OF THE PLANNING COIv1MISSION OF THE CITY
OF CHULA VISTA, CALIFORgIA
Held February 6, 1956
The Planning Commission of the City of Chula Vista met on the above date in the Council
Chambers at Civic Center, at 7:30 P.M. with the following members present: Shamrell,
Menzek, Young, Raitt, Crossley, Burford and Hesse. Absent: none. Also Present: City .
Planner Scherer, Principal Engineer Johnson and City Attorney Campbell.
APPROVAL OF MINUTES:
It was moved by Member Crossley, seconded by Member Hesse and unanimously carried
that the minutes of the meeting of January 23, 1956, .be approved, copies having been
mailed to each member.
J. M.' BANISTER PROPERTY: -
The City Council referred the J. M. Banister property to the Planning Commission for
further discussion. The Planning Commission agreed that ChairmanRaitt-would contact
the Banister Company, as their representative, and offer the following solution to
the problem of Mankato Street, and bring the Banister's .reaction to the proposal tb
the next meeting. The solution to be offered is as follows: That The Banister Company
resurface Mankato street from Third Avenue to Garrett for a width of 25 feet; That
on the northerly 5 feet of the present 30' right-of-way, the Banister Company construct
a sidewalk, curb and gutter; If the Banister Company agrees to this proposal, the.
city shall return to them the 30' parcel of ground from Garrett Avenue to the east for
a distance of 180 feet.
PERMISSION TO BUILD ON AN EASEMERT - Aaron Winner -.140 First Avenue
A letter from Mr. Aaron Winner asking permission to build a residence on a 1217 easement. •
The lot is to the rear of a parcel fronting at 140 First Avenue. Chairman Raitt asked
Mr. Winner if there was any reason why they couldn't build two houses on the entire
lot and if the two lots could not be returned to their original one-lot ownership.
It is an R-2 zone. Mr. Winner agreed to do this, namely, return parcels 1 and. 2 to
the original ownership.
It was moved by Member Young, seconded by Member Menzel and unanimously carried that
the request to build on an easement ,be denied because of the resulting substandard
lots, and with the recommendation that parcels one and two be reverted to original
ownership.
DISCUSSION ON OLD LIBRARY SITE:
Member Young, chairman of the committee, stated that they would not have all the in-
-formation needed before another month and would like to make a report at that time.
The Planning Commission acknowledged and asked that Member Young inform the secretary
when the committee is ready to make their report.
SOUTHERN CALIFORNIA PLAI�TNIIQG CONGRESS:
E �An invitation to a dinner meeting for members was read to the Commission. Mone of the
members will be able to attend, so no reservations were made.

SUBDIVISIONS:
Shaffer Court - Final Map - Glover and "E"
Final maps of the above subdivision were presented to the Commission along with the
recommendations of the Department of Engineering and the committee from the Planning
Commission.
It was moved by Member Young, seconded by Member Burford and unanimously carried that
the final map of Shaffer Court be approved, as the subdivider had complied with all
recommendations of the tentative map.
Kenwood Village #6 - Final Map - Between Kearney and "K", west of Fifth
Final maps of Kenwood Village #6, and recommendations of the Ingineering Department
and the committee from the Planning Commission were presented to the Commission. The
Planning Commission recommends that the subdivider' change the name of the proposed
Kearney Street as the alignment with the present Kearney would result in a jog of
approximately 250 feet. The subdivider agreed to this condition.
It was moved by Member Shamrell, seconded by Member Young, and unanimously carried
that the final map of Kenwood Village #6 be 'approved, as the subdivider met with
the requirements of the tentative map and with the recommendation that the proposed
Kearney Street be given another name.
VARIANCES:
Frank Hagen, MD - 492 Third Avenue
The variance application of Frank Hagen, MD, for the purpose of constructing a medical
building in' an R-3 zone was read to the Commission. `there were no objections from
the audience.
It was moved by Member I`Ienzel, ..seconded by Member Crossley and unanimously carried that
the variance be granted subject to the following conditions:
1. That the applicant maintain a 5' setback on Third Avenue.
2. That he be allowed a 10' reduction in rear yard setback.
3. That he provide off-street, dustless surface parking for a minimum of
ten cars.
4. That advertising signs be restricted to a five square feet sign, lo-
cated within the setback lines.
5. That all public improvements be approved by the Department of Engineering.
George and Mary Kenworthy - 276 "K"
The variance application of the Kenworthys asking permission to reconstruct a flower
stand was read along with committee recommendations. Mr. Phillip Burell, 270 "K"
Street, stated he objected to Mr. Kenworthy' s building such a stand. He feels that
if he is allowed to do this, that it will open up the street for more commercial uses.
Chairman Raitt stated that Mr. Kenworthy has been selling flowers there for some time
- prior to the enactment of the zoning ordinance, which makes it a non-conforming use,

