HomeMy WebLinkAbout1960-02-01 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA February 13 1960 A regular meeting of the Planning Commission of the City of Chula Vista was held at 7:30 P.M. on the above date in the Council Chamber at Civic Center, with the following members present. Stevenson, Sparling, Weakland, Stewart, Harmstead, Adams and Guyer: Absent: none. Also present: Director of Planning Fretz and City Att- orney Kugler. APPROVAL OF MINUTES It was moved by Member Sparling, seconded by Member Harmstead and unanimously carried that the minutes of the meeting of January 18, 1960 be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - B. S. Dockstader R-1 to R-3 and C-2 Southeast Corner Broadway. and "Kit Street Chairman Stewart stated that both applications submitted by Mr. Dockstader for C-2 and R-,3 zoning of adjoining properties at the southeast corner of Broadway and ['Kit Street would be considered at this time. Director of Planning Fretz reviewed the applications and submitted a map showing the resultant request for commercial zoning to a 370 foot depth along the south property line, commercial zoning to a 190 foot depth along the "Kit Street frontage and the remaining 180 feet frontage on "Kit Street proposed for R-3 zoning. This being the time and place as advertised, Chairman Stewart opened the hearing. Mrs. Marian Bartlett, speaking for Mr. Dockstader, spoke favoring the rezoning, stating that Mr. Dockstader felt the type of use proposed for this property would be of benefit to the area. Letters were read from Mr. Glenn Fuller, Mr. D. R. Tyson, and Mr. Elnathan 'Wattawa recommending approval of the change of zone. A petition with 20 signatures was read approving the change of zone. Mr. Thomas Johnson, 797 Beech, submitted a petition with 52 signatures protesting the original application and a petition with 56 signatures protesting the second application. He stated that, in many instances, property owners signed both applications. Protests were heard from Mr. Louis Klein, 785 Ash; Mr, Douglas Bryant2 '797 Ash; Mr. Paul Breininger, 790 Ash; and Mr. Joseph Barahura, 542 "Kit. They protested the R-3 zoning fronting on ttK", the depth of the proposed C-2 zone, possible traffic problem resulting from the proposed development and possible affect on the value of their properties. Mrs. Bartlett stated that the applicant would withdraw the request for R-3 zoning on the t'Kt' Street frontage, leaving this property R-1. Mrs. Orville Blue, 825 Broadway, spoke favoring the rezoning, stating that her property is the same depth and that it cannot be used as R-1. There being no further comment, the hearing was closed. RESOLUTION NO. 159 - Recommending to City Council Rezoning from R-1 to 0-2 of property on the Southeast Corner of Broadway and ngn Street. Offered by Member Sparling, passed, adopted and approved by the following vote, to wit: AYES: Members Sparling' Weakland, Stewart' Harmstead' Adams' Guyer and Stevenson NOES: none ABSENT: none, Request for Change of Zone - Robinhood Homes, Inc. South Side of Telegraph Canyon Road It was moved by Member Harmstead, seconded by Member"Guyer and unanimously carried that the application be set for public hearing on March 7, 1960m CONDITIONAL USE PERMITS PUBLIC HEARING - George Trusty � 828 Ada Street - Trailer Park The application was read requesting permission to construct and operate a trailer park on C-2 property., north of Ada Street on the east side of Montgomery Freeway. A map was presented showing the location. and a plot plan of the trailer park. Planning Director Fretz stated that if the application is considered favorably, consideration should be given to a turn-around at 'the north end of the interior streets, This being the time_and place as advertised, Chairman Stewart opened the hearing. Mro J. E. Raeder, 765 Palomar and Mr© Edward Rohrer, 805 Palomar, spoke favoring the application. There being no further comment, the hearing was closed®_ It was moved by Member Adams and seconded by Member Guyer that the Planning Commission recommend to City Council that a conditional use permit be granted to George Trusty for construction and operation of a trailer park, as 'shown on plot plan submitted, on property near the southeast corner of Montgomery Freeway and Palomar Street. That the approval be subject to the conditions that the roadways be a minimum 20 foot width and be connected at their northerly end with a road, for the purpose of providing a turn- around. That the action be based on the following findings of fact: 1. Proposed use will have no adverse effect on public health, safety or welfare, in that the characteristics 'of the use do not entail noise, smoke, odor, dust or other nuisance factors* 2. There is a trailer park and a motel to the north of this property. A trailer park is primarily a residential land use and the park will aput R-.3. and C-2 property. The motion carried by the following vote, to wit: AYES: Members Adams, Guyer, Stevenson, Sparling, Weakland, Stewart and Harmstead NOES: none ABSENT: none SUBDIVISIONS Both Robinhood No., 6. and Judson Estates No® 3 were held over to the February 15th meeting. Planning Director Fretz stated that the staff feels some consideration should be given to establishing a policy that full-width streets, rather than half streets, be required where the subdivider owns the land on both sides of the proposed street* ® 2 �, l He stated that with the present practice of a tentative map being filed on a large area' and the filing of final maps and development of the property occurring in units, half-streets on the boundaries of units have been suggested in Robinhood No. 6. He stated that there are