HomeMy WebLinkAbout1956-10-15 PC MINS MINUTES OF A REGULAR ADJOURNED MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Ocrober 15, 1956 The regular adjourned meeting of the Planning Commission of the City of Chula Vista was held on the above date in the Council Chambers at Civic Center at 7:30 P.M. with the following members present: Calkins, Crossley, Burford, Hesse and Menzel® Absent: none. Also Present: Associate Engineer Harsh0man and City Attorney Campbell. APPROVAL OF MINUTES: ,It was moved by Member Crossley, seconded by Member Calkins and unanimously carried that the minutes of the meeting of October 1, 1956, be approved, copies having been mailed to each member. ZONE VARIANCE - RAY L. SPENCE, 483 Minot 44 Notices Mailed, 1 Signature Obtained The applicant's request to add a carport to his existing house, three. feet from the side property line on the north of his property, was presented to the Commission. No objections were filed, either written or oral. It was moved by Member Menzel, seconded by Member Crossley and unanimously carried that the applicant's request for a 2' reduction in the north side yard setback for the length of the proposed carport is granted® SVATKO BROTHERS - Southeast Corner of Fourth and "E" Vice Chairman Burford opened the continuation of a public hearing on the variance appli- cation of the Svatko Brothers to construct an auto laundry at the southeast corner of Fourth and 10E" Streets, an M-1 use in a C-2 zone. There being no comments, either for or against the granting of the variance, the hearing was closed. It was moved by Member Menzel, seconded by Member Crossley, that the variance be deniedo The motion carried by the following vote, to-wit: AYES: Members Menzel, Crossley and Burford NOES: Members Calkins and Hesse ABSENT: none Vice Chairman Burford explained tothe applicants that as provided in Ordinance No. 398, they may appeal this decision to the City Council within ten dayse CONTINUATION OF PUBLIC HEARING - Proposed Vacation of a Portion of Moss Street Vice Chairman Burford opened the continued public hearing on the vacation of'a portion of Moss Street. A letter was read from the City Engineer reiterating the department's recommendation that this portion of Moss Street be vacated and elaborating on their previous statement that intersections of less than 900 angles are hazardous. The letter further stated that if Moss Street is left as is, the intersection will actually be 115 feet wide, but if the street is vacated and the plan to continue the flow of traffic from Moss to Naples via Alpine is affected, the intersection will be only 40 feet wide. -1 0 This comparison in itself, provides a very good reason to proceed with the present plan. Protests to this vacation were made by Mrs. M. L. Jorgenson, 119 Naples, Mrs. J. A. Gorman, 161 Naples' Robert MacNear, 121 Naples and Robert Ganz, 129 Naples. Their protests concerned the fact that more traffic would be thrown onto Naples Street as drivers would not make the turn onto Moss via Alpine Avenue and also the lack of safe passage to school for their children who now walk down Naples Street, Mr. Ganz stated that these people had been told the original plan of the subdivision going in at this location called for the street to remain as is with the small triangle resulting being planted with trees and shrubs. He asked what had brought about a change of plan. It was explained to Mr. Ganz that this was the plan as submitted on the tentative map of the subdivision. The triangular piece of land would have been dedicated to the City with its maintenance the City's problem, this, at the time, did not seem feasible to the Planning Commission. The Planning Commission also felt that the lot nearest to the intersection of Moss and Naples would not be a desirable building lot with a street on three sides. For these reasons the Planning Commission requested that the building lot nearest the intersection be eliminated, leaving a larger triangle than originally pbnned. The question arose as to what traffic signs would be posted if this plan is affected. Engineer Harshman stated that the present plan for traffic signs, including those ex- isting, is as follows: On Naples - at Third Avenue and at Hilltop (both existing); On Jacqueline Way, Second Avenue, Karen Way and Alpine Avenue at Naples; and one on Second Avenue at Doss Street. One of the protestants stated that this plan would make Naples a through street, and would not slow down the traffic. The Chairman of the Planning Commission explained that after the development of the street, if the situation becore s such as to require stop signs on Naples, the people may request an additional sign or signs and their request will receive consideration. The public hearing was closed. It was moved by Member Crossley, seconded by Member Hesse and unanimously carried that the Planning Commission recommend to the City Council that a portion of Moss Street be vacated as shown on map attached and that the plan to continue the flow of traffic from Moss to Naples via Alpine be accepted, as shown. APPEAL OF ZONE VARIANCE - Granted to Melvin and Ray-Etta Morrell at 332 "E" Street The letter to'the4City Council protesting the Planning Commission action in granting a variance to reduce the ten foot setback to zero foot on Landis Avenue adjacent to the above property, was read to the Commission. A report on the findings of the Plan- ning Commission concerning the variance in question was read. It was moved by Member Crossley, seconded by Member Menzel and unanimously carried that the findings be approved as written, and forwarded to the City Council for their action. CLARIFICATION OF ORDINANCE NO. 398 Proper Zoning of a Dog Kennel The Planning Commission requested that a resolution be prepared for the next meeting establishing a Dog Kennel as a use allowable in an M-1 zone. In the judgement of the Planning Commission, a dog kennel is no more objectionable than an animal hospital, an allowable use in an M-1 zone. 2 Proper Zoning of a Pet Shop The Planning Commission requested that the matter be held over until the next meeting in order that they might give more study to the problem. CORRESPONDENCE: Fred Kidd - 230 Ash Mr. Kidd was granted a zone variance in 1952 to conduct the wholesaling and manufacture of cermmics in his residence. The variance has expired and he has been granted two 90-day extensions of time to enable him to locate in the correct zone. Mr. Kidds letter states that he has located a building at 380 "E" Street and asks a further extension to allow him to continue operation at 230 Ash while remodeling is taking place at 380 "E" Street. It was explained that 308 "E" Street, being a C-2 sone is still not the correct zone for his type of business - any wholesaling or manufacturing is an M-1 use. It was moved by Member Menzel, seconded by Member Calkins and unanimously carried that the applicant be granted an additional 90-day extension so that he may either find another location or submit a zone variance, if he desires, for 380 "E" Street. V. L. Stowell - 669-A "F" Street Mr. Stowell's letter requesting permission to build on an easement was read to the Planning Commission. The lot in question is an R-3 lot and he wishes to build rental units to the rear of his existing residence. The building lot is not on a dedicated street but .has access from an easement to "F" Street. Mr. Stowell is now endeavoring to work out an agreement with adjacent property owners to put Davidson Street through which will provide frontage on a dedicated street for him and adjacent owners. The Planning Commission requested that the matter be held over until the November 5th meeting so that they might visit the location on the field trip of November 1, 1956. MISCELLANEOUS: Vice Chairman Burford asked the City Attorney for the status of various requests referred to him by the City Council from the Planning Commission. Mr. Campbell replied that the requested amendment that would require a property survey before construction was under study and the request for a definition of occupation and business would also be con- sidered. Vice Chairman Burford asked the status of the off-street parking ordinance referred to him by the City Council. Mr. Campbell stated that it had been referred to him with no date given for its return to the Council and that consequently nothing had been done with it as yet. The Planning Commission unanimously agreed to write a ,letter to the Council requesting the status of the parking ordinance at the present time and asking what the Council's intentions are with respect to it. The Planning Commission directed that letters be written to Members Young and Shamrell expressing the regret of the Commission that it had been necessary for them to resign and thanking them for their fine service to the City while serving on the Commission.
