OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
January 5, 1959
A regular meeting of the Planning Commission of the City of Chula Vista was held
on the above date at 7:30 P.M. in Council Chambers: at Civic Center with the following
members present: Sparling, Calkins, Stewart, Adams and Culnan. Absent: none.
Also Present: Director of Planning Fretz, Principal Engineer Harshman and City
Attorney Kugler.
APPROVAL OF MINUTES'::
It was moved by Member Adams, seconded by Member Sparling and carried that the
minutes; of the meeting of December 19th be approved, copies having been mailed to
each member.
C W-UNICATIONS:
Appeal from Planning Commission Denial of Zone Change - Banister-Robinson-Henderson
North and South of "E" Street, Abutting S.D. & A.E.. Railway
An appeal filed by Mr® Lee Raitt to Planning Commission denial of the requested
change of zone was read and Chairman Stewart asked that the findings of the Planning
Commission be read for. approval. Lee Raitt stated that plans. for the development of
the property are ready and he would like to present them before the Commission takes
action on the appeal. Chairman Stewart stated, and the City Attorney concurred, that
the only action possible for the Commission at this time would be to forward their
findings.' on the denial of the zone change to the Council. Secretary Stonehouse read
the findings.
It was moved by Member Culnan, seconded by Member Calkins and carried that the
findings be approved as: written and forwarded to the Council, with the appeal, for
their action.
Recreation Areas=
A letter was: regd from Mrs. Esther McMahan requesting that the city give some con-
sideration to requiring more areal in multiple residential construction so that families:
living there will have, at least, some area for recreational use.
Chairman Stewart directed that the staff answer the letter., thanking Mrs. McMahan for
her interest and stating that the matter will be given serious study at the time the
zoning ordinance is amended,
Request for Six-Foot Fence - Pony League
A letter was read from the Pony League asking permission to construct a six-foot
fence within the setback on Fourth Avenue at their playing field in Eucalyptus Park,
The Commission directed that a letter be written to the Pony League stating that the
ordinance prohibits the construction of a fence over 32 feet in height within the
setback and that a six foot fence, as described for the Pony League ball park site,
would have to be approved by the Commission upon application for zone variance.
REZONING
Public Hearing - Southwest Corner of.Fourth and "E" Street --. James Connolly - R-1 to R-3
Mr, Connollyls application was; read requesting rezoning to R-3 of his property,next to
the real estate office at the southwest corner of Fourth and "E"' Street.
This being the time and place as advertised, Chairman Stewart opened the hearing. Mr.
. Connolly submitted, as additional information, an excerpt from the Planning Commission's
Report to the City Council on their denial of a previous request for zone change which
stated: "It would, however; not -be contrary to the principles of good zoning practice
to rezone the western one of these two lots to R-3, to act as a buffer between the
existing R--1 and the commercial on the corner. This compromise would also serve to
relieve this R=1 property from the hardship of abutting commercial usagem" There
being no further comments, Chairman Stewart closed the hearing,
It was moved by Member Culnan, seconded by Member Sparling and carried that the
application be approved and the Commission recommend to the City Council that Mr,
Connollyfs property, as described, be rezoned from R'-1 to R'�3 for the following
reasons::
1. It will not deteriorate the value of adjacent properties*
2. It will act as a buffer between the Rel to the west and the buainess; lot
on the corner, which will be in keeping with good zoning practicer

The application was read requesting that.the property on the southwest corner of
Fourth and "F", be rezoned to 0,-2 from R,3. Maps were presented showing existing
land use on the particular property, as well as land use on adjacent land and across
Fourth and "F" Streets. Plans were presented showing the miniature golf course
planned for a portion of the property, if rezoned.
This being the time and place as: advertised, Chairman Stewart opened the hearing.
Mr, Ralph Paxton, Jr., stated he would like his portion of the property to remain
R-3 at this time, but that he has: no objection to the rezoning- to C�2; of the rest
of the property as described. Mr. W. Fitzpatrick, owner of property at 432 "F",
west of the area proposed for rezoning, asked about the plans for widening "F", Mr,
Syd Morris, who proposed to construct the miniature golf course, stated that every
consideration will be given to any recommendation the Police Department might make
with respect to traffic safety, Member- Calkins stated that he feels that the Fourth
and "F" intersection is. a. very dangerous one and he questions whether or not the
already heavy traffic should be increased by such a use. The entrance. and exit to
the proposed miniature golf course, as shown on plans, was: discussed as to whether
or not the flow of traffic should be reversed, Chairman Stewart pointed out that
the application is for a zone change and that once the zone change is made there iso
no control over the development of the property. There being no further comment:
Chairman Stewart closed the hearing.
It was moved by Member Adams, seconded by Member Culnan and carried, with Member
Calkins voting "no", that the application requesting rezoning from R-3 to C�2 of the
property at the.southwest corner of Fourth and "F", as described on the application,.
be approved and recommended to the City Council, for the following reasons:.

