HomeMy WebLinkAbout1957-05-06 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA May 6, 1957 The regular meeting of the Planning Commission was held at 7:30 P.M. on the above date in the Council Chambers at Civic Center with the following members present: King, Armstrong, Calkins, Menzel and Crossley. Absent: Members Hesse and Stewart. Also Present: City Attorney Campbell and Associate Engineer Harshman. IVAN PA INE - 396 Broadway - Zone Variance The application asking for reduction in rear yard and side yard setbacks was presented to the Commission with a plot plan showing that the ea sterly 125 feet of the property is located in an M-1 zone and the westerly 40 feet is located in the R-3 zone. It was moved by Member King, seconded by Member Calkins and unanimasly carried that the variance be granted, that Mr. Paine may build the apartment units with a five foot rear yard setback and a 3 foot side yard setback, a reduction of ten and two feet re- spectively. E. ROBERSON AND H. MORGAN - 175 "E" Street - Zone Variance The application requesting permission to operate a real estate and insurance office at the above address, a C-1 use in an R-3 zone, was presented. Comments were received from Mr. Farris, 189 Brightwood, Mr. Dale Fish, 160 Brightwood and Mrs. Byrn, 220 Elder, stating that they object to spot zoning and for that reason are objecting to ghe granting of the variance. It was moved by Member Calkins, seconded by Member Crossley and unanimously carried that in accordance with the Commission's recommendations to City Council on the proposed rezoning of "E« Street between Broadway and Fourth Avenue and because the applicant failed to prove the *.urisdictional facts as required by ordinance, that the variance be denied. EMMA GILES - 244 Garrett - Zone Variance The applicant regaests permission to operate a beauty consultant studio in the residence, on a part-time basis, a C-1 use in an R-3 zone. A peittion protesting the granting of the variance, signed by 18 property owners, was read. Protests were heard from Mr. Riley, Mr. DeBoyer, Mr. Hummell, Mr. McCrae . Mrs. Giles stated that she had not intended to create dissension. It was moved by Member Armstrong, and carried that the variance be denied for the reason that the jurisdictional facts as required by ordinance were not proven. The motion carried by the following vote, to-wit:' AYES: Members King, Armstrong, Calkins, Menzel and Crossley NOES: none ABSENT: Members Hesse and Stewart - 1 - B. I. VANDERHEYDEN - 101 Woodlawn - Zone Variance Mr. Vanderheyden's application requesting that he be given a variance to do radio and television repair in his garage, a C-1 use in an R-3 zone, was presented. Mr. C. Smith, 102 Oaklawn and Mr. Ed Dike, 91 Woodlawn, spoke stating that they favor the granting of the variance. It was moved by Member Crossley, seconded by Member Armstrong and unanimou,* carried that the variance be denied for the reason that the jurisdictional facts required by ordinance were not proven. CAIRNS MANOR - Final Map - Between Naples and Emerson at Helix The final map of Cairns Manor Subdivision was presented to the Commission along with a letter from the subdivider's engineer asking that the map be approved with certain lots being below the required 7(1000 square feet. It was moved by Member Calkins, that the final map of Cairns Manor be approved and for- warded to City Council with the following recommendations:: 1. That the map be approved with the following deviations from the minimum 7,000 square feet lot area: Lot 1 - 684o Lots 12 to l8'- 6900 Lot 18 - 6420 Lot 19 6441 Lot 20 - 6966 Lot 73 - 6251. Lot 96 - 6614 WHITTINGTON SUBDIVISION NO. 5 - Final Map - South of "L" Street at Beech Avenue City Attorney Campbell ruled that no cation may be taken on the final map of this sub- division until the annexation is complete. LOUIS G. WEISMAN - Requests for Rezoning A letter was read from Mr. Weisman requesting that his property located on "K" Street, part of which is in the R-1 zone and part of which is in the M-1 zone, be zoned en- tirely M-1, C-2 or C-3. A map accompanied the letter showing the properties and zoning on Third Avenue between "K" and "L" and on "K" Street immediately adjacent to that front- ing on Third Avenue. City Attorney Campbell ruled that the Planning Commission need not take action on such request at the present time because the application for such rezoning is not complete. He stated that the application must include, among other things, an exact legal dexcrip- tionof the property for which rezoning is requestedo The Planning Commission directed that the secretary write to Mr. Weisman stating the decision being made and explaining that he must furnish more complete information before a public hearing can be set on such rezoning. PROPOSED LEGISLATION REGARDING ZONING NEAR SCHOOLS City Attorney Campbell confirmed reports to the Planning Commission that there is pro. posed legislation in Sacramento which would prohibit any change of land use or zone within 500 feet of any school without the consent of the school districto 2 A It was moved by Member King, seconded by Member Crossley and unanimously carried that a letter be directed to the City Council stating that the Planning Commission is opposed to such legidation and recommending that the City Council protest this legislation in any acceptable mannero RECOMMENDATION: Chairman Menzel requested that a letter be read which recommends to City Council that more help be given to the Planning Department and that the services of a Planning Con- sultant be procured for the Commission until a City Planner is hired. A letter was read recommending to the City Council that in any event the services of a consulting firm be obtained for the purpose of making a study of the commercial areas of the City in relation to the residential areas. The letter stated that the requested study is in connection with petitions for rezoning to commercial, particularly that of "E" Street between Broadway and Fourth Avenue. It was moved by Member Armstrong, seconded by Member Calkins and unanimously carried that the letters be approved and forwarded to City Council. MOHR®ADAMS®PLOURDE REPORT It was decided that the Planning Commission will hold study meetings on the report and then ask for a joint meeting with the Harbor Commission and City Council, Monday, May 13th, 1957 was tentatively set for the first study meeting.
