MINUTES OF A REGULAR MEETING
OF THE PLANNING C0I0IISSION OF THE CITY OF
CIULA VISTA, CALIFORNIA
Held November 7th, 1955
The Planning Commission of the City of Chula Vista held its regular meeting on the
above date at 7:30 P.M. in the Council Chambers at the Civic Center with the following
members present: Shamrell, Burford, Young, Raitt,. Crossley and Hesse. Absent: none.
Also Present: City Planner Scherer and City Attorney Campbell and also Associate
Engineer Harshman.
APPROVAL OF MINUTES:
It was moved by Member Crossley, seconded by Member Shamrell and unanimously carried
that the minutes of the meeting-of October 17th, 1955, be approved, copies having
been mailed to each member.
CORRESPONDENCE:
W. T. Harris - 53 Third Avenue
A letter was read from Mr. W. T. Harris, 53 Third Avenue asking that the City Planning
Commission approve the change of the name of Third Avenue Extension to Third Avenue
and that. the portion of Third Avenue extending north from the intersection of Third
Avenue and Third Avenue Extension to Seavale be changed to Seavale entirely. The
reasons for this request are, the existing confusion with the Third Avenue Extension and
Third Avenue and that Third Avenue will never extend north to the City Limits becaase of
the terrain.
City Planner Scherer stated that if the change were contemplated, a public hearing would
not have to be held for the change to Third Avenue from Third Avenue Extension, but that
a public hearing would have to be held on the name change .to Seavale.
The Planning Commission members felt they would like to have an .opportunity to look the
area over before attempting to make a decision. It was moved by Member Crossley,
seconded by Member Hesse and unanimously carried that the matter be held over until the
December 5th meeting so that the Planning Commission could visit the location on the
next field trip.
Harold Beaumont - 641 First Avenue
A letter was read from Mr. Beaumont asking that the Planning Commission allow him to
make a change on his nonconforming use - apartment on an R-1 lot - to allow him to
install a separate -light meter on the apartment in question from the main meter into
the main house. This would enable him to get off the "commercial rate" imposed upon
him by the .`utility company and thereby lower the service charge..
After considerable discussion, it was the concensus of opinion that if they allowed
Mr. Beaumont to make a change they would have to do it in the form of a variance which
would allow Mr. Beaumont to use the lot' for any R-3 purpose. Mr. Raitt expressed the
regret of the Planning Commission to fir. Beaumont, that they would be unable to help
him and stated that hoped he could resolve his problem another way. -

PUBLIC HEARING:
Chairman Raitt declared the Public Hearing on the rezoning of the area between Broadway
and Montgomery Freeway and from "C" Street south to "L" Street, open. The Resolution
of Intention #58 to amend' Ordinance #398, was read and the maps prepared showing the
proposed and present zoning were displayed and explained by the City Planner.
Mr. Ed Culnan at 644 "G" Street objected to the rezoning, at least that portion which
would change his property to an M-1 zone. He felt that changing any of the land where
houses existed to M-1, would be detrimental to the property. He stated he moved to
this area, which is largely agricultural, for privacy and so that he could ride his
horse every day. He stated that he felt the city was looking too far ahead in zoning
so much land to M-1 for light industry.
Mrs. Lester Harris of 666 "I" Street objected to the rezoning because she felt the M-1
zoning on any residential property would be detrimental to the property value. She stated
she was having a hard enough time selling her property because of the location and would
have a harder time if it is zoned M-1. This particular section is to be reclassified to
R-1. She stated that other cities solve the problems of occupying houses in industrial
areas by allowing negroes to move into the city, but that Chula Vista could not solve
the problem in like manner because negroes were not allowed to live in Chula Vista.
She also felt that property owners there were being discriminated against because they
had to maintain certain setbacks while trailer parks were allowed right om the street.
Mr. Benbow, living on "I" Street, objected to the rezoning of the property to M-1 for
the reason that it would be too close to the new school.
Mr. Charles Woodward, 628 "G" Street, objected on the same lines as Mr. Culnan.
Other comments were that the city desperately needed more industrial land, and that it
had to come from some place and the location as indicated seemed reasonable.
City Planner Scherer stated that the areas allotted for industrial land was largely agri-
cultural and therefore not built: up. Along "G" Street, he stated there were only six
houses. It was also brought out that negroes were not kept out of Chula Vista and could
not, by law, be so.
Chairman Raitt stated that the Planning Commission did not wish to jeopardize property
values .in this area or in any other area, and that he for one, would like to have more
time to look over the area before any action was taken. He stated that definitely
some rezoning was going to have to take place, and that the purpose of a public hearing
was to find out the objections to a plan and what the people who would be effected felt
about it. The members of the Planning Commission concurred in the opinion that more
time was needed to study the situation.
Member Burford moved, Member Crossley seconded, and it was unanimously carried that
the public hearing should be continued to the meeting of November 21st to give more
time for a study, and that a field trip would- be held by the Commissioners on Monday
morning, 8:30 A.M. , November 14th, to go over the area of the city that will be
affected by the rezoning.

