OF-THE PLANNING COMMISSION OF THR
CITY OF CHULA VISTA, CALIFORNIA.
November 3, 1958
The regular meeting of the Planning Commission of the City of Chula Vista was held
on the above date in Council Chambers at Civic Center, with the following membprs
present: Sparling, Calkins, Stewart, Bendickson, Adams and Culnan. .Absent: Member
Crear, Also :Present: Director of Planning Fretz, City Attorney Kugler.
APPROVAL OF MINUTES:
It was noted that the minutes: of the last meeting in the matter of rezoning of property
near "K"' Street and Fourth Avenue stated that the City Council had affirmed the action
of the Planning Commission in recommending denial of a request for zone change from
R-1 to R-3, and that actually the Commission had recommended that the change be made.
It was moved by Member Bendickson, seconded by Member Sparling and carried that the
minutes: be approved with the above correction,
TRAILER PARK LOCATION - Appeal from Commission Approval of Site Within Industrial
Annexation
Chairman Stewart reviewed the matter, stating that the Planning Commission should at
this meeting complete their findings with regard to the appeal of their approval of
a trailer park location for the Muster Corporation. He read a copy of the letter from
the Planning Commission dated July 20, 1958, recommending to the Council that an
emergency ordinance be adopted so .that trailer parks would no longer be allowed to
locate in an industrial zone and would be classed as a C-2 use,
It was moved by Member Sparling, seconded by Member Calkins and carried unanimously
that the report of findings be written and forwarded to the City Council and that the
findings include the following:
1. That requirements for location- of a trailer park as outlined in Ordinance
472, Section 5, had been met as shown below:
a. That the land is zoned Mv2, and trailer parks are an allowable use
in an M-2 zone.
b.. That the operation -and maintenance of a trailer park will not unduly
interfere with enjoyment of adjacent property devoted to residential use.
c. That the proposed use. will not result in dangerous automobile traffic
congestion with the conditions placed upon the construction of the trailer
park when the Planning Commission approved such location.
d. That the proposed use will not be materially detrimental to; the public
welfare or injurious to the property and property improvements in the
immediate neighborhood.
e. That it appeared and on the express condition that, all the provisions
of this ordinance will be complied with.
20 That the Planning Commission recommend--to the City Council that the
appeal be denied and the Commission action affirmed.
3. That the Planning Commissions original action in approving the location
of the trailer park was unanimously carried.
4. While there is no guarantee under the zoning ordinance as to eventual
zoning after annexation, the property owners; annexing were of the opinion
that they would have the privilege of developing their properties according
to existing ordinances,
REZONING OF PROPERTY BETWEEN FIG AND FOURTH "Hit_ AND"I"
Chairman Stewart reviewed the matter, explaining that the Commission recommended to
City Council that this area be rezoned to Rel from R«2 for the reason that it is
predominantly I.developed as R-1. The City Council had requested the Commission to give
the matter further study with regard to the proximity of Vista Square and with regard
to the fact that the lots: do not. have the minimum 7,000 square feet in area required
for an R-1 lot.
It was moved by Member Bendickson, seconded by Member Calkins and carried that the.
Planning Commission amend their previous recommendation that the area be rezoned to R@-1
and now recommend that it remain B-2, and further that the City Council suggest to the
interested property owners that they investigate the possibility of deed restrictions
to prohibit further R•-2development of the area, Member Sparling voted "No",
ZONE VARIANCE - John D. McKinney .- 398 "H10 Street.
The application Baas read requesting that a variance be granted allowing construction and
operation of a dry cleaning call-office, a.C_1 use on the R-3 lot, _and requesting the
following variances from area requirements in order that such a building may be erected:
1. Reduction in lot area from 6,.000 to 4032 square feet.
2* Reduction in lot frontage from 50 to 47*85 feet.
3o Reduction of setback on "H" from 20 to 17 feet.,
4,, Reduction of setback on Fourth from 20 to 8 feete
This being the time and place as advertised, Chairman Stewart opened the public hearing.