1. That good zoning practice will be served in that the subject property is:
surrounded by commercial and industrial uses on the east and south and by
public buildings on the north; further, that the property does- not lend
itself to residential development, and is suitable -for C,2 zoning®
Public Hearing - Ordinance for Prezoning
The proposed ordinance on prezoning of lands abutting ChulaVista was: read and City
Attorney Kugler outlined an addition to the proposed ordinance which would require
the preparation of a zoning map for areas: that may be annexed, which reads as follows:
"To facilitate the purpose of thin section, the Planning Department shall prepare a
land use study map of areas surrounding the City of Chula Vista which may become
annexed to the city, Said map. shall be subject to the approval of the Planning Comm"
ission."'
Chairman Stewart opened the public hearing. There being no further comments, the
hearing was closed.
It waa moved by Member Sparling, seconded by Member Calkins and carried that the
Planning Commission recommend to the City Council the adoption of the Prezoning
Ordinance as read, with the additions proposed by City Attorney Kugler,
Site Plan Ordinance - Discussion
A "site plan ordinance", submitted by Consultant Whitnall, was discussed® It was
moved by Member Calkins that the hearing be set for the first meeting of February.
City Attorney Kugler stated that he feels that the Commission should study the
ordinance sufficiently before a public hearing is: called. Planning Director Fretz
concurred with this and told the Commission that it should not have been placed on
the agenda- as an item to be set for hearing'. Member Calkins withdrew: the motion
and then moved that the matter be set for consideration at the next meeting.
Member Sparling seconded the motion and it carried unanimously.
Approval of Plans for Bowling Alley , Banister Development Company
Mr. Harold G. Sadler, Architect, presented plans for the development of the bowling
alley for the J. M, Banister Development Company,, to be located on the south side of
"E« Street, east of Montgomery Freeway. Chairman Stewart read a letter from the
architec•ts:, describing construction materials to be used to decrease noise from the
bowling alley.
It was: moved. by Member Culnan, seconded by Member Calkins and carried that the plans,,
as presented, be approved with the understanding that there will bean entrance to
the development on Woodlawn at the southern edge of the propertys. and subject to
compliance with the letter submitted by Mre Sadler regarding transmission of noise
from the bowling alley,
SUBDIVISIONS'
Halecrest Estates-- Tentative Map
Planning Director Fretz reviewed the revised tentative map of Halecrest Subdivision
which the Commission approved on December 15th. He pointed out that the area along
Telegraph Canyon Road had been excluded from approval until access and design of
commercial area were worked out. He then explained the revision which had been
worked out with the developer,

