OF THE CITY OF CHULA VISTA, CALIFORNIA
October 1, 1956
The regular meeting of the Planning Commission of the City of Chula Vista was held on
the above date in the Council Chambers at Civic Center with the following members
present: Shamrell, Menzel,, Calkins, Burford and Crossley. Absent: Member Hesse.
Also Present: Associate Engineer Harshman
APPROVAL OF MINUTES:
It was moved by Member Calkins., seconded by Member Shamrell and unanimously carried
mat the minutes of the meeting of September 17th, 1956, be approved, copies having
been mailed to each member.
Vice Chairman Burford stated that Chairman Young had submitted his letter of resignation
to Mayor DeGraaf but the Planning Commission has not as yet received official notice*
UNFINISHED BUSINESS::
Robert Casey - Intersection of Moss and Naples - Use Variance
A letter was read from Mr. Casey stating that because of the numerous protests to his
application for a zone variance to allow a service station at the above intersection$
he felt a moral obligation to the adjacent property owners to withdraw said applica-
tions No action was taken.
PUBLIC HEARING
Proposed Vacation of a Portion of Moss Street - 7:45 P.M.
This being the time and place as advertised for a Public Hearing Vice-Chairman Burford
declared the hearing open. Letters were read from the Department of Engineering, Police
Chief Roberts and the Safety Council recommending that the proposed vacation of a portion
of Moss Street be approved for safety reasons. Letters were read from the San Diego
Gas and Electric Company and the Pacific Telephone and Telegraph Company stating that
they hand no objections to the closing as advertised as they have no utilities in the
area:,,
A petition was read into the record signed by 39 property owners in the area contiguous
to the intersection, protesting the closing of this section of Moss Street. These
people feel that if the above plan is accomplished, it will put more traffic onto
Naples Street,, which is used extensively by school children and because Moss Street, as
it is now aligned, is a more direct and safe route to both Chula Vista and the Freeway
and should not -be changed.. Protests regarding resulting traffic conditions were heard
from Mr. Robert Ganz, 129 Naples, Mrs. J. A. Gorman$ 161 Naples, Mr. and Mrs. J. W.
Erxleben,, 103 Naples, J. T. Moore, 1123 First, Mrs. M. D. Jorgenson, 119 Naples, Mr. and
Mrs. Knudsen, 1120 Alpine and J. T. Warren, 1123 First. It was explained to the people
present that the proposed vacation of a portion of Moss Street was in no way connected
with the development of Mr. Robert Casey's property, either the subdivision or the tri-
angle formed by the intersection of Moss Street and Naples and that the plan was pro-
posed by the City Engineering Department and not by Mr. Casey. It was further stated
that in Chula Vista's Subdivision Ordinance and also in the State Highway Planning

Manual, right angle stEeets are declared the safest and that streets intersecting at
angles of less than 90 are hazardous.
It was moved by Member Menzel, seconded by Member Calkins and unanimously carried
that the matter be referred back to the Safety Council and Department of Engineering
for further study, with the request that it be seait-back to the Planning' Commission
for their meeting of October 15th.
CORRESPONDENCE:
Mr. William Carnes .- 695 First
A letter was read from Mr. Carnes requesting Planning Commission's approval for him to
conduct. a television and radio repair shop. It would be a matter_ of repairing radios
and televeisions in customers homes with shop work to be done in National City. He
stated that he would not advertise and would do no work on the premises at 695 First
Avenue.
The Planning Commission stated that if this is the case and that the work is to be
solicited by telephone as stated, he would ,be:_allqued to do so with a soliciter's license
from the Finance -Department. He was. told that.,if any work is done on the premises,, and
if he adver'tises,. it will necessitate a.business license and therefore would not be
allowed in a residential zone without benefit of-a zone variance.
Dr. and Mrs. Stadin - 67 Fourth Avenue
A letter was read from Mr. A. R. Stadin asking that the Planning Commission extend the
time on a variance granted to them in May of 1956, for one year. The letter stated
that due to both he and Mrs. Stadin being called away for several. months duration, they
had not been able to establish the nursing home for which the variance was granted.
It was moved by Member Calkins, seconded by Member Menzel and unanimously carried that
the time limit on the variance be extended to November 7, 1957 and the applicant shall
comply with all conditions of the original zone variance.
Ray L. Spence - 483 Minot
A request was made by Mr. Spence that the Planning Commission hear a zone variance appli-
cation on the mid month meeting so that he would not be held up for a month. Permission
was given to hear the application on the October 15th meeting.
Ines Abadi - 424 Vista Way
A letter was read from Mrs. Abadi asking the Planning Commission to clarify whether
or not she would be allowed to sell gift items and jewelry in Chula Vista,, soliciting
&m door to door and by telephone. The Planning Commission stated that under existing
ordinances, if the business is conducted entirely on a soliciting basis, with no adver-
tising, no type of show room on the premises and no selling from the premises, she
could operate with a solibiter's permito
SUBDIVISION
Bison Subdivision - Final Map - Woodlawn at "H" Street
Final Maps were presented along with a letter from the Department of Engineering recom-

