PLANNING CaMSSION OF THE
CITY OF CHULA VISTA, CALIFORNIA:
December 1, 1958
The regular meeting of the Planning Commission of the City of Chula Vista was
held on the above date in Council Chambers: at Civic Center, with the following
members present: Sparling, Calkins, Stewart, Adams and Culnan. Absent: Member
Bendickson. .Also Present: Director of Planning Fretz, Principal Engineer Harshman
and City Attorney Kugler.
APPROVAL OF MINUTES:
Member Culnan offered the following corrections to the minutes of the meeting of
November 17th, 1958:
1. Line 3 of page 2 reading "and abuts good R-1 property whose owners object
to the rezoning", should read "and is in the immediate vicinity of RM1
property where the owners object to the rezoning".
2. That line 2 of the title of Resolution No. 111, on page 2 of the
minutes should read "Consider Rezoning from R-3 to C-1 and/or C-2 the
Land Between" rather than "Consider Rezoning From R-3 to C-2 and/or C-2
the Land Between".
It was moved by Member Adams, seconded by Member Calkins and carried that the minutm
be approved with the above corrections, copies: having been mailed to each member.
COMMUNICATIONS'
Appeal from Planning Commission Denial of Zone Change - Between Fig and Fourth and
"H11 and "I"
A letter was; read from Mr. Charles McKenna, appealing the Planning Commission denial
of a zone change from ftA2 to RPl of the property between "H" and "I" and Fourth and
Fig. Chairman Stewart asked for the reading of a report of the findings. Member
Sparling stated that he feels the area should be rezoned to R-1.
It was moved by Member Adams, seconded by Member Calkins and carried that the findings-
be approved as written and be forwarded to the City Council with the appeal. Member
Sparling voted "no".
Air Pollution Control Board
Director of Planning Fretz reviewed the request from the Air Pollution Control Board
that the city voluntarily submit to them any requests for location of industries. He
stated that the Council had agreed to this request and had forwarded the letter to
the Planning Commission for their information
Land Use � Napless and Vista - Bob Woods
Mr. Bob Woods stated that he had learned that the value of his R-1 property had
decreased because of the proximity of the shopping center at Hilltop and Naples. .He .
had been told by the F,HoA* that it would increase if it were zoned R�,2 and that, in
any event, R••1 zoning was not logical for property abutting the commercial area®
The Commission advised that if the other property owners in the area agree, the
Commission will consider an application for rezoning%
Vicinity of First and "D" ., Gene McMillin
Mr. Fretz reviewed the situation, stating that Mr, McMillin had applied to the Council
for permission to move a dwelling onto' a lot at First and "D" and that the Council
had referred the matter to the Planning Commission because the lot did not have the
minimum 50 foot frontage. A recommendation was; also requested as to the desirability
of a street extending north from "D" Street at First Avenue. Mr. Fretz a:Tlained to
the Commission that Mr. McMillin had obtained additional footage to provide 50 foot
frontage for the lot, No action was taken in reference to the street extension, the
general consensus of opinion being that a recommendationn should be predicated upon a
master plan,.
REZONING
SOUTH SIDE OF "J", EAST OF BROA dAY •- Elk's Lodge a R•-1 to C-2'
It was moved by Member Sparling, and seconded by Member .Adams that the application
requesting rezoning from Rwl to C-2 for the property on the south side of "J", east
of Broadway, be denied. The motion failed to carry,
It was moved by Member Culnan, seconded by Member Sparling and carried that the item
be dropped from the agenda,
REQUEST FOR REZONING Fourth and "E" James Connolly
An application was submitted by Mr. James Connolly requesting a change of zone from
Rdl to R'-3 of his property. , The Commission directed that a public hearing ba called
for January 5,:
VARIANCES
Casey Construction Company - North Side of "H", West of Fourth
This being the time and place as advertised, Chairman Stewart opened the public
hearing and asked for the reading of the application requesting a, variance allowing
development of R►-2 property with multiple residential units. Mr, James Patten,.
representing the applicant, presented a plot of the proposed development and stated
that there would be 120 dwelling units and two swimming pools, Mr. Patten explained
that they had not applied for a zone change, which appears to be proper for this
request, because of the time involved.' There being no further comment, the hearing
was closed,
Member Culnan stated that he could see no reason why the Casey Construction Company
should not be allowed to develop their property, there being no development along
"H It in that area that could be effected by multiple units.
It was; moved by Member Calkins, seconded by Member Sparling and carried, with Member
Stewart voting "no", that the applicant be granted permission to develop this: R-Z
property with multiple units. Further, that the action be based on the following
findings of facts
1. The variance is; necessary for the preservation of a substantial property
right.
2® That the granting of the variance will not be materially detrimental to
property and improvements in the area.

