OF THE PLANNING CWTISSION OF THE
CITY OF C HULA VISTA, CALIFORNIA
November 18, 1957
An adjourned meeting of the Planning Commission was held on the above date in Council
Chambers at Civic Center at 7:30 P.M. , with the following members present: King, Arm-
strong, Calkins, Stewart, Culnan and Bendickson. Absent: Member Crossley. Also pre-
sent: Acting City Attorney Boyer.
Chairman Stewart welcomed the new member, Mr. Edgar Culnan, to the Planning Commission.
APPROVAL OF MINUTES:
It was moved by Member Armstrong, seconded by Member Crossley and unanimously carried
that the minutes of the meeting of November 1., 1957, be approved, copies having been
mailed to each member.
ZONE VARIANCE - Drs. M. L. Day and D. F. Fields - 162 "E"
The variance application was read asking that the applicants be allowed to operate(.doc-
torvs offices at 462 "Ell Street, a C-1 use in an R-1 zone. Protests were heard from Mrs.
Elizabeth Galligan, 466 "E"; E. J. Ford, 215 Ash; Jack Stewart, 215 Figs; B. Ramage, 214
Fig; Alice Parkin, 183 Brightwood and Mr. Ben Herrin, 221 Ash, that they were opposed
- to zone variances if the whole area is not to be developed commercially, that this is
just another way to commercialize the street even though1he rezoning has been denied,
and that the variance should be denied as the rezoning has been denied.
• It was moved by Member Armstrong, seconded by Member Culnan and carried that the variance
be denied for the reason that jurisdictional facts required by ordinance, were not proven.
ZONE VARIANCE - Hardy and Ursula Rothschild - 471 "E"
The application was read asking that permission b e granted to operate an art gallery and
real estate office at 471 "E", a C-1 use in an R-3 zone. Mr. Rothschild elaborated on
the information given in his application and stated that an art gallery would be beneficial
to the City of Chula Vista as well as the neighborhood. Protests were heard from Alice
Parkin, 183 Bright-wood; Mr. Don Byrns, 220 vElder; E. J. Ford, 215 Ash and Bill Ramage, .

Member Culnan moved, Member Armstrong seconded and it was unanimously carried that the
variance be denied for the reason that the jurisdictional facts required by ordinance,
were not proven.
ZONE VARIANCE - Harold Morgan and E. Roberson - 475 "E"
The application was read asking that a variance be granted allowing the operation of a
real estate office at 175 "E", an R-3 zone. Protests were heard from Alice Parkin, 183
Brightwood; Ben Herrin, 221 Ash; Elizabeth Galligan, 466 "E" and Bill Ramage, 214 Fig.
Mr. Morgan elaborated on his request for a real estate office and Irr. Hardy Rothschild,
471 "E", spoke favoring the granting of the variance.
It was moved by Member Armstrong, seconded by Member Culnan and unanimously carried
that the variance be denied for reasons that the jurisdictional facts as required by
ordinanc.e were not proven.
ZONE VARIANCE - Lawrence Kuebler - 424 "G"
Mr. Kuebler' s application asking that he be allowed to develop his R-2 property, located
at the rear of existing multiple units and abutting school property, as R-3, was read..
It was moved by Member King, seconded by Member Bendickson and unanimously carried that
the variance be approved, that Mr. Kuebler be granted permission to develop this property
according to plans and specifications submitted, subjedt to the following conditions:
1. That the number of units be restricted to 7.
2. That off-street parking spaces be provided for each unit.
3. That the' Engineering Department approve of any necessary public improvements.
ZONE VARIANCE - Frank Whittington, approximately 627 Guava
Mr. Whittirg ton's application requesting permission to build an R-1 dwelling on a lot
having less than 7,000 square feet was ready Mr. Whittington explained the situation,
stating that it was not possible to get additional land from the south (Whittington
Subdivision No . 6) and that the owner of property to the north did not care to sell any
land and that the maximum lot area is. 5,562 square feet. Mr. Karl Klies, 615 Fourth,
protested the dead-ending of Guava Avenue in Whittington Subdivision No. 6. Mr.' Harold
Morgan, 475 "E" stated that as a real estate- man he knows that small, close in lots,
are in demand and that people prefer having less yard area to maintain.
