OF THE PLANNING COM14ISSION OF THE
CITY OF C HULA VISTA, CALIFORNIA
September 4, 1957
The regular meeting of the Planning Commission of the City .of Chula Vista, California
washeld on the above date in Council Chambers at Civic Center at '7:36P:M. with the
following members present: King, Calkins, Menzel, Stewart. Absent: Members Crossley
and Armstrong. Also Present: City Attorney Campbell .and Principal Engineer Harsl- nan.
APPROVAL OF MINUTES:
It was moved by Member Stewart, seconded by Member Calkins and unanimously carried that
the minutes of the meeting of August 19 be approved, copies having-been mailed to each
member.
PUBLIC HEARING - Amendment to Master Street Plan
"H" Street, east of Hilltop Drive
Chairman Menzel opened the public hearing, asking for comments from the public. Mr. John
Malloy, 449 Hilltop, commented about the practicability of extending "H" Street through
directly east of the existing "H" Street. Mr. Joseph Rindone, Jr. , Superintenddnt of the
Sweetwater Union School District, spoke, stating that the District is attempting to pur-
chase a portion of the Pardee-Phillips Annexation, which might perhaps change the plan
for streets in the area. He stated that the schools do want "H" Street to go through in
some manner to provide access to the school property.
Chairman Menzelstated that as this public hearing had been scheduled prior to the time
the city was aware of the schools plans, it was based on changing "H" Street as it is mw
shown on the master street plan, extending east slightly under the quarter-section line,
to confdrm to the plan shown in Pardee-Phillips Subdivision.map, with "H" Street extending
directly east of the existing "H" Street.
Member Stewart moved that this portion of the amendment to the master street "plan be
held over until suchzitime as the schools plans for development in the Pardee-Phillips
Annexation are finalized. Member King seconded the motion and it carried unanimously.
Master Streets west of Montgomery Freeway
The =chairman'.explained the proposed change and asked Mr. R. Landells, member of the
Harbor Commission, what recommendations that body might have. Mr. Landells explained
that they had previously recommended to Planning Commission and City Council that the
change be made..
Member King moved that the Planning Commission recommend to the City Council that the
master street plan be amended to conbrm with the Mohr-Adams-Plourde Plan, specifically
Project No. 1006-8, for the area west of Montgomery Freeway. The motion was -seconded by
Member Calkins and carried unanimously.
PUBLIC DARING - Vacation of a Portion of Third Avenue
This being the time and place as advertised, Chairman Menzel opened the public hearing on
the proposed vacation of that portion of Third Avenue between "C" Street and Sea Vale
Street.

A letter was read from Mr. W. Ray Coyle protesting the vacation for the reasons that
it would landlock his property and because in his opinion, the city would in the future
need'the right-of-way for a developed street.
Mr. and Mrs. Louis Rudolph, 299 Sea Vale, spoke in favor of the vacation because of the
cost in filling and grading the street if it were constructed and because the unimproved
street prevents them from landscaping the west sidd of their property. Mr. Frank Dawson
owning property at "C" and Third spoke favoring the vacation.
A representative for Mr. Sam Shapov and Mr.Coyle spoke protesting the vacation for reasons
given above.
Member Stewart moved, that in view of the fact that vacating the street would land lock
property and because there doesn't appear to be any urgent reason to vacate it, that it
be recommended to City Council that Third Avenue between Sea Vale and "C" .Streets not be
vacated. The motion was seconded by. Member-Calkins and unanimously carried.
ZONE VARIANCE - Peter & Nellie Zounes, 636 "E" Street
The variance application was read asking that a zone variance granted in 1949 be expanded
to allow the processing of fish and meat products. The previous variance was for a whole-
sle meat distributing plant, an M-1 use in an R-3 zone. Mr. McDonnough, Mr. Bill Lane
and Mr. L. Holzeman spoke explaining. the anticipated operation and stating that there
will be no rendering involved, no packing in the usual sense of the word, no noxious
odors will be created and that they will use only frozen filets of tuna. They further
explained that improvements will be made to the property so that it will be an asset to
the neighborhood.
Protests were heard from Mr. Wayne Vanderpool, owner of business properties on the north
side of "E" Street, Jim Lister, representing Johnson-Tyson-Lynds, owners of property to
the west which will be developed into rental units, Leonard Morgan representing Mr. B.F.
Smith owner of a cabinet shop adjoining this property and a letter of protest was read from
.�Jrs. Ella Berlinger, 190 Broadway.
The application for zone variance was signed by 5 persons approving the granting of the
variance and Mr. R. Landells spoke extensively kvoring the granting of the variance. He
stated that he had had considerable experience in meat packing and that upon investigating
the process outlined here, was certain that no ill-affects can be created.