Mr. Lee Raitt requested that the Commission consider rezoning of the entire block
in the very near future. Mr. Al Boyer stated that if the Commission considers re-
zoning the block between Fourth and Fifth, he feels that the property from Fifth
to Broadway should also be considered for rezoning to Cr2,
Casey Construction Company - 498 Fourth Avenue -
This being the time and place as advertised, Chairman Stewart opened the public
hearing to consider an application filed by the Casey Construction Company for per-
mission to develop their entire lot at 498 Fourth Avenue with multiple units. The
property is: divided by a zone boundary, leaving 40 feet zoned R-2 and 12.5 feet zoned
R-3. There being. no comments' the hearing was closed.
It was moved by Member Culnan' seconded by Member Sparling and carried, with Member
Stewart voting "no", that the variance be granted for the reasons listed below'
with the condition that access to 1°H° and Fourth be subject to approval by City
Engineer and Karffrmg Departments

1. That the lot is divided by a zone boundary with only a small part
being zoned R-_2.
2. That the variance is: necessary for the preservation of a substantial

to property or improvements in the same area,.
Rose Zimprich - 583 Roosevelt
This being the time and place as advertised, Chairman Stewart opened the public
hearing and asked that the application be: read' The applicantsrequested that she
be allowed to construct a duplex on the rear of her R-2 lot, making a total of 3:
units, and further that she be granted a reduction in rear yard setback from 20 to
15 feet.
Mr. Coe, brother of Mrs. Zimprich, stated that there is commercial property within
one,.half block -of the property in question and that zone variances have been granted
in the same block. -Therefore, he feels that the applicant is entitled to a variance.
It was moved by Member Culnan, seconded by Member Adams and carried that the request
be denied for the reasons that there doesn't appear to be exceptional circumstances
about the property which qualify for a variance, that it would establish a precedent
in the neighborhood and because a duplex-would over-crowd the property.
Jesse C. Madden - 823 Fourth Avenue
This being the time and place as advertised, Chairman Stewart opened the public
hearing and asked that the application be read requesting permission to develop a:
portion of Mr. Maddents R-1 property with 5 dwelling units. Mr. Madden stated that
he has a total of 2621000 square feet in an R"l zone, of which approximately 16,000
is vacant and cannot be used without a variance, A letter was read from Fire Chief
George Lee approving the construction of additional units with access to Fourth on
a driveway, if the driveway is widened to 20 feet.
Protests were heard from Mr. Giardini, 351 San Miguel, Mrs. Bagnell, 821 Fourth,.. and

