HomeMy WebLinkAbout1960-06-06 PC MINS MINUTES OF A REGULAR MEETING OF THE PLANNING C011MISSION OF THE CITY OF CHULA VISTA, CALIFORNIA June 61 1960 A regular meeting of the Planning Commission of the City of Chula Vista was held at 7:30 P.M. on the above date in the Council Chamber at Civic Center with the following members present: Weakland, Stewart, Harmstead and Adams. Absent: Members Stevenson and Guyer. Also present: Director of Planning Fretz, City Attorney Kugler and Principal Engineer Harshman. APPROVAL OF MINUTES It was: moved by Member Harmstead, seconded by Member Adams and unanimously carried that the minutes of the meeting of May 16, 1960 be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - South Side of "K" Street, West of Third Avenue - R-1 and M-1 to C-2-P Planning Director Fretz submitted a map of the area showing zoning and property cuts. He stated that the Commission had initiated the hearing and that, if rezoned, the M=1 frontage on "K" Street would be developed with R-1 property adjacent on the south, which is being considered for C-2 zoning. This being the time and place as advertised, Chairman Stewart opened the hearing. Protests were heard from Mr. Frank Giardini, 351 San Miguel and Yxs. Frank Giardini, to the effect that commercial zoning of the R-1 property will be detrimental to their property value and that further consideration should be given to this before the zoning is acc omplished. Mr. A. L. Simas, 388 "K" Street and Mr. Behran, representing Mrs. Bagnell, spoke favoring the change of zone. _Planning Director Fretz stated that somewhere commercial and residential property must meet. He said that it is generally acknowledged that the rear property line is the logical division line. There being no further comment, the hearing was closed. RESOLUTION N0. 171 - Recommending to City Council Change of Zone From R-1 and M-1 to C-2-P of Property On South Side of "K" Street, West of Third Avenue Offered by Member Adams, passed, adopted and approved by the following vote, to wits AYES: Members Adams, Weakland, Stewart and Harmstead NOES: none ABSENT: Members Stevenson and Guyer PUBLIC HEARING - Madalon Bagnell - Rear of 350 "K" Street - R-1 to C-2 (cont.) Planning Director Fretz reviewed the -matter, stating,that the eastern portion of Mrs. Bagnell's property, land-locked and zoned R-1, is to be developed with the M-1 frontage on "K" Street, just recommended for rezoning to C^-Po Chairman Stewart reopened the hearing. Mrm Frank Giardini protested the change of zone, stating that it will detrimentally affect the value of his property at 351 San Miguel. There being no further comment' the hearing was closed. Member Adams stated that Mrs® Bagnell's property is needed to adequately develop the frontage on "K" Streetnproviding off-street parking. He stated that he feels commercial zoning backing up to the rear of residential property will have very little impact on the residential development, sighting as an example the recently built homes: abutting commercial frontage on Third Avenue in the 600 block. Mr. Adams stated that he feels the removal of the industrial use on "K" Street will have an up-grading effect on the residential property in the area. RESOLUTION N0. 172 Recommending to City Council Change of Zone from R-1 to C-2-P Property at the Rear of 350 "K" Street Offered by Member Harmstead9 passed, adopted and approved by the following vote, to merit: AYES: Members Harmstead, Adams, Weakland and Stewart NOES: none ABSENT: Members Guyer and Stevenson PUBLIC HEARING - Cresta Way Annexation - Interim R-1-B-20 Planning Director Fretz reviewed the proposed interim zoning of Cresta Way Annex- ation and stated that the one lot below the minimum 20,000 square feet R-1-B-20 zoning is already developed and can be.maintained as a lot which was a matter of record. This being the time and place as advertised, Chairman Stewart opened the hearing. There being no comment, either written or oral, the hearing was closed. RESOLUTION NO. 173 --, Recommending to City Council Interim R-1-B-20 Zoning for Cresta Way Annexation Offered by Member Harmstead, passed, adopted and approved by the following vote, to merit: AYES: Members Harmstead, Adams, Weakland and Stewart NOES: none ABSENT: Members Stevenson and Guyer PUBLIC HEARING - North of "G't Street, West of Hilltop Drive - R-1 to R-1-B-12 Planning Director Fretz submitted a map showing property cuts within the area proposed for R-1-B-12 zoning and explained that the lots below the minimum 12,000 , square feet required with this zoning could be maintained. