HomeMy WebLinkAbout1960-03-07 PC MINS M=ES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA March 72 1960 A regular meeting of the Planning Commission of the City of Chula Vista was held at 7:30 P.M. on the above date in the Council Chamber at Civic Center, with the following members presents: Stevenson, Sparling, Weakland, Stewart, Adams and Guyer. Absent: Member Harmstead. .Also Present: Director of Planning Fretz, Assistant Planner Brown, City Attorney Kugler and Principal Engineer Harshma.n. APPROVAL OF MINUTES- It was moved by Member Sparling, seconded by Member Guyer and unanimously carried that the minutes of the meeting of February 15, 1960, be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - Robinhood Homes, Inc. - South Side of Telegraph Canyon Road and "L" Street and North of Intersection Thereof The application was read requesting rezoning from interim R^1 to R-3 and C-1 for land on the south side of Telegraph Canyon Road and "L" Street and for land north of the intersection of these. streets* _Planning Director.Fretz submitted a map showing the area proposed for rezoning and stated that the area requested for C-1 is triangular- shaped and at present has a street on all three sides. He stated that the City Council is presently considering vacation of that portion of Telegraph Canyon Road on the north side of this lot. This being the time and place as advertised, Chairman Stewart opened the hearing® Member Adams stated he feels the city should be very cautious in creating any com- mercial zones in the new residential areas® Member Stevenson stated he feels the triangular-shaped lot is not suitable for residential zoning and therefore the commercial zoning is appropriate. Planning Director Fretz stated that the city's action in confining the commercial zoning in Halecrest Subdivision to the east side of Hale Drive and requiring adequate depth, indicated a desire to avoid strip com- mercial zoning along Telegraph Canyon Roadm He stated that the triangular-shaped lot in question could be developed adequately under a conditional use permit or possibly with a zone variance, either procedure giving the city control over parking and type of development„ There being no further comment, the hearing was closede Member Stevenson offered a resolution recommending to the City Council that the land fronting on the south of "Ll' Street and Telegraph Canyon Road be rezoned to R-3 and the lot north of the intersection of these streets be rezoned to C-1, based on the following: 1. Good zoning practice requires the change in that the lot proposed for C-1 is triangular in shape and is not suitable for residential use* r� 2. The proposed R-3 zoning fronts upon two heavily travelled streets and rears upon R-1 lots. The motion was seconded by Member Guyer and failed to carry by the following vote, to-wit: AYES: Members Stevenson and Guyer NOES: Members Sparling, Weakland, Stewart and Adams ABSENT:. Member Harmstead Members Stewart and Adams stated that they agree that the triangular-shaped parcel is not desirable for residential use but do feel that it can be developed adequately under a conditional use permit at a later date. RESOLUTION NO. 161 - Recommending to City Council Rezoning from Interim R-1 to R-3 Property on the South Side of Telegraph Canyon Road and "L" Street and North of the Intersection of These Streets. Offered by Member Sparling, passed, adopted and approved by the following vote, to-tit: AYES: Members Sparling, 'T%Teakland, Stewart, Adams and Guyer NOES: Member Stevenson ABSENT: Member Harmstead Request for Rezoning " Hal Johnson and Company - 121 Madison Avenue - R-3 to C-2 It was moved by Member Guyer, seconded by Member Weakland and unanimously carried that a public hearing be called for April 4, 1960, to consider the application. Request for Rezoning- Jadson, Inc. - 600 Block "H" Street R-3 to C-2 (P) City Attorney Kugler stated that in view of the fact that the ordinance creating the Supplemental "P" Zone will not be effective until March 10, the Commission cannot set a date for public hearing on the application at this meeting. Request for Rezoning - Broadway Annexation No. 2 - Precise Zoning It was moved by Member Guyer, seconded by Member Weakland and unanimously carried that a public hearing be called for April 4, 1960 to consider the zoning. CONDITIONAL USE PERgTS _ PUBLIC HEARING Allen-3esker - Northeast Corner Third and IV' Street - Business Office The application was read requesting permission to construct an office building for Levelon Builders on the northeast corner of Third and "D" Street. Planning Director Fretz submitted a plot plan of the property showing the proposal. This being the time and place as advertised, Chairman Stewart opened the hearing. .The Commission questioned