HomeMy WebLinkAbout1956-05-07 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHUL.4 VISTA Held May 7, 1956 The regular meeting of the Planning Commission washeld on the above date in the Council Chambers at Civic Center with the following members present: Members Shamrell, Menzel, Young, Raitt, Crossley and Burford. Absent: Member Hesse. Also present: City Attorney Campbell, Principal Engineer Johnson and -City Planner Scherer. APPROVAL OF MINUTES: It was moved by Member Crossley; seconded by Member Burford and una-limously carried that the minutes. of the meeting of April 16 be approved, copies having been mailed to each member. CORRESPONDENCE: Letters were read from the San Diego County Planning Commission regarding small craft harbors and from the Recreation Commission regarding a proposed recreation area in Otay. No action was necessary. SPECIAL ORDER OF BUSINESS: Planning: Service Station - Hilltop and Naples - Gibson and Dudley After some discussion it was moved by Member Young, seconded by Member Burford and unanimously carried that the revised plans of the service station to be constructed in the Gibson and Dudley Shopping Center at the northwest corner of Hilltop and Naples be approved, subject to the. final Engineering Department check. South Bay County Building - Plans for addition It was moved by Member Young, seconded by Member Burford and unanimously carried that the plans for the addition to the South Bay County Building be approved as submitted, and a letter sent to the City Council accordingly. Civic Center Addition - Plans for addition It was moved by Member Shamrell, seconded by Member Young and unanimously carried that the plans submitted be given tentative approval with the recommendation that the pre- liminary and final architectural plans be sent to the Planning Commission for approval. Request to Build on Easement - Charles Campbell, 43 'Corte Maria A letter was submitted to the Planning Commission from Mr. Canpbell, withdrawing the request to build on an easement,: Subdivisions: Whittington, Unit #r4 - Final Map - First and "H" Street It was moved by Member Crossley, seconded by Member Burford and unanimously carried - 1 - that the final map of 1hittington, Unit #4, be approved assubmitted, as the subdivider had met with the requirements of the tentative map . Variances: Use: Gordon Snyder (A.E. Gall2Ler) - 568 Otis A-letter was read to the Commission asking that the time be extended on avariance granted on October 4, 195 ., to allow R-3 development of .4 R-2 lots. Two of the lots were developed before' the 6 months time exTired. The applicant wishes to develop the 2 remaining lots at this time, approximately 13 months after the expiration of the variance. It was moved by Member Young, seconded by Member Crossley and unanimously carried that the time be extended 19 months from the -expiration date of the variance; giving the applicant until November 4, 1956, to develop his land. Member Hesse arrived at 8:00 P.M. Dr. & Mrs. Stadin - 67 Fourth Avenue 15 signatures obtained, 4 notices mailed Dr. and Mrs. Stadin wish to operate a nursing home for semi-invalid patients, an R-3 use in an R-1 zone. A letter was read from Mr. and Mrs. Noderer, 75 Fourth Avenue, protesting. the granting of the variance. It was moved by Member Crossley, seconded by Member Young and unanimously carried that the variance be granted subject to recommendations as submitted by the committee, which follow: 1. That dustless-surfaced off-street parking be provided for a minimum of 10 cars.. 2. That no advertising sign larger than 5 square feet be permitted. 3. That no alcoholic, drug, mental or contagious disease patients be admitted, as defined by California State Code. 4. That any additional buildings shall be approved by the Planning Commission. Richard Wilson - 219 "E" Street 15 signatures obtained, 15 notices mailed The applicant requests permission to operate an insurance office at 249 "E" Street, a C-1 use in an R-1 zone. A letter was offered from the Fredericka Homes, adjacent property owner to the west, to the effect that the land in their ownership isproposed to be used as a commercial enterprise in the future. It was moved by Member Shamrell, seconded by Member Menzel that' the variance be granted subject to the conditions following: 1. That dustless-surfaced_ off-street parking be provided for a minimum of -5 cars. 2. , That public improvements, curb, gutter and sidewalk, be installed according to specifications of the Department of 1'ngineering. 