OF THE PLANNING COWISSION OF TIE
CITY OF CHULEA VISTA, CALIFORNZ
October 20, 1958
A regular adjourned meeting of the Planning Commission of the City of Chula Vista
was held on the above date in Council Chambers at .Civic Center at 7:30 P.11., with
the following members present: Sparling, 1;alkins, Stewart, Bendickson,-Adams and
Culnan. Absent: TTember Urear. Also Present: Director of Planning Fretz, Planning
Consultant Whitnall., City Attorney Kugler and Principal Engineer Harshman.
APPROVAL OF MINUTES:
It was. moved by IuTember (Calkins, seconded by Member BenAickson and carried that the
minutes of the meeting of October 6, 1958, be approved, copies having been mailed to
each member.
ZONE VARIANCE J. 1A. Bannister Development Company - South Side of !'E", East of Freeway
This being the time and place as advertised, Chairman Stewart opened the-public hearing.
The application was read and Director of Planning Fretz displayed plot plans and ex-
plained that this application supplements one previously granted which will allow
construction and operation of abowling alley, a C-2 use, in an R-3 zone. Mr. Fretz
explained that the variance previously granted applied to property having 163 feet
frontage on "E" Street and that, because of as change of plans for the building, the
applicant is requesting that an additional 82 foot frontage be included.
There being no further comment, the hearing was. closed.

It was moved by Member Adams, seconded by Member Culnan and unanimously carried that
the application be granted as above outlined, subject to conditions listed below:
1.. That 5 parking spaces be provided and maintained for each alley, with
a. minimum of 120 spaces.
2. That a 25 foot setback be maintained along "Ell Street and not be used
for off-street parking.
3. That air-conditioning be installed in the building so 'that windows will
not be left opened and thus create a noise nuisance.
4, That final plains be submitted to the Commission prior to construction.
Further, that the variance be granted for the reasons that this property is not
suitable for residential construction due to the proximity of the railroad track'
and the freeway, that the proposed development is a good use for the property and
that it will not be materially detrimental to any- of the surrounding property.
SETBACK VARIANCE - William Howarth - 117 King St.
The application was read and Mr. Fretz presented plot plans of the property and
explained. that the applicants were requesting a. reduction in rear yard setback from
20 to 10 feet for the purpose of adding a. room to the house. Mr. Howarth explained
that this .was the only place a room could be added to the house. A letter was. read
from Dr. R. Kelly stating that the addition of a bedroom to the house is required
because a private bedroom is necessary for lairs. Howarth's health.
It was moved by Member Bendickson, seconded by Member Adams and carried that the
application for a. reduction in rear yard setback from 20 to 10 feet be denied for
the reason that evidence was not presented indicating that there are exceptional
conditions applicable to the property which denies the applicant of a reasonable
property right.
SETBACK VARIANCE - Leroy and Mary Kratzer - 51 East "J" Street
The application.was read and Planning Director Fretz explained and indicated on a.
plot plan that the applicants are requesting a reduction in east side yard setback
from 5 to 22 feet for the purpose of constructing an attached screened patio. The
applicant stated that it would not be desirable to put the entrance door to the patio
on the side of the building within the required 5 foot setback, therefore, 'he would
like a reduction in setback to give room on. the front of the proposed building for
an entrance.
It was moved by Member'Adams, seconded by Member Sparling and carried that the app-
lication be denied because evidence: was not submitted indicating conditions applicable
to the property which will deny the owner of a reasonable p'' e�ty right.
SEAVIE LT ESTATES, UNIT 1\10. 1 - Final Map - East of Kellogg School, North of Naples
The final map of Seaview Estates, Unit No. 1, was presented to .the Commission and Mr.
Fretz described its location with respect to existing streets and other developments.
It was moved by member Culnan, .seconded by Member Calkins and carried that the final
map of Seaview Estates, Unit No. 1, be approved and recommended to City Council.
APPROVAL OF TRAILER PARK LOCATION - ,Hal Johnson - West of 0f"oodlawn, Forth of '"D" Extended
Director'of .Planning Fretz reviewed the request and-stated that the matter had been
held over from the la.st meeting to determine whether or not access to and from the
proposed trailer park across the R-3 portion of the property is a proper use. Attorney
Boyer, speaking for Mr. Johnson, stated that he has presented a letter to the secretary
signed by the owners of the property stating" that they have been unable to sell or
lease the land for industrial use and that it has proven economically impractical to -
keep the land under agriculture; therefore, they feel that the trailer park plan would
be the best use for their property.

