OF THE PLANNING COMMISSION -OF THE
CITY OF CHULA VISTA, CALIFORNIA
October 15, 1959
A regular meeting of the Planning Commission of the City of Chula Vista was held on
the above date in the Council Chamber at Civic_Center at 7:30 P.M., with the following
members present: Stevenson, Sparling, Weakland, Stewart,-Harmstead, Adams and Guyer.
Absent: none. Also present: Director of Planning Fretz, City Attorney Kugler and
Principal Engineer Harshman,
APPROVAL OF MINUTES:
It was moved by Member Sparling, seconded by Member Harmstead and unanimously carried
that the minutes of the meeting of September 28th be approved, copies having been
mailed to each member.
PUBLIC HEARING -m Amendment of Zoning Ordinance to Allow "Home Occupationse1
This being the time and place as advertised, Chairman Stewart opened the hearing.
The proposed definition of "Home Occupation" was read and Planning Director Fretz
explained how the Zoning Ordinance would be amended to allow home occupations in the
residential areas.
There being no further comment, the hearing was closed.
RESOLUTION NO. 13.7 - Recommending to City Council Amendment to Zoning Ordinance to
Define and Provide for 'Home Occupations"'
Offered by Member Stevenson, passed, adopted and approved by the following vote,
to-wit:
AYES: Members Stevenson, Sparling, Weakland., Stewart, Harmstead, Adams and Guyer
NOES: none
ABSENT: none
Amendment to Ordinance 398 - Eliminating Racetracks as C-2 Use w Discussion
Chairman Stewart stated that the City Council .had directed that the Planning Commission
initiate a public hearing to eliminate racetracks as a C-2 use. City Attorney Kugler
recommended that any action be deferred at this time in view of present litigation
regarding race tracks. He stated that the city is taking the stand that race tracks
are not a permitted C-2 use.
It was moved by Member /Guyer, seconded by Member Harmstead and unanimously carried
that the matter be-deferred until final action in the litigation on race tracks and
. that a letter be written to City Council accordingly.
Billboards as a C-2 Use - Hale Company
A letter was read from the Hale Company asking permission to erect billboard signs
in the C-2 area along Broadway to serve as directional and advertising signs for the
Haleerest Estates Subdivision. The letter asked for consideration by the Commission
under the provision of the ordinance which allows other uses similar to and no more
objectionable than uses allowed in the same zone. City Attorney Kugler stated that
the ordinance classifies billboards as an M-1 use and the Commission cannot, by resolution
allow the use in a more restricted zone. The Commission discussed the desirability of
proposing an amendment to the Ordinance to allow billboards in 'a C-2 zone. Mr. R. Nickel,
from the Hale Company, stated that the signs are only temporary and are not more ob-
jectionable than others now on Broadway.
It was moved by Member Stevenson, seconded by Member Harmstead and unanimously carried
that a letter be written to the Hale Company stating that the ordinance now provides for
billboards as an M-1 use and the Commission cannot by resolution allow them in a more
restricted zone.
Meeting Dates
City Attorn§ry Kugler stated that it will be necessary that the City Council adopt an
ordinance establishing that the Commission shall have one regular meeting each month, to
conform to Charter requirements. He stated that the Commission has established by a pre-
vious resolution the date of the regular meeting and an adjourned meeting and that these
dates can be changed, if the Commission desires, by resolution.
It was moved by Member Adams, seconded by Member Harmstead and unanimously carried that
the City Attorney prepare an ordinance for submission to the City Council providing for
the regular meeting of the Planning Commission in accordance with Charter requirements.
REZONING
Request for Rezoning - Moss, Naples and Alpine Streets - R-1 to C-2
An application was read requesting rezoning from R-1 to C-2 of the lot at the inter-
section of Moss, Naples and Alpine Streets. It was moved by Member Sparling, seconded
by Member Guyer and unanimously carried that a hearing be set on November 2, 1959, for
consideration of the application.
Request for Rezoning - Rear of Property on Northeast Corner Third and IIL" Street
An application was read requesting reaoning from R-1 to C-2 of the property on the
northeast corner of Third and "LI'. It was moved by Member Sparlin.g, seconded by Member
Guyer and unanimously carried that a hearing be set on November 2, 1959, for consider-
ation of the application.
RRe.nest for Rezoning - Rear of Property on Southwest Corner Broadway and UP Street
An application was read requesting rezoning from R-3 to Cat of the rear of the property
on the southwest corner of Broadway and IIJI'. It was moved by Member Sparling, seconded
by Member Guyer and unanimously carried that a hearing be set on November 2, 1959, for
consideration of the application.
Request for Change of Setback - North Side of I'D", West of Woodlawn
An application was read requesting change of setback from 25 feet to zero feet along the
north side of I'D" west of Woodlawn. It was moved by Member Sparling, seconded by Member
Guyer and unanimously carried that a hearing be set on November 2, 1959, for consider-
ation of the application.