the'statement in the application referring to the storage of materials in the rear yard. Mr. Herb Allen stated that storage is not a major problem and involves only a few pieces of lumber, signs and similar articles. City 2 Attorney Kugler stated that a contractor's storage yard is an M-1 use and that the ordinance would not allow the storage of lumber, etc., in the subject property. He stated that it would allow storage of the signs used for the business as an incidental use. Mr. N. J. Beaker spoke regarding the storage of materials. There being no further comment, the hearing was closed® It was moved by Member Guyer and seconded by Member Sparling that the Planning Com,- mission recommend to the City Council that a conditional use permit be granted to N0 J. Beaker and H. V. Allen for construction and operation of a business office, according to plans submitted, on the northeast corner of Third and °Dt' Street, with the condition that there shall be no storage of building materials. Further, that the action be based on the following findings of fact: 1® The characteristics of the proposed use will not involve damage or nuisance arising from noise, smoke, odor, dust, vibration; hazards from explosion, contamination or fire. Nor will the proposed use cause hazard from increased traffic. 2. The characteristics of the use are compatible with types of uses in the surrounding area. The property to the north is developed with a real estate office and across "D" Street it is proposed that a geriatric hospital be constructed. _ The motion carried by the following vote, to-wits AYES: Members Guyer, Stevenson, Sparling, Weakland, Stewart and Adams NOES: none ABSENT: Member Harmstead VARIANCES' PUBLIC HEARING - Frank and Rose Fowler «. Second Avenue at UCU Street - Setback Reduction The application was read requesting reduction in setback along Second Avenue from 30 to 15 feet. Planning Director Fretz submitted a map showing location of the property and the topography of the land._ This being the time and place as advertised, Chairman Stewart opened the hearing. Principal Engineer Harshman stated that improvements for Second Avenue have been designed and that the existing right-of-way will permit the travel-way desired. Mr. A. J. Gibbons, purchaser of a portion of the property, spoke favoring the variance and stated that there is not sufficient buildable area in the property if the setback is not reduced. Mr. T. Barnum, 20 Second Avenue, protested the variance' stating that it will create a dangerous traffic condition. A letter protesting the variance was read from Mr. and Mrs. Dewey Mitchell, 10 Second Avenue® Mrs. Frank Fowler stated that they hope ultimately to get three lots out of the property. There being no further comment, the hearing was closed. It was moved by Member Adams and seconded by Member Stevenson that a reduction in 3 �- setback be granted along Second Avenue from 30 to 15 feet and that the action be based on the following findings of fact: 1. There are exceptional circumstances about the property in that it drops very sharply near Second Avenue, leaving most of the property much below street level. 20 It will be very difficult for the owner to use the property in an economical manner, if the variance is not granted. 3. The few objections to the variance indicate that the granting of the variance will not be materially detrimental to the adjacent area. The motion carried by the following vote, to wit: AYES-. Members Adams, Guyer, Stevenson, Weakland and Sparling NOES: Member Stewart ABSENT: Member Harmstead PUBLIC HEARING Keystone Realty Company - 737 Third Avenue - Setback Reduction The application was° read requesting a reduction in rear yard setback from 15 feet to zero to allow construction of a commercial building, Planning Director Fretz submitted a plot plan of the property. This being the time and place as advertised, Chairman Stewart opened the hearing. Max Stewart, Manager of Keystone Realty Company, stated that they can better use the area required for a rear yard for providing off-street parking. There being no further comment, the hearing was closedo It was moved by Member Stevenson and seconded by Member Sparling that the Keystone Realty Company be granted a reduction in rear yard setback from 15 feet .to. zero and that the action be based on the following findings of fact: 1. The city is at present considering an ordinance to eliminate all requirements for rear yards in commercial areas® The application will allow the owner full use of his property, which is the intention of the ordinance now being considered, 2. It does not appear that the variance will be detrimental to adjacent properties, The motion carried by the following.vote, to-wit:, AYES: Members Stevenson, Sparling, Weakland, Stewart, Adams