HomeMy WebLinkAbout1955-11-21 PC MINS MINUTES OF A REGULAR ADJOURNED MEETING OFT HE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA Held November 21, 1955 The Planning Commission of the City ofChula Vista held its regular adjourned meeting on the above date at 7:30 P.M. in the Council Chambers at the Civic Center with the following members present: Shamrell, Menzel, Raitt, Corssley and Hesse. Absent: Members Young, Burford, Also Present: City F5nner Scherer, Principal Civil Engineer .Johnson and City Attorney Campbell. APPROVAL OF i9ITNTES: It was moved by Member Crossley, seconded by Member Shamrell and unanimously carried that the minutes of the meeting of November 7, 1955 be approved, copies having been mailed to each member. CORRESPONDENCE: The letter and report from the Subdivision Standards Committee' of the San Diego County Planning Congress was discussed briefly by the Commission and City Planner Scherer. Chairman Raitt stated that he felt the project was worthwhile and that the committee- is doing a good job. PUBLIC HEARING - Resolution #58, amending Ordinance #398 Chairman.Raitt continued the public hearing on Planning Commission Resolution #58, amending Ordinance #398• Mr. Ed Culnan, 644 "G" Street objected to the changing of R-3 land to M-1 for the reasons that he felt that it would be detrimental to his and otherresidential property in the are, He pointed out that the area to be changed From R-3 to M-1 composes 143 acres and that there is a total of 56 homes. He further stated that a large part of this was-..agri- cultural land and that farming, in his opinion_, was needed in Chula Vista because the farming industry here brought into Chula Vista $20,000,000.00 per year. He felt that Chula -Vista has always been a city of homes, recreation and farming and that it should be allowed to stay .that way, and that while the rezoning could not force the farmers out, it definitely was not encouraging them to remain. Mr. Virgil Livesay, 695 -11G11 Street, stated that if the farmers didn't farm their land, and leased it instead, they would just make enough to pay their taxes and would get no return on their investment. He stated that he felt that if the farmers stopped to think about it, they would knowit was for their best interests to let industry come in as their land would be much more valuable to them. If they had to sell to subdividers for residences, they would not get the full value out of their land. Mr. J. C. Haney, 527 Oaklawn, the property owners at 330 .Broadway, 79 Woodlawn, 532 Oaklawn all objected for the reasons stated previously. The property owner at 352 Broadway, who also owns 649 'TG" Street, had objected pre- viously to making an M-1 zone in this area. Now the property owner feels that it would be fine if it could be confined to the area along the railroad tracks. The property owner at 394 Broadway- agreed with her. - 1 - Mr. Leonard Moe, 77 Woodlawn, the property owners at 101 Woodlawn, 628 "G" Street and 91-A Woodlawn all objected to changing- it to M-1 because they felt it would be detri- mental to property values. Another property cw ner asked if this problem - obtaining industrial land - could be approached through the process of zone variances and leave it as now zoned. Mr. Fry, representing the Arizona Eastern Railway Company stated that people coming into an area for industrial property would go elsewhere if they had to wait for approval from the Planning Commission and City Council on zone variances. Chairman Raitt stated that zoning by variance was illegal but under some circumstances that it-could be done. He stated that that is the reason the City is faced with this problem of land not property zoned today. lie stated that it is "a result of short-sighted- ness and should have been taken care of ten years ago. Mrs. Norma Roberts, 568 Glover, Secretary of the Citizens League, stated that industry will have to come to Chula Vista if they are to support themselves. She stated that in 1962 to 1970 the World -Par II babies will be entering into-the labor market and we will have to provide for them. She also stated that the total tax rate in Chula lista is almost out of proportion to value received and that it will have to be raised in the near future if the City' s revenue is not increased either by expanding our land available for industry or land for commerce. Chairman Raitt stated that some changes have already been made in the proposed rezoning and more would most probably be made. More work .and study will have to be done before the proposed rezoning can be effectuated and every effort