HomeMy WebLinkAbout1959-02-16 PC MINS MINUTES OF AN ADJOURNED REGULAR MEETING OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA, CALIFORNIA February 163 1959 The adjourned regular meeting of the Planning Commission of the City of Chula Vista was held on the above date in Council Chambers at Civic Center at 7030 P.M. with the following members present: Sparling' Calkins, Stewart, Harmstead, Adams and Culnan. Absent: Member Stevenson. Also Present: Director of Planning Fretz, Planning Consultant Whitnall, City Attorney Kugler and Principal Engineer Harshman. APPROVAL OF MINUTES: It was moved by Member Calkins, seconded by Member Sparling and carried unanimously that the minutes of the meeting of February 16, 1959, be approved, copies having been mailed to each member. COMMUNICATIONS Letters were read from Mr. Michael Valen, 156 "E" Street; H. G. Morgan, 257 Broadway; Robert Pennegar, 1036 Vista Way; and Oliver Underwood, 482 Third Avenue, regarding the inclusion in a new zoning ordinance of a zone for professional uses. The Commission directed that the writers be thanked for their interest and that the letters; be held for consideration during the re writing of the Zoning Ordinance, REZONING Hobart Investment Company - 120 feet East of Broadway, South Side of "J" - R-1 to R-3 An application was read requesting that the property occupied by the Wilson's Trucking Yard as a non-conforming use be rezoned to R-3 for the reason that it is no longer suitable for R-1 development. It was moved by Member Calkins, seconded by Member Sparling and unanimously carried that the matter be set for hearing on March 16, 19590 William Wootters - Northwest Corner of Third and "L" - R-1 to C-1 The application was read, requesting that the property on the east side of Third Avenue above 11V Street be rezoned to C-1. It was moved by Member Culnan, seconded by Member Calkins and unanimously carried that the matter be set for public hearing on April 6, 1959, and that the planning staff prepare a study on the remaining frontage on Third Avenue as well as land use and proper development of the vacant land in that block. Rezoning of Newly Annexed Lands - Hilltop High School Annexations Stewart Annexations, Kile Morgan #2 Annexation, Kile Morgan #3 Annexation, "J" Street School Annexation, Judson Dam School Annexation' Buford-Morris Annexation, Morgan Annex- ation and Horgan-Stanley Annexation It was noted that the above-mentioned annexations, zoned R-a1 upon annexation as an interim zoning' have not as yet been considered for permanent zoning, as required by ordinance. It was moved by Member Culnana seconded-,by Member Sparli.ng and unanimously carried that a hearing be set for March 16th to consider permanent zoning of these newly annexed lands. Proposed Development of Property at the East End of the 300 Block of Palomar Drive Planning Director Fretz presented a map showing proposed development of land at the end of Palomar Drive in the 300 block and noted its proximity to, and possible effect upon.. the application for rezoning land at the northwest corner of Third and "L". The Commission directed that the map be placed on the agenda for the next meeting and that this proposal be considered in the survey to be made in connection with the application for zone change on Third and "Ye VARIANCES Pony League - Eucalyptus Park - Fifth Avenue - Setback Reduction The application asking for a reduction from 25 to 10 feet of the setback along Fifth Avenue for the construction of a six foot fence to contain a playing field was read. It was explained that the topography is such that a fence along the setback would not serve any purpose and that it would also cut down on the usable land. This being the time and place as: advertised, Chairman Stewart opened the hearing, There being no commentsp the hearing was closed, It was moved by Member Culnan, seconded by Member Calkins and unanimously carried that the setback reduction from 25 to 10 feet be -granted with the condition that the fence be: of chain link and that the action be based on the following findings of fact: 1. That there are unusual circumstances about the intended use of the property in that it was leased for the purpose of a playing field, with a fence as an accessory use. 2. That the land cannot be used for its intended purpose if the variance is not granted. 3. That the variance will not materially affect adjacent properties, SUBDIVISIONS Madeline Court - Final Map - King Street Extended, West to Second The final map of Madeline Court was presented to the Commission and the Director of Planning keviewed the conditions of the tentative map and the recommendations from the Department of Engineering for the final mape It was moved by Member Sparling, seconded by Member Calkins and unanimously carried that the final map of Madeline Court be approved and recommended to the City Council subject to the following conditions: - 2 1. That a 6 foot utility easement be provided at the rear of all lots. 2. That the 29 foot Lot As deeded by the Roseview subdivider' be dedicated for street purposes. 3. That the subdivider dedicate 7 feet to the south of Lot As Roseview Subdivision, for street purposes9 as shown on map. 4. All conditions of the tentative map be complied with. Robinhood No. 3 (formerly Kile Morgan ##3) - East of Baptist Church Mr. Fretz presented the final map of Robinhood No. 3, the tentative map of which had been filed as Kile Morgan No. 3, and reviewed the conditions of the tentative map. The recommendations from the Engineering Department were read. It was moved by Member Sparling' seconded by Member Culnan and unanimously carried that the final map of Robinhood ##3 be approved and recommended to the City Council subject to the following conditions: 1. That setbacks shown as 10 feet around the cul-de-sacs on Monterey Court and Mission Court be increased to 15 feet. 2. All other setbacks be approved as shown. 3. That the dimension on the diagonal property line between lots 114 and 115 be changed to read 136.80' rather than 186.800 4. That all Engineering Department requirements be complied with. MISCELLANEOUS Extension of Time - Use of Building for Church Purposes - Bay View Baptist Church A letter was read from the Pastor of the Bay View Baptist Church requesting per- mission to continue conducting church activities in the building at 672 Third Avenue until the new church plant is completed at the east end of Jamul Street,, It was moved by Member Sparling' seconded by Member Harmstead and unanimously carried that the request be granted and that the building at 672 Third Avenue may continue to be used for church activities for an additional 6 months' expiring on September 17, 1959- 395 By-Pass After discussion of the routing of 395 By*Pass to the east of Chula Vista' it was moved by Member Sparlings seconded by Member Calkins and unanimously carried that the Planning Commission recommend to the City Council that they authorize Director of Planning Fretz9 a representative of the City Engineer and any other person they might wish to designate' to contact the California State Highway Engineers to discuss with them the routing of 395 By-Pass. It was further moved and carried that other interested agencies--National Cityp San Diego City and San Diego County--be contacted as to whether or not they-wish to coordinate similar efforts. - 3 - Procedure for Public Hearings The Commission discussed the desirability of expediting rezoning matters by authorizing the planning staff to set the dates for public hearing rather than to require that applications be submitted to the Commission before a hearing is set. City Attorney Kugler stated that the Zoning Ordinance does state that the Commission shall set the hearing for zone variances as well as zone changes and that the proper action to change this procedure would be to request an amendment to the text of the ordinance. ._ It was moved by Member Adams., seconded by Member Culnan and unanimously carried that the City Attorney draw an ordinance giving the planning staff the authority to set the date for public hearing on rezoning applications and zone variance applications.
