HomeMy WebLinkAbout1961-05-01 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA May 1 , 1951 A regular meeting of the Planning Commission of the City of Chula Vista was held 'on the above date at 7:00 P.M. in the Council Chamber at Civic Center with the following members present: Stevenson, Comstock, Weakland , Stewart, Harmstead, Adams and Guyer. Absent: none. Also present: Director of Planning Fretz, City Attorney Duberg and Attorney Boyer, and Principal Engineer Harshman. APPROVAL OF MINUTES It was moved by Member Adams, seconded by Member Weakland and unanimously carried that the minutes of the meeting of April 17, 1961 , be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - Interim R-1 , R-3 and C-2-P - Muraoka' Annexation Planning Director Fretz submitted maps and explained the proposed zoning and existing land use of the area. He stated that the staff feels that the City should impose suffi- cient restrictions on the commercial development to assure orderly development and improve- ments and prevent premature or speculative zoning. He added that if there is a market for a 40-acre shopping center the staff feels it would be better for- Chula Vista to have this developed in the City, under City standards, and with the citizens of Chula Vista enjoying its benefits as well as contributing to its use. Mr. Fretz explained interim zoning procedure. This being the time and place as advertised, Chairman Stewart opened the hearing. Member Comstock asked whether the City should restrict the commercial development to C-1 and permit C-2 uses with variances or conditional use permits. Planning Director Fretz stated that some of the uses normally found in a large shopping center would not be permitted with C-1 zoning. Chairman Stewart sited a service station as being one use almost always found in a large shopping center that is not allowed in a C-1 zone. Mr. Ray Muraoka, 103 Quin- tard, stated that they had a trailer park in mind for the area proposed for R-3 zoning and it was explained that R-3 is the required cl,assification for trailer parks. There being no. further comment, the hearing was closed. RESOLUTION NO. 208 - Recommending to City Council Interim R-1 , R-3 and C-2-P Zoning for the Muraoka Annexation Offered by Member Stevenson, passed, adopted and approved by the following vote, to-wit: AYES: Members: Stevenson, Comstock, Weakland, Svtewart, Harmstead, Adams and Guyer NOES: none ABSENT: none PUBLIC HEARING - R-1 to C-2 - Southwest Corner 3rd and "L" and Change in Building Line from 25 to 0 feet - J. D. Peters ►. A letter was read from Mr. J. D. Peters asking that the matter be continued to the next meeting inasmuch as he could not be present. It was moved by Member Comstock, seconded by Member Adams and unanimously carried that the matter be continued to May 15 , 1961 . PUBLIC HEARING - R-3 to R-1 and R-2 - West of Broadway, "H" to "L" Planning Director Fretz submitted maps showing existing land use and proposed zoning of the area west of Broadway and between "H" and "L" Streets, and stated that this area is zoned R-3 but predominantly developed with single-family residences and duplexes. He ex- plained that the staff feels that the zoning should reflect the land use and would help maintain property values. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Quay Collicott, 827 Woodlawn stated that some of the properties w,:,re bought with the idea that rental units could be added to the property later and that those who had already built second units would have an advantage over those who had not. Mrs. Wilhelm Sievers , 702 Madison, asked whether there is any thought to extending commercial zoning down "J" Street as far as Madison. Mr. Ralph Small , 645 "J" Street, stated that he believes R-1 would be too high a classification, as some of the lots are too big for R-1 development and some of the lots are already developed with multiple units. Planning Director Fretz stated that he doesn ' t feel there are enough multiple uses in the area to11justify the R-3 zoning. Chairman Stewart stated that testimony indicates some of the people do want to build rental units on the property and that the fact that the City upgraded the land by zoning, might be a basis for applications for variances in the future. Mr. Fretz stated that the land is designed for single-family units and he believes adding other units would create an undesirable area. There being no further comment, the hearing was closed. Member Adams stated that he agrees with the Planning Director, that building multiple units on the back of these lots is the very thing we should want to head off in order to prevent blighting the area. He stated that some time ago the Commission decided that rentals built on the rear of the standard-sized lot were detrimental to neighborhoods and had amended the ordinance to prevent this in an R-2 zone. . He stated that the Planning Commission has the prerogative to change the ordinance to safe-guard the community, and this should be accomplished before there are too many multiple units.