HomeMy WebLinkAbout1961-01-30 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA January 30, 1961 A regular meeting of the Planning Commission of the City of Chula Vista, California, was held at 7:00 P.M. on the above date in the Council Chamber at Civic Center, with the following members present: Stevenson, Comstock, Weakland, Harmstead and Adams. Absent: Stewart and Guyer. Also present: Director of Planning Fretz and City Attorney Kugler. STATEMENT: The Secretary of the Planning Commission hereby states that she did post within 24 hours of the adjournment, as provided by law, the order of the Planning Commission .for the adjourned meeting of January 30, 1961 . In the absence of Chairman Stewart, Vice-Chairman Stevenson presided. APPROVAL OF MINUTES It was moved by Member Adams , seconded by Member Harmstead and unanimously carried that the minutes of the meeting of January 16, 1961 be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - C. P. Mote - Southwest Corner Fig Avenue and "H" Street - R-2 to C-2 The application was read requesting rezoning from R-2 to C-2. Planning Director Fretz explained diagrams showing surrounding lots and zoning. This being the time and place as advertised, Vice-Chairman Stevenson opened the hearing. Mr. L. H. Turpin and Mr. Joseph Meyer, along with other property owners on Fig Avenue, objected to the proposed commercial zoning. Bob Thompson, representing the owner, told the Commission that the owner wants to use the existing triplex for business offices and that if the C-2 is not acceptable, perhaps the property could be zoned R-3. This , he said, would permit the owner to apply for a conditional use permit. Member Comstock said he would like to see a study made of the zoning of the entire area around Vista Square. There being no further comment, the hearing was closed. RESOLUTION NO. 199 - Recommending to City Council Change of Zone from R-2 to R-3 of the Lot on the Southwest Corner of Fig Avenue and "H" Street Offered by Member Harmstead, passed, adopted and approved by the following vote, to-wit: AYES: Members Weakland, Stevenson, Harmstead and Adams NOES: Member Comstock ABSENT: Members Stewart and Guyer Vice-Chairman Stevenson explained that the action did nothing more than to recommend that the property be zoned for the use that it now has. He stated that to use the property for business offices , a conditional use permit would have to be approved by the Commission. CONDITIONAL USE PERMITS PUBLIC HEARING - California Water & Telephone Company - 1105 Oleander Avenue The application was read requesting a conditional use permit to locate a booster pumping station at 1105 Oleander Avenue, an R-1 zone. This being the time and place as advertised , Vice-Chairman Stevenson opened the hearing. A plot plan was shown and Mr. Ditter, of California Water & Telephone Company, ex- plained the need and operation. There being no further comment, the hearing was closed. It was moved by Member Comstock, seconded by Member Adams and unanimously carried that the application for conditional use permit to allow location of a booster pumping station at 1105 Oleander Avenue be approved, subject to the condition of a planting screen around the site (to be approved by the Planning Department) . VARIANCES PUBLIC HEARING - California Water & Telephone Company - 1105 Oleander Avenue - Height Variance The application was read requesting a variance to construct a 6 foot chain link fence within the front setback. Mr. Ditter explained that the fence is necessary to protect this equipment from vandalism. Planning Director Fretz pointed out that evidently the equipment was situated on the lot within the setback in an attempt to keep as much as possible of the remaining lot intact. This being the time and place as advertised, Vice-Chairman Stevenson opened the hearing. Member Adams said he felt that a better job of coordination could have been effected if the water company had come to the city prior to installation of the equipment. There being no further comment, the hearing was closed. It was moved by Member Adams , seconded by Member Comstock and carried that the application requesting permission to construct a 6 foot chain link fence within the front setback at 1105 Oleander Avenue be approved, based on the following: 1 . Intended use of the property is necessary for public health and welfare. 2. A six foot fence is necessary for protection of the equipment from vandalism. Member Harmstead 'voted "no", stating that he feels a study shoil'ld be made as to the amount of ground that should be required for a u_tilities.? installation. PUBLIC HEARING - Charles R. and Viola Jantz - 547 "F" Street - Area Variance 2 - The application was read requesting a reduction in the required amount of off- street parking from 1200 sq. ft. to 1025 sq. ft. The application also requested that a portion of the parking be allowed in the front setback area. A plot plan was shown. This being the time and place as advertised, Vice-Chairman Stevenson opened the hearing. Mr. Jantz explained that he inadvertently had made an error, thinking that his lot was 135 feet deep rather than 125 feet. Members Comstock and Adams questioned how such a thing could happen. The Commission discussed the merits of several alternate parking areas but came to no conclusion. It was moved by Member Comstock, seconded by Member Harmstead and unanimously carried that the public hearing be continued to the next meeting, February 6, 1961 , for furthersstudy of the site in the field. APPEAL FROM PLANNING COMMISSION DENIAL OF VARIANCE - Ralph's Superette, Inc. - 303 Hilltop Circle. The secretary read the Planning Commission findings of the denial of a variance to Ralph 's Superette, Inc. , 303 Hilltop Circle, requesting permission to remodel the existing store building on the property, a non-conforming use, into four separate C-1 uses. It was moved by Member Adams , seconded by Member Harmstead and unanimously carried that the findings be approved and forwarded to City Council . SUBDIVISIONS - Robinhood Subdivision Unit No. 7 - Tentative Map Planning Director Fretz explained that this map contains no substantial changes from a previously approved map except that several lots within the future freeway right-of-way had been eliminated. He added that the final map had not been filed in the prescribed time and no extension had been requested. Mr. Fretz said that the planning staff is concerned about the connection where East "L" Street flows into Telegraph Canyon Road. He explained that since the lots in this area have been eliminated, the map shows only a half street at this point. Principal Engineer Harshman presented the Engineering Department recommendations as follows: 1 . That the right-of-way for the south half of Telegraph Canyon Road be dedicated and improved. 2. That the map be approved subject -to final approval of street sections , drainage provisions , sewer facilities and all other improvements to the public right-of-way by the Division of Engineering. 3. That the radius of Telegraph Canyon Road be modified so as to be tangent to the centerline of East "L" Street extended. This , in effect, will shift the subject right-of-way to the north a maximum of 6 feet. Robert Casey, owner and subdivider, told the Commission that he had cooperated with the State Division of Highways and the City in not developing land in the proposed - 3 - freeway right-of-way and requested favorable action on ' this matter. Member Stevenson asked Mr. Casey what his feelings were relative to the Engineering Department recommendations. Mr. Casey said he thought the State in their ac- quisition would buy the right-of-way for East "L" Street. Planning Director Fretz pointed out that it would be several years before the State would develop this freeway and that in the meantime, we should have a full width street. Mr. Casey conceded to the recommendations as set forth. It was moved by Member Comstock, seconded by Member Harmstead and unanimously carried that the tentative map of Robinhood Subdivision Unit No. 7, beiapproved and recommended to City Council subject to the Engineering Department recommendations. MISCELLANEOUS Planning Director Fretz informed the Commission that an inspection of several zoning ordinances which he considers "modern", reveal that plant nurseries , as "limited operations", are permitted in the C-1 zone. He read a letter from the Downtown Association Development Committee indicating that this group feels a plant nursery would help to "round out" the selection of merchandise offered in this area. Vice-Chairman Stevenson asked that the Planning Director and the City Attorney prepare an amendment for Commission consideration. ADJOURNMENT The meeting adjourned sine die.
