OF T11E PLANNING COMMISSION OF
THE CITY OF CHULA VISTA, CALIFORNIA
December 3, 1957
The regular m eting of the Planning Commission was held on the above date in Council
Chambers at Civic Center with the following members present: Armstrong, Calkins'
Stewart, Bendickson, Byron and Culnan. Absent: Member King. Also Present: Acting
City Attorney Boyer and Principal Engineer Harshman.
Chairman Stewart introduced the new member, Mr. Walter Byron and welcomed him to the
Commission.
APPROVAL OF MINUTES
It was moved by Member Calkins, seconded by Member Bendickson and carried that the
minutes of the meeting of November 18th be approved, copies having been mailed to
each member, with the correction that the motion approving the minutes of the Novem-
ber 4th meeting was made by Member Calkins rather than Member Crossley.
KIFFE'S SUBDIVISION NO. 1 - Tentative Map - "G" At Hilltop
Copies.o_f the tentative map of Kiffe' s Subdivision No. 1 were presented to the Commission
and a letter of recommendations from the Department of Engineering was read. Mr. Stewart
pointed out that there are a few things about the map that do not comply with ordinance
requirements and city policies. The Planning Commission has established a policy that
monolithic curb, gutter and sidewalk will be avoided where possible;that cul-de-sacs
will not be accepted in subdivisions if it is possible for the streets to continue
beyond the limits of the subdivision; and the ordinance regulating the subdivision of
land requires a minimum 50 foot property line radius.
It was moved by Member Calkins, seconded by Member Culnan and carried that two new
maps be submitted, one showing the street with a 401 right-of-way extending to the
northern boundary of the subdivision with a temporary turn-around shown within the
right-of-way and the other with a 501 right-of-way extending to the northern boundary
of the subdivision and a temporary turn-around shown within the rightof-way. These
maps to be submitted to the Planning Commission at 2:00 P.M. , Thursday, December 5,
and that a special meeting shall be called for this purpose among others.
HILLTOP GLEN - Tentative Map - Easterly End of Shasta, West of Hilltop Drive
Tentative maps of the 16 lot subdivision were presented to the Commission along with
the letter of recommendations from the Department of Engineering. Mrs. Kodish, 52
Shasta spoke of her concern with the drainage problem in the area and asked that she
be made fafniliar with the drainage control plan. She further requested the grading
plan of the subdivision. It was explained that the city has no control over the grading,
but that the drainage control would be submitted to the, city for approval before the
final map is approved.
Member Bendickson moved, Member Calkins seconded and the motion was carried that
the tentative map of Hilltop Glen be returned with a request that a map showing the
drat-nage control in the area be submitted.

ZONE VARIANCE - Casey Construction - Southeast & Southwest Corner of Fig and "I"
The application asking that permission be granted to develop these two R-1 lots as R-3
was read and a map presented showing vicinity. Protests were heard from Mr. VanNoy, the
northeast corner of Fig and "I", Mr. and Mrs. Harry Wheat, 631 Brightwood, Mr. Sorenson,
589 Guava, Mr. Fred Olmstead, 615 Brightwood and Mr. Hamilton, 589 Fig. Protests were
read from Mrs. J. W. Rosengren, Jr., 548 Guava, Mr. and Mrs. R. C. Fackler, 466 "I",
Mr. and Mrs. E. L. Michel, 610 Brightwood, Mr. and- Mrs. Roy Reynolds, 616 "I" and Louis
Kaiser, 455 "I".
Chairman Stewart closed the hearing, and it was moved by Member Culnan, seconded by
Member Calkins and carried that the variance be denied for the reason that the jurisdic-
tional facts required by ordinance were not proveny beyond a reasonable doubt.
Member Calkins was excused at 8.:50 P.M.
APPROVAL OF PLANNING COMMISSION FINDINGS - Denial of Variance to Drs. Fields and
Day at 462 "E" Street
Offered by Member Armstrong, read in full, passed and approved by the following vote,
to-wit:
AYES: Members Arm strong,' Stewart, Bendickson and Culnan
NOES: none
ABSENT: Member King and Member Calkins
Member Byron declined to vote because he had not participated in the nearing.
APPROVAL OF PLANNING COMMISSION FINDINGS - Denial of Variance to Hardy Rothschild
at 471 "E" Street
Offered by Member Armstrong, read in full, passed and approved by the following vote,
to-wit:
AYES: Members Armstrong, Stewart' Bendickson and Culnan
NOES: none
ABSENT: Members King and Calkins
Member Byron declined to vote because he had not participated in the hearing.
APPROVAL OF PLANNING COMMISSION FINDINGS - Denial of Variance to H. Morgan and E.
Roberson at 475 "E" Street
Offered by Member Culnan, read in full, passed and approved by the following vote,
to-wit:
AYES: Members Armstrong, Stewart, Bendickson and Culnan
NOES: none
ABSENT: Members King and Calkins
Member Byron declined to vote because he had not participated in the hearing.
Member; Calkins returned at 9:10 P.M.
DISCUSSION - Business Licenses
It was explained to the Commission that a list of persons possessing business licenses

showing addresses in residential areas had been submitted to the Planning Department
with the request that the Commission make a recommendation as to whether or not business
licenses should be issued for the coming year. It was further explained that some of
these persons a.re' operating under zone variances and a few have been operating for
several years, most likely before the zoning ordinance was adopted. City Attorney
Boyer stated that the Police Ddpartment is the enforcement body and should be responsi-
ble for any violations,
The Commission directed that a letter be forwarded to the City Administrator explaining
the situation and asking for approval and enforcement of the following plan to be fol-
lowed in an effort to auoid similar situations in the future. .
1. That applications for all new business licenses with the exception of out-of-
town concerns and soliciters, be submitted tolhe Planning Department for..approval as to
zoning.
2. When a license shows a residential address and if in the opinion of the Planning
Staff the residential location will be used only for mail and telephone purposes, the
application for business license may be approved.
3. If there is a doubt as to whether the applicant will be using his residential
location for the storage of any materials having to do with this business or if there
is a question as to whether the location will be subjected to more traffic than if
residential, the matter shall be referred to the Police Department for investigation
before th6 license is issued.
The Commission further directed that the above-mentioned list be studied and each one be
treated as .a new application. When the business licenses have been in effect -long
enough for the use to be considered as non-conforming and/or when the location is being
used only for telephone and 14ail purposes, licenses may be issued for the coming year.
When neither of the two situations apply to a business license, it may not be issued.
DISCUSSION - Broadway Zoning
Chairman Stewart explained that a request had been received from the Broadway Division
of the Chamber of Commerce requesting that the study of the rezoning of Broadway be re-
opened with emphasis placed on zoning Broadway from M-1 to C-2, as soon as possible. Mr.
Jack Perrine speaking for the association, explained reasons behind this request and also
why property owners on BroadwV 'do not wish the matter delayed indefinitely.
Member Culnan stated that he is of the opinion that if within a month the city has no
prospect of a full-time planner, that the Commission consider requesting the services of
a planning conulstant firm for the specific study of Broadway zoning.
Chairman Stewart directed that the matter be placed on the agenda for. the meeting of Jan-
uary 6th and if at that time the city does not have at least a prospect for a planner, .
that the matter of hiringg -a planning conusltant for this particular problem be considered.
ADJOURNMENT:
It was moved by Member Armstrong, seconded by Member Calkins and carried that the meeting
adjourn until December 5, 1957, at 2:00 P.M.