It was moved by Member Sparling' seconded by Member Calkins and carried that the
revised tentative map of Halecrest Estates dated January 5, 1959, be approved and
recommended to the City Council for approval with the following conditions:
1. All conditions placed on approval of the tentative map- on December 15th
except number 5.
2. That a 22- foot alley, along the rear of all R--3 property, be improved
to its full width, according to Engineering Department specifications:.
3. That Telegraph Canyon Road be improved according to ordinance and city
specifications and that access be limited to that shown on approved map..
4. That the development of the commercial area be subject to our proposed
"Site Plan Ordinance"..
5. Setbacks be established at 15 feet when garages are arranged so that the
driveways curve and it is possible to park a' car without overhanging
public property and that setbacks be established at 20 feet when the
driveways go straight to the garage so that it is: possible to park a car
without overhanging public property.
McMillin Manor ® 'tentative Map
Director of Planning Fretz presented tentative maps. of McMillin Manor located within
the proposed McMillin Annexation.
It was moved by Member Sparling, seconded by Member Culnan and carried that the
tentative map of HdTillin Manor be approved and recommended to the City Council,
subject to the following provisions:
1. All recommendations of the Engineering Department be complied with
excepting that the drainage ditch between lots 3, and 4, on the north
side of Georgina Street.9ne -d be only 10 feet wide rather than 12 feet.
24 Setbacks be approved as shown.
3. Claire Avenue be developed to a 1/2 width through to "I" Street and that
curb and sidewalk be installed on the west side of Claire to "I" Street.
4. All lots have a minimum 7,,000 square feet in area.
Seaview: Estates No, 2 Final Map.
Mr. Fretz presented maps of Unit No. 2-of S'eaview; Estates and discussed the rec-
ommendations of the Engineering Department.
It was moved by Member Sparling, seconded by Member"Adams and carried that the
final map of Seaview Estates No, 2 be approved and recommended to the City Council with
the provision that Engineering Department recommendations be complied with.
Cortez Manor No, 2 - Final Map
Planning Director Fretz presented the final map of Cortez Hanor No,, 2. The letter
of recommendations from the Department of Engineering was read.

It was moved by Member Calkins, seconded by Member Adams and carried that the final
map of Cortez Manor No. 2 be approved and recommended to the City Council subject to
. compliance with all Engineering Department requirements.
ANNEXATIONS
Brown Annexation - South of Naples Street
Director of Planning Fretz presented a maps of the proposed 110 acre Brown Annexation
of uninhabited territory and explained its location,
It was: moved,by Member Sparling3 seconded by Member Calkins and carried that the Brown
Annexation be recommended to the City Council for approval.
United Annexation South of Telegraph Canyon Road
11r. Fretz submitted to the Commission a map of the proposed United Annexation of
uninhabited territory and a map showing its general location.
It was moved by Member Culnan, seconded by Member Adams and carried that the United
Annexation be recommended to the City Council for approval.
P.ylant No, 2 Annexation - North of Naples, east of Del Mar
Mr. Fretz explained to the Commission that this annexation of uninhabited territory
is adjacent to Pylant Yeo.' 1 Annexation on the east side of Del Mar, north of Naples
Street and presented maps showing its boundaries.. He said there are eight lots
involved.
It was moved by Member Adams, seconded by Member Calkins and carried that the Planning
Commission recommend to the City Council that the annexation be approved.
MISCELLANEOUS
Rewriting of Zoning Ordinance
The Commission discussed the inadequacies of the zoning ordinance and the resulting
confusion and loss of time to all concerned with its use. The Commission agreed that
there is immediate need for revision and the only sensible way to have a. comprehensive
basic tool is to have the zoning ordinance completely rewritten.
It was moved by Member Sparling, seconded by Member Calkins and carried that the
Planning Commission request the City Council to engage Gordon Whitnall' s cffice•to
begin work immediately on rewriting the zoning ordinance.
Official Plan Line Ordinance
Director of Planning Fretz discussed with the Commission the need for an official
plan line ordinance, the enabling legislation required to implement a Master Plan of
Streets and Highways. He explained that Chula Vista has a Master Plan of Streets
and Highways upon which we could adopt official plan lines. Mr. Fretz said this is
the tool that may be used to prohibit construction upon precisely engineered right-
of-ways for streets and highways and it appears now, that we will have a need for this
basic legislation in the months ahead.

It was moved by Member Adams, seconded by Member Culnan and carried that the
Planning Commission direct the City Attorney to prepare an Official Plan Zine
Ordinance for Commission consideration.
Recommendation for Planning Commission Member
Chairman Stewart stated that the City Council. will be appointing two new members to
the Planning Commission soon and he feels it might be well, if the Commission so desires,
to make any recommendations to the City Council they might have.
It was moved 'by Member Calkins, seconded by Member Sparling and carried that the
Planning Commission recommend to the City Council that Mr. Jack Harmstead, a former
member of the Planning Commission who resigned in January of 1955, be appointed to
fill one of the vacancies®