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Robert Prescott, owner of property at 360 Hilltop Drive and Mr. John Anderson, 366 Hilltop Drive, stated they wished their properties to be excluded from the proposed zoning for the reason that they wish to further develop their property at a - 2 - later date. There being" no further comments the hearing was closed. Planning Director Fretz stated that one of the basic reasons for proposing Sup- plemental B-12 zoning for the property was to protect the character of the area, most of the lots having well over 7,000 square feet. He stated that another reason was the inadequacy of street access to the property west of Hilltop Drive. Member Adams stated he feels further division of some of the property will result in incompatible development. There being no further comment, the hearing was closed. Member Weakland questioned whether he should vote on the matter in view of the fact that he owns property within the area proposed for rezoning. City Attorney Kugler stated that in view of there being only four members of the Commission present and Member Weakland's vote is necessary to carry a motion., it would be better if he abstained from voting. Chairman Stewart rescinded the closing of the hearing and directed that it be continued to the June 20th meeting. REQUEST FOR REZONING - Oo E. Underwood - Portion of Brown Annexation, South Side- of Naples Street Between Melrose and Neptune - C--2-P It was moved by Member Harmstead., deconded by Member Adams and unanimously carried that a hearing be set for June 20th for consideration of change of zone from Interim R-1 to C-2-P for property on the south side of Naples Street., between Melrose and Neptune. REQUEST FOR REZONING - F. Whittington - Southwest Corner Hilltop Drive and "J" Street R-itoC 2 It was moved by Member Harmstead' seconded by Member Adams and unanimously carried that a hearing be set for June .20th for consideration of change of zone from R-1 to C-2 for property on the southwest corner of Hilltop Drive and "J" Street. REQUEST FOR REZONING - Henry Rienstra - Northwest Corner Fourth and "E" - R-3 to C-2-P It was moved by Member Harmstead., seconded by Member Adams and unanimously carried that a hearing be set for June 20th for consideration of change of zone from R-3 to 0-2-P for property on the northwest corner of Fourth and "E" Street. CONDITIONAL USE PERMITS PUBLIC HEARING - Hal Johnson - Approval of Trailer Park - South of Flower Street Extended., West of Woodlawn Avenue Mr. Johnson's application was read requesting permission to extend his existing trailer park south below Flower Street extended., west of Woodlawn Avenue., a C-2 zone. Planning Director Fretz submitted a map showing the proposed development and adjacent property cuts. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Elmer Sorrenson., speaking for the applicant., stated that the frontage of the — 3 — C-2 property on "E" Street would be developed with a commercial use and the trailer park will not be extended further south. There being no further comment, the hearing was closed, It was moved by Member Adams and seconded by Member Harmstead and unanimously carried that the Planning Commission recommend to City Council that the application for Con- ditional Use Permit submitted by Hal Johnson requesting permission to develop a trailer park on C-2 property, be approved as per plans submitted subject to the condition that all washroom and sanitary facilities required by the trailer park ordinance be con- structed. Further that the action be based on the following: 1. The granting of the permit will not be materially detrimental to the public health, safety or welfare in that the use does not involve the nuisance factora of smoke, odor, dust, vibration, explosion or contam- ination, nor does it appear that the use will create unusual volume or character of traffic. 2. The use is compatible with the other uses in the area as there is a trailer park to the north and commercial zoning to the south. VARIANCES: PUBLIC HEARING - Abe and Rose Orley - Approval of Lot Served by Easement - 380 Hilltop . Drive (cont.) Planning Director Fretz reviewed the request, stating that the applicant has property totalling 24,000 square feet fronting at approximately 380 Hilltop Drive and that they propose to divide the property into two lots. He stated that the westerly lot, to be served by an easement to Hilltop Drive, has 9,600 square feet, leaving adequate area in the Hilltop Drive frontage for two R-1 lots. Chairman Stewart stated he believes proper division of the property should be two lots fronting on Hilltop Drive. Member Harmstead stated one of the purposes of the proposed B�-12 zoning for the area was to prevent further division. It was moved by Member Harmstead and seconded by Member Adams that because the owners are not present and because the general area is being considered for B-12 zoning, the matter be continued to -June 20th. The motion failed to carry by the following vote, to fait: AYES: Members Harmstead, Adams and Stewart NOES: Member Weakland ABSENT: Members Stevenson and Guyer SUBDIVISIONS Sweetwater Valley Industrial Park - Final Map Planning Director Fretz submitted the final map of Sweetwater Valley Industrial Park and reviewed the conditions. of the tentative map. Engineering Department recommend- ations were read, It was moved by Member Adams,, seconded by Member Harmstead and unanimously carried that the final map of Sweetwater Valley Industrial Park be recommended to City Council - 4 - for approval subject to compliance with the Engineering Department recommendations as follows: 1. That a traffic barrier be provided on Highland Avenue opposite the Willow Street bulb connection to prevent ingress and/or egress for south bound traffic. 