OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
July 16, 1962
The adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held at 7:00 P.M. on the above date in the Council Chamber at the Civic Center
with the following members present: Stewart, Comstock, Weakland, Stevenson, Willhite,
Adams and Guyer. Also present: Assistant Planner Warren, City Attorney Duberg and
Principal Engineer Harshman.
STATEMENT
The Secretary of the Commission hereby states that she did post within 24 hours of
adjournment, as provided by law, the order of the Commission for the adjourned
meeting of July 2, 1962.
A copy of the City Council 's resolution commending Kyle 0. Stewart for his services
as Chairman of the Planning Commission for the past five years was read.
APPROVAL OF MINUTES
Assistant Planner Warren told the Commission that Mr. George Whyte of Wittman
Engineering has asked to have condition #4 in the minutes of July 2, 1962, condi-
tional use permit, Mobile Home Park, changed from "That a new pump station for
sewage disposal be built by applicant. . ." to "That a pump station for sewage dis-
posal be provided. . . ." Mr. Whyte feels that the Castle Park School pump station
may be available.
The Commission declined to change the conditions and stated that Mr. Whyte should
present the matter to the City Council .
It was moved by Member Comstock, seconded by Member Adams and unanimously carried
that the minutes of the meeting of July 2, 1962 be approved , copies having been
mailed to each member.
CONDITIONAL USE PERMIT
(Cont'd) - Chula Vista Christian Reformed Church - East "J" Street - Church Site
Assistant Planner Warren submitted the plot plan showing the proposed location of
the church site, reviewing the discussion of the previous meeting in which the
Commission asked that the Engineering and Planning Departments make a feasibility
study of serving the property behind the proposed site with access and submit their
recommendations to the Commission.
A letter from the City Engineer was read stating that the land in question would not
become "land-locked" although the most feasible means of access would be eliminated
if the property proposed for a church site was developed as such.
Chairman Stevenson asked if it were legally possible to reopen the hearing at this
time. City Attorney Duberg stated that according to our ordinance, the hearing
would have to be rescheduled so that notice of same could be mailed to all property

owners as required by ordinance.
Member Adams stated that the public hearing should be rescheduled only if comments
not previously discussed would be presented.
Chairman Stevenson asked a representative of the group of protestants present if
any new information would be offered if the hearing were reopened.
Mr. Leonard Babin, 734 Monterey Street, speaking for the group, stated they felt
they had pertinent information to relate. Five letters of protest from property
owners in the area, and two petitions from property owners - one to reopen the
public hearing and one protesting the request for use permit - are on file in the
planning department.
It was moved by Vice-Chairman Stewart, seconded by Member Guyer that a new public
hearing for the Chula Vista Christian Reformed Church for a request to use property
on East "J" Street for a church site, be scheduled for the first meeting of August.
The motion carried by the following vote, to-wit:
AYES: Members Stewart, Weakland , Stevenson, Willhite and Guyer
NOES: Members Adams and Comstock

VARIANCE
PUBLIC HEARING - Claude Weigle - 233-241, "G" Street - Setback Reduction and Area
Requirements
The application was read for a variance from the provisions of the City Code for
four lots on the northeast corner of Del Mar Avenue and "G" Street. The applicant
proposes to construct a six-unit apartment building on the corner lot, one unit
for every 845 sq. ft. instead of every 1 ,000 sq.ft. as required by Code. He is
also requesting reduction of setback along Del Mar Avenue from 15 feet to 5 feet
to allow for construction of this building. He further proposes to construct one
7-unit apartment building on each of the other three lots with one unit for every
876 sq.ft.
Assistant Planner Warren submitted a plot plan of the proposed plan stating the
land here was zoned R-3.
This being the time and place as advertised, Chairman Stevenson opened the hearing.
Mr: Claude Weigle, the applicant, and Mr. R. J. Kinsley, 805 Brighton Court,
San Diego, Contractor, spoke in favor of the request.
Mr. James Duberg, owner of the property at 264 "G" Street, stated he was opposed
to the variance of area requirements as requested by the applicant.
There being no further comments, either for or against, the hearing was closed.
The Commission and applicant discussed the possibility of developing the four lots
as one, but Mr. Weigle said that for economic reasons, they desire to develop the
lots separately.
It was moved by Member Adams , seconded by Member Willhite that the application

