OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
March 21, 1960
An adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held on the above date at 7:30 P.M. in the Council Chamber at Civic Center with
the following members present: Stevenson, Stewart, Harmstead, Adams and Guyer,
Absent: Members Sparling and Weakland. Also present: Director of Planning Fretz,
City Attorney Kugler, Principal Engineer Harshman and Planning Draftsman Lee.
STATEMENT:
The Secretary of the Planning Commission hereby states that she did post
within 24 hours of adjournment, as provided by law, the order of the City Planning
Commission for the adjourned meeting of March 21, 1960.
APPROVAL OF MINUTES:
It was moved by Member Stevenson, seconded by Member Guyer and unanimously carried
that the minutes of the meeting of March 7, 1960, be approved, copies having been
mailed to each member,
REZONING:
PUBLIC HEARING - Borgerding Annexation - Precise C-2 Zoning
Director of Planning Fretz stated that the Supplemental "P" Zone Ordinance is now
effective and he believes that development of the Borgerding Annexation should in-
clude off-street parking.
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried
that the hearing be continued.
RESOLUTION 163 - Resolution of Intention to Call Public -Hearing on April 4, 19603
to consider Precise C-2 "P" Zoning For Borgerding Annexation
Offered by Member Harmstead, passed, adopted and approved by the
following vote, to-wit:
AYES: Members: Harmstead, Adams, Guyer, Stevenson and Stewart
NOES: none
Absent: Members: Sparling and Weakland
Request for Rezoning - Jadson, Inc. - North Side of "H", 600 Block - R-3 to C-211PTI
It was moved by Member Guyer, seconded by Member Stevenson and unanimously
carried that a public hearing be called for April 4, 1960 for consideration of the
application.
Request for Rezoning - Callahan & Ure - 804 Broadway - R-3 to C-2
It was moved by Member Guyer, seconded by Member Stevenson and unanimously
' carried that a public hearing be called for April 4. 1960 for consideration of the
application.

VARIANCES
PUBLIC HEARING —David Julien - 507 "J" Street - AreaVariance
The application mas read requesting permission to divide the property at 507 "J"
into two seven thousand square foot lots, the rear lot having only 20 feet frontage
on "J" Street. Planning Director Fretz submitted a plot plan showing the proposed
division and a map showing adjacent property cuts.
This being the time and place as advertised, Chairman Stewart opened the hearing. Mr.
Julien spoke favoring the granting of the variance, Mrs. Violet Haro, owner of property
at 515 "J" Street, next to Mr. Julients property, stated they would also like to develop
the rear of their lot and would like to work with Mr. Julien in providing access.
It was moved by Member Stevenson, seconded by Member Adams and unanimously carried that
the public hearing on the application for variance be continued to April 4 h to allow
further study,
PUBLIC HEARING - John and Mary Macevicv. - 298 Myra Setback Reduction
The application was read requesting permission to reduce the side yard setback along
"J" Street from 10 to 0 feet for construction of a 6 foot fence along the property line..
Planning Director Fretz submitted a plot plan showing the proposed fence.
This being the time and place as advertised, Chairman Stewart opere d the hearing. Mr,
Macevicz spoke, stating the height of the fence is important because it will hide the
"drying area" from the' street and from the neighbors. He stated that it will not create
a traffic hazard because it will be located away from the intersection.. Member Adams
called the Commission' s attention to the fact that the setback on this lot in -a new sub-
division is only 10 feet on "J" and 15 feet on Myra.. Chairman Stewart stated he feels
granting the variance will set a precedent.
It was moved by Member Adams, and seconded by Member Harmstead that the variance be denied
for the reason that evidence was not presented indicating a hardship to justify the
granting of the variance. The motion carried by the following vote, to-gait:
AYES Members:- Adams, Guyer„Stevenson, Stewart and Harmstead
NOES: none
ABSENT: Members: Sparling and Weakland