will be made so that the least number of citizens are adversely affected. No solution will please everyone. It seems that the majority of the prople whom he has discussed the proposed change with feel that land is needed where it-.has been proposed. The remaining members of the commission voiced thein approval of Mr. Raitt's remarks. Member Shamrell moved, Member Hesse seconded and it was unanimously carried that the Public Hearing be continued to the January 9th meeting, 9:00 P.M. PLANNING: Southern Baptist Church - Church and Center Streets A letter from Mr. Walter See, Architect of the proposed addition was read and maps pre- sented showing the proposed building. Mr. Scherer explained the maps. The question of providing parking arose," and it was brought out that the chutch was in the process of acquiring add'tional land for parking purposes. It was moved by Member Crossley, seconded by Member Shamrell and unanimously carried that the plans be approved as submitted with the recommendation that the church acquire the land needed for parking. . CENTRAL Southern Baptist Church - Hilltop and "J" Streets A letter from the pastor of ,the Church, Mr. Ray -Tatum, was read risking the approval of the Planning Commission of the tentative location plans submitted for a new church. The maps were presented and the area designated for parking was shown. It was moved b Member Crossley seconded b 11cmber Y� J, y Menzel and unanimously carried - 2 - r that the tentative plans of the church be approved as submitted with the recommendation that they provide parking at the ratio of one parking space for each ten seats in the church and final maps and any subsequent additions of the church be submitted to the Planning Commission for approval. DISCUSSION - Proposed amendment to the Subdivision Ordinance The proposed amendment was read to the Commission and the audience, which basically increased the number of maps required by the Planning Commission; required the sub- divider to have a preliminary conference .with the Planning Staff; required the sub- divider to stake and flag the centerlines of proposed streets; and, defined when a subdivider could apply for a variance in order to change setbacks, et al, on proposed maps. City Attorney Campbell stated he felt that two of the items were repetitious and that the Engineering Ilepartment had for some time been working on a. revised subdivision ordinance. He suggested tha_l a letter be written to Mr. Lloyd Lee:; the representative of the Contractors Association in Chula Vista, and to Mr. Algert and other priv,:te engineers asking them to meet with the Engineering Department and the Planning Commission to offer constructive suggestions on a new ordinance. The. motion was made by Chairman Raitt, seconded by Member Crossley and unanimously carried that the City Planner be directed to write a letter to Mr. Lee- and Mr.Algert asking them to set a date for a meeting with the Planning Commission and the Engineering Department. DISCUSSION : - Proposed repeal of Ordinance #42 acid amendment to Ordinance #398 It was the opinion of the Planning Commission that the City Attorney write a clarifi- cation of Ordinance #424 and Section 12 of Ordinance #398 before any action is taken on this proposed amendment. Chairman Raitt asked that City Attorney Campbell prepare an interpretation of Ordinance #424 and of Ordinance #398, Section 12.. DISCUSSION m Proposed ordinance ori curbs, gutters -and sidewalks Chairman Raitt asked City Attorney Campbell for his interpretation of the proposed ordinance. Mr. Campbell stated that he was aware. of the discrepancies in the ordinance as prepared, but it was his understanding that it complied with the desires of -the City Council. After a short discussion, it was decided that Mr. Campbell, Ns. Johnson, Mr. Grady, Mr. Scherer and representatives of the Planning Commission meet on November 23, 1955 at 8:00 A.M. for a conference to discuss the wording of the text and the intent of the ordinance. VARIANCE: - Joseph Medeiros, Corte Maria and Mitscher A variance was submitted by Mr. ,Medeiros, requesting a 10' setback reduction on Corte Maria, due to the topographical conditions of the lot and that connection could not - be made to the sewer on Corte Maria. _ 3 .. It was moved by Member Crossley, seconded by Member Shamrell and unanimously carried that the variance be granted for reasons stated in the application and that Mr. Medeiros be granted a 101 reduction in setback on Corte Maria and that sidewalks be constructed in accordance with the requirements of the Department of Public Works.
