An adjourned regular meeting of the Planning Commission of the City of Chula Vista,
was held on the above date at- 7:30 P,M, in the Council Chambers, at Civic Center with
the following members present: Sparling, Stewart, Adams and Culnan. Absent: Member
Calkins. Also Present: Director of Planning Fretz, Planning Consultant Whitnall,
City Attorney Kugler and Associate Engineer Manners
APPROVAL OF MINUTES:
Member Stewart asked that the minutes of the meeting of December 1,. 1958, be corrected
to show- that his vote in the matter of the approval of a trailer park location for Hal
Johnson, north of "D" Street and 190 feet west of Woodlawn, was "yes" rather than "no"
as reported.
City Attorney Kugler stated that the matter of prezoning as written in the minutes
might be clarified by reading as follows: "City Attorney outlined a -proposed ord-
inance which would provide for zoning studies. and hearings of land previous to
annexation to Chula Vista. After adoption by the City Council of an ordinance acc-
omplishing an annexation,.. the Council could then,pass an interim zoning ordinance
carrying out the results: of the studies and hearings, which would become effective
upon filing the annexation by the Secretary of State."

COMMUNICATIONS-:
Appeal of Planning Commission Action in Approving Trailer Park Location -- North of "D",
West of Woodlawn
The appeal to Planning Commission approval of location of a trailer park for Hal
Johnson, north of "D" Street and 190 feet west of Woodlawn, filed by Mr. Leonard Moe,
was read and Chairman Stewart asked for the reading of the Planning Commission's
report of findings.
Member Culnan stated that in reading the Trailer Park Ordinance, he agrees with Mr.
Moets. appeal that the application wassnot proper in that the applicant failed to file
with the Planning Commission complete building specifications, sewage disposal and
water supply ae required . City Attorney Kugler stated that the text of that section
of the ordinance appears to be ambiguous, however, it appears the ordinance does
require submission of .the above-mentioned items.. He then stated that it was: a matter
of administrative interpretation. The applicant apparently did submit everything
relevant to the action- to be .taken by the Planning Commission, with the belief that
the sewage, water supply and-building specifications should be submitted to the proper
departments. after approval of location by the Planning Commission. He further stated
that the question as to validity of the application does- not prejudice the action
of the Planning Commission. Member Culnan withdrew his objection.
It was moved by Member Sparling, seconded by Member Adams and carried that the appeal
and the findings, as: read,, be forwarded to the City Council with the recommendation
that the appeal be denied.
Discussion of Application for Zone Chan - J. D, Peters
Mr. Fretz explained that an application for zone change had been filed for rezoning
of property at the southwest corner of Fourth and "F". The application wassread,
requesting a change of zone from R�_3 to C-2 for the property located south and west

and adjacent to the utility station at the southwest corner of Fourth and 'IF".
It was moved by Member Culnan, seconded by Member Sparling and carried that the
application be set for public hearing on January 5, 1959-
Public Hearing - South Side of""F", East of 4th from R-3 to C,2 - Chula Vista School
District
This being the time and place as. advertised, Chairman Stewart opened the hearing
on rezoning from R-3 to C-2 of property across from the "F" Street School. The
application requesting the rezoning was read and Director of Planning Fretz submitted
maps showing the boundary of the area proposed for rezoning and indicated adjacdnt
land use and zoning. : '
There being no comments, either for- or against, Chairman Stewart closed the hearing.
It was moved by Member Adams, seconded by Member Culnan and carried that the Planning
Commission recommend to the City Council approval of the application by the Chula
Vista School District for rezoning from R-3 to C-2, based on the following findings
of fact:
1. That good zoning practice requires the change in that the surrounding
properties: are zoned M-1 and C-2.
2. That the property is suitable for C'-2 zoning.
3. That the change will serve the public convenience and general welfare.
Public Hearing - Southeast Corner of Woodlawn and "E" - Johnson-Tyson-Lynds - R-3 to C-2
The application was read requesting a change of zone from R--3 to C-2 of property on
the southeast corner of Woodlawn and "E" Street. Mr. Fretz submitted maps showing
the proposed rezoning of the parcel and its proximity to other property proposed for
rezoning.
This. being the time and place as: advertised, Chairman Stewart opened the public
hearings. Questions as to whether or not Davidson Street would be put through the
block were raised by Mr. Stowell, 669-4 "F" Street and Ir. McMickel, 6531711 Street,
Mr. Fretz stated to the Commission that this application and another set for hearing
immediately following this one represent approximately 40 acres of vacant land along
"E" Street that lends itself to a planned commercial development that could be an
asset to the City. He stated that he would like to see the applications denied
without prejudice until such time as the city has an ordinance which would incorporate
site planning in new, commercial zones. He stated that an ordinance could be pre-
pared for the next meeting.
Chairman Stewart asked Mr. James: Lister, representing the applicants, if they have

