OF THE PLANNING' COMMISSION OF THE
CITY OF CHULA VISTA' CALIFORNIA
April 20, 1959
An adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held on the above date at 7:30 P.M., -in the Council Chambers at Civic Center,
with the following members presents . Stevenson,. Sparling, Calkins, Stewart, Harmstead,
Adams and Guyer. Absent: none. Also present: Director of Planning Frets, City
Attorney Kugler, Planning Consultant Whitnall and Principal Engineer Harshman. °
Chairman Stewart introduced the new member of the Planning Commission who is replacing
Mr. Culnan, Commander William Guyer,
APPROVAL OF MINUTES:
It was moved by Member Sparling, seconded by Member Calkins and unanimously carried
that the minutes of the meeting of April 6, 1959 be approved, copies having been
mailed to each member.
REZONING
Request_ for Rezonixg Celia Hatz and William Wooters West Side of.-Third, "K" to "L".
The application was read, requesting rezoning from R®1 to C-1 of property on the west
side of Third Avenue beginning 290 feet south of "K" and extending to "L" Street.
Director of Planning Frets reviewed the matters' stating that this application includes
property on the west side of Third Avenue that is presently zoned R-1, and some M1.
The request extends to a depth of 290 feet.
It was moved by Member Stevenson, seconded by Member Harmstead and unanimously
carried that the matter be set for public hearing on May 18th,
VARIANCES"
Pttblic Hearing - F. R. Burgess & F. E. Dawson - 379 "J" St,
The application was read, requesting a variance allowing the two property owners to
divide their R-1 properties into eight building sates, five of which would have their
frontage on a 30-foot easement from "J" Street. Director of Planning Fretz presented
vicinity maps of the area, showing proximity of the property to Garrett Avenue in
Cortez Manor Subdivision and showing adjacent property cuts.
This being the time and place as. advertised, Chairman Stewart opened the hearing.
Protests as to the effect of proposed development on an existing drainage problem
were heard from Mr. John Wilburn, 395 "J", Mrs. Walter Hulme, 691 Fourth and Mr, ,
William Halton, 397 "-J". Mr. Dawson stated that they will follow the City Engineer's
recommendations as to drainage for the area if the Planning Commission grants the
variance. Member Sparling stated that he is of the opinion that development of the
property, as proposed, requires the filing of a tentative subdivision map. Director
of Planning Frets stated that he understood when talking to Mrs. Burgess that the
application was to be submitted for her property only and that he is of the opinion
the property in question should be.developed by a cul-de-sac from Garrett Avenue.
Mr, Lee Raitt stated that when Cortez Manor was- subdivided, the drainage was studied
and that there is a problem which will have to be settled by the City., Mr. Raitt
stated that they, as subdividers, had attempted to work out a way to include the
Dawson and Burgess properties in the Cortez Manor Subdivision, but had not been able
to reach an agreement, with the owners. He stated that he had stubbed the sewer on
the west line of Garrett so that it can be run into the Dawson-Burgess properties and
that he will buy their property for development or sell what he owns between Garrett
and the Dawson and Burgess properties at their price if they will pay one-half of the
improvements and build under the same restrictions he did in Cortez Manor.
There being no further comment, Chairman Stewart closed the hearing.
It was moved by Member Sparling and -leconded by Member Calkins that the variance be
denied for the reason that it is poor planning to put eight or nine houses on a 30—
foot easement and that it would not be sufficient access for emergency vehicles.
The motion carried by the following vote, to-wit:
AYES&. Stevenson, Sparling, Calkins, Stewart, Harmstead, Adams and Guyer

ABSENT: none
The Planning Commission recommended to the applicants that they file a tentative
subdivision map for subdividing the property.
Public Hearing ® F. I. & Dorothy Brown m 898 Second Avenue
The application was read, requesting permission to reduce the required side-yard
setback along Second Avenue from 25 to 11 feet for purpose of completing construction
on a patio. Director of Planning Fretz presented a plot plan showing location of the
patio in relation to property lines and streets.
This being the time and place as advertised, Chairman Stewart opened the public hearings
Mr. Brown spoke, stating that two required setbacks along streets left very little
building area on the lot.
There being no further comment, the hearing was closed.
It was moved by Member Harmstead that the variance be granted and the applicant be
- allowed to construct the patio as requested, with a reduction in setback to 11 feet
on Second Avenue. That the action be based on the following finding of facts:
1. There are exceptional circumstances pertaining to this property that do
not pertain to other properties in the area in that there are large
setbacks on both streets, cutting down available building area.
2. For this reason' the variance is necessary for the preservation of a
substantial property right.
3e The granting of the variance will not be materially detrimental to
public welfare or adjacent property or improvements, based on the fact
that Second Avenue is unimproved,

SUBDIVISIONS:
Mylo Ocean view Estates - Tentative Map
A second revision of the tentative map of Mylo Ocean view Estates was presented by
the Planning Director who reviewed the conditions of the first revision which had
been approved by the Planning Commission. He stated that the subdivision has been
enlarged, after annexation of more land, causing the submission of a third tentative
map. Mr. Fretz stated that the subdivision will have only one access, a one-half
width of Oneida Street which will be improved with an eighteen foot travel-way. Prim
cipal Engineer Harshman stated that'Mr. LoCicero has ggreed to pave an additional six
feet south of the Oneida Street centerline and the subdivision' if he is able to obtain
the land for dedication from the owner of the property. Mr. Fretz stated that it is
recommended that Oxford Street, shown as an 80 foot right-of-way., be approved as a 60
foot right-of-way.,
It was moved by Member Sparling, seconded by Member Calkins and unanimously carried
that the revised tentative map of Mylo Ocean View Estates be approved and recommended
to the City Council, subject to the following conditions:
1. Oxford Street be approved with a 60 foot right-of-way.
2® One foot lots as required by the Director of Planning.
3. All cut and fill slopes be according to F. H. A. specifications., including
the planting of slopes.
4. All recommendations of the Engineering Department be complied with.
5. It be recommended that the subdivider improve an additional six feet along
the south of the centerline of Oneida Street, to effect a 24 foot paved
travel-way, if the subdivider is able to obtain the land from the owners
McMillin Manor - Final Map
Mr. Fretz presented the final map of McMillin Manor and reviewed the conditions of
the tentative map which have been complied with.
It was moved by Member Stevensony seconded by Member Calkins and unanimously carried
that the final map of McMillin Manors having met all conditions of the tentative map,
be approved and recommended to the City Council.
Country Club View No. 2 - Final Map
Director of Planning Fretz stated that the final map is not ready for Planning
Commission action.
MISCELLANEOUS
Flood Zone Ordinance
Mr. Fretz stated that he had contacted San Diego County, as requested by the Planning

Commission' with regard to an ordinance establishing 'Flood Zones", and that the
county does not have such an ordinance. He said they have been directed to take
the matter under advisement. City Attorney Kugler stated that he has a copy of Los
Angeles County ordinance establishing 'Flood Zones" in two particular areas. Manning
Consultant Whitnall explained to the Commission the mechanics of such an ordinance,
and gave a brief resume of information that the city would have to acquire, before such
an ordinance could be adopted. Director of Planning Fretz stated that he will keep
in contact with San Diego County in an effort to get whatever information they might
obtain relative to the Sweetwater River Valley.
Amendment to Zoning Ordinance
Director of Planning Fretz summarized the proposed ordinance amendments. He suggested
that the Commission study the changes, comparing them with existing regulations. Chair-
man Stewart said he would appreciate particular study by the Commissioners of the pro-
vision for trailer parks in the R-3 zone under a Conditional Use Permit.
