HomeMy WebLinkAbout1960-04-04 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA April 4, 1960 A regular meeting of the Planning Commission of the City of Chula Vista was held at 7:30 P.M. on the above date in the Council Chamber at Civic Center, with the following members present: Stevenson, Sparling, Weakland, Stewart, Harmstead, Adams and Guyer. Absent: none, Also present: Director of Planning Fretz, City Attorney Kugler, Principal Engineer Harshman, Assistant Planner Brown and Planning Draftsman Lee. APPROVAL OF MINUTES It was moved by Member Harmstead, seconded by Member Sparling and unanimously carried that the minutes of the meeting of March 21, 1960 be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - Hal Johnson and Company - 121 Madison Avenue R-3 to C-2 The application was read requesting rezoning from R-3 to C-2' of the property at 121 Madison Avenue for use as a parking lot and for storage of materials in connection with the applicant's plumbing shop on Broadway. Planning Director Fretz submitted a map of adjacent property cuts and zoning. This being the time and place aB advertised, Chairman Stewart opened the hearing. Mr. -Elmer Sorrenson, speaking for the applicant, stated that the depth of the existing C-2 zone is not adequate to provide needed parking and storage of materialso Protests were heard from Mr. Jesse Mondot, 115 Madison Avenue; Mr. C® .W. Labadie, 86 Madison Avenue; Mr. Rupert Beaty, 110 Madison and Mrs. Rosalie Volck, 128 Madison Avenue. Comments were that the area is predominantly residential and the rezoning will be harmful to the neighborhood. A show of hands indicated 12 persons protesting the change of zone. There being no further comment, the hearing was closed. Member Harmstead stated that while it is felt that commercial zoning should have more depth than this property, circumstances are different in that there is an alley between the commercial and existing residential; and, that rezoning would be an intrusion into a residential area. Member Adams stated that if the use of the property were re- stricted to a parking lot, as indicated by Mr. Sorrenson, a conditional use permit would suffice, and that he feels a parking lot would not damage the area too greatly. Member Stevenson agreed that parking on the lot might not be too detrimental to the neighborhood, but that storage of materials would not be desirable. It was moved by Member Sparling and seconded by Member Stevenson that the application for change of zone from R-3 to C-2 of property at 121 Madison Avenue be denied for the reason that it would not be good zoning practice; would be spot zoning and would be an intrusion of commercial use into a residential area. The motion carried by the following vote, to-Tait: AYES: Members Sparling, Weakland, Stewart, Harmstead, Adams, Guyer and Stevenson NOES: none ABSENT: none PUBLIC HEARING - Jadson, Inc. - North Side "H" Street, 600 Block - R-3 to C-211Ft The application was read requesting change of zone from R-3 to C'�=211P" for property on the north side of "H" Street, east and west of Oaklawh. A map was presented showing adjacent property cuts and zoning. This being the time and place as advertised, Chairman Stewart opened the hearing. He outlined from the Zoning Ordinance what constitutes justification for a change of zone. Mr. Elmer Sorrenson, speaking for the applicant, stated that he does not feel C-211P" zoning on this property will aggravate the traffic or parking problem any more than existing commercial zoning in the areas There being no further comment, the hearing was closed. Chairman Stewart stated he feels it would constitute strip zoning and would affect existing residential property on the south side of the street. Member Adams stated he feels it would be an intrusion into the existing residential zone across "H" Street and the apartment units north of the subject property. He stated he feels it would set a precedent for rezoning on the south side of "H" Street. It was moved by Member Stevenson and seconded by Member Adams that the application be denied on the basis that it would not be good zoning practice; would constitute strip zoning and because additional commercial zoning is not needed in the area® The motion carried by the following vote, to-wit: AYES: Members Stevenson, Weakland, Stewart, Adams and Guyer NOES: Members Sparling and Harmstead ABSENT: none PUBLIC HEARING Callahan and Ure - Rear of the Southwest Corner Broadway and "Kit Street Ro3 to Con-2 The application was read requesting C-2 zoning for the rear of the property at the southwest corner of Broadway and "K°t Street. Planning Director Fretz submitted a map showing property depth being 180 feet and the existing commercial zone 125 feet deeps This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Callahan stated that the rear, zoned R-3, cannot be used for R-3 purposes and cannot be used with the frontage. .There being no further comment, the hearing was closed® Planning Director Fretz explained that this situation exists -all up and down Broadway but due to the existence of other more important matters, the staff has been unable to �• present an overall rezoning proposal on this. .» 