HomeMy WebLinkAbout1955-03-07 PC MINS MINUTES OF A'REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, .CALIFORNIA Held Monday, March 7, 1955 The Chula Vista Planning Commission met in the Council Chamber at Civic Center at 7:30 P.M. on the above date with the following Members present: Mohr, Farris, Young, Henninger, Trook, Raitt, Perrine. Absent: None. Also Present: Principal Civil Engineer Johnson, City Attorney Campbell, OPINION FROM CITY ATTORNEY Chairman Mohr read an- opinion by the City Attorney on action taken by the Plan- ning Commission at its meeting of February 21, 1955 on a proposed mortuary variance at 151 Fourth Avenue. City Attorney Campbell, in answer to a question by the Commission, stated that in his opinion, a person with an option on property may be considered the same as an owner or lessee in applying for a zone variance. APPROVAL OF MINUTES It was moved by Member Young, seconded by Member Farris and unanimously carried, that the minutes of the meeting of February 21, 1955 be approved with the following amendment relative to the Gardner-Stafford zone variance request: that further action on the proceedings shall be held in abeyance pending action or advice from the City. Council. CONTINUATION OF HEARING - Gardner-Stafford zone variance request. Another lengthy discussion ensued on the variance request for a mortuary at 151 Fourth Ave. After hearing both the pros and cons of the matter, it was moved by Member Young, seconded by Member Farris that the variance be granted for the reasons stated in the application. The motion failed to carry by the following vote, to-wit: AYES: Member Young. NOES: Members Perrin, Farris, Henninger, Raitt, Trook, Mohr. ABSENT: None. Since the majority of the Commission voted "No", the variance was therefore denied. ZONE VARIANCES Hazel F.. Walsh, 626 Colorado Ave.,. requested a variance to allow a home beauty shop in an R-3 zone. It was moved by Member Rai.tt, seconded by Member Farris and unanimously carried, that the variance be denied for the reason that the Commission determined that personal financial hardship was involved and not hardship relating to land or building use. Louis J. Lombardy, 666 Third Ave., requested a variance for a mortuary located in an R- zone. It was moved by Member Trook, seconded by Member Perrine and unanimously carried, that the variance be granted for the reasons stated in the application. Terryfs Trailer Park, 350 National Ave. requested a variance to allow the ad- dition of seven trailer spaces in an existing trailer park in an R-3 zone. It was moved by Member Young, seconded by Member Perrine and unanimously carried, that the variance be granted for the reasons stated in the application. Winfield C. Thompson, N W Corner "K" St. and Church Ave., requested a variance to allow the construction of a medical building and paved parking area in an R-1 zone. It was moved by Member Young, seconded by Member Trook and unanimously carried, that the variance be granted for the reasons stated in the application, and provided that there be parking space within the property confines for at least 10 cars, as per the plan submitted. Lloyd J. Reuter, N W Corner "K" St. and Church Ave., requested a variance to al- low a paved parking lot in an R-1 zone. It was moved by Member Farris, seconded by. Member Perrine and unanimously carried, that the variance be granted for the reasons stated in the application, for a parking lot only, and provided that bumper guards be established on the north property line. Charles E. Brown, 700 Blk, National Ave. (west side), requested a variance to build a new car agency in an M-1 and R-3 zone. It was moved by Member Trook, seconded by Member Perrine and unanimously carried, that the variance be granted for the reasons stated in the application, and that the Planning Commission recommends to the City Council that it feels that it is desirable to have a 20 foot alley through the rear of the property and that the Council take whatever action is necessary to acquire dedications for alley purposes. V. P. Flynn; M.D., 587 Third Avenue, requested a variance to allow the opening of a doctor's office in an R-3 zone. It was moved by Member Raitt, seconded by Member Henninger and unanimously carried, that the variance be granted for the reasons stated in the application. M. Gilbert Dudderar, 651 Third Ave., requested a variance to operate a mortuary in an R-3 zone. After a lengthy discussion, Chairman Mohr recommended that the matter be held over until the meeting of March 21, 1955, at which time the applicants : shall present sufficient information to the Commission. Mrs. Allegra M. Powers, 258 Alpine Ave., requested a variance to allow an 18 inch side and rear yard forthe construction of a plastic covering over an existing patio. It was moved by Member Young, seconded by Member Perrine and unanimously carried, that the variance be granted for the reasons stated in the application. Matthew Moschetti2' 141 Brightwood Ave., requested a variance ,to allow a 3 ft. side yard to connect a rear building to existing house. It was moved by Member Farris, seconded by Member Young and unanimously carried, that the variance be granted for the reasons stated in the application. LETTER - Mrs. Emma Kappner. The Secretary read a letter from Mrs. Kappner, 156 Third Ave., requesting another six month's extension on a zone variance granted her September 14, 1953 and on which two six month's extensions had previously been granted. It was moved by Member Raitt, seconded by Member Young and unanimously carried, that the requebt be denied. FINAL MAP - Silver Dollar Tract - Eugene Boas. It was moved by Member Young, seconded by Member Farris and unanimously carried, that the Final Map of the Silver Dollar Tract be approved, subject to engineering check, with.provisions for 6 ft. utility easements. -2- TENTATIVE MAP - Bella Vista Heights - Jack Spencer. It was moved by Member Farris, seconded by Member Young and unanimously carried, that the Tentative Map of Bella Vista Heights be approved with a 1 ft. lot at the end of Emerson Street and at the north and south ends of Teresa Way, and that.Lots 13 and 14 have 15 ft. side yards. FINAL MAP - Whittington Subdivision Unit #3. -- F. Whittington. It was „moved by Member Farris, seconded by Member Young and unanimously carried, that the Final Map of Whittington Subdivision, Unit No. 3 be approved with Lots A. B and C at the southerly end of Second Avenue, ,and with 6 ft. easements to be provided on the westerly end of Lots 65 and 66, and subject to engineering check. The Commission recommended to the City Council that steps be taken to open "L” Street West to Third Avenue to provide access for people in the new subdivisions. LETTER - Chula Vista City School District. Chairman Mohr read a letter from J. C. Lauderbach, Superintendent of the City School District, requesting approval of a 'site on Fourth Avenue between "G" and IIHrr Streets to be used as additional playground for the Vista Square School. It was moved by Member Farris,' seconded by Member Young and unanimously carried, that the request be approved. LETTER - Chula Vista Recreation Commission. Chairman;lMohr-read_&,_letter fromiF. S. Fulwiler, Director of Recreation, re- questing a discussion with the Planning Commission on possible land for'parks and recreation facilities. A general discussion was held with Mr. Fulwiler and Mr. Sorenson of the Recreation Commission. No action was taken. RESOLUTION NO. 44.- Relating to Opinions Without Hearing.. Offered by Member Trook, read in full, passed, adopted and approved by the fol- lowing vote, to-wit: AYES: Members Trook, Perrine, Farris, Young, Henninger, Raitt, Mohr. NOES: None. ABSENT: None. OTHER ITEMS Amendment-of Zoning Ordinance No. 398. It was moved by Member Farris, seconded by Member Perrine and unanimously carried, that the Planning Commission recommend to the City Council that an Ordinance be adopted providing that no residential use can be made of any "M" Zone except by zone variance procedures. Public Improvements. A general discussion was held and it was the consensus that all new construction be required to improve property as provided in the Subdivision Ordinance. The matter was referred to Principal Civil .Engineer Johnson for further study.
