HomeMy WebLinkAbout1957-02-04 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Held February 4, 1957 The regular meeting of the Planning Commission of the City of Chula Vista was held in the Council Chambers at Civic Center on the above date, at 7:30 P.M. with the following members present: King, Armstrong, Menzel, Calkins and Hesse. Absent: Member Crossley, Also Present: City. Attorney Campbell and Junior Engineer Hughes. APPROVAL OF MINUTES: It was moved by Member Calkins, seconded by Member Armstrong and unanimously carried that the minutes of the meeting of January 21, 1957, be approved, copies having been mailed to each member. H.. C. BACHMAN - Request to Submit Variance f6r February 18th.meeting It was moved by Member King, sedonded by Member.Calkins and unanimously carried that Mr. Bachman's request for a variance to be placed on the agenda of' the meeting of Feb- ruary 18th, be granted. �r1ILLIAM J. BURKE - 512 "D" .Street - Request to 'wild on an Easement Mr. Burke's request that they be allowed to build a 5-plea on a lot having its only access to a dedicated street via a 100 foot easement, 11 feet wide. -The property, lo- cated next to 512 "D" Street, is zoned R-3 -and it is not possible to gain access in any other manner. Fire Chief Lee wrote to the Commission stating that :,they approve the easement providing it is kept clear at all times, as 11 feet is the minimum clearance of fire equipment. It was moved by Member Hesse, seconded by Member King and unanimously carried that the applicant be given permission to construct the five-plex on the lot in question with the stipulation that the easement be kept free at-all times as requested by the Fire Chief. Apple Blossom Corporation - 323 Rose View Place The Apple Blossom Corporation's request, presented by a variance application at the January 21st meeting, to reduce the 'required 20 foot rear yard setback by 14 feet for the distance of one room, was discussed. . Member Hesse stated that as the Planning Commission had gone on record that they would no longer legalize infractions against theoDning ordinance by granting variances, he moves that the variance be denied. The motion to deny the variance was seconded by Member King and carried unanimously. APPEAL OF ZONE VA"=ANCE GRANTED TO ROBERT CASEY --Intersection of Moss and Naples An appeal by Mr. C. C. Alley, 258 Kearney, of the variance granted to °Robert Casey to construct an apartment building on. the property at the intersection of Moss and Naples Streets, was read to the Commission. The Planning Commission's Report of the Findings were read into the record. - 1 - it was moved by Member Armstrong, seconded by Member Calkins and unanimously carried that the report of the findings be approved and forwarded to the City Council with the appeal. REZONING OF A PORTION OF THIRD AlnRTUE The map prepared -by the Department of Engineering was presented to the Commission for approval and Resolution No. 84, Recommending the Rezoning of a Portion of-Third Avenue, was read. The map met the approval of the Planning Commission and the Secretary was directed to forward Resolution No. 84 and Zoning Map IX to the City Council for action. WHITTINGTON SUBDIVISION NO. 5 - "L" Street at Beech Avenue A petition was read from Mr. Frank Whittington asking that his property, to be included in Whittington Subdivision No. 5, be annexed to Chula Vista. Mr. Whktingtori' stated that boundaries of his proposed annexation has feceived the approval of the Boundary Commission, but that he doesn't have r_: written approval. City Attorney Campbell stated that the Planning Commission could take no action on either the annexation or subdivision map at this time. R. H. WOODWARD - approximately 73 Sea Vale (Third Avenue) � Zone Variance P1r. Woodward's application requesting permission to construct and operate one and two story apartment buildings -with swimming pool and recreation building, an R-3 -use, was presented to the Commission; A letter was read from Mr. Harold Young, 315 Kimball Terrace, approving the request stating that he feels this is the ideal development for the area. Protesting the granting of the variance because of the variance setting a precedent, lack of sufficient information about the development, an anti.cipted traffic problem with theimrrowness of Sea dale at that point, and an anticipated drainage problem, were Mr. Jack' Brower, Mr. Walter Byron, William Rathman, C. D. DeZort, J. E. Rinesmith, Robert Grutzmacher, William Hardy, A. R. Riesland, A. R. Mills, P. W. Carter, Ray Hall, Burnett Bernasky, K. T. Weisgerber, Mr. Christianson, Rita Windrum, K. 0. Stewart L. R. Rudolph and D. Newell. A petition was submitted to the Planning Commission signed by 38 property owners in the area., protesting to the granting of the variance for reasons stated above. Mr. hl Boyer, speaking for the applicant stated that an ordinance is written in such a manner that when property is incorrectly zoned, there is an opportunity through a zone variance to correct the error. He stated that in this particular case, it is not practical for the 32 acres to be subdivided and that attempts to do so in the past proved to be too expensive. There are definite "unusual circumstances10 applying, to this .property and with regard to the drainage problem, it could be made a condition of the variance that the applicant's engineers work with and under the approval of the City Engineer to assure a good solution to the dranage problem. He stated that the Planning Commission could control the development going in through their conditions on the zone variance and thus protect the neighbors. It was moved by Menber Armstrong, seconded by Member Hesse and ,unanimously carried that the variance be held over to the-March 4th meeting, for further study. Wilbur and Carol Blink — 188 rifth - Zone Variance The variance applicaton asking permission to establish an art studio as a home occupation for the purpose of repairing and rejuvenating store mannequins, was presented to the Commission. A letter was read from Mr-;. Wilfred Wallace, 175 Fifth, protesting the 2 granting of the variance. Prbtests were heard from Mrs. Loretta Cootware, 168 Fifth Avenge, and Mr. K. Thomas, 164 Fifth Avenue as they wish the area to remain free of business. It was moved by Member Calkins, seconded by Member Hesse and unanimously carried that the applicant be granted permission to conduct an art studio:- with no photography involved, as a home occupation, with the following conditions: 1. That the variance be for a period of one year. 2. That no ohange be made in the residence for the benefit of the business. 