OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
September 15, ,1958
An adjourned regular meeting of the Planning Commission .of the 'City of Chula Vista
was held on the above date at 7:30 P.M. in. the Council Chambers at Civic Center, with
the following members present: Crear, Sparling, Calkins, Stewart, Bendickson and
'Culnan. Absent: Member Adams. Also Present: Planning Consultant Whitnall, Principal
Engineer Harshman and City Attorney Kugler,
APPROVAL OF MINUTES:
It was moved by Member Calkins, seconded by Member Culnan and carried that the minutes
of the meeting of September 2,. 1958, be approved, copies having been mailed to each
member.
SETBACK VARIANCE - John Cowley and Anna Miller - South Side- of Center, 400 Block.
The application was read requesting the reduction in setback from 25 to 15 feet for
the properties on the south side of Center, going east from Fifth Avenue. Favorable
statements were heard from Mr. Cowley, Earl Brown, Mr. Kenworthy and Bill Robinson
from Rand-Fletcher. Protests were heard from Lloyd Ribeau, S. Carroll, N. Renick and
a letter protesting was read from Mr. and Mrs. Alton Parsons. A protesting petition
was read signed by Mr. and Mrs. Ned Renick, Mr. and Mrs. Lloyd Ribeau, Mrs. Carroll
and Mrs. McNeely.
It was explained by the applicant that, after dedicating .16 feet for street purposes,
there is not sufficient property depth .to build the proposed multiple units without
having to allow for a large drainage course across the south part of their properties.
It was moved by Member Culnan, seconded by Member Sparling and carried, with Members
Crear and Bendickson voting "no", that the request for reduction in setback from 25
to 15 feet be granted for the reason that there are unusual circumstances about the
property which would deny a reasonable property right - as shown following - unless
a .variance is granted: 1. That the applicants dedicated 16 feet for street purposes,
which 16 feet would have provided part of the required setback. 2. That one house
is already located on the south side of, Center with a 15 foot setback. 3. That
because of the topography'of the lots, if forced to observe a 25 foot setback, the
applicants will have considerable difficulty with a large drainage course through the
south part of their property. 4. That the houses on the north side of Center pur-
portedly do not observe ,a 25 foot setback.
TENTATIVE MAP - Madeline..Court - East of Second, North of "J" 'Street.
Tentative maps of Madeline Court were presented and a letter -read from the Engineering
Department recommending approval. It was noted that this subdivision will develop the
land lying north of "J" and east of Second which is, at present, used as a nursery,
and that the city has a 29 foot wide lot A extending along the northern edge of this
property from the existing King Street on the east to Second Avenue. The developer
proposes to use this 29 foot strip for the street to serve lots cut from the nursery
property and has added sufficient footage to make a travel-way acceptable to the
Engineering Department even though it does not meet minimum requirements of the sub-
division ordinance. Chairman Stewart stated that the Commission had gone on record
previously to the City Council that it was felt that the through access from First
to Second was needed at this location and that.the nursery property could not be
developed except by using this 29 foot strip.

RESOLUTION NO. Recommending to City Council That the Street Width Requirement
of Ordinance 377 be Suspended for Madeline Court Subdivision
Offered by. Member Bendickson, read in 'full, passed, adopted and approved by the
following vote, to-wit:
AYES: Members Crear, Sparling, Calkins, Stewart, Bendickson and Culnan
NOES: none
ABSENT-: Member Adams
It was moved by Member Sparling, seconded by Member Calkins and carried that the
tentative map of Madeline Court be approved and recommended to the City Council
subject to the following conditions:
1. That the text of Resolution No. 109 be accepted by City Council.
2. That Lot A, of Roseview be dedicated for street purposes,
3, That the curb at the westerly end of the cul-de-sac on King Street
be broken and the cul�de,sac be connected with.the proposed King
Street in a manner approved by the Engineering Department.
4. That Engineering Department requirements be complied with.
5, That parking be prohibited on the north side of the new King Street
for its entire length and on the south side of the new King through
the narrow portion,
TENTATIVE MAP � Seaview Estates - East of Kellogg School, North of Naples.