3. That no advertising sign larger than 50 square feet be permitted. 2 _ The motion carried by the following vote, to-wit: AYES:, Members ..Shamrellj ,T4enze1- Young, Burford-and Hesse NOES: Members Raitt and Crossley ABSENT: None Frank Alshouse - 122 Corte Maria 9 signatures obtained, 16 notices mailed The application was 'withdrawn by letter stating that another application would be submitted at a later date. Ted Bell - 76 "J" Street 32 .signatu�.es obtained, 4 notices mailed The applicant wishes to construct another home on his R-1 lot. There are now 3 houses on the lot. He also wishes permission to use an easement to First Avenue as access to the house on the rear of his property. It wasmoved by Member Young, seconded by Member Crossley and unanimously carried that I he applicant be permitted to construct this additional house subject to the following conditions: 1. That curb, gutter and sidewalk be constructed on "J" Street. 2. That old houses 1 and 3 (as shown on plan submitted) be removed before final inspection on the new house, leaving only 2 houses on the lot.. 3. That old house #2• (as shown on plan) be removed within 5 years and the lot split into 2_ R-1 sized lots (7,000 sq. ft.) . Mr. Bell may construct a new residence on the rear of his property, which portion being Lot 2 which faces on a private easement that crosses Lot 122 westward to First Avenue. (Easement granted.to Robert's Glen: on January 23. 1956.) Fernando Basulto Limon - 291 Alvarado 33 notices mailed, 0 signatures obtained' Mr. Limon requests permission to construct a service station, a C-2 use, at 291 Alvarado, a C-1 zone. A petition signed by 12 property owners in the area protesting the granting of a variance to allow another service station on Third Avenue was read. After some discussion it was decided that the matter should be held over until the next meeting so that a plot plan could be submitted and for recommendations from the Safety Council. Robert McAvoy - 398 "C" Street 1 signature obtained, 3 notices mailed Mr. McAvoy requests permission to construct an advertising sign in an R-3 zone. The applicant was granted a variance in June, 1954, to construct and operate a restaurant at this location. It was moved by Member Young, seconded by Member Burford that the variance be granted subject to the location approval by the City Planner. The motion was carried unani- mously. Lee P. and Gerald W. Hart - -462, 464, 464? Third 33 notices mailed., 0 signatures The applicants wish to construct a real estate office (a C-1 use) at the front of rental units, in an R-3 zone. - 3 - It was moved by Member Young, seconded by Member Menzel and unanimously carried that the variance be denied for the reason that the jurisdictional facts, as required by ordinance, were not proved. Variances - Other Lawrence Kuebler - 362 Minot The applicant wishes a 91 reduction in rear yard setback. It was moved by Member Young, seconded. by Member Burford and unanimously carried that the variance be granted subject to the condition that the remaining area in the rear yard not be used for construcb-ng additional structures or buildings so as to reduce still further the amount of light, air and space. Robert Rankine - 155 East Naples .The applicant wishes to construct a 61 fence from the rear of his house to the rear property line. It was moved.by Member Crossley, seconded by Member Young and unanimously carried that the variance be denied for the reason that the jurisdictional facts, as required by ordinance, were not proved. James R. and Dorothy Sweeney - 898 Helix The applicant wishes a 51 reduction in setback on the side yard, so that they might install a 51redwood fence on that line. It was moved by Member Burford, seconded by Member Hesse and unanimously carried that the application be held over until the next meeting for further study. Clifford Liesmali - 626 Date The applicant requests a 11 reduction in front yard setback. It was moved by Member Burford, seconded by Member Hesse and unanimously carried that- the variance be granted for reasons stated in the application. John Adams - 609 Brightwood The applicant is requesting. permission to construct a dwelling on an undersi2ed lot. He was granted a zone variance for this purpose on August 1, 1955, but the variance was not used during the six months time allotted. It was moved by Member Young, seconded by Member Hesse and unanimously carried that the variance be granted subject to the conditions that it be used only for R-1 dwelling and R-1 setbacks be observed.
