HomeMy WebLinkAbout1957-04-22 PC MINS REGULAR ADJOURNED MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA April 22, 1957 The regular adjourned meeting of the Planning Com mission was held on the above date at 7:30 P.M. in the Police Training Room, Civic Center, with the following members present: Members Armstrong, Stewart, Menzel and Crossley® Absent: Members Hesse, King, and Calkins. Also Present: City Attorney Campbell and Associate Engineer Harshman. APPROVAL OF MINUTES: It was moved by Memher Crossley, seconded by Member Stewart and unanimously carried that the minutes of the meeting of April 1, 1957, be approved, copies havinglBen mailed to each member. CAIRNES MANOR - Tentative Map - Helix at Emerson Recommendations for the tentative map of Cairnes Manor Subdivision, from the Department of Engineering, were read. It was moved by Member Crossley, seconded by Member Stewart and unanimously carried that the tentative map of Cairns Manor be approved xubject to the following conditions: to That Engineering Department recommendations be complied with. 2. That it be recommended to City Council that existing 1' lots on the centerline of Naples, Theresa Way and on Leanna Way at the westerly end be dedicated for street purposes. 3. Setbacks be approved as shown. 40 That the subdivider dedicate 1' lots A. B, C and D-b the city for street purposes. ALBERT HERNEY - 136 Mankato - Zone Variance Mr. Herney's request for a 5' reduction in rear yard setback 'Was read® It was moved by Member Crossley, that the variance be granted to allow the reduction of the required rear yard setback from 20 to 15 feet for the purpose of adding a rec- reation room to the existing dwelling. The motion carried by the following vote,- to-wit: AYES: Members Armstrong, Stewart, Menzel and Crossley NOES none ABSENT: Members Hesse, King and Calkins DOWELL & PATTERSON - N.E. Corner of San Miguel and Fourth - Zone Variance , The applicant's rqquest for a reduction in rear yard setback of 4 feet, was read � 1 - P It was moved by Member Stewart that for reasons stated in the application, the variance be granted, allowing the reduction of the required rear-yard setback from 20 to 152 feet. The motion carried by the following vote,to-wit: AYES: Members Armstrong, Stewart, Menzdl and Crossley NOES:. Members: none ABSENT: Members Hesse, King and Calkins MRS. CAROL LINDHOLM - 117 "E" Street - Request for Relief from Installing Public Improvements Mrs. Lindholm's letter requesting they be exempt from installing public improvements on their property at 147 "E" Street and giving reasons why they feel they should be exempt, was read. Associate Engineer Harshman stated that the Engineering Department had made a survey and in their opinion there is no reason wiry such installation would be impractical or create a dangerous situation. It was moved by Member Stewart, seconded by Member Armstrong and unanimously carried that the request for exemption from installing public improvements be denied. ALFRED MELZER - 28 "H" Street - Relief from Installing Public Improvements Mr. Melzer's letter requesting that he be exempt from installing public improvements on his property at 2811H" Street was read. The Associate Engineer stated that the Engineering Department's survey failed to indicate that such installation is impractical or that it would tend to create a dangerous condition. It was moved by Member Armstrong, xeconded by Member Stewart and unanimously carried that the request for exemption from installing public improvements be deniede COTTON CONSTRUCTION COMPANY - Rarkway at Broadway - Relief from Installing Public Improvements The letter requesting such exemption was read and plot plans submitted to the Planning Commission. It was moved by Member Crossley, seconded by Member Stewart and unanimously carried that the request be denied inasmuch as the applicant failed to prove that such installation is either impractical or that it creates a dangerous sii,uation. RESOLUTION NO. 90 - Granting a Conditional Permit for the Operation of a Pet Store at 491 Third Avenue and giving Conditions Therefor. Offered by Member Crossley,passed, adopted and approved by the following vote, to-wit: AYES: Members Armstrong, Stewart, Menzel and Crossley NOES: none ABSENT: Members Hesse, King