HomeMy WebLinkAbout1957-01-21 PC MINS MINUTES OF AN ADJOURNED MEETING OF THE PLANNING COPMISSI_ON OF THE CITY OF CHULA VISTA, CALIFORNIA Held January 21, 1957 The regular adjourned meeting of the Planning Commission of the City of Chula Vista was held on the above date in the Council Chambers at Civic Center with the following members present: King, Armstrong, Calkins, Menzel, Crossley and Hesse. 'Members Ab- sent: none. Also Present: City Attorney Campbell, Junior Engineer Hughes APPROVAL OF MINUTES: It was moved by Member Armstrong, seconded by Member Calkins and unanimously carried that the minutes of the meeting of January 7, 1957, be approved, copies having been mailed to each member. CORRESPONDENCE: City Council .- Model 11Fall .Out" Shelter The City Council wrote to the Planning Commission explaining -why their recommendation to locate the model "Fall-Out" Shelter on the Old Library Site was not accepted and why it is to be located on the city property across from the Civic Center buildings. T. P. Huntington - 311 Del Mar, . A letter was read from Mr. C. C. Alley concerning a' variance granted to Mr. T. P. Huntington at 311 Del Mar Avenue fort he corztruction of a building to be used as office space for professional persons. Mr. Alley states that they w;_sh to allow all uses listed in the Business License Ordinance, Section 18, excepting a newspaper pub- lisher, real estate broker and check cashing. City Attorney Campbell stated that the motion made at the meeting of January 7th granting the variance would have to stand, i.e. "...by professional persons only as defined in the Business License Ordinance." No action was taken. Mr. Ralph Paxton - 144 Minot - Ordinance No. -513 Mr. Paxtonts request that he be relieved from installing curb, gutter, sidewalk and s houlde: as required in Ordinance No.. 543, was presented to the Commission. Mr. Paxton s tated that there are no other curbs, gutters, sidewalks or shoulders installed in that black and he is of the opinion that the Engineering Department does not have the design for that location. Jr. Engineer Hughes stated that they do not have the design at this time, but that it can be made and is a matter of routine, to establish such design upon receipt of a permit for the installation of such public improvements. Member King stated that he feels by granting such :- . requests, the Planning Commission is defeating the purpose of the ordinance. Member King moved, with Member Hesse seconding, that the applicant's request be denied. The motion carried by the following vote, to-wit: - 1 - P tdj�vl\Vel CUTV,n . ABSENT: none APPROVAL OF SCHOOL SITE - Hilltop School Dr. Lauderbach, of the Chula Vista School Dittrict requests Planning Commission approval of ten acres in the Hilltop Housing area as a school site. A letter was read from the Department of Engineering recommending certain improvements. It was moved by Member Crossley, seconded by Member Hesse and unanimously carried that the site be approved for a school location subject to the following Engineering Department recommendations: 1. The northerly 10 feet of the property be dedicated for street purposes` 2. The frontage on Street be improved with curb, gutter, sidewalk and paving. ZONE VARIANCE - Apple Blossom Corporation - 323 Rose View Place The application was read requesting that they be granted a variance to allow a part of the house to extend 14, into the rear yard setback, leaving considerably more than 50% of the rear yard open and free of construction: The applicants stated that the design of the house is such that it cannot be placed on the lot in any other manner. Mr. R. L. Byrd stated that the plans were prepared with the belief that the house could be built with in 5 feet of the rear property line. Dr. Gould spoke stating that the type of house they are buildi"ig will contribute a great deal to Chula Vista and the area because they are so unique and have a valuation exceeding the average house in the area. He feels the improvements on the property will compensate for the technicality of being too close to the property line, which was done in error. Mr. Nicholas Kromydas, representing his father and mother, owners of property immediately to the rear of the lot .in question protessted the granting of the variance as they feel it will be detrimental to their property. He stated that he had-checked with the BAilding Department and had been :.told that the house could not be-built '-within 20 feet of the rear property line .and had so told the construction foreman. This had taken place before the concrete had been poured for the foundation. Mr. Carl Keisling, Construction Superintendent for the developers, stated that he had been told by the Building Department that he could not build within 20 feet of the property line and. had received inspection on the forms only on that portion of the house properly. located, but that he. had complete ccnfidence that the variande would be granted and had consequently poured the concrete. . It was moved by Member Hesse, seconded by Member Crossley and -unanimously carried that the variance be held over until the next meeting so that it could be placed on the agenda for the next field trip. ZONE VARIANCE - Robert Casey - Intersection of Moss and Naples Streets At the January 7th meeting Mr. Casey had requested that he be granted a.variance for the construction of 20 apartment units, an R-3 use in an R-1 zone. The matter was held over for this meeting and a plot plan of the proposed apartment building with a front eleva- tion Baas presented for the Commission's consideration. Protests to the granting of the zone variance were made by Mr. D. Jorgenson, 119 Naples, Mr. MacNear, 121 Naples and Mr. Bob Ganz. These protests were that the people wanted - 2 - the area to stay completely R-11 that they prefer to look at the view of the Country Club rather than an apartment building, that they didn't li.ke ,a two-story building for that location, and that they are afraid the apartments will be rented to people with children with no provisions made for a play area. It was moved by Member Hesse and. seconded by Member Armstrong that the variance be denied. The- motion failed to carry by the following vote, to-.wit:- AYES: Members Armstrong, Menzel and Hesse NOES: Members King, Calkins and Crossley ABSENT: none It was moved by Member Crossley, and seconded by Member King that the variance be granted with the following stipulations: 1, That the laundry area be enclosed and be located and equipped as shown on the plan submitted. 2. That the area to be utilized as trash pick-up stations, be enclosed and kept clean, 3. That adequate off-street parking be provided, as required by Ordinance No. 398, for R-3 uses. 4. Public improvements be installed on all streets surrounding the property. 5. . That a 15' setback be observed on Naples and Alpine and a-10' setback be observed on Moss Street. The motion carried by the following vote, to-wit: AYES: Members King, Calkins, Menzel and Crossley NOES: Members Armstrong and Hesse ABSENT: none REZONING OF THIRD AVENUE (Former Extension) The public hearing having been closed at the meeting of January 7th, the Chairman asked if the members had any further discussion or any action to recommend*. Member Crossley moved and Member Armstrong seconded that the Planning Commission recom- mend to the City Council the rezoning of a 200' depth on either side of the center line of Third Avenue from R-1 to C-1, and that the proposed rezoning of the balance of the properties fronting on Third Avenue (the former Extension) from R-1 to R-3, be excluded from this action. The motion carried by the following vote, to-wit: AYES: Members King, Armstrong', Calkins, Menzel, Crossley and Hesse NOES: Members: none ABSENT: Members: none RESOLUTION N0: 84 - Recommending to City Council the Rezoning of a Portion of Third Avenue and Establishing thereon a new building line. Offered by Member Crossley, passed, . adopted and approved by the following vote, to-wit: AYES: Members King, Armstrong, Calkins, Menzel,. Crossley and Hesse NOES: none ABSENT: none -3 - r � The Chairman directed that the recommendation not be forwarded to the City Council until the Planning Commission is in possession of a map prepared by the Engineering Department showing the proposed rezoning and setback line. Chairman Wenzel directed that a letter be written to the City Engineer directing that a map be prepared for this proposed amendment to Ordinance No. 398 for the nest meeting and that City Attorney Campbell be requested to notify the Planning Commission of any possible legalities.