of Claude Weigle, 233-241 "G" Street for a setback reduction on the Del Mar side
from 15 feet to 5 feet be approved, the exceptional circumstances being that it
is a narrow corner lot with a deep setback on two sides that would leave an un-
reasonable buildable width; that the request for a variance of area requirements
be denied, as no exceptional circumstances would justify it.
Further. , the action be based on the following findings:
(1) Setback variance is necessary for the preservation of a substantial property
right of the applicant.
(2) That granting this setback variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in which the
property is located.
The motion carried by the following vote, to-wit:
AYES: Members Adam, Guyer, Stewart, Comstock, Weakland, Stevenson and Willhite
NOES: None
ABSENT:None
STREETS AND HIGHWAYS
Rex and Frances Eckert - Corner of Brightwood and "D" Streets - Request for
deferral of construction of public improvements
A letter from Rex and Fr'a.nces Eckert was read in which they asked for a post-
ponement for laying sidewalks along their property stating as reasons for
deferral , that pedestrian traffic was light and that there is presently no side-
walk in front of any of the property along this street.
Assistant Planner Warren submitted a plat of the location.
A letter from the City Engineer was read in which the division of engineering
recommended that the request be denied in that the construction will not "cause
a defective condition" nor will construction be "extremely impractical ."
Chairman Stevenson asked Mr. Harshman, Principal Engineer, about the possibility
of granting the deferral and getting a bond .from the applicant to insure in-
stallation at a later date. Mr. Harshman explained that there were no side-
walks on either side of. the street from "D" to Flower and that the ordinance
encourages improvements-;--Since curbs already exist here, denying this request
will be one step in completing the improvements in this block as soon as possible.
Chairman Stevenson felt it might stimulate civic pride in the neighborhood, when
one person puts in sidewalks , encouraging others to follow the example.
Member Adams said he felt that if the Commission granted this deferral without
legal basis , they would be setting a precedent.
It was moved by Member Guyer, seconded by Vice-Chairman Stewart that the request
for deferral of construction of public improvements on the corner of Brightwood
at "D" Street, as requested by the applicant, be denied. No valid reasons for
deferral could be found in accordance with the ordinance.

The motion carried by the following vote, to-wit:
AYES: Members Guyer, Stewart, Stevenson and Adams
NOES: Members Willhite, Comstock and Weakland

COMMUNICATIONS
Written - Ralph Paxton, 590-592 & 594 "D" Street - Extension of time on Variance
A letter was read from Ralph Paxton, Jr. requesting a 6-month extension on their
zone variance. The letter was dated July 2, 1962.
Assistant Planner Warren reviewed the variance which granted a reduction in front,
side and rear yard setbacks to zero along the east, south and west property
lines and a reduction along "D" Street to 5 feet. The expiration date of the
last extension was July 10, 1962.
Vice-Chairman Stewart thought the request for extension was based on the fact
that conditions were such that they could not go ahead with their development
at this time.
It was moved by Vice-Chairman Stewart, seconded by Member Adams and unanimously" ,
carried that the request of Ralph Paxton, Jr. for a 6-month extension on a zone
variance be granted.
MISCELLANEOUS
Appeal from Planning Commission Denial of Variance - Allison E. Gilbert -
1027 Corte Maria
A report of the findings of the .Rlanning Commission was read in regard to the
appeal made by Allison E. Gilbert to the City Council . The report stated:
'The Planning Commission finds that there are no exceptional circumstances about
the property to justify a variance for reduction of side yard setback as re-
quested by the applicant. The purpose of the variance was that an existing patio-
lanai which the applicant built in violation of an ordinance be allowed to remain.
The ordinance requires a 5-foot side yard setback and the room involved lies 12
feet from the property line."
It was moved by Vice-Chairman Stewart, seconded by Member Comstock and unanimously
carried that the Commission is in agreement with the findings.
ADJOURNMENT
It was moved by Member Weakland, seconded by Member Comstock and unanimously
carried that the meeting adjourn sine die.