and Calkins RESOLUTION NO. 91. - Establishing a Specific Manufacturing Use as an M-1,Use Offered by Member Crossley Passed, adopted and approved by the following vote, to-wit: AYES: Members Armstrong, Stewart, Menzel and Crossley NOES: none ABSENT: Members Hesse, King and Calkins i REPORT OF PLANNING COMMISSION ON APPEAL OF ZONE VARIANCE GRANTED TO R.H. WOODWARD The appeal to the City Council of Planning Commission action in granting a zone variance to R. H. Woodward to construct and maintain apartment units at 73 Third Avenue, an R-1 zone, was presented. The Planning Commission's report on said action was read. It was moved by Member Stewart that certain deletions be made, seconded by Member Cross- ley and unanimously carried, Member Crossley moved that the report to the City Council on the granting of the Wood- ward zone variance be approved and forwarded-to City Council with the above deletions. The motion carried by the following vote, to-wit: AYES Members Armstrong, Menzel and Crossley NOES: Member Stewart ABSENT: Members Hesse, King and Calkins REPORT OF PIA NNING COMMISSION ON APPEAL OF ZONE VARIANCE DENIED TO FRANK FOWLER An appeal filed by Mr. and Mrs. Frank Fowler on:the denial of their requested setback variance was presented to the Commission. The �Planning Commission' s report on said action was read. It was moved by Member Stewart, seconded by Member Crossley and unanimously carried that e4=r' the report be approved and forwarded to City Council. REPORT OF PLANNING COMMISSION ON REZONING OF FOURTH AVENUE The appeal filed by Commander Farrel to the rezoning of a portion of Fourth Avenue north of "D" Street to be recommended to City Council was presented and the report of the Planning Commission on such recommendation was readm City Attorney Campbell ruled that the appeal is void inasmuch as this is a recommendation from the Planning Commission to Council and a public hearing will be required in the Council; however, in view of certain statements made in the appeal, the Planning Com- mission may send its report to the City Council. It was moved by Member Stewart, seconded by Member Crossley and unanimously carried that even though the appeal has been ruled void by the City Attorney, in view of statements made in the appeal, that the Planning Commission report be approved and forwarded to City Council. REPORT OF PLANNING COMMISSION ON APPEAL OF DENIAL OF REZONING OF A PORTION OF "E" STREET Mr. C&nnolly's appeal from the Planning Commissionts denial of the request to reznne a portion of "E" Street was presented to the Commission and the report of Planning Commissior. findings read. It was moved by Member Crossley, seconded by Member Stewart and unanimously carried that the report be approved and forwarded to the City Council. MOHR ADAMS-PLOURDE REPCR.T Inasmuch as the Planning Commission is of the opinion that time other than at a regular meeting should be allotted to the study of the report, an informal discussion was set , for 7:00 P.M., Monday, April 29th, at the Council Chambers. REQUEST FOR LOCATION OF AUTO WRECKERS ON MONTGOMERY FREEWAY AT "E" STREET It was moved by Member Crossley, seconded by Member Stewart and unanimously carried that an operation of auto wreckers, be allowed as an. M02 use. PARDEE-PHILLIPS ANNEXATION NO. 2 Plot plans were submitted to the Commission showing Pardee-Phillips Annexation No. 2. It was moved by Member Stewart, seconded by Member Crossley and unanimously carried that the Pardee-Phillips Annexation No. 2 be approved and recommended to the City Council for action, PARDIDE-PHILLIPS SUBDIVISION - Revised Tentative Map A - Hilltop at "H" Revised tentative maps of Pardee-Phillips Subdivision showing the addition of lots which are included in Pardee-Phillips Annexation No. 2, was presented. It was moved by Member Crossley, seconded by Member Armstrong and unanimously carried that the revised tentative map of Pardee-Phillips Subdivision, No. A, be approved, pending annexation, with the following conditions: 1. That the map meet all requirements of the Zoning and Subdivision Ordinances. 2. That the Engineering Department recommendations be followed. 3. That Carla Avenue be extended to the northern boundary of the subdivision. ADJOURNMENT Chairman Menzel adjourned the meeting sine, die.
