member Crear, seconded by Member Calkins and carried that the applifthton
be granted a reduction in- setback on Hilltop from 30 to 15 feet for construction of a
house with the condition that the house front on nGli Street. Further, that the variance
be granted for the reasons that two such large required setbacks deprive the owners of
too much land, making it hard to build a house compatible with the neighborhood, that
the reduction in setback will not be materially detrimental to- adjacent properties.
LAYOUT OF PROPOSED SUBDIVISION, — Lot A, Roseview (Madeline Court)
Mr. J. D. Peters and Mr. Wayne Smith request Planning Commission approval of a layout of a
proposed subdivision which will have a street less than the required 40 foot width. It
was explained that the 'Commission had previouslygone on record as favoring the eventual.
use of the 29 foot lot for street purposes to open up land-locked property within the
block and to continue King Street through to Second from First. The subdivision ord—
inance establishes a minimum 40 foot street width.
The Commission indicated they would approve such a width street and recommend it to City
Council if subdivision maps gave evidence that it would be the best way to develop this
land—locked area. Mr. Smith requested that the tentative map of the area, to be known
as Madeline Court, be placed on the agenda for the September 15th meeting.
APPROVAL OF TRAILER PARK — 600 Block "Gil Street — Harry J. Krause.
The matter, having been held over from the August 18th meeting, was considered with
respect to location of sewer lines to be put through the Krause property and with respect
to whether or not a provision for Woodlawn north from "Gil Street should be made. It was
determined that the sewer lines will go through the property and that their locations have
been figured closed enough so that the plans need not be delayed. Chairman Stewart
stated that the study requested with regard to a possible provision for Woodlawn had
been presented.
It was moved by Member Culnan, seconded by Member Calkins and carried that the applicant
having presented evidence asrrequired by ordinance--that the property is zoned correctly,
that a trailer park will create no dangerous traffic congestion, that it vrill not be
detrimental to adjacent uses nor general welfare, nor will it interfere with enjoyment
of adjacent residential uses--that the Commissionapprove the location ofa trailer park
subject to the following conditions:
1. That the trailer park be constructed and maintained to the satisfaction of
the Building Department.
2. That construction be delayed until such time as the city can put through its
sewer line, in accordance with agreements now being negotiated.
MORGAN ANNEXATION — Uninhabited Territory — East End of Emerson
Maps. were presented showing the location of a proposed annexation of 72 acres lying
at the easterly end of .Emerson.
It was moved by Member Calkins, seconded by Member Culnan and carried that the Planning
Commission recommend to the City Council the annexation of 721 acres known as the morgan
Annexation.
REQUEST FOR ZONE CHANGE — M. Dalseth — West of Proposed East »Jt Street School Site.,
Chairman Stewart explained to the applicants that the city has an opinion from Mr.
Whitnall as to the use of land vri.th broken topography for multiple residences, but
that a complete recommendation on this application for change of zone could not be made

until the survey work for a master plan now being conducted is completed. He explained
that in addition to topography, consideration must also be given to the proportion of
multiple residential zoning as to other residential zoning and also the relation to
surrounding proposed developments. Mr.-Dalseth and Mr. Alley explained to the Commission
that they are attempting to secure financing now available for multiple residential and
will need action on the change of zone before a request can be made for the financing.
Chairman Stewart directed that Mr. Nbitnall be sent a copy of the application with the
request -that, if at all possible at this time, a report be made to the Commission and
that if such a report is available for the Sept. 15th meeting, ,the Commission may then
set a public hearing for October 6th.
SETBACK VARIANCE — Archie A. Montgomery — 28 nJ" Street
Mr. fiontgomery's. request, held over from August 18th meeting, for permission to divide
his property into three-R-1 lots, serving the two rear lots via- an easement, was
considered. A map was presented showing adjacent properties and the Hilltop and First
Avenue frontages through which a street must pass to serve the interior of the block
and-Mr. Montgomery's rear property. The Commission concurred that it does not appear
feasible to develop the rear portion of this large lot in any manner excepting an
easement from IPJ".
It ,was moved by Member Sparling, seconded by Member Culnan and carried as follows:
That Mr. Montgomery's request to divide his property into three lots and build on the
two rear lots via an easement to PIJPP be approved subject to the following conditions:
1. That the easement be a minimum 20 foot width and be surfaced with plant mix.
2. That curb returns be constructed at the easement entrance on IPJ".
3. That the property be divided and recorded as separate 7,000 sq* ft. lots
before a building permit is.issued.
ZONING CLASSIFICATION FOR TRAILER. PARKS
fihe Commission directed that the matter be placed on the agenda for the next meeting.
CENTER STREET .OPEWBG — East from Fifth
The,-Engineering Department reported that they are not ready with a report as to poss—
ibility of'a cul-de—sac at the easterly end of Center Street. The Commission directed
that the matter be on the agenda for the next meeting.
APPEAL OF ZONE CHANGE DENIAL — Fourth and PPEPP Streets — James Connolly
The Chairman requested that the appeal from Planning Commission action in denying the
zz►ne change at Fourth and 'PEPP be' read.. The Commission directed that the information
necessary to answer the appeal be compiled and presented at the next meeting.
APPEAL OF ZONE CHANGE DENIAL. — West of Woodlawn between ChiRa Vista and- I'D"
The appeal to the City Council from Planning Commission action in denying a zone change
for the west side of Woodlawn between PPD" and Chula Vista was read. The Commission