3. That no advertising signs be displayed. 4. That no one other than the immediate family be employed. 5. That no show room be utilized. Esther Del Rio Garcia, et al - 655 "G" Street, Zone Variance The applicant requests permission to construct and operate an auto trailer court, at the above address, an M-1 use in an R-3 zone. This area is immediately to the west of the Rose Arbor Trailer Court. Mr. Ed Culnan, 644 "G" Street, inquired as to the setback the trailer court would observe and the type of landscaping and improvements going,,in. He stated that as long as the development is as good or better than that of Rose Arbor Trailer Court, he would have no objections. ° It was moved by Member King, seconded by Member Calkins and unanimously carried that the variance be ,ranted with the conditions that the applicant observe a- 25' setback on "G" Street which shall be kept attractively landscap6d and which shall not be used for.-the parking of automobiles, and that public improvements be installed on adjacent streets. Chula Vista Boys Club - 495 "I!' Street - Zone Variance The applicants request that they be allowed to construct their club building with a 10' reduction in setback. The petition stated that there are no existing buildings on that side of "I" Street other than Vista Square Housing Ptoject, and that when the area is developed as a possible R-2 or R-3, a 15' setback -would- be acceptable. It was moved by Member Armstrong, seconded by Member King and unanimously carried that the Boys Club be .allowed to construct their building on a 15' setback on both "I" Street and Fifth Avenue. James R. Blanc - 267 "J" Street- Zone Variance Mr. Blanc' s request for permission to conduct accordian instructions in his home four afternoons a week and the incidental sale of instruments, was presented to the Commission. Mss. Odessa Border, 681 Del Mar, spoke in favor of the granting of the variance. Questions were raised as to the extent of the sale of instruments. It was moved by Member King, seconded by Member Calkins and unanimously carried that the applicant be given permission to conduct accordian lessons and sell instruments as an incidental operation, for a period of one year, with the following conditions: 1. That no advertising be done. 2. No outside help be employed. 3. No changes in the appearance of the building benefiting the business. - 3 - Bernice Edward Santos - 90 Oaklaim - Zone Vc-±iance Mr. and Mrs. Santos request that they be given permission to construct a garage attached to the rear dwelling on their R-32ot, and built to -the rear lot line, a reduction of 15 feet of the rear setback and a reduction of 2 feet of the side ,yard setback. Mrs. Alcia Creel, 83 Oaklawn, representing also Mrs. Pearl Fisher, Ed Page and Mr. Lebadee., protestbd the granting of the variance as they feel the applicant is over- crowding his property. Mr. Santos stated that he is actually covering less of his property.-than if he were detaching the garage and building on the property line, which is permissible by the ordinance. He stated that he has improved the property a great deal since he purchased it and feels the garage will be an added improvement. Mr. Edwin Deuchler, owner of property directly to the rear of the Santos property, stated he approves the reduction in setback as he feels it is more sightly than having a few feet left untended betweeen the garage and rear lot line. It was moved by Member Armstrong, seconded by Member King and unanimously carried that Mr. Santos be granted permission to construct the garage, attaching it to the rear dwelling and building # to the rear property line, thus reducing the' rear yard setback for the width of the garage to 0' and thus reducing the side yard setback for the length of the garage to 3 feet. DISCUSSION: Third Avenue North of Sea \Vale Chairman Menzel asked Jr. Engineer Hughes if the Engineering Department would make a study on the possibilities of Third Avenue extending from Sea Vale north to "C" Street and if it is possible, whether the street would serve a useful purpose, or whether the Engineering Department would recommend that that portion of Third Avenue be vacated. Rezoning of San Diego Methodist's Property on "E" Street - A petition was read from the Board of Directors of San Diego Methodists' Home and from Mr. William Eckhart of the Bank of America, asking that their properties fronting on "E" Street east of Third Avenue be rezoned from R-3, Multiple Family Residences to C-1, Limited Commercial. It was moved by Member Calkins, seconded by Member Hesse and unanimously carried that a public hearing be set for the 18th of February to consider the above requested rezoning, Pardee Subdivision and Annexation - Hilltop and "I" Streets Realtor Paul Miller presented maps to the Planning Commission of a proposed subdivision which is in the process of being annexed to the City, and asked that it be put on the agenda for the February 18th meeting. Member Armstrong moved, Member Calkins seconded and it was unanimously carried that the subdivision and annexation be placed on the agenda for the February 18th meting.