- Member Stevenson agreed and stated that the City had also tried to improve the standards by increasing the minimum lot size to 7,000 square feet. Member Harmstead stated he feels rezoning the area would penalize those people who bought with the intention of constructing rental units Chairman Stewart stated he believes this type of problem is generated by allowing R-3 property to be developed as R-1 , and that the ordinance should be amended to prevent this. RESOLUTION NO. 209 - Recommending to City Council Rezoning from R-3 to R-1 and R-2, Area West of Broadway between "H" and B°L" Streets Offered by Member Stevenson, passed, adopted and approved by the following vote, to-wit: i AYES: Members: Stevenson, Comstock, Stewart, Weakland, Adams and Guyer NOES: Member Harmstead ABSENT: none SUBDIVISIONS Robinhood #8 - Tentative Map Planning Director Fretz submitted the tentative map of Robinhood #8, explaining that the area was included in Robinhood #5 tentative map, but that the time had expired making it = 2 - i necessary to file a new tentative map. A letter was read from the Engineering Department recommending approval subject to certain conditions. It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried that the tentative map of Robinhood #8 be approved and recommended to City Council subject to the following conditions: 1 . The name Tara Place be changed to Nova Place and Moss Street to East Moss Street. 2. The cul-de-sac on Nova Place shall have a 5 foot monolithic sidewalk and shall have a 39 foot curb radius. 3. The property east of the easterly subdivision boundary shall be graded to provide adequate drainage and shall b'e in such a manner as to not contribute run-off to the proposed Robinhood #8. If slope rights are required, they shall be submitted prior to approval of the final map. 4. Than Nacion Avenue be improved to a 40-foot travel-way. w 5. That exact sidewalk location be determined by the Division of Engineering when improvements plans are developed. Vieg inia Terrace - Tentative Map Planning Director Fretz submitted the tentative map 'of Virginia Terrace, stating that the original tentative map had expired. Engineering -.Departmen.trecommendations on approval of the map were read. Chairman Stewart asked whether there should be a cul-de-sac at the southerly end of Myra Street and whether any one foot lotk are needed. Mr. Kelley, K & B Engineering Company, representing the subdivider, stated that there is no dirt available on the site to do the filling as recommended by the Engineering Departmen for Melrose Avenue, and that filling this would also create a grade problem for the land to the east. He stated that he realizes -this is a deep curve, but it is not a major street Principal Engineer Harshman stated -that he doesn 't believe this factor should prevent approval of the map - that it can be approved subject to further negotiations between the subdivider and the Engineering`='Department. It was moved by Member Stevenson, seconded by Member Harmstead and unanimously carried that the Planning Commission approve the tentative map of Virginia Terrace and recommend approval to City Council subject to the following conditions: 1 . The travel-way of Melrose Avenue be changed to 40 feet. 2. The profile grade of Melrose Avenue be redesigned and approved by Engineering Department. 3. That Melrose Avenue be graded 8 feet east of the easterly boundary and the sub- divider shall submit necessary slope rights to accomplish additional grading. 4. The Engineer shall submit drainage calculations for the subdivision. 5. The curb radius of cul-de-sac street shall be shown on the map. 6. Sidewalks shall be constructed 0.5 feet off property line. _ 3 _ 7. The structural section of Melrose Avenue and Naples Street shall be 22 inches of asphalt concrete and 5 inches of aggregate base. 8. The map show 1 foot lots along side and end of Melrose and at end of Myra. 9. That a temporary cul-de-sac be constructed at the southerly end of Myra. 10. That a new tentative map, showing these changes , be submitted to the Planning Director for approval prior to submission of final map. COMMUNICATIONS Appeal from Planning Commission Denial of Zone Change The Planning Commission findings were read on denial of zone change from R-2 to C-1 for property on the north side of '!H" Street, between Smith and Fifth Avenue. It was moved by 'Member Guyer, seconded by Member Harmstead and unanimously carried that the findings be approved as read and forwarded to City Council . MISCELLANEOUS Nurseries in C-1 Zone Member Adams stated that he believes that if nurseries are allowed in a, C-1 zone with a conditional use permit, the operation should be much more restricted than as now allowed in a C-2 zone. He offered several suggestions which were given to the secretary. The Commission discussed the suggested standards and concurred they were good. It was suggested that perhaps the term "nurseries" should not be used - depending upon the dictionary definition of a nursery - as a use permitted with conditional use permit in C-1 zone. Planning Director Fretz stated that he appreciates the suggestions and that the amendment will be brought to the Planning Commission soon.