PUBLIC HEARING - Lowell Terry - 600 "F" Street - Trailer Park (continued)
Planning Director Fretz reviewed the matter and submitted a map showing location of
service roads and entrances to the trailer park, location of proposed buildings and the
swimming pool.. He stated that ordinances will require improvement of 'IF" Street with
curb, gutter `and. sidewalk and provision of off-street parking.
This being the time and place as advertised, Chairman Stewart opened the hearing,
Mr. Lowell Terry spoke favoring the trailer park and stated that it vaill be developed in
the same manner as the existing portion. There being no further comment, the hearing
was closed.
It was moved by Member Harmstead and seconded by Member Guyer that the application for
conditional use permit submitted by Lowell Terry for a trailer park in the 600 block of
"F" Street be approved and recommended to City Council, subject to compliance with all
requirements expressed in the ordinances. That the action be based on the following:
1. The granting of the permit will not be materially detrimental to the public
welfare, health or safety, in that there will be no damage from explosion,
contamination or fire nor will there be any noise, odor, smoke dust or vib-
ration involved in the use.
2. The characteristics of the use proposed are reasonably compatible with types
of use in the area.
The motion carried by the following vote, to-Wit:
AYES: Members Ha.rmstead, Adams, Guyer, Stevenson, Sparling, Weakland and Stewart

L. J. Reuter - 698 Fourth Avenue Setback Reduction
The application was read requesting reduction in setback on Mr. Reuter's propertyg from
25 feet to 17 feet on Fourth Avenue and from 25 feet to 22 feet on "J" -Street. Planning
Director Fretz submitted a plot plan of the property showing driveway access to the
proposed garage and location of the driveway entrance from the intersection.
This being the time and place as advertised, Chairman Stewart opened the hearing.
Mr. Reuter stated that he has designed a 1700 square foot home and that the require '.
setbadks take approximately one third of his property. There being no further comment,
the hearing was closed.
It was moved by Member Sparling and seconded. by Member Guyer that the application for
reduction in setback on Fourth Avenue from 25 to 17 feet and on "J" from 25 to 22 feet
for property at 698 Fourth Avenue, be approved for the reason that having two large set-
backs' the buildable portion of the property is greatly reduced, causing a hardship
and that it will not be materially detrimental to the property in the area.
The motion carried by the following vote, to-grit:
AYES: Members Sparling, W'eakland, Stewart, Harmstead, Adams, Guyer and Stevenson

SUBDIVISIONS
Russell P. Haas Industrial Park - Tentative Map
Director of, Planning Fretz submitted the tentative map of the subdivision and reviewed
adjacent land use and zoning, Mr. Fretz stated that he feels it is very desirable
that a map be filed on industrially--planned areas., and that the design be flexible,,
He stated that -the map proposes 48 foot wide travelways for streets U7ith an 8 foot
cement swale rather than curb and gutter, which will give a 64 foot overall improved
section in an 80 foot right-of-way. Mr. Fretz reviewed his recommendations and those
of the Engineering Department. The Commission discussed the feasibility of requiring
a sewer line to be constructed on Main Street in view of Principal Engineer Harshmants
statement that contact has been made with San Diego City and San Diego County in an
effort to provide sewer facilities in that area® It was felt that this should be
considered at the time the final map is submitted.
It was moved by Member Guyer, seconded by Member Adams and unanimously carried that
the Planning CdLmmission recommend approval of the tentative map of Russell P. Haas
Industrial Park to the City Council, subject to the following conditions:
1. Zero setback along all streets.
2. 1 foot lots be dedicated where recommended by the Planning Director.
3. Provision be made for Orange Avenue to extend west if it can be worked out$
4, That 20 feet be dedicated for Main Street in addition to the existing
right-of-way with the understanding that the San Diego Gas & Electric
Company have agreed that .they will dedicate 20 feet of their property

5. That improvements of streets be-4 inches of asphaltic conerete .over
9 inches decomposed granite rather than 3 inches over 6 inches as proposed.
MISCELLANEOUS
Amendment to Residential Zones - Providing for Larger Lots
Planning Director Fretz reviewed- the proposed amendment to the Zoning Ordinance
which will provide for larger lots than now required in Chula Vista and will establish
appropriate open spaces on these lots. He stated that property owners in several
areas have indicated an interest in larger lot areas and that it appears desirable
that Chula Vista make provision for them.
It was moved by Member Sparling3 seconded by Member Guyer and unanimously carried that
a public hearing be set on November 2' 1959, for consideration of an amendment to the
Zoning Ordinance providing for larger building sites than now required.
Zoning on "Ku Street
Member Adams asked if it is still the intention of the Commission to consider re-
zoning the M-1 zone on RK" Street, west of Third Avenue, to commercial. He noted
that only the frontage of these lots is zoned 141-13 the rest being R-1. The Commission
directed that the Planning Director prepare maps of the area showing property cuts,