and that Mr. Kenworthy can continue to sell flowers there. He actually wants only to
improve the appearance of the old stand. Mr. D. Siler, another neighbor, asked what
assurance they will have that the stand will be in use for only 18 months and that
it will be a nice appearing stand. He was told that it had been stated in the appli-
cation by Mr. nenworthy that it would be_ in use only 18 months, and that it would be
a part of the variance that it could be, used for only 18 months. As far as appearance,
Mr. Kenworthy would have to show plans to the Building and Planning Departments before
construction.
It was moved by Member Crossley, seconded by Member Burford- and unanimously carried
that the variance be granted subject to the following conditions:
1. That the stand be portable and be located at least 50 feet from the centerline
of "K" Street.
2. That the design of the stand be subject. to the Departments of Planning and
Building' s approval.
3. That no advertising signs be allowed.
4. That he provide off-street parking.
5. That the variance be in use for a period not to exceed 18 months.
Sam Shapov - 7 Third Avenue Extension
The variance application of Mr. Shapov, requesting permission to erect a real estate
office, was read together with the recommendations of the Department of Engineering
and the Planning Commission investigating committee.
It was moved by Member Young, seconded by Member Shamrell, and unanimously carried
that the variance be granted subject to the following conditions:
1. That the applicant install curb, gutter, drainage appurtenances; and, that
pavement be installed to the centerline of "C" Street from the intersection
of Third Avenue Extension to the eastern limits of the property as described
by this variance.
2. That dustless-surfaced, off-street parking be installed for a minimum of
ten cars.
3. That advertising signs be restricted to a total of 100 square feet and lo-
cated within the setbacks of the R-3 zone.
Margaret K. and Margaret S. Brown - 550 Fourth Avanue
The variance application submitted by the Misses Brown was read to the Commission.
The situation was explained to the audience and to the members of the Commission who
had not attended the field trip. It was brought out that even though two different
zones divided the property, it was possible to utilize the property without causing
a hardship.
It was moved by Member Young, seconded by Member Crossley and unanimously carried
that the variance be denied for the reason that the jurisdictional facts, as required
by ordinance, were not proved. The secretary was directed to inform the applicants
r that the action could be appealed to the City ''ouncil.

City Attorney Campbell was excused at 8:45 P.M.
Brown & Woolery - Lots 4 and 5, Valhalla Subdivision
The application requesting permission to build multiple units, triplexes, on lots 4
and 5 at the corner of Fig-,,-and 11H" Streets, was presented to the Planning Commission.
Mr. Peter Leone and Mr. Warwick in the immediate neighborhood asked why the entire
neighborhood couldn't be rezoned to R-3 or preferably to commercial uses. Chairman
Raitt stated that it would take more than this variance request to change it. It
takes public hearings preceeded by considerable study, and that while the Commission
contemplates rezoning various parts of the city, any change lies in the future. He
stated that if these particular people have problems, they may submit a variance appli-
cation and their problems will receive consideration.
It was moved by Member Young, seconded by Member Shamrell and unanimously carried that
the variance be approved subject to the following conditions:
1. That the plot plan showing locations of units be approved by the Department
of Planning before a building permit is issued.
2. That each triplex contain a minimum of 750 square feet per unit, and be
only one story high, and that the exterior be in keeping with the adja-
cent single family residences.
COMMUNITY RELATIONS COMMITTEE:
Mr. Jack Perrine, acting as chairman of the Community Relations Committee made a
report to the Planning Commission of the progress made by their committee.