The map of Seaview Estates Subdivision was presented to the Commission with re-
commendations from the Planning Department shown in red and a letter of recommendation
was read from the Engineering Department.
It was moved by Member Sparling, seconded by.Member Culnan and carried, with Member
Crear voting "no", that the tentative map of Seaview Estates be approved and
recommended to the City Council, subject to the following conditions:
1. All streets be extended as shown in red on the map except that Neptune
shall dead-end at Melody Lane and Montclair shall dead-end at Nacion.
2. That 1 foot lots, as shown in red, be dedicated to the City.
3. All lots' be a minimum 7,000 square feet in area,
4. That 20 foot setbacks be maintained except where they are shown in red
as 10 feet,
5. . That street names be approved as shown in red,

Member Crear stated that in voting "no", he was actually protesting approving sub-
division maps without more information,regarding provisions for streets and without
some study being developed regarding a more restricted residential area with larger
lots in the back-country.
REZONING OF A PORTION OF "J" STREET ANNEXATION - M. J. Dalseth
An application was read requesting rezoning from R.-1 to R-3 of a portion of the "J"
Street Annexation, that portion lying west of the school site and north of the
proposed "'J" Street extension. The Commissiondirected that a public hearing be set
for the 6th of October for consideration of the application.
ZONING _CLASSIFICATION FOR TRAILER PARKS
Chairman Stewart described zoning classification for trailer parks in other cities,,
Mr. Whitnall stated that when considering and comparing what other cities require, that
different elements and circumstances are involved in different localities so that quite
possibly the same classification will not serve equally well.-
The Commission concurred that before a public hearing could be called, the Commission
must be sure as to what recommendations they intend to make to the City Council. It
was: directed that the matter be placed on the agenda for the next meeting and that Mr.
Whitnall bring his recommendation as to correct classification as well as a good
ordinance governing only trailer parks. . The Commission-further directed that the staff
attempt to get a copy of the Palm Springs trailer park ordinance as well as their
zoning classification.
APPROVAL OF LOCATION OF TRAILER PARK - Muster Corp. - East of Freeway
An application was read and plans presented for a proposed trailer park to be located
within the Industrial Lands Annexation, south of Moss, between Industrial Boulevard
and Montgomery Freeway. The Commission directed that the matter be set for hearing
for the meeting of October 6, 1958.
PROPOSED STREET OPE[VING - Elder Below "I" Street
Maps showing g the proposed development of property at the northerly end of Elder below
"I" Street were presented showing the construction of a partial cul-de-sac which would
serve as: frontage for two lots. It was explained that the applicant requests that the
Planning Commission start •procedures: for establishing the proper setback around the
cul-.de-sac and Planning Commission approval as "to radius of the cul-de-sac. "
The Commission directed that'a public hearing be set for October 6th for consideration
of establishment of 10 foot setback around-the cul-de-sac. It was further directed
that more precise information with regard to the property cuts be- submitted at the
meeting,
PROPOSED CUL-DE-SACC FOR CENTER STREET
A report was submitted to the Commission showing the three possibilities for location
of a cul-de-sac at the.easterly end of Center, east of Fifth. The Commission agreed,
upon recommendation from the Engineering Department, that a cul-de-sac east of existing
right-of-way appeared to be the most feasible and practical and directed that the
matter be brought back to the Commission after a city representative -contacts property
owners involved, regarding dedication.

APPEAL OF PLANNING COMMISSION ACTION ON DENIAL OF REZONING - James: Connolly
An appeal was read from Planning Commission action in denying rezoning from R-1 to C-1
of the two properties on the southwest corner of Fourth and "E". Chairman Stewart
requested that the Planning Commission' s findings be read.
It was moved by Member Bendickson, seconded by Member Crear and carried, .with Members
Sparling and Culnan voting "no"„ that the Planning Commission findings, as read, be
approved and forwarded to City Council along with 'the appeal filed by Mr. Connolly.
APPEAL OF PLANNING CMIISSION ACTION ON DENIAL OF REZaTING - Hal Johnson
An appeal was read from Planning Commission action in denying rezoning from R..3 to MI-1
of the property on the west side of Woodlawn between "D" Street and Chula Vista Street.