and Guyer NOES: none ABSENT: Member Harmstead SUBDIVISIONS ' Montebello Circle - Final Map • Planning Director Fretz submitted the final map of Montebello Circle, explaining that it is a one-lot subdivision that involved the vacating of a portion of Montebello Street. It was moved by Member Guyer, seconded by Member Adams and unanimously carried that the final map be approved and recommended to City Council¢ Mark Hill - Tentative Map Planning Director Fretz submitted the tentative map of Mark Hill. Principal Eng- ineer Harshman stated that the Engineering Department has not completed their check and made the following comments: 1. The map does not show the method of sewage disposal and will require a pumping station. 2. Atypical section is not shown for the cul-de-sac$ 3. A five foot contour interval map should be submittedd It was moved by Member Sparling, seconded by Member Adams and unanimously carried that the map be reconsidered at the March 21st meeting. Virginia Terrace - Tentative Map Planning Director Fretz submitted the tentative map of Virginia Terrace. It was moved by Member Sparling, seconded by Member Guyer and unanimously carried that the tentative map of Virginia Terrace be approved and recommended to the City Council subject to the following conditions: 1® 1 foot lots be reserved along the eastern and southern line of Melrose Avenue and on the southern end of Myra Place shown on map. 2. That a temporary turns-around be constructed at the southerly end of Myra Place. 3o That adequate drainage facilities be provided. 4, Typical section to be shown for the cul-de-sac¢ 5. That the improvements shown for Naples should indicate 22inches of asphaltic concrete over 5 inches of base rather than 2 inches over 4 inches. 6. Street names to be approved by the Planning Director. Cortez Manor No. 3 - Tentative Map Planning Director Fretz submitted the tentative map of Cortez Manor No. 3. YX* John Wilburn, 395 ttJrc Street and Mr. Bill Holton, 393 "J" Street, requested that consideration be given to the drainage problem in the area which, they feel, was ® aggravated by the development of Cortez Manor No. 1 and No. 2. Principal Engineer 5 Harshman asked that a legal opinion be submitted as to. the responsibility of increased runoff brought about by development. Mr. Harshman stated that there is undoubtedly an increase in run-.off, but he questions whether the development adversely affected the drainage of the area. Planning Director Fretz reviewed the map, explaining that setbacks conform with those in Cortez Manor No. 1 and No, 2. Principal Engineer Harshman stated that the typical section is not shown for the cul-deo-sac. Member Sparling moved that the tentative map of Cortez Manor No. 3 be approved and recommended to City Council with the following conditions: le That garages be constructed 30 feet back so that automobiles parked in driveways will not overhang public property. 2. All recommendations of the Planning Director and Engineering Department be complied with. 3. That prior to submission of the final map, an agreement be reached regarding the drainage problem intthe area. City Attorney Kugler agreed with Subdivider Lee Raitt, that the map cannot be conditioned upon an agreement. Member Sparling withdrew his motion. It was moved by Member Sparling, seconded by Member Guyer and unanimously carried that the map be resubmitted to the Commission on March 21 to allow time for City Attorney Kugler to prepare an opinion as to responsibility of the subdivider of increased runoff or change in natural drainage courses. SETBACKS PUBLIC HEARING - Rear Yards in Commercial Areas Chairman Stewart reviewed the matter, stating that the proposed amendment to the rear yard requirements in commercial zones had been altered at the last hearing and readvertised, and declared the hearing opene Director of Planning Fretz read the proposed amendment, and the Commission discussed its effect on adjacent residential lots. There being no further comment, the hearing was closed. The Commission discussed the advisability of no rear yard where a commercial got abuts on the side lot line of a residential zone. It was generally agreed that the amendment should be recommended as is and if a problem does arise, a further change be recommended. RESOLUTION NO. 162 - Recommending to City Council Amendment to Rear Yard Requirements in Commercial Areas Offered by Member Sparling, passed, adopted and approved by the following vote, to-wit: fAYES: Members Sparling., Stevenson, Weakland, Stewart, Adams and Guyer NOES: none ABSENT: Member Harmstead � 6 -. Brown Annexation* It was moved by Member Sparling, seconded by Member Adams and unanimously carried that the Planning Commission reconanend to City Council that the E. L.