2 Member Stevenson questioned whether or not zoning along the entire block should not be considered all at one time. Member Adams stated that commercial zoning backed up to R-3 is a good relationship and the rear of the property, while not serving a useful purpose zoned R-3, could be used to advantage zoned C-2, RESOLUTION NO. 164 - Recommending to City Council Rezoning From R-3 to C-2 of Property At Rear of Southwest lCorner Broadway and "Kt' Street . Offered by Member Adams, passed, adopted and approved by the following vote, to."wit: AYES: Members Adams, Guyer, Stevenson, Sparling, Teakland, Stewart and Harmstead NOES: none ABSENT: none PUBLIC HEARING - Borgerding Annexation - Precise C-211P" Zoning Planning Director Fretz submitted a map showing the Borgerding Annexation and zoning of adjacent land within Chula Vista, This being the time and place as advertised, Chairman Stewart opened the hearing. There being no comment, either for or against, the hearing was closed. Zoning RESOLUTION NO. 166 - Recommending to City Council Precise C-21tP"/for Borgerding Annexation Offered by Member Harmstead, passed, adopted and approved by the following vote, to-wit: AYES: Members Harmstead, Adams, Guyer, Stevenson, Sperling, Weakland and Stewart NOES: none ABSENT: none PUBLIC HEARING - Interim R-3 and C-211Ptt Zoning for Broadway Annexation No. 2. .Planning Director Fretz submitted a map showing area proposed for R-3 and C-211P" zoning. This being the time and place as advertised, Chairman Stewart opened the hearing, Mr. James Bailey, owner of property at 581 Arizona Street, questioned whether or not his automobile repair business would be a permitted use in the C-211P" zoning. Planning Director Fretz explained -that an automobile repair business is an allowed use in the C-2 zone. Member Adams questioned the advisability of zoning the frontage on Fifth Avenue R-3 when property directly across the street is developed as R=1. He suggested that possibly R-2 would be a better zone for this frontage. Mr, Rego, owner of'property within the annexation, stated that they agree with the zoning to 0�21tP11 and R-3. He said they want to develop the entire R-3 in a unit and the R-2 'zone would not allow them to do this. There being no further comment, the hearing was closed. RESOLUTION NO. 165 Recommending to City Council Interim R-3 and C-2t'P" Zoning for Broadway Annexation No. 2. .Offered by Member Guyer, passed, adopted and approved by the following vote, td wait: - 3 � AYES: Members Guyer, Stevenson, Sparling, Weakland, Stewart, Harmstead and Adams NOES: none ABSENT: none CONDITIONAL USE PERMITS PUBLIC HEARING - Pugh and Bokstrom - 524 Parkway - Massage Parlor in R-3 Zone The application was read requesting permission to open a steam and massage parlor at 524 Parkway. Planning Director Fretz presented a plot plan of the property showing existing buildings and the proposed off-street parking. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Pugh spoke in favor of the application. Mr. Melvin Cowherd, owner of property at 510 Parkway, protested the conditional use permit and submitted a petition with 23 signatures which he said represented 85% of the property owners immediately affected, opposing the conditional use permit. He stated that the area is a nice residential neighborhood and that such a use would 'be'detriraental. Other protests were heard from Mr. Robert Berg, 531 "Gtr Street; Ips. J. A. Funk, 535 "G" Street; and Mr. R. B.­Campbell, 520 Parkway. Mr. Pugh stated that it is not a commercial-type massage parlor, that there would be no more than 4 or 5 customers daily and would create no traffic problems There being no further comment, the hearing was closed. City Attorney Kugler stated that in his opinion a steam-massage parlor is not a per- mitted use in an R-,3 zone with a conditional use permit . that it is neither a business or professional office. It was moved by Member Sparling and seconded by Member Adams that the Planning Com- mission finds that a steam and massage parlor is not a use permitted in an R�3 zone with a conditional use permit and that the application be denied. The motion carried by the following vote, to wit: AYES: Members Sparling, Weakland, Stewart, Harmstead, Adams, Guyer and Stevenson NOES: none ABSENT: none VARIANCES. PUBLIC HEARING .q David Julien 507 "J" Street _ Area Variance (cont.) Planning Director Fretz reviewed the matter and submitted a plot plan showing how the landlocked property in the area can be developed. He stated that Mr. Julien's request to build on the rear of his lot, with frontage