MINUTES OF AN ADJOURNED REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA June 20, 1960 An adjourned regular meeting of the Planning Commission of the City of Chula Vista was htld at 7:00 P.M. on the above date in the Council Chamber at Civic Center with the following members present: Stevenson, ZTeakland, Stewart, Adams and Guyer. . Ab- sent: Member Harmstead. Also present: Director of Planning Fretz and City Attorney I{ugler. STATEMENT The Secretary of the Planning Commission hereby states that she did post within 24 hours of the adjournment, as provided by law, the order of the City Planning Com- mission for the adjourned meeting of June 20, 1960, APPROVAL OF MINUTES- Meeting of June 6, 1960 It was moved by Member Adams, seconded by Member Stevenson and unanimously carried that the minutes of the meeting of June 6, 1960 be approved, copies having been mailed to each member. REZONING PUBLIC HEARING - West Side Hilltop Drive, North of ttGtt Street - R-1 to R-1-B-12 (cont.) Planning Director Fretz submitted a map showing area proposed for R-1-B-12 zoning and explained that it had been proposed to maintain. the character of the are a and also because of a lack of proper access for further lot splits. Chairman Stewart reopened the hearing. Mr. John Andersons owner of property within the area, asked that his property be deleted because he would like to divide his property further. He stated that lots adjacent to the north and west of his property have a maximum �8,000 square feet per lot. There being no further comment' the hearing was closed. Member Adams stated he feels there is every reason to rezone the entire area, as proposed, to B-12; that properties proposed for further lot split do not have street frontage and would have to be developed on easements, in which case, the fewer homes the better. RESOLUTION NO. 175 - Recommending Rezoning from R-1 to R-1-B-12 For Land West of Hilltop Drive, North of "Get Street. Offered by Member Stevenson, passed, adopted and approved by the following vote, to wit: AYES: Members Stevenson, Stewart, Adams and Guyer NOES: none ABSENT: Member Harmstead ABSTAIN: Member Weakland PUBLIC HEARING - South Side of Naples Street Between Melrose and Neptune Avenues - Interim R-1 to C-2-P -- Oliver Underwood The application was read requesting a change of zone from interimR-1 to C-2-P. Planning Director Fretz submitted a map showing the existing 4 acre shopping center at Hilltop Drive and Naples Street and the proposed 10 acre site on Telegraph Canyon Road. He explained that' as shown on the map, a 4 to 10 acre shopping center should serve 7 to 20 thousand persons. The interpretation of this is shown by inscription of a one-half radius service area around the Hilltop-Naples site containing approxi- mately 5,000 persons and a one mile radius service area around the proposed Telegraph Canyon Road site which ultimately is expected to contain 20,000 persons. He stated that the site on Naples Street proposed for rezoning is included in the expected service area of the Telegraph Canyon site. Planning Director Fretz stated that the parcel in question is 290 feet deep with 800 to 900 feet frontage on Naples. He stated that there is considerable vacant land adjacent and that a harmonious develop- ment could be designed for the entire area, with residential units and a shopping center and that the shopping area could be as .far south as Palomar Street. Mr. Fretz stated that a coordinated design for the entire area is almost mandatory in view of the topography and that it should be developed as one site. This being the time and place as advertised, Chairman Stewart opened the hearing. Comments favoring the rezoning were heard from' r. Oliver Underwood, applicant; ..�. Mr. William Sims, 353 Montcalm; Mrs. Darrell Wright, 280 Montclair and Mr. R. Markley, 387 Montcalm. Their comments were that Naples Street, presently half-width, would be improved to full width, improving traffic situation; that the proposed Telegraph Canyon Road shopping center is 314 mile away; that a fifth of the population of Chula Vista lives in this southeastern section; most of the people in this area do not have two cars and must walk to a shopping area; and necessary improvements for development of this land, with its -topography problem, would be very expensive. Protests were heard from Mr. Alfred Walton, 314 East Naples Street; Mr. Gordon Beckley, 361 East Naples; Mr. Leroy Gertch' 325 Naples; Mrs. A. Walton, 341. East Naples and Mr. Wilson Basye, 319 East Naples. Their