Mark Hill - Tentative Map
Planning Director Fretz stated that changes were being made to the map requiring sub-
mission of a revised tentative map.
It was moved by Member Adams, seconded by Member Harmstead and unanimously carried that
the tentative map of Mark Hill be held over for consideration at the April ?nth meetingv
Cortez Manor #3 - Tentative Map
Planning Director Fretz reviewed the previous consideration of the map, stating that
the only questions had been setbacks for garages when driveways go straight in from the
street and whether the subdivider has any responsibility for increased run-off in the

area from land development. City Attorney Kugler stated that there is no may the City
can require a subdivider to actually do work on land other than his own within a sub.
division. Principal Engineer Harshman stated that the subdivider, Lee Raitt, had sub-
mitted a letter in which he agrees to bare 2/3rds the cost of a structure for drainage;
however, he does not admit a legal responsibility. He stated that the City Engineer had
agreed to contact adjacent property owners in an effort to work out a solution to the
drainage problem in the area. Comments were heard from Mr. Lee Raitt, Mr. John Woolburn,
395 "J"- Street and Mr. E.R. Sinram, 399 "J" regarding proposed drainage facilities.
It was moved by Member Adams, seconded by Member Guyer and unanimously carried that the
tentative map of Cortez Manor #3 be approved and recommended to City Council subject to
compliance with the recommendations of the Planning Director and Engineering Department
and, with the condition that garages set back 25 feet when driveways go straight in from
the street.
Mylo Ocean View Estates #3 - Tentative Map
Planning Director Fretz submitted the tentative map of Mylo Ocean View Estates #3, ex-
plaining that the subdivider does not own enough land on Oxford Street to put in even a
half street. City Attorney Kugler has ruled that no off-site improvements can be re-
quired which means that the subdivider must either acquire right-of-way or jog the
street. Mr. Algert, Civil Engineer representing the subdivider, pointed out the dis-
advantages of jogging the street.
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried that
the tentative map of Mylo Ocean View Estates #3 be held over to the April 4th meeting.
Sweetwater Valley Industrial Park o Final Map
Planning Trisector Fretz submitted the final map and explained that there are several
changes from the tentative map approved by the City. Mrs. Richard Martin, owner of
property on Edgemere Road, commented regarding the extension of a street from the sub-
division over their property to Edgemere Road.
It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that
a revised tentative map of the subdivision be submitted reflecting the changes shown
on the final map and with the realignment of Willow Street further north and its ex-
tension as a through street from Highland to Edgemere Road,
Request for Dedication of Lot A, Kiffee Subdivision #1
Planning Director Fretz submitted a map showing Kiffee Subdivision #1 and the adjacent
area. He stated that E. L. Brown and B. Jaehn had requested the vacation for utility
purposes. Chairman Stewart questioned the advisability of dedicating the one-foot:loty
thereby allowing complete access to Vista Way, He stated that :Lot A was acquired to
assure the extension of Vista Way. City Attorney Kugler stated that the City can grant
an easement across the one-foot lot for utility purposes.
It was moved by Member Guyer, seconded by Member Harmstead and unanimously carried that
the Planning Commission recommend to City Council that Lot A of Kiffee Subdivision #1
not be dedicated but that the city grant an easement across the lot for utility purposes.
' MISCELLANEOUS
® Rear Yard Setbacks in Commercial Zones
Planning Director Fretz stated that several qu4stions had been raised during the

Council discussion of the proposed ordinance and that he and City Attorney Kugler would
try to resolve them,
It was moved by Member Stevenson seconded by Member Guyer and unanimously carried
that the matter be continued to April 4th,
San Diego County Planning Congress
An invitation was extended to the Commission to-attend the Spring Meeting of the San
Dieto County Planning Congress on March 28th at Mission Valley Inn. Planning Director
Fret, explained that there will be two panel discussions of interest to the Commission,
Alpine Annexation - Inhabited Territory
A map of the proposed Alpine Annexation was submitted,,
It was moved by Member Stevenson, seconded by Member Harmstead and unanimously carried
that the Planning Commission recommend to City Council that permission be granted to
commence annexation proceedingso
COWUNICATIONS
A letter was read from Mrs. Betty Marinee, asking permission to conduct an electrology
business from her home as a home occupation.
The Commission directed that Mrs. Marinee be requested to furnish more information about
the equipment to be used and if possible, attend the meting of April 4th,
ADJOURNMENT
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried that
the meeting adjourn, sine die,