directed that the information necessary to answer the appeal be compiled and presented
at the next meeting.
UNINHABITED ANNEXATIOkIS
Chairman Stewart explained to the Commission that the secretary would like a statement
from the Commission as to whether they wish to review and make recommendations on
annexations of uninhabited territory before they go to City 'Council. The Commission
expressed the opinion that any annexation has a connection with planning; therefore
the annexation maps should be reviewed by the Commission.

CIARIFICA TION OF ZONING ORDINANCE CLASSIFICATIOIV OF "CLINIC"
It was explained that the Zoning Ordinance specifies that professional offices shall
be allowed in the C-1 zone and that clinics shall be classified a C-2 use but that the
ordinance does not define "clinic."
The Commission-directed that the matter be presented.to the new Director of Planning
for recommendation when he assumes his duties.
REQUEST FOR APPROVAL OF TENTATIVE LAYOUT OF STREET OPENING
Mr. A. B. Ellington presented a map showing the proposed development of land at the
northerly end of Elder Avenue below "I" Street. This development would add a cul-de-sac
to the existing dead-end of Elder and provide frontage for two lots. kir. Ellington
requested an indication from the Commission as to whether they would approve the dead-
ending of the street. The Commission stated that because evidence at hand indicates
that it is not likely Elder can be continued through to "I", it appears to be a.
practical development and that formal approval can be given'when the improvement plans
are ready to present to the ;City Council.
COMMUN TCA TIONS
A letter was read from Mrs.Crosser, 626 Elder Avenue, calling attention to a fire
hazard across from the Boyts Club. She also asked whether or not something can be
done to put Elder through north to "I". Among other faults of the dead-end street,
trucks, and cars are forced to turn around in driveways.
A letter was read from the Fire Department stating that the wooden fence and grass
referred to across from the Boy's Club does not constitute a fire hazard.
The Commission directed that a letter be written to Mrs. Crosser explaining the pro-
posed development of the and of Elder Avenue and further explaining that the Fire
Marshal has reported that the condition of the property across from the Boy's Club
cannot be considered a fire hazard.

REQUEST FOR CHANGE OF ZONE - Between Fig and Fourth, Shasta and "I"
The application requesting change of zone for the above property was read and the
Commission directed that a hearing be called for October 6th meeting.
REQUEST FOR LOCATION OF A TRAILER PARK - North of the Trailer Park, South of "D" and
West of Woodlawn
A request for approval of location of a trailer park to be constructed north of the
trailer park on the west side of Woodlawn, south of "D", was presented. The Commission
directed that a hearing be set for the 6th of October.
PROPOSED AMENDMENT TO SUBDIVISION ORDINANCE
Engineer Manners stated that the Engineering Department expects to propose to the City
Council an amendment to the Subdivision Ordinance which will affect the procedure for
submission� of maps and requested that the Commission approve such proposed amendment.
It was moved by Member Culnan, seconded by Member Calkins and carried that the
Planning Commission recommend to -the City Council.-that the Subdivision Ordinance be
amended with regard to procedure on maps as outlined by the Engineering Department.
PROPOSED STREET GUIDE
Engineer Manners presented a map to the Planning Commission which he would like to
suggest be used as a guide for our major streets in the area east of Chula Vista. He
stated that it is not expected that it be followed as would a precise plan under a
master plan, but feels it would serve very well as a guide until such master plans
are completed.
It eras moved by Member Crear, seconded by Member Sparling and carried that the map
presented, dated September 2, 1958, be approved for use as a guide in the development
of main streets to the east until such time as precise plans are completed.
