OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
May 16, 1960
An adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held at 7:00 P.M. on the above date in the Council Chamber at Civic Center with
the following members present: Stevenson, Weakland, Harmstead, Adams and Guyer.
Absent: Chairman Stewart. Also present: Director of Planning Fretz, Associate
Engineer Phillips and City Attorney Kugler.
STATEMENT: °
The Secretary of the Planning Commission hereby states that she did post within 24
hours of the adjournment, as provided by law, the order of the City Planning Commission
for the adjourned meeting of May 16,, 1960.
ELECTION OF VICE-CHAIRMAN
Chairman Stewart being absent, the Secretary of the Commission asked for nominations
for the office of Vice-Chairman., left vacant by the resignation of Cecil Sparling.
Member Adams nominated Member Stevenson. Member Guyer seconded the nomination and
moved that nominations be closed and that the secretary cast a unanimous ballot for
Member Stevenson as Vice-Chairman. The motion was seconded by Member Weakland and
carried. Vice-Chairman Stevenson presided.
APPROVAL OF MINUTES - Meeting of May 29 1960
It was moved by Member Guyer., seconded by Member Harmstead and unanimously carried
that the minutes of the meeting of May 2, 1960, be approved, copies having been
mailed to each member.
REZONING
PUBLIC HEARING - Rear of 350 "K" Street - R-1 to C-2 - Madalon Bagnell
The application was read requesting C-2 zoning for a portion of Mrs. Bagnell's property
at the rear of 350 "K" Street. Planning Director Fretz reviewed past zoning action in
this area and submitted a map showing adjacent zoning and property cuts. He stated
that he understands this property is to be purchased by Mr. Severin and Mr. Trevellon,
owners of the M-1 property lying between this parcel and "K" Street; the sale being
conditioned on rezoning to C-2. He suggested that the Commission continue this matter
until June 6th. He also suggested that the Commission consider initiating the rezoning
of the M-1 and R-1 property to C-2-P.
This being the time and place as advertised, Vice-Chairman Stevenson opened the hearing.
Protests were heard from Mr. Edward Johnson, 372 San Miguel, and Mrs. Frank Giardina,
351 San Miguel, that the proposed change of zone would adversely affect the valuation
of their properties.
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried
that the hearing be continued to June 6th.

RESOLUTION NO. 169 - Setting a Date of Public Hearing to Consider Rezoning to 0-2-P
`? From R-1 and M-1, Property on South Side of 300 Block "KI" Street,
as Outlined on Map
Offered by Member Adams, passed, adopted and approved, by the following vote, to Wit:
AYES: Members Adams, Guyer, Weakland, Stevenson and Harmstead
NOES: none
ABSENT: Member Stewart
CONDITIONAL USE PERMITS
PUBLIC HEARING - 488 Fourth Avenue - Youmans, Edmunds and Schrock
The application was read requesting a conditional use permit to develop the R-3
property at 488 Fourth Avenue with a .professional office building. Planning Director
Fretz submitted a plot plan of the ..proposed development.
This being the time and place as advertised, Vice-Chairman Stevenson opened the hearing*
Mr.' Vic Wulff, architect, spoke for the applicants and submitted a drawing of the
proposed two-story development.
There being no further comment, the hearing was closed.
Member Adams questioned whether or not development must conform to plans submitted
and Planning .Director Fretz stated that the Commission may condition an approval upon
conformance to the plans.
It was moved by Member Guyer and seconded by Member Harmstead that the application for
conditional use permit to allow development of a'-professional building at 488 Fourth
Avenue, an R-3 zone, be recommended to .City Council for approval and that action be
based on the following:
1. That the development will-not be materially detrimental to public health,
safety or welfare by means of noise, smoke' odor, dust or -vibrations,
explosion or fire nor increase in traffic hazard for the reasons that the
proposed. use does not involve any of these characteristics and off-street
parking is provided.
2. The characteristics of. the use'are compatible with adjacent development
in that it is adjacent-, to a medical-building -and a-hospital is being
constructed to the west.
The motion carried.by the following vote, to-wits
AYES: Members Guyer, Weakland, Stevenson, Harmstead and Adams
NOES: none
ABSENT: Member Stewart
Mr. Vic Wulff stated that the applicants might. desire to construct a three-story
building rather than.the two-story and future building .on the rear of the property
as shown on plot plan and. may need.a variance for reduction -in setback along Fourth
from 25 to 15 feet. He asked the Commissionts feelings on the matter. City Attorney