comments were that a shopping area would increase the traffic and that the area should retain its present R-1 character. A petition was read approving the rezoning signed by 182 property owners and one approving the re- zoning signed by 1.4 teen-agers. Chairman Stewart stated that' all property owners like shopping facilities within walking distance but that it is not always possible. He stated that the Commission is attempting to develop a plan for orderly growth and- development of the entire city, shopping areas, schools$' etc© There being no further comment, the hearing was closed. Member Adams complimented the Planning Director on his presentation and stated he feels the Hilltop-Naples site is not too far to walk and that any commercial area in that vicinity should be further south and east. He stated that to expect shopping facilities within walking distance from each home is too extreme. It-was moved by Member Stevenson and seconded by Member Guyer that the request for change of zone from Interim R-1 to C-2-P for property on the south side of Naples: Street between Melrose and Neptune Avenues be denied in that neither public necessity, convenience, general welfare nor good zoning practice require the change. Further, that the action be based on the followings The praposed use is not compatible with - 2 - existing R-1 use in the area and because of the nearness of the Kellogg School. The motion carried by the following vote, to-wit: AYES. Members Stevenson' Stewart, Adams and Guyer NOESs Member Weakland ABSENT: Member Harmstead PUBLIC HEARING - Southwest Corner Hilltop Drive and 11J" Street - R-1 to Cm2 - Frank Whittington The application was read requesting a change of zone from R-1 to C-2' of property on the southwest corner of Hilltop Drive and "J" Street. Planning Director Fretz sub- mitted a map of the area. This being the time and place as advertised, Chairman Stewart opened the hearing. Comments favoring the rezoning were heard from Mr. Frank Whittington, applicant, and Mr. Thor Olsen, representing the present owner, stating the land is no longer suitable for residential use because of the location of the school and the traffic on both Hilltop Drive and "J" Street. Mr. Whittington cited the use of a garage to house a power generator for the San Diego Gas and Electric Company as an indication that it is not strictly a residential area. Protests were heard from Mr. Max Candiotti, 681 Hilltop Drive and Mr. Robert Mudd, 687 Hilltop Drive to the effect that it will increase existing heavy traffic, will be an intrusion into a residential area and•will act as a precedent for extending commercial zoning down "J" Street. A petition was read app- roving the change signed by 23 persons. There being no further comment, the hearing was closed. It was moved by Member Stevenson and seconded by Member Adams that the request for change of zone from R-1 to C-2 for property on the southwest corner of Hilltop Drive and "J" Street be denied in that it is not compatible with surrounding zoning and development and might act as a precedent for commercial zoning down "J" Street. The motion carried by the following vote, towit: AYES: Members Stevenson, Weakland, Stewart, Adams and Guyer NOES: none ABSENT: Member Harmstead PUBLIC HEARING - Northwest Corner Fourth and "Ell Street - R-3 to C-2-P - Henry Rienstra The application was read requesting change of zone from R-3 to C-2-P for property on the northwest corner of Fourth and "Ell Streets. Planning Director Fretz submitted a map showing zoning of adjacent properties. This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Paul Miller, representing the applicant, stated that the property has been divided into two lots, the corner one being 1501 x 161' and the portion adjacent on the north being 751 x 1501. Comments favoring the rezoning were heard from Mr. Paul Miller, Mr. Walter Henderson, owner of the second parcel and Mrs,, Dora Black, 440 "E" Street. They favored change of zone because the other three corners of the inter- section are used commercially and because the appraised value and selling price of the property, the heavy traffic on both "Ell Street and Fourth Avenue and resulting noise make it undesirable for residential use, - 3 - There being no further comment, the hearing was closed. Member Adams stated he believes commercial zoning for the corner lot is justifiable, but that he doesn't feel the second parcel should be rezoned® He stated that recent development of multiple residential along Fourth