After the reading of the Planning Commission findings with regard to the appeal, it
was moved by Member Culnan, seconded by Member' Cal.kins and carried that the findings
be approved and forwarded to Council, as approved.
PLANNING COMMISSIad DENIAL ON REZCNING OF A PORTION OF 200 BLOCK OF "E"' STREET - Haig
Merigan
The appeal from Planning Commission action on denial of the petition for commercial
zoning was not submitted as expected. No action taken.
PROPOSED DEVELOPMENT - South Side of "J", East of Madison
Wayne Smith, Engineer, presented plans showing development of the land on the east
side of Madison, south side of "J". This multiple dwelling development will dead-
end Riverlawn Avenue. Mr. Smith explained to the Commission that the property can
be developed as planned because the property is zoned R-3, but that they would like
to request' that the Planning Commission recommend to the City Council that the 1 foot
lot on the north end of Riverlawn Avenue be de_dicated ,for street purposes. If the
1 foot lot is dedicated, then the developers of the property in question may use the
street as access to off-street parking for the multiple units. Mr. Smith also ex-
plained that there is a 1 foot lot along the eastern edge of Madison which will need
to be dedicated for street purposes after the developers complete necessary improvements
on Madison.
It was moved by Member Culnan,' seconded by Member Crear and carried that the
Planning Commission recommend to the City Council that the 1 foot lot along the
eastern edge of Madison be dedicated for street purposes after necessary improvanents
are completed 'and that the one foot lot on the northern end of Riverlawn below "'J"
be dedicated to street purposewrbecause with the proposed development it will not be
desirable to extend Riverlaim through to "J".
REQUEST FOR LITTLE LEAGUE SITE -APPROVAL
A letter was read from Mr. Phillip Mednick, President of the South Bay Little"League,
requesting Planning Commission approval of construction of a ball park on Pope Pius X
church property for use by South Bay Little League players.
Dr. C. Lauderbach, Superintendent of Chula Vista Elementary School District, stated
that it is a policy of the elementary district not to grant permission to use school
grounds. Because of the apparatus on school grounds, they do not lend themselves to
a ball park. City Attorney Kugler ruled that such a recreational facility is not a

permitted use in the R-1 zone in Chula Vista and that it may be considered a C-2 use.
The Commission directed that a letter be written to Mr. Mednick explaining that the
Commission could not approve the site for a Little League ball park because it is
not a use permitted in the R_l zone, and that their action is not in any way an
expression of their- opinion with regard to Little League teams.
APPROVAL IN GENERAL OF STREET ALIGNIEN T IN VICINITY OF JUDSON SCHOOL SITE
Mr. Victor Wulff and Dr. C. Lauderbach presented maps to the Commission and requested
that the Commission indicate their opinion as to whether or not streets around Judson
School Site, as shown on the maps, will coincide with plans the city might have. The
plans were compared with a study begun by the Planning and Engineering Departments so
that the Commission could consider the over-all street plan in the area.
The Commission concurred that, with evidence at hand with regard to topography and
developments: of adjacent areas, the plans, as shown' appear to be satisfactory.
REQUEST FOR CHANGE OF ZONE .- "J"' Street at Broadway
An application was read requesting rezoning from R-1 to C-2 of the property now
occupied by the Wilson Trucking Service on "J" Street at Broadway. The Commission
directed that a. public hearing be set for the 6th of October.
FINAL MAP w Dalseth Hills #3 - East End of "J" Street
Final maps of Dalseth Hills #3, located at the east end of "J" Street, were presented.
It was moved by Member Calkins, seconded by Member Bendickson and carried that the
final maps of Dalseth Hills #3 be approved subject to compliance with requirements of
tentative map, and further-subject to requirements of the Engineering Department and
the Planning Department.
DISCUSSION
The need for meetings with the Planning Consultant for discussion of planning problems
and principles in general and for discussion on preparation of a Master Plan, was
discussed. Mr. 14hitnall offered to meet with the Commission as often as possible for
a Planning "Clinic" so that a common understanding of planning functions could be
reached. The Commission welcomed the opportunity and the mid-month meeting of October
was set for the first of the meetings to be held with Mr. 1,Phitnall, as well as other
City officials.