on "J" Street large enough to accommodate a driveway, had been continued to allow further study as to the possi� bility of developing adjacent land-locked property. The Commission discussed the matter with Mr. Julien and with his consent continued it for further study. PUBLIC HEARING John Keeley 198 "H"'Street - Setback Reduction The application was read requesting a reduction in setback along "H" Street from 25. to 22 feet. A plot plan was submitted showing proposed development of the property. This being the time and place as advertised, Chairman Stewart opened the hearing, 4 Nir. Keeley stated that they intend to place the building on this eastern edge of the 70 foot frontage leaving the corner open for visibility. He added that they have reduced their building width so that two full lanes of parking can be provided, giving them a ratio of 22 square feet of parking for each one square foot of building. Tera Dan Lawson spoke favoring the variance. There being no further comment,. the hearing was: closed. It was moved by Member Stevenson and seconded by Member Sparlin that the applicant be granted a reduction in setback 'along 11H" Street from 25 to 22 feet for the purpose of constructing a commercial building- and that the action be based on the following: 1. The property is zoned Cm2 and has two large setbacks, being a corner lot. 2. Without the granting of a reduction in setback, the applicant will be deprived of reasonable use of his land for its intended purposed 38 The granting of the variance will not be materially detrimental to Public welfare or surrounding areas.. The motion carried by the following vote, to-wit: AYES: Members Stevenson, Weakland, Stewart, Harmstead, Adams, Guyer and Sparling NOES: none ABSENT: none SUBDIVISIONS Mark Hill - Tentative Map Planning Director Fretz submitted the tentative map of Mark Hill Subdivision and read recommendations from the Engineering Department. The Commission discussed the feasi- bility of placing a Supplemental IV' Zone classification on the property to require larger lots but no action was taken. It was moved by Member Guyer, seconded by Member Adams and unanimously carried that the Planning Commission recommend to City Council that the tentative map of Mark Hill be approved subject to the following conditions 1. Compliance with recommendations of the Engineering Department. 2. Compliance with recommendations of the Planning Director, 3. One foot lots be provided at either end of Markly and along the east side of Markstrom. 4. Street names to be approved by the Planning Director, Wlo Ocean View Estates No. 3 - Tentative Map Planning Director Fretz submitted the tentative map of Mylo Ocean View Estates Noe 3 and reviewed discussion at the previous meeting regarding Oxford Street, Mr. LoCicero, subdivider, stated that they had attempted to purchase enough land to - 5 provide more right-of-way for Oxford Street, but cannot until June because the property is in an estate. City Attorney Kugler stated that, in some instances, it is possible to negotiate for land before a will is probated and suggested that Mr. LoCicero contact an attorney to determine whether this could be done in this particular instance. It was moved by Member Sparling, seconded by Member Harmstead and unanimously carried that the tentative map of NIylo Ocean View Estates No. 3 be continued to the next meeting. SETBACKS Rear Yard Setbacks in Commercial Zones The matter was held over until such time as the staff has time to prepare another amendment for Commission consideration. MISCELLANEOUS Request for Practice of Electrology as Home Occupation - Betty Marinee, R. E. Mrs. Marinee appeared and described the machine she intends to use in the practice of electrology from her home® She stated that the Federal Communications Commission approval of the machine is number M.E© 535 and is covered in F. C. C. rules, Section 18.11, The Commission directed that the staff obtain the information included in the F. C. C. rules and the F. C. C'. approvals Robinhood No. 8- Planning Director Fretz stated that the FHA hdd recommended to Robert Casey that one of the streets-in Robinhood No® 8 be terminated ina cul-de�--sac because of the closeness of two intersections. He asked whether the Commission felt such a change could be made when the final map is submitted. City Attorney Kugler stated that if the change pro- posed substantially alters the tentative map, that a revised tentative map should be submitted. It was moved by Member Guyer, seconded by Member Harmstead and unanimously carried that a revised tentative map of Robinhood No. 8 be submitted indicating the desired chant.e. Seminar Chairman Stewart suggested that the Commission consider having a dinner meeting in the form of a seminar on problems of hillside development. April 11, 1960 was ten- tatively agreed upon, to be confirmed by Planning Director Fretz.