There being no comments favoring the variance and no protests., written or oral, the
hearing was, closed®
It was moved by Member Adams, seconded by Member Sparling and carried that the variance
be denied for the reason,that evidence presented does not indicate that there is a`hard§,
ship within the meaning of the ordinance that requires a zone variance for relief,
AREA VARIANCE - John and Mary Almond 541 "D" Street-
The application was read requesting that .the applicants; be granted permission to build
a. duplex on their R.-3 property which, as a result of a proposed lot split' will be
sub-standard in area, having 5,215.60 square feet, and substandard in lot frontage,
having only 40 fooj; frontage on a. dedicated streets It was: explained that the duplex

could be constructed under existing ordinance provisions, if the lot is not split.
Mrs. Almond explained that the applicants; proposed to split the lot so that in
financing the nes-i construction it will not be necessary to mortgage their home:.
It was- moved by Member Culnan, seconded by Member Sparling and carried that the variance
be denied for the reason that evidence presented does not indicate that the property
suffers; a hardship not applicable to other R-3 properties. Since the property is
zoned R.,3, the proposed duplex can be constructed without the lot split' resulting in
a sub-atandard lot.
TENTATIVE' MAP' ® Cindy Park Subdivision A East End of Inkopah
Tentative maps, of Cindy Park were presented to the Commission showing the proposed
development of 5 acres north of the new- Baptist Church Site.
It was moved by Member Bendickson, seconded by Member Culnan and carried that the
tentativ& maps of Cindy Park be approved., pending annexation, subject to the rec.
ommendations of the Engineering Department, and further subject to the dedication of
a 1 foot lot along the east line of Melrose and at the north and south ends of Melrose.
TENTATIVE MAP— Kile Morgan Terrace No. 2 ® East End of "L" Street
Director of Planning Fretz presented maps to the Planning Commission which show,
extensions of streets not shown on the map approved by the Commission® Mr# Fretz
explained that the Council had approved the map with these changes and that it was
being brought back to the Commission for their information. It wras explained that
no action is required from the Commission because the map was not basically changed.
WILLIAM A. BUFORD ANNEXATION A North of Baptist Church Annexation
Maps were presented showing the proposed annexation of 5. acresnorth of the Baptist
Church "Annexation and Director of Planning Fretz explained to the Commission that this.
annexation would be developed as Cindy Park Subdivision, approved earlier in the
meeting.
It was moved by Member Sparling, seconded by Member ,Calkins and carried that the
Planning Commission recommend to the City Council that the proposed annexation known
as; William A. Buford Annexation be accepted.
PREZ`ONING - Discussion
Chairman Stewart reviewed a draft of an ordinance which would provide for the permanent
zoning of land around Chula Vista which might in the future be annexed. The Commission
directed that the matter be placed on the agenda for the next meeting, to give the
Commission members opportunity to study the draft.
ZONING OF "E"' STREET - Between Montgomery Freeway and Broadway
Chairman Stewart directed that the matter of commercial ironing for "E"' Street between
the Freeway and Broadway be placed on the agenda for the next meeting and that the
Planning Department staff prepare necessary maps and data for a study by the Commissione
CASTLE PARK ANNEXATION STUDY - Member Sparling
Member Sparling explained to the Commission that various city officials, as well as the
Chamber of Commerce, have been approached by property owners within the Castle Park
areaas to what the city could offer the area if it were annexed. He explained that
the Area- Development Conmiittee of the Chamber of Commerce is planning to hold a
meeting in conjunction with civic groups in Castle Park and would request that city
officials attend to answer questions about possible annexation and available services
thereafter. Mr. Sparling stated that many people are of the opinion that the ordinance
in effect in Chula Vista, which zones all newly annexed lands to R.-1 until after-
necessary studies, was a factor causing misunderstanding and hesitation with regard
to this area annexing to Chula Vista. He stated that if a definite plan could result
from the Planning Commissionts next meeting with regard to the earlier-discussed
prezoning ordinance, it would be to the benefit of the city and would help clear up
any misunderstandings among the Castle Park residents: as far as zoning is concerned.