plans for the development of this property. Mr. Lister stated that they do not as
yet have any plans developed. There being no further comment, the hearing was,- closed,

application be denied without prejudice until such time as an ordinance for site
planning for commercial zones; can be drafted and with the understanding that, at that
time, the city will initiate the hearings for rezoning so that the applicant need
not re-apply.
Public Hearing - North and South of "E", abutting the S.D. & A.F. Railway - from R-3
and M,1 to C.-2 - Henderson, Bannister and Robinson
The application was read requesting .rewoning from R--3 and M-1 to C-2 of the vacant
land abutting the railroad tracks from "F" Street north to approximately 660 feet
north of "E" Street. Mr. Fretz submitted maps showing the area. This being the
time and place as; advertised, Chairman Stewart opened the hearing.
Mr. Lee Raitt, representing the property owner, spoke stating that, in view of the
Commission' s action on the previous application, that he wishes to add to the inform-
ation on the application that plans are underway for the property south of "E"' Street,
approximately 132 acres, and requested that the Commission act favorably for this
portion of the property. He stated that the land lying north of "E" has not yet
been planned and delay would not affect this portion. He stated further that the
development will be a planned commercial development and that the property is now.
owned by Mr. J. M. Bannister. Mr. Raitt stated that the developer is spending
considerable money for plans of the area. In response to Chairman Stewart's question
as to whether money has been. spent for plans for the area before the rezoning was
approved, Mr. Raitt stated "no" but the developers were awaiting the Commission' s
findings so that they could start on plans. Chairman Stewart stated that he did not
understand how the delay, if the application is denied without prejudice, could cost
money, if plans were not being prepared for any of the property excepting the bowling
alley, which already has been approved as a zone variance. He further stated that
he felt there is a great deal to be gained by site plans and that the whole area
should be dealt with similarly and the application denied without prejudice.
Planning Consultant Whitnall clarified the action of the Planning Commission' s- denial
of the last application and explained the purpose of an ordinance authorizing site
plans for the commercial zones. Mr. Raitt stated that the high cost of the land in
this, area is assurance that the land will not be developed without a plan.
Comments- were heard from Mr. Augustus, 699 "E", George Bosik,; south side of "F"', and
Mr. Jim Lister, as to the affect of commercial zoning on the property and what would
be included in a "site plan" ordinance. Mr. Fretz explained the procedure which
would be proposed. There being no further comment, Chairman Stewart closed the
hearing.
It was moved by Member, Culnan, seconded by Member Adams and carried that the app-
lication be denied without prejudice until such time as an ordinance for site planning
for commercial zones can be drafted and that, at that time, the city will initiate
the hearings for rezoning so that the applicant need not reapply.
PublicHe - Area from "F" to Flower and Broadway to S.D. & A.E. - .from R�3 to C-2
Mr. Fretz presented maps showing the area for which the city had initiated hearings:
to consider rezoning from R-3 to Cs.2. He explained that it incorporated the area
between "F" and Flower and Broadway and the 'railroad tracks that had not been included,