several disadvantages to this practice and he and the Engineering Department feel that a unit of a subdivision should be a complete entity and not be dependent upon possible completion of half streets as part of another unit. Member Sparling stated that quite often when half-streets are on fill, the ground will erode under the pavement. The Commission concurred that all sewer laterals and utility lines should be stubbed to the property line and a full width travel way with curb and gutter improved on streets on the boundary of the separate units of a subdivision. City Att- orney Kugler said he concurred that this was a reasonable request. He asked that the matter be continued for study of the wording of policy statement in resolution form. SETBACKS PUBLIC HEARING - Establishing Setbacks in Palomar and Industrial Lands Annexations Planning Director Fretz submitted a map showing proposed setbacks in the Palomar Annexation and a portion of the Industrial Lands Annexation. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Bill Richardson, owner of land north and south of the Palomar Inn property, spoke favoring the setbacks. There being no further comment, the hearing was closed. It was moved by Member Harmstead, seconded by Member Stevenson and unanimously carried that the Planning Commission recommend the establishment of building lines in the Palomar Annexation and a portion of Industrial Lands Annexation, as follows: A 5 foot building line along the following streets: 1. Within the Industrial Lands Annexation - along the east side of Montgomery Freeway, zoned C-2, and along the west side of Walnut Avenue, zoned C-2. J 2. Within the Palomar Annexation - along the east side of Montgomery Freeway south of Palomar Street, interim zoned C-23 'and along the east side of Montgomery Freeway, north of Palomar Street. 3. Within the Palomar Annexation - along the north and south sides of Palomar Street, interim zoned C-2. 4, Within the Palomar Annexation - along the west side of Industrial Boulevard, interim zoned C-2. 5. Within'the Palomar Annexation - along the east and west sides of Walnut Avenue, interim zoned C-2. A 15 foot building line along the north side of Ada Street and the east side of Montgomery Freeway within the Palomar Annexation, interim zoned R-3. MISCELLANEOUS Lot Development at East End of Palomar Drive - Irvin Rose - 3 � Planning Director Fretz explained that even though the Planning Commission had recommended to City Council the dedication for street purposes of 1 foot lot at the east end of the 300 block Palomar Drive, there is a question as to whether they had also approved the plan for development of two lots fronting on the and of Palomar Drive. He stated that each lot would have only 28 feet frontage on the street and a variance would be necessary prior to development of the lots. An excerpt was read from the Planning Commission minutes of August 103 19599 concerning the matter. City Att- orney Kugler stated that the Commission could not have committed itself to approval of the lots without having first considered a variance on their 28 foot frontage. The Commission indicated that it had not approved lot layout and suggested that Mr. Rose apply for a variance for approval of the two 28 foot frontage lots before going back to the City Council with the request for dedication,of the 1 foot lot at the east end of Palomar Drive. Little League Planning Director Fretz stated that at the present time, the ordinance does not make provision for such activities as a Little League playing field in any residential zone and stated that a variance will be before the Commission at the next meeting for app- roval of a site on the west side of Fifth Avenue, south of tsKt► Street, an R-1 zone. He asked the Commission to consider provision for such uses in the R-1 zone with a conditional use permit. Member Harmstead stated that a children's playground should be considered similarly. Chairman Stewart stated that he feels much consideration and study should be given to such a proposal. He stated that he doesn't feel such a use can be likened to a school playground, which is allowed in an R-1 zone as an adjunct to a school, because activity is not controlled at all times as it is on a school playground. It was suggested that the matter be discussed at a future meeting. Joint Meeting with Harbor Commission Planning Director Fretz stated that a joint meeting of the Harbor Commission with the Planning Commission has been set up on February 8th for the purpose of discussing industrial development for the tidelands. The Commission concurred with the-desir- ability he desir--ability of a joint meeting with the Harbor Commission and stated that 7:30 P.M. on Monday, February 8th,, would be agreeable for the meeting. City Attorney Kugler, referring to the discussion meeting the Commission will have, explained the state law prohibits "secret" meetings, and stated that any meeting of members at which there is any consideration given to a specific matter or any de- - liberation which might guide future policy, must be public. Chairman Stewart stated that the subject of discussion meetings of the Commission would not be of policy or on specific matters, but rather general planning functions of an educational natured City Attorney Kugler commended the Planning staff for its work in compilation of the Zoning Ordinance and its amendments. Planning Director Fretz reported that the Assistant Planner would report for duty Wednesday, February 33 1960. Member Harmstead stated he feels a study should be made of the naming of streets, and suggested a pattern for the use of "Avenuets, «Streets', slDrive", "Court". ADJOURNMENT - 9:15 P.M.