mending that the Planning Commission accept the name of Wdodlawn Avenue for the
street in the subdivision rather than require a different name and that a 12 feet
setback be approved by the Planning Commission on Woodlawn Avenue.
It was moved by Member Menzel, seconded by Member Crossley and unanimously carried
that as the subdivider had met the requirements. of the tentative map, the final map
of Bison Subdivision be approved subject to the Engineering Department recommendations
as listed above.
VARIANCES:
Peter Schnor - 730 First Avenue - 32 notices mailed, 6 signatures obtained
The application for a 2 foot reduction in the required side yard setback to enable
Mr. Schnor to add a bathroom to his existing house was read. There were no pro-
tests, either written or oral.
It was moved by Member Crossley, seconded by Member Shamrell and unanimously carried
that the variance be granted - a 2' reduction in the north sideyard setback for a
distance of 10 to 15 feet.
Melvin and Ray Etta Morrell v 332 "E" Street - 31 notices mailed 10 signatures obtained
The applicant's request that they be allowed to build out to a 0' setback on the y
adjacent Landis Street, in line with' a laundromat directly across "Ell Street, was
read. The existing setback is 10 feet. A letter from Mr. Albert Boyer, protesting
the granting of the variance was read,
It was moved by Member Crossley, seconded by Member Calkins and unanimously carried
that the applicant be allowed to build up to the property line on Landis Street, a
10 foot reduction in side yard setback.
Svatko Brothers - Southeast Corner Fourth and "E" - 29 notices mailed, 8 signatures
The application requesting permission to construct and operate an auto laundry, an
M-1 use in a C-2,.zone, was presented. Letters from the Department of Engineering.-and
from the Safety Council were read recommending certain conditions if the variance is
granted. Letters were read from Robert A. Miles and from Kathleen E. Scott protesting
the granting of the variance.
Mr. Alen and Mr. Louis Svatko, stated that they feel these two objections should not
hold up-the granting of a variance when there were 8 signatures approving the variances
and that``they, had already been held up* for' a matter of three months. 4.
It was moved by Member Crossley, and. seconded by Member Shamrell that the variance
be denied. The motion failed to carry, and the members stated that the matter should
be held over until the next meeting.
Mr. Wilson, attorney for the Svatko Brothers stated that it is unfair to his clients to
hold up or even deny their variance for two protests when 8 other people approved the
granting of the variance. Mr. Dan Lawson stated that he felt that the Svatko Brothers
were being unduly delayed, as they should have been allowed to build at that location
without a variance, as a C-2 use.

It was moved by Member Crossley, seconded by Member Menzel and unanimously carried
that inasmuch as the members were still not satisfied as to whether the location is
a good one for an auto laundry
,the hearing be held over until the October 15th Plan-
ning Commission meeting.
INDUSTRIAL ANNEXATIONS:
It was moved by Member Shamrell, seconded by Member Crossley and unanimously carried
that what is known as Industrial Annexation #11 already approved by the Boundary
Commission, be combined with what is known as Industria, Annexation #2 and after it
has been established that the necessary valuation to carry the annexation is assured,
that it be forwarded as an entity to the Boundary Commission for approval of the
boundaries, This annexation to be bounded on the north by the City of Chula Vista
boundary, on the east by the west line of Industrial Boulevard, on the south by the
north line of Palomar street and on the west by the boundary of the City of San Diego.
The Planning Commission approves the above and recommends to the City Council that
action be taken, after approval by the Boundary Commission, to expedite its annexation.
DEDICATION OF A PORTION OF MONTEBELLO STREET
Maps showing the dedication of a portion of Montebello Street to the City of Chula
Vista, were presented. This portion lies east of First Avenue and is the northerly
half of the street, the southerly half having been previously dedicated.
It was moved by Member Menzel, seconded by Member Calkins and unanimously carried
that the dedication of Montebello Street, east of First Avenue, as shown on map sub-
mitted, be approved subject to the Engineering Department requirements and recommended
to the City Council for acceptance.
DISCUSSION:
The Planning Commission requested that a letter be written to tie City Council recommend-
ing that as the city is in need of the services ofa trained planner,, steps be taken to
employ another City Planner.
ADJOURNMENT:
It was moved by Member Calkins, seconded by Member Menzel and unanimously carried that
the meeting adjourn until October 15th, 1956.