on the two previous applications; and the school property*
This being the time and place as advertised, Chairman Stewart opened the hearing.
Mr. Franks, Jefferson and "E", stated that he would prefer to see the zoning remain as
it is, at least for the present. Member Culnan itemized uses allowed in a C-2 zone.
There being no further comments, the hearing wasi, closed.
It was moved by Member Sparling, seconded by Member Adams and carried that the app-
lication be denied without prejudice until such time as an ordinance for site planning
for commercial zones can be drafted and that, at that time, the city will initiate the
hearings for rezoning so that the applicant need not re-applys
Request for Rezoning - North Side of "H", 660 feet West of Broadway - Ernest Kandt
An application was read requesting rezoning from R-3 to C-2 of property west of
Broadway approximately 660 feet, on the south side of "H". It was moved by Member
Culnan, seconded by Member Adams and carried that a hearing be called for January
19, 1959.
Request for Rezoning - North from "Ht". 620 feet Between Fourth and Fifth - Casey, et al
The application was read requesting rezoning from R-2 to R93 of that property on the
north side of "H"; between Fourth and Fifth. It was moved by Member Sparling,: seconded
by Member Culnan and carried that the matter be set for hearing for January 19, 1959a
SUBDIVISIONS'
Halecrest Subdivision - Tentative Map - North of Telegraph Canyon Road
Director of Planning Fretz submitted the revised tentative map of Halecrest Subs
division, showing a realignment of streets around the site for the proposed water
tank and a realignment of certain streets to assure better circulation of traffic
throughout the subdivision. He explained that a portion of land shown on the sub-
division map is. not in Chula Vista yet due to an error in describing the annexation
and cannot be acted upon at this time. Mr. Fretz: pointed out the areas that the
builders hope to develop as C-1 and R-3. He said that a final recommendation con-
cerning development of Telegraph Canyon Road dealing with access and width required
is still to be worked out and the staff recommends that the area between Telegraph
Canyon Road and ."X" Street be omitted from approval at this date.
It was moved by Member Sparling, seconded by Member Culnan and carried that the
Planning Commission recommend to the City Council that the tentative map of Halecrest
Subdivision be accepted with the following provisions::
1® That all public improvements be installed according to Engineering
Department recommendations,
2. That the area between the alignment of existing Road Survey 866 and
Road Survey 1086 be annexed to Chula Vista,
3a 1 foot lots to be shown and dedicated on the final maps au follows:
a. East end of streets marked "X", "R", "P'l, "Y", "Jlt.
b. West end of streets marked "X", "D", "J".
C. On the north side of the subdivision from the extreme extension
of "J" connecting to the school property on the north.

d. On the west side of "H" from "J" to the north boundary of the
subdivision.
e. On the north end of "H"'.
4. That "J" Street be extended to the west boundary of the subdivision.
5. That the area between Telegraph Canyon Road and "X" Street be'omitted
from tentative map approval until details of access can be worked out.
6. All final street alignments to be settled with the engineer,.of-work.
7. Street names to be determined by the Director of Planning#
8. "T" Street be a 60 foot right-of-way with a 40 foot pavement, all other-
street sections to be as shown on tentative map.
9. All lots to have a minimum area of 7,000 square feet,
10, Street alignments: to be as- shown on revised tentative map, dated
December 15, 19584
11. If rear lot lines are established on the center of slopes greater than
20 feet, a 5 foot bench with a 3 foot paved drainage ditch shall be
constructed.
ANNEXATIONS.
McMillin Annexation - Uninhabited Territory at the East End of Georgina Street, North
of "I"
Director of Planning Fretz submitted maps of the proposed annexation and explained
that it had been included in a map previously shown to the Commission of an annex,.
ation of inhabited territory known as Hilltop Highlands Annexation,
It was, moved by Member Adams, seconded by Member Sparling and carried that the
Planning Commission recommend to the City Council that the McMillin Annexation be
accepted,
Hilltop Highlands Annexation
A map wasrpresented showing a proposed annexation of inhabited territory lying
along the east side of Hilltop Drive and the north side of "I" Street and including
property fronting on G eorgina. S:treet,
It was moved by Member Culnan, seconded by Member Adams and carried that the Planning
Commission recommend to the City Council that the proponents: be given permission to
circulate petitions for annexation of land known as the Hilltop Highlands Annexation.
Proposed United Annexation

Director of Planning Freta explained to the Commission that the city had prepared an
annexation map of land lying east of the city generally between Telegraph Canyon Road
and Seaview; Estates Subdivision and that this had been done with the purpose of re-
ducing the number of small annexations being processed and to avoid the near land'
locking of county areas.

He stated that 10 acres: of this land had.been petitioned for annexation by Mr,
William Peterson who would like to have'approved by the city without the delay
that would be caused by including it ' the proposed United Annexation,
Mr. Fretz stated that he did not feel there would be any delay because the United
Annexation could be approved by the Boundary Commission on the 23rd or 30th of
December, acted upon by the Planning Commission on January 5th and submitted to the
Council for their next meeting ® January 13th. He stated that because the Peterson
Annexation has already been approved by the B oundary Commission' in the event that
the proposed United Annexation is not ready for action on January 5th by the Planning
Commission, that the Peterson Annexation can be acted upon and forwarded to the City
Council for their January 13th meeting. He stated that the City Council will not
meet until January 13the
It was.- moved by Member Sparling, seconded by Member Culnan and carried that the
Peterson Annexation be continued until the January 5th meeting and that if the United
Annexation is not ready for action, that the Commission will consider the Peterson
Annexation and forward it to the City Council,
