PIANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
August 5, 1957
The regular meeting of the Planning Commission of the City of Chula Vista was held at
7:30 P.M. on the above date in- CouncilChambers at Civic Center with the following
members present:; King, Calkins, Menzel, Crossley, Stewart, Axelson. Absent: Member
Armstrong. Also present: Attorney Albert Boyer, Principal Engineer Hars`hman.:
APPROVAL OF MINUTES
It was moved by Member Callins, seconded by Member Crossley and unanimously carried'.
that the minutes of the meeting of July 15, 1957, be approved, copies having been
mailed to each member.
APPROVAL OF REQUEST FOR EXEMPTION FROM ORDINANCE NO 543: St. Johnt s-
Episcopal Church - First and Kearney
A plot plan s4owing proposed and .future construction .of churchbuildings'-for the St.
Jo�ml s Episcoppl Church on First Avenue south of Kearney,. was .presented .along with
a letter asking for relief from installing certain public improvemen is at the location.:
A letter was read giving recommendations of the Department of Engineering faith regard
to public improvements.
It was moved by Member Stewart, seconded by Member Axelson and unanimously carried-:a's
follows: That the Planning Commission finds .that as indicated in recommendations from
the Department of Engineering, it is extremely impractical at this time for sidewalk,
to be installed on the northerly 260 feet of the west side of First or for any of the
public improvements to be installed on the remainder of the church property on First ;.
but, that curb, gutter, sidewalk and shoulder be installed on the" south side of Kearney
abutting the church property and on the southwest corner of the intersection of First
and Kearney and that curb, gutter and shoulder be installed on the northerly 260 feet
of the west side of First Avenue abutting church property. That the balance of the public
improvements be installed at the time the remaining buildings shown on the plan are
constructed. That the church site be approved as per plan submitted.

AMENDMENT OF MASTER STREET PLAN - "Hit Street east of Hilltop and Master Streets west
of Montgomery Freeway
The Commission set a public hearing for Tuesday, September 3, 1957, for consideration of
amending the master street plan to conform to the Mohr report, project No. 1006-8 for the
area west of Montgomery Freewak and also to conform to the tentatively approved map of
Pardee-Phillips Subdivision for the extension of "H" Street east of, Hilltop Drive,
H. Street and Sons - Relief from Provisions of Ordinance No. 543.
The letter from H. Street & Sons asking thaat they be exempt from installing public
improvements at their wrecking yard, now under construction, at "E" Street and Bay Boule-
vard, Wext, was read along with a letter of recommendations from the Department of
Engineering.

194 Montebello, protested the change of zone. Mr. Dominicl� Rego, petitioner for the
rezoning, stated that because of the strong opposition, he wishes to withdraw the
CD
petition.
Member Crossley moved, Member Axelson seconded and the motion carried that the petition
for rezoning be denied.
PROPOSED REZONING OF PROPERTY FRONTING ON BROADWAY BETWEEN "Ht' AND "I"
The situation was explained that because a portion of property fronting on Broadway be-
tween "H" and "I" is being used to a 150 or 180 foot depth for business and because the
business zone is only 125 feet deep�.,a request for the extension of the M-1 zone to a
180 foot depth from 125 feet had been made.
The Commission directed that a letter be written to the party questioning the depth of
the zone stating that they should apply for a zone variance to resolve their particular
, situation or that they wait until the Commission is in a position to make a study of the
complete Broadway area with respect to type and depth of zoning. Rather than undertake
to correct the situation piecemeal, the Commission- prefers to have a study made of the
entire length of Broadway and attempt to resolve the problem in one action.
Member Stewart requested that a legal opinion be gotten as to the difference between a
zone variance and a zone change with respect to the title of the property, and that
this information be included in the above-described letter.
JUDSON RESERVOIR ANNEXATION
No action taken as the proponents for annexation requested that the .petition be withdrawn
at this time.
PLANNING COMMISSION FINDINGS ON THE "E" STREET REZONING
Chairman Menzel asked that the report from the Planning Commission on their findings
of the proposed rezoning of "E" Street from R-1 and R-3 to C-2, be read and asked the
members for any comments they may have. Member Stewart stated that he is of the opinion
that the correction to be made to the minutes of the August 5th meeting should also be
be reflected in the findings. Member Armstrong stated that even though he did not attend
the meeting at which the decision was reached, he had been present at the hearing and
agrees with the findings.
It was moved by Member Stewart, seconded by Member Crossley and carried that the find-
ings be approved with the above change and forwarded to City Council. Member King
voted "no" for the reason that he had been in favor of the rezoning.
HALF-STREET DEDICATION EAST OF SECOND AVENUE, SOUTH OF MURILY
Member Stewart moved, Hember Crossley seconded and the motion carried that the matter
be held over to the September 3rd meeting for further study and a field trip.
EXTENSION OF TIME ON ZONE VARIANCE - Fbrence Rehfield, Southwest Corner 5th & Flower
A letter was read from lvi-s. Rehfield asking that the time on a variance granted to her
allowing a reduction in setback on both Fifth and on Flower Streets be extended for
one year. Mrs. Rehfield has built on Flower, using the setback reduction granted, but
has not been able to build on Fifth using the 20' setback granted.

It was moved by Member Stewart, seconded by Member Axelson and carried that Mrs.
Rehfield be granted an extension of time on the variance granting a setback reduction
on Fifth Avenue. Said extension to expire September 1, 1958.
SOUTHERN CALIFORNIA PLANNING CONGRESS
A communication from the Southern California Planning Congress was read adcing the
name of the member appoirted to serve on the Advisory Board. Chairman Menzel was
elected to serve in this position.
HARBOR COMMISSION RECOMMENDATION TO ODUNCIL
A communication from the Harbor Commission with respect to the letter from the San Diego
and Arizone Eastern Railway concerning the Mohr-Adams-Plourde Report was read. No action.
PETITIONS FOR REZONING
Due to the numerous petitions for rezoning of small pieces of property being brought
before the Commission, discussion was held as to a means to curb the promiscuous filing
of petitions as a means of avoiding paying the fee for a zone variance. At the present
time a .$35.00 filing fee is charged to handle the expense of processing zone variances
with no fee being charged for zone change. It was thought that in order to avoid diffi-
culty, if a charge is made, it would cover the cost of processing the petition for re-
zoning and not the actual amendment of the ordinance. There is at present a $50.00
filing fee when plans for new trailer parks are submitted to the Commission for approval.
The Commission directed that the secretary contact local .cities to determine what
charges, if any, are made for requests to reclassify or change zones and also to obtain
the average publication charge for the most recent requests for rezoning that we have
had.
ORAL COMMUNICATION
Mr. Peter Schnor, 700 First Avenue, explained that he has a problem with the grade level
of the street at his property, and needed help. The Commission explained that he would
have to contact the Engineering Department or the City Council, as theyhave no authority
in s uch matters.
ADJOURNMENT:
Chairman Menzel adjourned the meeting sine, dies explaining that the regular meeting of
September would be held on the 3rd rather than the 2nd due to the 2nd being Labor Day.

Member Stewart moved, Member King seconded and the motion carried unanimously, that a
letter be directed to the City Council with the findings above approved, stating that
the Planning Commission again strongly recommends that a study of the commercial zoning
in Chula Vista in connection with the proposed rezoning of "E" Street to commercial, be
made by a competent planning consultant prior to any action accomplishing the rezoning.