Kugler stated that the Commission had approved a two-story building, as stated in the
application and as shown on plot plan.. .and that a new application would have to be
submitted if the applicants desire a three-story building. Vice-Chairman Stevenson
stated that the Commission can consider a reduction in-setback only after submission of
a variance application and each application is considered on its own merits.
VARIANCES
PUBLIC HEARING - Abe & Rose Orley - 380 Hilltop Drive - Approval of Easement
The application was read requesting permission to divide property fronting at
approximately 380 Hilltop Drive and build on the rear lot' having access to Hilltop
Drive via an existing 18 foot easement. Planning Director Fretz submitted a map of the
area showing lot sizes and stated that with R-1 zoning, there is nothing to prevent the
lot on Hilltop Drive from being divided into two building sites of 7,200 square feet
each, He questioned the desirability of the city furthering this in view of the size
of other lots in the area, He then submitted a map showing lot sizes in the Cresta'Way
Annexation on the east side of Hilltop Drive. He said that. these property owners want
R-,11-B-20 zoning which they feel will help maintain the character of this area. Planning
Director Fretz suggested that the Commission consider interim zoning of R-1-B-20 for
the property in the Cresta Way Annexation and at the same time initiate R-1-B-12 zoning
for the area surrounding the Orley property.
This being the time and place as advertised' Vice-Chairman Stevenson opened the hearing.
Mr. Fretz stated that several persons had protested to him the use of the easement by
so many. properties.
It was moved by Member Adams, seconded by Member Guyer and carried that the public
hearing be continued to June 6j, 1960.. Member Weakland voted "no".
RESOLUTION NO. 170 - Calling Public Hearing for Consideration on Interim R-1-B-20
Zoning for the Cresta Way Annexation and for Consideration of
R-1-B-12 Zoning for Land on West Side of Hilltop Drive As Shown
on -Map
Offered by Member Harmstead, passed' adopted and approved by the following votes to-
AYES:
otAYES: Members Harmstead, Adams, Guyer.. Weakland and Stevenson
NOES: none
ABSENT: Member Stewart
SUBDIVISIONS
Final Maps
Sweetwater Valle Industrial Park
Planning Director Fretz submitted a map of the subdivision and explained differences
from the approved tentative map. He stated that the extra width appearing to be a part
of Highland Avenue is a frontage road and is desirable because of the difference in
grade and so that Willow Road will not intersect Highland at that particular location.
.He reviewed recommendations from the Engineering Department and the Commission discussed

the method of providing sewer for the area, since it is not possible at this time to
extend the sewer down the west line of Highland Avenue. Mr.Ralston, representing the
subdivider stated that a delay to prepare easements along the east side of Highland would
be a hardship and asked that the Commission recommend approval of the map to the City Coun.
cil subject to provision for the _sewer. City Attorney Kugler stated that the map should
be complete before it is approved by the Planning Commission.
It was moved by Member Adams, seconded by Member Guyer and unanimously carried that the
final map of Sweetwater Valley Industrial Park be continued to the June 6th meeting.
Mr. Ralston objected to the delay in action on the final map and stated that he believes
sufficient information is on hand that the Commission could approve the map and that
he understood from the Engineering Department that the map was approved for action by
the Planning Commission. Associate Engineer Phillips stated that the only approved plan
to sewer the area is for the line to run down the west side of Highland Avenue and that
this cannot be done until the Highland Avenue Annexation is resolved. He stated that
the subdivider had not been informed of this matter earlier because of the lack of
time and that if they propose to run the sewer down the east side of Highland, an ease-
ment will have to be provided. Mr. Kelley of the Tuttle Engineering Company stated
that the matter is primarily engineering and that he feels the map could be approved
subject to provision of sewer facilities as approved by the Engineering Department.
CONTIUNICATICNS
A letter, referred to the Planning Commission from the City Council, was read requesting
that Mr. 0. E. Underwoodis and Mr. Pickrell's property in -the Brown Annexation be zoned
C-2. A petition was noted signed by numerous property owners in the areaapproving C-2
zoning. It was moved by Member Guyer, seconded by Member Harmstead and unanimously
carried that a letter be written to Mr. Underwood advising him that an application
for rezoning should be filed. Mr.Bill Simms, 353 Montcalm, spoke favoring C-2 zoning
for the property.
MISCELLANEOUS
Home Occupations - Discussion
Planning Director Fretz stated that he feels the provision in the Zoning Ordinance for
home occupations should be studied further before it is determined that it is not working
properly and because there is nothing that needs immediate attention, he would prefer
that the discussion be delayed.
It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that
the discussion on home occupations be continued until such tine as the staff feels it
necessary to suggest further amendment.
Master Plan on Tidelands
Planning Director Fretz stated that the Harbor Commission would have a:publid hearing on ,
May 23 to consider the raster plan for development of the area west of Montgomery Freeway
as prepared by the planning staff. He stated that the Harbor Commission would like to
have as many members of the Planning Commission. as possible attend.

It was moved by Member Harmstead, seconded by Member Adams and unanimously-carried that
the meeting adjourn, sine die.