Member King moved, Member Armstrong seconded and the motion carried unanimously that
Mr. Whittington be granted permission to build a dwelling on the R-1 lot at approximately
627 Guava, having 5,562 square feet.
ZONING OF NEWLY ANNEXED LANDS
Chairman Stewart stated that atthe previous meeting it .had been tentatively agreed that only
two of the annexations might not be suitable for R-1 zoning, i.e. Whittington Annexation
Number 2 and "J" Street Annexation. He further stated that in checking with LaMesa, San
Diego City and National City, topography by itself is not considered as warranting less
restricted zoning than R-1. Concession was often made by a reduction in front yard setback
for garages, but that unless other factors are present, hilly property does not require
zoning for multiple units.
;The Commission directed that a public hearing be set for January 6, for the rezoning of
Whittington Annexation No. 2 to C-2 and C-1 as shown on map and for rezoning of the
following annexations to R-1:7
Lillian Rice School Annexation Pardee-Phillips Annexation No. 1
Naples Street School Annexation Pardee-Phillips Annexation No. 2
Telegraph Knolls Annexation Horton Annexation
Whittington Annexation No. 1 "J" Street Annexation
COM iUNICATIONS:
Mr. Ben Herrin, 221 Ash, asked if the Planning Commission could obtain name plates for
the Council table so that during Commission meetings the public would know the names of
the members. -The Commission directed that a letter be written to the City Administrator

asking if the request could be complied with.
A copy of a letter was read addressed to Mr. Rindone, Superintendent of the Sweetwater
Union High School District, from the San Diego County Planning Commission regarding the
proposedlocation of the new high school lying partially in the Pardee-Phillips Annexa.w
tion to Chula Vista and partially in the county. The County Planning Commission made'
certain recommendations to the school district with respect to provisions for certain
streets in the area.
Mr. Edward Crossley' s. letter of resignation fromt-the Planning Commission was read, stating
that it would be affective as soon as a replacement is appointed by the City Council.
The Commission directed that the letter be filed until a replacement is appointed, at
which time a letter is to be mailed to Mr. Crossley thanking him for the cooperation
with the Commission and for the time and help given to the City of Chula Vista.
PROPOSED PROFESSIONAL ZONING FOR "E" STREET
Chairman Stewart read the Council' s action in requesting the Planning Commission to study
the feasibility of creating a professional zone for "E" Street and asked for the reading
of the uses allowed in a similar ordinance now in effect in San Diego.
'Chairman Stewart stated that he feels "E" Street, being used as a through street which
was widened at the expense of the public and for the public's convenience, should not
change in any way to create interference with through traffic. He stated further that
when "L" Street is widened and put through, the same conditions will exist on both "L"
and "H" Streets that now exist on "E" Street. . He is of the opinion therefore, that what-
ever is done with zoning on "E" Street will establish a precedent for zoning ori "H"
and "L".
It was moved by Member C;ulnan, seconded by Member Calkins and unanimously carried that:
1. The Planning Commission recommend to City Council that the present
zoning on "E" Street be maintained.
2. That the Commission go on record as disapproving professional zoning
for "E" Street.
3. That it be brought to the Council' s attention that the north side of
"E" Street (R-3 zone) can now be developed with a few of the uses allowed
in San Diego' s professional ordinance, i.e. hotels and non-profit lodges
and clubs.
4. That the reasons for this action are the same as those outlined in the
Planning Commission's recommendations against commercial zoning for "E"
Street and the reasons outlined in the shady made by the planning consultant.