Avenue indicates that it can be used economically as R-3. It was moved by Member Adams and seconded by Member Weakland that the Planning Com- mission recommend to the City Council that the lot on the northwest corner of Fourth Avenue and "E" Street be rezoned from R-3 to C-2-P2 but that the second lot., to the north, remain R-3. Further that good zoning practice requires the change because the property is adjacent to other commercial property. The motion failed to carry by the following vote, to wait: AYES: Members Adams, Weakland and Stewart NOES: Membera Guyer and Stevenson ABSENT: Member Harmstead Member Stevenson stated that he thinks if such rezoning would occur that eventually it would be necessary to rezone "E" Street down to Broadway and that he has: felt for some time that there is too much commercial zoning in Chula Vista. He stated that he would like to see a survey of the city as to percentage of commercial to residential zoning and that he believes the subject property can be developed adequately with R-3 zoning. Member Guyer agreed with Nlember Stevenson. Member Adams stated that he feels the percentage of commercial zoning should not be considered alone and if property is in a. spot where it can logically be zoned for commercial use, it should be rezoned. Member Weakland stated that he feels the owners are being denied use of their property. Chairman Stewart stated that he feels the corner lot is entitled to commercial zoning as the other three corners have a commercial use but that he does not agree with the opinion that because property is on a heavily travelled street it must be zoned commercial. VARIANCES PUBLIC HEARING - 568 Broadway - Max Weinstock - Rear Yard Reduction 15 ft,, to zero The application was read requesting a reduction in rear yard setback at 568 Broadway from 15 feet to zero for the purpose of constructing a carport to enclose the existing parking area. Planning Director Fretz submitted a plot plan and explained that the rear of the property is zoned R-3 but that a variance was previously granted allowing its use by a commercial building and granting reduction in rear yard setback for the building from 15 feet to zeroo This being the time and place as advertised, Chairman Stewart opened the hearing. Mr. Carl Roth, representing Mr. Weinstock, stated that the carport 16'intended to keep children from homes to the.west from playing in the parking area. There being no further comment., the hearing was closed. It was moved by Member Guyer and seconded by Member Stevenson that the request for reduction in rear yard setback from 15 feet to zero for the purpose of constructing a: carport at 568 Broadway be approved. Further., that action be based on the following findings of fact: 4 1.( There are exceptional circumstances in that the property is being used for a commercial purpose and the variance will entitle the applicant to full use of his property, 2. The variance is necessary for preservation of a substantial property right so that the applicant may enclose his parking lot in order to keep children out of the area. 3. The variance will not be materially detrimental to public health, safety or welfare because there is no apparent objection to the reduction. The motion carried by the following vote, to wit: AYES: Members Guyer' Stevenson, Weakland, Stewart and Adams NOES: none ABSENT: Member Harmstead PUBLIC HEARING - North Side Naples Street' West Side of Hilltop Drive - Deduction in Side Yard Setback from 5 feet to zero - Dr. 0, S. Harbaugh and William Gibbs, Jr. The application was read requesting reduction in side yard setback from 5 feet to zero for the purpose of constructing a store building between the existing Mayfair Market and drug store. Planning Director Fretz submitted a plot plan of the property. This being the time and place as advertised, Chairman Stewart opened the hearing. A letter was read from Mr. Kenneth Reed, approving the variance. Dr. 0. S. Harbaugh spoke favoring the application. There being no further comment, the hearing was closed. It was moved by Member Adams and seconded by Member Guyer that the request for re- duction in side yard setback from 5 feet to zero be approved for construction of a- store building on the north side of Naples Street, west of Hilltop Drive. Furthers that action be based on the following findings of fact: 1. There are exceptional circumstances about the property in that the entire area is developed with a shopping center under a zone variance and the zero side yard setback is compatible with the other buildings. 