HomeMy WebLinkAbout1956-07-02 PC MINS MINUTES OF A REGULAR ADJOURNED MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA. July 21 1956 .The regular adjourned meeting of the Planning Commission of the City of Chula Vista was held on the above date in the Council Chambers at Civic Center at 7:30 P.M. with the following member-o present: Shamrell, Menzel, Young, Burford and Hesse. Absent: members Raitt and Crossley. Also Present: City Planner Scherer. APPROVAL OF MINUTES: It was moved by Member Burford, seconded by Member Hesse and unanimously carried that the minutes of the meeting of June' 18, 1956, be approved, copies having been mailed to each member. UNFINISHED BUSINESS: Proposed Service Station - 291 Alvarado After a short discussion on the type of sign to be erected at the proposed service sta- tion it was moved by Member Shamrell, seconded by Member Hesse 'and unanimously carried that the advertising sign to be ,erected, in connection with the service station for which a zone variance was granted, must be governed-by the following conditions: 1. No flashing lights to be permitted. � 2. That the sign be non-revolving. 3. That all advertising signs not exceed a total of 100 square feet, excepting those on buildings such as "lubricating" "washing", etc. 1 Monolithic Curb, Gutter and Sidewalk The letter and report from the City Engineer regarding monolithic curb, gutter and side- walk in relation to street right-of-way widths, was held over for further study. CORRESPONDENCE: A letter was read from Mr. Fred Kidd, 230 Ash Street, asking that he be given a 90-day extension of time on a zone variance granted to him for the manufacture of ceramics in an R-1 zone: It was moved by Member Burford, seconded by Member Menzel and unanimously carried that as the applicant has endeavored to secure another location for his business and as he has shown good faith, that the request for a 90-day extension of time be granted . A letter was read from Mr. G. Lee Geyer, 670 Del Mar, reporting conditions existing at 666 Del Mar, which lot has a main house and 2 additional rental units. The owner has divided the lot, with 501 frontage on Del Mar, jogging around the main house to a 30' minimum width and then back out to a 50' width to the rear of the lot. Mr; Geyer stated that he and his neighbors feel that it is not in� the best interests of the neigh- borhood to have so many houses on a lot and asked that the Planning Commission determine whether or not such a lot could be built upon. - 1 - After some discussion, the Planning Commission directed that a letter be written to Mr. Geyer, with copies to the Building Department and the City Council, stating that the ordinance requires an average 50' width per building lot. In the opinion of the Planning Commission, the manner in which the lot was divided does not give it an average width of 501 ; therefore, no building permit can be issued. SPECIAL ORDIE R OF BUSINESS: Subdivisions: Kile Morgan Terrace - Final Map - Fourth and Sierra Way It was moved by Member Menzel, seconded by Member Burford and unanimously carried that ;the final map of Kile Morgan Terrace be approved subject to the following conditions: 1. That a utility easement be shown on the westerly portion of Lot 17. 2. That the utility easements on San Miguel be governed by the recommendations of the Department of Engineering. 3. That no monolithic curb, gutter and sidewalk be constructed. 4. That all public improvements be according to specifications of the Department of Engineering. 5. That the Planning Commission recommends to the City Council that they accept a 40' radius turn-around rather than the 50' radius as required by the Sub- division Ordinance, on the easterly end of San Miguel. Variances: Mr. and F°xs. D.R. Lovell - Use Variance - 135 "D" Street Mr. and Mrs. Lovell's application requesting permission to construct a four-unit apartment and a single family dwelling on a lot extending from "D" Street through to Minot Street (approx±mately 135 "D" and 134 Minot), an R-3 use in an R-2 zonep was read. Mrs. Frances Hawkenson requested that it be clarified whether or not the lot abutts an alley or "D" Street. It was determined that the lot abutts "D" and also Minot. It was moved by Member Burford, seconded by Member Menzel and unanimously carried that the variance be granted subject to the following conditions: 1. That they provide dustless-surfaced off-street parking for each unit. 2. That the applicant maintain a setback as prescribed by ordinance. 3. That the building plans be subject to the Building Department. Mr. Earl Lombard, 228 "H" Street - Setback Variance Mr. Lombard requested,a 5' reduction in front yard setback so that he could construct an apartment building 201 from the property line. Plans for the building were shown and it was the-feeling of the Planning Commission that Mr. Lombard was trying to put too many units on the lot. , Mr. J. E. Eddy, 223 "H"'Street, Misses Helen and Lillian Kennedy, 222 "H" Street protested the granting of the variance, stating that all the other houses were set back more than the required 251 , therefore, the applicant should be made to comply with the ordinance. -2 - Member Shamrell stated that he could see no reason why the applicant had to put 20 units on the lot, that 18 would be sufficient and he would still be getting full value from the land. It was moved by Member Burford, seconded by Member Shamrell and unanimously carried that the variance be denied for the reason that the jurisdictional facts as required by ordinance were not proved. It was suggested that Mr. Lombard construct 18 units and observe all setbacks, RECOriMENDATION Member Shamrell's term on the Planning Commission expired June 30, 1956. It was the unanimous opinion of the Planning Commission that a letter be written to the City Council recommending that Mr. Shamrell be reappointed to the Planning Commission for another term. DISCUSSION The members of the Planning Commission discussed the article in the Chula Vista Star- News reporting that Mr. Harold Foster of the Sweetwater Union School District stated that the schools should be eliminated from the proposed parking ordinance and that the Planning Commission should not attempt to tell the schools what to do. Mr. Scherer read from the Government Code an article giving the Planning Commission authority to recommend certain things to the schools and giving them jurisdiction over the location etc., of all public buildings, including schools. The Planning Commission directed that the City Planner, after consulting with the City -XC Attorney, write to the Sweetwater Union and Chula Vista School Districts, calling their attention to the Government Code and stating that in the future, the Planning Commission should receive copies and reports from the schools on all proposed buildings, additions, new locations, etc., for approval and recommendations.