Attorney Kugler stated that a. private road to serve the M--1 property, across the R-3
frontage on Woodlawn,• is not in violation of the ordinance.
Chairman Stewart stated that he feels there are other considerations--the development
of the R-3 portion of the property, what street improvements on ffoodlawn will be
needed'to service that development as well as the added traffic from the trailer park
and the outcome of the Council's public hearing on Mr. Johnson's request for &1-1 -
zoning for the R-3 portion of the property.
It was. moved by Member Culnan, seconded by 'lember Calkins and carried that the matter
be continued until the results are known of the public hearing before the City Council,
on the rezoning to M-1 of the R-3 portion of the property. .
Attorney Boyer agreed that the matter be continued to the meeting on December lst.

# REZONING MATTER ON FOURTH AND "KP - Bagnell and Madden
Commission Secretary Stonehouse explained that the Council. had affirmed the action of
the Planning Commission in recommending denial of the application for zone change from
R-1. to R-3 for property located at Fourth and "K" Streets but they referred the matter
back to the Planning Commission with the recommendation that a zone variance be con
sidered for.the area.
The Planning Commission directed that the staff confer with the owners of this property
with respect to submitting an application for zone variance.
EXTENSION OF TDIE ON ZONE VARIANCE - George Kenworthy - 276 11K" St.
A letter was read from Tis. Kenworthy requesting that the Commission grant a 9 months
extension of time on a variance previously granted which allows the applicant to
maintain a stand on his R-1 property for the sale of flovrers raised on the premises.
It was moved by Member Bendickson, seconded by Member Culnan and carried that the
applicant be granted an additional 9 months time to operate the flower stand, under
the same conditions as on the original variance.
REZONING MATTER ON FOURTH AND "Ef" - James Connolly
Planning Director Fretz explained that the Council had affirmed the action of the
Planning Commission in recommending denial of the application for rezoning from R-l. to
rC-1. of the two lots; at the southwest corner of Fourth. Mr. .Connolly stated that he was.
not aware that the Council would take action at the meeting when they affirmed the
Planning Commission action, so was not present and that because of a statement in the
Planning Commission's record to the effect that they would not be opposed to R-3 zoning
for his lot, he would like to request that the Commission initiate a zone change from
R-1 to R-3 of hiss property.
The Elanning Commission concurred that there is no urgency in the interest -of the public
that requires the change and that this, area will be considered when the entire zoning
pattern is re-analyzed during master plan studies.
APPEAL OF APPROVAL OF TRAILER PARK FOR MUSTER CORPORATION
Appeals to Planning Commission action in approvinIg a trailer park location for the
Muster 'Corporation in the Industrial Lands Annexation, submitted by Mr. Ronald
Landells and Mr. Lorenze Koester, were read.
Mr. Milton Freedman, attorney for the Muster Corporation, asked about procedure with
regard to the appeals and specifically asked that the Commission, when submitting
their findings and recommendations, to Council, state that their- action in approving
the location was. unanimous. Chairman Stewart directed that when the Planning Commission's
findings are prepared, that it be noted that the Commission's original action was:
unanimous.
Mr. Vies, Mohr, industrial consultant, appeared• before the Commission. He asked what
effect Ordinance No. 517, which prohibits buildings and structures from being erected
in M-1 and Ni-2 zones.-has: on trailer park location in these zones. Chairman Stewart
informed Mr. Mohr that some time ago the same question was: asked by the Commission
of the City .Attorney. He submitted a: written opinion stating that an automobile
trailer is not ordinarily or commonly thought of as a building or structure and that,
in his opinion, an automobile trailer park is allowed in an M-1 and an M-2 zone. Mr.

Mohr said he felt that if trailer occupants are allowed to vote,. and they are, that
they certainly are residents.
The Commission directed that the appeal be placed on the agenda for the next meeting.
REZONING MATTER - Fourth to Fig and "H" to "I"
Director of Planning Fretz told the Commission that the Council had referred the
matter of rezoning of the property between Fourth and Fig and "H" and "I" back to ,
the Commission for further study because the lots, while developed as R-1, do not
have the minimum area of 7,000 square feet. The desirability of R-1 zoning for the
area was discussed and the Commission directed that the staff and the City Attorney
seek a reasonable solution to the problem.
ZONING FOR NEWLY ANNEXED LANDS
The need for pre-zoning of area around the city and the authority needed to affect
such pre-zoning was discussed. Mr. Fretz explained to the Commission that the City
Council had requested the Commission to make a study of this subject and report to
the Council at their first meeting in December.
The Commission directed that the matter be placed on the agenda for the next meeting.

Minutes corrected meeting of November 3, 1958.
The Planning Secretary explained that the Council had not accepted the Planning
Commission's recommendation to rezone property at the corner of Fourth and "K" from
R-1 to R-3 and had referred the matter back to the Commission with the recommendation
that a zone variance be considered for the development of the area.