2. The variance is necessary for preservation of a substantial property right because without it the owner will be deprived of full use of his property. 3. The variance will not be materially detrimental to public health, safety or welfare because there is no apparent objection to the reduction. The motion carried by the following vote, to merit: AYES: Members Adams, Guyer, Stevenson, Weakland and Stewart NOES': none ABSENT: Member Harmstead - 5 - APPROVAL OF PLANS FOR ADDITION TO SHOPPING CENTER Planning Director Fretz explained that under the terms of the variance allowing construction of a shopping center at the Hilltop-Naples location, the condition was made that all new construction be submitted to the Planning Commission for approval as to type of use and provision of off-street parsing, etc. He stated that the plans, for which a variance was just granted, are for a store building to be located in the shopping center and that off-street parking for the entire shopping center appears to be adequate. It was moved by Member Adams, seconded by Member Guyer and unanimously carried that the plans be submitted at the next meeting for a variety store at the described lo- cation. Planning Director Fretz stated that the plans, as submitted, have sufficient information for Planning Commission act16no Member Adams moved that the previous motion be amended to be that plans be approved. for construction of a junior department store or a variety store in the location as shown on the plot plan submitted. The motion was seconded by Member Guyer and unanimously carried, STREETS MID HIGHWAYS Route No® 241 Planning Director Fretz submitted a map showing the two alternates proposed for Route No. 241 of the Interstate Highway system. He explained the routing of each and stated that several new subdivisions were designed around the proposed Alternate A. Mr. Fretz stated that there will be a public hearing by the Division of Highways on June 27th at the Recreation Center in Chula Vista for consideration of the two routes and that the Planning Commission should make a recommendation to the City Council. It was moved by Member Guyer, seconded by Member Adams and unanimously carried that the Planning Commission recommend the approval of Alternate A:. for Route No, 241, MISCELLANEOUS APPROVAL OF EQUIR4ENT FOR HOME OCCUPATION Planning Director Fretz stated that an application for home occupation business license had been submitted by Mr. Myron Moore, 57 E. Fortuna, and that the applicant proposes to operate an electronic sales and service-business for hi-fi equipmento Mr. Moore stated that he will have a maximum 6 cubic feet storage of small parts and that the equipment used does not interfere with television reception and is a maximum 3 to 4 cubic feet in size. He stated that he has a full-time job and will only work at the home occupation on a part-time basis. RESOLUTION NO. 176 - Resolution Finding that Equipment Used for Electronic Sales and Service not Objectionable in Home Occupation Offered by Member Adams, passed, adopted and approved by the following vote, to wait: AYES: Members Adams, Guyer, Stevenson, Weakland and Stewart NOES: none ABSENT: Member Harmstead - 6 - Planning Director Fretz stated that the applicant may have approximately 6 cubic feet of storage of materials and asked whether or not consideration should be given to amending the ordinance on this point to allow storage of approximately 10 cubic feet. He stated that as it now stands, the staff must determine how much storage would be allowed. The Commission stated that they do not feel storage of approxi- mately 10 cubic feet would be objectionable. AMENDMENT PROVIDING FOR LIMITATIONS OF USE OF FRONT AND SIDE YARDS Planning Director Fretz reviewed the proposed amendment to the Zoning Ordinance limiting the use of front and side yards for storage of automobiles, trailers., boats, etc, The Commission discussed the desirability of eliminating the section prohibiting parking of automobiles in operable condition for more than 24 hours in front yards. The matter was continued to the next meeting for further study. July Regular Meeting It was noted that the regular July meeting of the Planning Commission will fall on July lith and that it cannot be held the next business day, as required by the City Charter., in light of the City Council meeting. The Commission concurred that July 11, 1960 would be satisfactory. RESOLUTION NO. 177 - Cancelling Regular Meeting Date for July, 1960.