2. That -the subdivision map be clearly marked "Subject to Inundation', on each map. COMMUNICATIONS A letter was read from the Moose Lodge requesting permission to erect school safety signs on public property. It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that a request be made to. the Moose Lodge that one of the signs and the proposed locations of the signs be submitted at the June 20th meeting so that the Commission will have sufficient information to make a recom- mendation to the City Counci.lo MISCELLANEOUS Approval of Service Station Plans - Northwest Corner of Third Avenue and "L" Street Planning Director Fretz submitted and reviewed a plot plan of the proposed service station at. the northwest corner of Third Avenue and „L" Street and Engineering Department recommendations that the over-all width of each drive way into the station be a maximum 30 foot width. City Attorney Kugler stated that the amendment to the Zoning Ordinance allowing service stations in a. 0-I zone with a "special exception" appears to be invalid for the reason that no standards have been established to guide the Planning Commission and prevent arbitrary action. He stated that permission should not be granted pursuant to that provision and if service stations are a proper C-1 use, it should be by amendment to the Ordinance or possibly a conditional use permit procedure. Planning Director Fretz stated that there are many C-1 zones in the city that m uld not be suited to development with a service station and he feels allowing it in C-1 zones with a conditional use permit would prove more satisfactory. Chairman Stewart stated he agrees with the City Attorneyts statement and that an amendment to the Ordinance eliminating provision of service stations in a C-1 zone should be prepared. Comments favoring approval of the plans were heard from Mr. Art Westenborg and Mr. Charles Brown representing Richfield Oil and from Mr. William Ferguson of Richfield. It was moved by Member Adams, seconded by Member Harmstead and unanimously carried that the request for approval of plans be denied in view of the statement by the City Attorney that the provision allowing service stations in C-1 zones appears to be invalid. Approval of Equipment - Maintenance Service as Home Occupation An application for business license as a home. occupation was read requesting Commission approval of use of power tools, a table saw, radial arm saw and small joiner in a home occupation. Mr. Swallow, 612 Hilltop Drive, applicant, stated ® 5 - that the neighbors do not object to the use of the equipment which he believes is not heavy equipment. He stated that 90% of the work will be done in the customer's home and that what he will need to do in his garage does not exceed what he now does as a hobby. Chairman Stewart stated he feels the equipment is the same as that used in a. cabinet shop and should not be allowed as a business in a home. It was: moved by Member Adams, seconded by Member Harmstead and unanimously carried that the Planning Commission finds that use as a home occupation of the equipment described is, in the judgment of the Commission, objectionable from the standpoint of emission of dust, noise' vibration, etc. Amendment Providing for Limitations of Use of Rear and Side Yards Planning Director Fretz submitted a proposed ordinance limiting the use of front and side yards for the storage or parking of trailers, boats, etc.Q The Commission directed that the absent members be given copies of the amendment and that it be placed on the agenda of the June 20th meeting. Service Station Amendment The Commission discussed the desirability of eliminating the amendment of the Zoning Ordinance allowing service stations in a C-1 zone with "special exception" by the Planning Commission and listing them as permitted C-1 uses with a conditional use permit. It was moved by Member Adams, seconded by Member Harmstead and unanimously carried that an ordinance be prepared accordingly for the June 20th meeting. Southern California Planning Congress Dinner Meeting Planning Director Fretz informed the Commission of the dinner meeting to be held in Burbank on June 9th and asked that those wishing to go inform the Planning Department. Zoning The Commission discussed the balance of zoning in Chula Vista between commercial and residential in view of recent changes of zone *to C-2 and whether those properties recently zoned C-2 were of adequate size to conform to the Supplemental "P" zone requiring off-street parking. Planning Director Fretz submitted maps showing areas of the city$ particularly along Broadway, where zone depths do not meet property lines, thus leaving property divided by a zone boundary. "RESOLUTION NO. 174 - Resolution of Intention to Call Public Hearing to Consider Adjustment of Zone Boundaries to Conform to Property Lines in Various Parts of the City Offered by Member Adams, passed, adopted and approved by the. following vote, to-wit: AYES*- Members Adams, Weakland, Steuart and Harmstead NOES: none ABSENT: Members Stevenson and Guyer ADJOURNMENT It was moved by Member Harmstead, seconded by Member Adams and unanimously carried that the meeting adjourn to 7:00 P.M., June 20$ 1960.