Mrs. Giardini to the affect that such a development would lower property values on
Szn Miguel, that five units would overcrowd the property and -that granting such a
variance would have the same result as the rezoning the Council had previously
denied covering this property.
It was moved by Member Sparling that the variance be denied for the reason that the
property can be, developed' as it has access to "K" through Mrs. Bagnell's property
and that this request is similar to the matter of rezoning previously denied. The
motion died for lack of a second.
No other motion being offered, Chairman Stewart asked that Director of Planning
Fretz talk with both Mr. Madden and Mrs. Bagne119 get their reaction to questions
and that every effort be made to develop the two properties from the "K" Street access.
SUBDIVISIONS
Suburban Heights, Unit No. 1 - Final Map
Mr. Fretz reviewed the map, explaining that it agrees with the conditions placed on
the tentative map and that the subdivider is providing access to the area by pro"
posing to develop the eastern one-half of Hilltop Drive in the County according to
Chula Vista standards. Engineering Department recommendations were reviewed.
It was moved by Member Sparling, seconded by Member Culnan and carried that the final
map of Suburban Heights, Unit No. 1 be approved and recommended to the City Council
subject to the following:
1® That a sewer easement, as, recommended by the Engineering Department, be
'dedicated to Chula Vista before the dedication of the right-of-way of
Hilltop Drive to the County,
2. Final engineering checkp
3. All conditions of the tentative map*
Country Club View. (Kale Morgan Terrace No,,, 2) .. Final Map
The final map of Country Club View and the Engineering Department's recommendations
were reviewed by Mrb Fretz,
It was moved by Member Adams,. seconded by Member Calkins and carried that the final
map of Country C1ub'View, formerly Kile Morgan Terrace No.. 2 be approved and re-
commended to the City Council, subject to the following conditions:
1.. Final engineering check.
2, Engineering Department recommendations-,
3, Conditions of the tentative map,
Halecrest - Tentative Map
Mr. Fretz reviewed the 624-lot subdivision map. He pointed out problems that have
required extensive study by the staff, such as: water tank location, design of

commercial area and internal street circulation. He said Mr. Lovett, the sub-
divider' s engineer, has: agreed to limiting this matter to a discussion at this:
time with recommendations coming December 15th. The Commission spent considerable
time discussing the proposal made by the subdivider to place rear property lines
at the top of slopes and the resultant lots containing less than 7,000 square feet„
The matter was held over to the December 15th meeting for further study.
ANNEXATIONS"
Hilltop Highlands Annexation
Director of Planning Fretz explained that this: annexation of nhabited territory
will be referred to the Planning Commission by the Council in the future for re-
commendation and that it was being brought to the Commission at thin time for their
information.
MISCELLANEOUS,
Request for Location of Trailer Park " Hal Johnson
Planner Fretz reviewed the situation,: that the matter had been continued from a
previous: meeting. Plans were presented showing access to the area via. "D" Street
rather than across the Woodlawn Street R-3 property.
It was moved by Member Sparling, seconded by Member Calkins and carried, with
*Member Stewart voting "no", that the application for location of a. trailer park on
the M-1 property be approved subject to the following:
1. That access- be via "D" Street and not across the R-3 property on
Woodlawn. That "D" Street be improved with a 5 foot sidewalk set
2 feet off property line, a 13- foot parkway and paving to the
centerline of "D" which shall be: 2'0 feet wide. That the improved
"D" extend from the western line of the development to the east
line of Woodlawn„
Further, that the action be based on the following findings of fact:
14 The land is: coned M-1.
2. The operation and maintenance of a trailer park will not unduly
interfere with the enjoyment of adjacent property devoted to
existing residential use,
3. That the proposed- use will not result in dangerous: traffic congestion
with the required improvements: on "D" Street.
4. That the proposed use will not be materially detrimental to the
public welfare or injurious to the property and property improvements;
in the immediate neighborhood,,
50 That it appears, and on the express condition that, all provisions
of the Trailer Park Ordinance be complied with,
PRS
City Attorney Kugler outlined a proposed ordinance which would provide for zoning
studies and hearings: of land previous to annexation to Chula Vista. After approval
by the Secretary of State of annexation, the City Council could then paste an
interim zoning ordinance carrying out the results of the studies: and hearings.
The Planning Commission directed that the matter of considering the adoption of
such an ordinance be set for public hearing on December 15, 1958 if possible to
get legal notice in time,