The applicant stated that the present operation involves the packing of sau.-sage, weiners
and the like and that the proposed operation will be so similar that the appearance and
effects of the proposed operation will not be different than at present. They stated
that the business wishes to locate in Chula. Vista to be close to the tuna industry in
' San Diego.
Chairman Menzel .closed the hearing and Member Stewart stated that he feels the conditions
of the previously granted variance were Violated because the variance was for distributing
only and that processing of fish and meat foods is not allowed even in an M-1 zone. Member
King stated ,that varianci,es have been granted in the past with conditions which were Vio-
lated and the city. was left with no manner of enforcement. City Attorney Campbell stated
that there is no way to control such operations, that trying to declare a nuisance is
very hard, so that it is not a reliable control.
Member Calkins moved that the matter ,be .held over until the September 16th meeting for

further study. The motion carried by the following vote, to-wit:
AYES: Members King, Calkins and Menzel
NOES: Member Stewart
ABSENT: Members Crossley and Armstrong
ZONE VARIANCE - Lloyd Lee, Inc. , 740 "F" Street
The application for zone variance, asking a reduction in setback on "F"
Yfrom 25 to 0 feet was read. There being no representative in the audience
and because of a lack of information concerning the proposed use of the
land, the variance was held over to the next meeting.
ZONE VARIANCE - Walter Fish, 124 Landis
Chairman Menzel asked for the reading of the variance which requests per-
mission to construct a second unit on the property, an R-2 use in an R-1
zone.
Mr. Vanderpool, 197 Landis, spoke favoring the granting of the variance.
Chairman Menzel closed the hearing and Member King stated that he feels,
due to the fact that the surrounding property is zoned R-3, that this
variance should be granted.
Member Stewart stated that while he. is sympathetic with the problem, he
feels that there is no hardship, within the meaning of the ordinance.,
involved in this case and that therefore the variance cannot be granted.
Member King moved, with Member .Calkins seconding, that the variance be
granted. The motion failed to carry by the following vote, to-wit:
AYES: Members King and Calkins
NOES: , Members Menzel and Stewart
ABSENT: Members 'Crossley and Armstrong
ZONE VARIANCE - Abe Wasserman, 320 "G" Street
The variance application asking for permission to build 6 additional
rental units on his R-3 property for which setback variances are
required, was read.
Ms. Wasserman explained the situation and comments were heard from Mr.
Daniel Miranda. Chairman Menzel then closed the hearing.
Member Stewart moved that the variance be granted - units to be added
as per plan submitted, with a 2 foot reduction in west side yard setback,
12 foot reduction in east side yard setback and 63 foot reduction in rear
yard setback, all as shown on plan submitted with 'the following conditions:
1. That the applicant provide one adequate off-street parking
space for each dwelling unit.
2. That wherever a fire wall of 2-hour fire resistive material
is required the Planning Commission recommends that it be
constructed of brick veneer.
The motion carried by the following vote, to-wit:
AYES: Members King, Calkins, Menzel, Stewart
NOES: none
ABSENT: Members Crossley and Armstrong
PERMISSION TO BUILD ON EASE14ENT - E. J. Plwell, Hilltop, north of "G"
Maps were presented showing the proposed easement and locations of houses to be built.
Member Stewart moved, that in view of the fact that available records indicate that
it might be possible to widen the proposed easement or work with adjoining owners to
subdivide the area, that the matter be held over and the applicant attempt to work
out a better solution for developing this particular property. Member Calkins seconded
the motion and it was carried unanimously.
HALF-STREET DEDICATION - South of Murray, East of Second
Chairman Menzel explained the situation, that the city is in possession of a 30 x 290 foot
strip of land, dedicated for a period of 10 years for street purposes, which reverts to
the subdivider of adjacent property if it is not being used for streets within the ten
years. He explained that the Planning Commission had been asked to study the situation
to determine whether or not a street is needed in this location.
It was moved by Member Stewart, seconded by Member Calkins and unanimously carried that
it be recommended that this strip of land be adequately cleaned up and maintained but
not improved at this time: that by April 1, 1962, one year prior to the expiration of
the deed, if the area lying southerly thereof has not been subdivided, using this strip
for a street, that the city dedicate it for street purposes and open it up for usei::This
would result in a through street between First and Second, the only one south of Halsey
in this block.
CLARIFICATION OF ZONING ORDINANCE
The Commission was requested to clarify the ordinance as to whether or not furnaces for
the reduction of iron ores, on an experimental basis, would be allowed in the M-1 zone
under the classification "experimental laboratory".
The Commission ruled that this ,operation, as described, be allowed as an experimental
laboratory in the M-1 zones