PLANNING:
Proposed Corte Maria, "D" Street and Vista Way
A letter was read from the Corte Maria and "D" Street Cooperative Improvement District
and maps presented showing the proposed improvement of Corte Maria and "D" Street and
Vista Way. The property owners in that area, who are paying for the improvements,
request a six foot reduction in the minimum requirement for pavement width.
Chairman Raitt asked Associate Engineer Harshman if the plans ,met with the approval of
the Engineering Department. Mr.Harshman stated they did, that due to the topographical
condition in that area they felt that a 30 foot street would be sufficient as the area
could not expand greatly. The property owners are not putting in sidewalks, just curb
and gutter. They feel it is financially impossible for them at .,this time.
It was moved by MEmber Young, seconded by Member Crossley and unanimously carried that
the Planning Commission approve the request with the condition that Vista inlay also be
reduced to a 30 foot pavement and that construction should meet with the approval of the
Department of Engineering specifications; and, that the Planning Commission recommend
to the City Council that the city accept deeds for a 30 foot pavement and a 50 foot
right-of-way.
SUBDIVISIONS:
Hilltop Park - Tentative Map
The tentative maps and the recommendations of the Planning Department and Department
of Engineering were presented to the Commission. The subdivider stated that the name
of the subdivision could not be changed to Rosemount. because of an existing Rosemount
in San Diego County, but that they -would like to change the name at a future date.
It was moved by Member Young, seconded by Member Crossley and unanimously carried
that the tentative maps of Hilltop Park Subdivision be approved subject to the condi-
tions of the Engineering Department and that the subdividers could change the name
of the subdivision at a future date.
Kenwood Village #5 - Final Map
Final Maps of Kenwood Village #5, previously Kenwood Village #6,- were presented to the
Planning Commission. Recommendations of the- Planning Commission and of the. Department
of Engineering were read and noted.
It was moved by Member Young, seconded by Member Burford, and unanimously carried
that the final maps of Kenwood Village #5 be approved, subject to Engineering Department
recommendations, as the subdivider had met with the conditions of the tentative maps.

VARIANCES:
Hathaway & Quigley - 337 Third Avenue
The variance application asking for permission to use 25% of the floor area of an

existing auto supplies retail business for wholesale business was presented along with
recommendations of the committee from* the Planning Commission.-

o mission.It was moved by Member Young, seconded by Member Burford and unanimously carried that
the variance be granted for reasons stated in the application with the conditions that
the total of whole-sale business merchandise do notoccupy more than 25% of the floor
area and that no outdoor advertising sign be erected.
Joseph Medeiros - N.W. corner Corte Maria and Mitscher
The variance application and committee recommendations were read to the Commission and
the audience. Mr. Medeiros asked for a 10' reduction in his front yard setback. The
committee recommendations stated that the street is not on the building line map and in
such instances the ordinance calls for a 25' setback and that if the variance is granted,
the applicant shall construct a sidewalk in accordance with the Department of Public
Works requirements.
It was moved by Member Crossley, . seconded by Member Young and unanimously carried that
the variance be granted for reasons stated in the application and subject to the condi-
tion that the applicant construct a sidewalk in accordance with the Department of Public
Works specifications.
William J. Burke - west of 88 East "I" Street
Mr. Burke's variance application was read to the Planning Commission and recommendations
of the committee from the Planning Commission read. Mr. Burke requesteda 3' reduction
in the rear yard setback to enable him to build a more liveable house. After a short
discussion, it was moved by -Hember Burford., seconded by Member Crossley and unanimously
carried that the variance be granted for reasons stated in the application.
David Owens - 229 "I" Street
Mr. Owens' application for variance was read along with the recommendations from the
Planning Commission committee. Mair. Burke wishes to build an -apartment on the rear
of his property and requests a 10' reduction in the rear yard setback, to allow for
the construction.
After a discussion, Member Young, moved, Member Burford secondad, and it was._unainimoubly
carried that the variance be granted for reasons stated in the application subject to
the condition that the applicant extend an existing concrete apron adjacent to the
garage, northward, to provide for adequate off-street parking, and that the property be
soldas a unit and not as separate dwellings.
D. L. Haas - 300 Block Del Mar
The applicant wishes to construct a dwelling on a lot which is 1,500 square feet short
of the required 6,000 square feet for an i3-3 lot. The committee recommendations were
read. Member Young moved, Member Burford seconded and it was unanimously carried that
the variance be granted for reasons stated in the application subject to the condition
that the lot be used for just one dwelling and that it never be--developed as an R-3 lot.
Edward Crossley - 146 "L" Street
The applicant, Mr. Edward Crossley, Planning Commission member left the Council Chambers

-�I and the variance application along with the committee recommendations were made.
Mr. Crossley wishes to construct a 61 fence on the side of his property and thereby
allow his family more privacy. Because of the terrain, a normal height fence would
afford no privacy. It was moved by Member Burford, seconded by Meraber Shamrell and
unanimously carried that the variance be granted for reasons stated in the applica-
tion.
Robert G. Dale - 316 "G" Street
Mr. Dale asked for an extension of time on a variance granted in February to allow
Mr. Dale to attach garages to his houses on the rear property line.
Member Young moved, !`'!ember Shamrell seconded and it was unanimously carried that
Mr. Dale be granted an additional six months to complete this work.
MISCELLANEOUS:
Mr. Scherer gave the Commissioners invitations to the semi-annual meeting of the
San Diego County Planning' Congress and reminded them of the report that shouldbe
presented at the meeting.
ADJOURNMENT:
It was moved by Member Young, seconded by Member Shamrell and unanimously carried that
the meeting adjourn until November 21st, 1955•

Final maps of CasaoLindaSubdiv sioprwere�zp"r.esented to the Planning Commission along
with recommendations of the Department of Engineering and the Planning Commission
committee.
It was moved by Member Young, seconded by 11ember Crossley and unanimously carried
that the final maps of Casa Linda Subdivision be approved subject to the Engineering
Department recommendations, as the subdivider has complied with the stipulations
of the tentative map.
