OF THE PLANNING COMMISSION OF THE
CITY OF CHULA VISTA, CALIFORNIA
October 26, 1959
An adjourned regular meeting of the Planning Commission of the City of Chula Vista
was held at 7:30 P.M. on the above date in the Council Chamber at Civic Center with
the following members present: Stevenson., Weakland, Stewart, Harmstead, Adams and .
Guyer. Also present: Director of Planning Fretz and City Attorney Kugler.
STATEMENT
The Secretary of the Planning Commission hereby states that she did post within 24
hours of adjournment., as provided by law, the order of adjournment of the City
Planning Commission for the adjourned meeting of October 26, 19590
APPROVAL OF MINUTES-
It was moved by Member Stevenson, seconded by Member Harmstead and unanimously
carried that the minutes of the meeting of October 15., 1959 be approved with the
following correction: Item 5 under approval of Russell Pa Haas Industrial Park
Subdivision on page 4 should read " 3 inches of asphaltic concrete over 9 inches of
decomposed granites' rather than 116 over 911, as recorded.
REZONING
PUBLIC HEARING - Allen-Besker ® Northeast Corner Third and "D" - R-1 to R-3
The application was read requesting rezoning from R-1 to R-3 of the northeast corner
of Third and "D" and Planning Director Fretz submitted a map showing zoning of ad-
jacent properties.
This being the time and place as advertised., Chairman Stewart opened the hearing.
A letter was read from the Fredericka Homes stating that they intend to request R*-3
zoning for their property_.on the southeast corner of Third and s'D" for development
with a geriatric hospital. Mr. Herb Allen and Mr. Besker voiced opinions as to why
the property is not suitable for R-1 use. Mr. �Louis Rudolph, 299 Sea Vale, stated
that R-3 zoning had previously been denied for land north of this particular property.
Chairman Stewart observed that to zone this lot R-3 at present would be spot zoning.
Planning Director Fretz dtated that Mr. Baker, Superintendent from Fredericka Homes.,
indicated they will submit an application for R-3 zoning very soon*
It was moved by Member Guyer., seconded by Member Adams and unanimously carried
that the public hearing be continued to the meeting of November 16, 1959.
CONDITIONAL USE PERMITS
PUBLIC HEARING - Hardy and Ursula Rothschild - 471 "E" Street - Art Gallery
The application was read requesting a conditional use permit to allow operation of an
art gallery in the home at 471 "Es' Street*
This being the time and place as advertised, Chairman Stewart opened the hearing.
Letters of protest were read from the Bank of America as trustees of the Tessitore
Estate at 457 UEU Street and from Charles and Lillian Clarkson, 446 Fern Street;
Raymond and Isabel Carpenter, 450 Fern Street and William and Marie Lang, 440 Fern
Street. The protests were that this use would be the only nonresidential use on
the block; it would act as a precedent for other commercial uses and would result
in a parking problem. Protests were heard from Mr. William Ramage, 214 Fig, speaking
for himself, Mrw.Jack Stewart, 250 Fig and Mrs. Charles Huffman, 221 Fig. Protests
were also heard from Mr0 Hank Ferris, 189 Brightwood, Mrs, Alice Parkins, 185 Brightwood
and Mr. Frank Relaford, representing the Trust Department, Bank of America, for the
Tessitore Estate, Mr. Roscoe Johnson, 161 Brightwood, spoke favoring the permit,
stating that he feels it will benefit the area and that "Ea Street is no longer desirable
for residential use because of the heavy traffic Mr, Rothschild stated that he intends:
to continue living in the house after the business is established and that there is
not sufficient volume in this type of business to warrant a shop in a commercial loc..
ation.
Member Stevenson stated that the conditional use permit procedure was provided for
the purpose of allowing some commercial uses in R-3 zones if the characteristics are
compatible with the surrounding area. He stated that while in this particular in.
stance it is not likely that a large number of customers would be on the premises at
one time' it is a retail business whose characteristics are not normally compatible
with residential uses. - Member Harmstead stated that he feels the ultimate zoning and
development of DED Street must be considered. Director of Planning Fretz reviewed the
previous consideration of commercial zoning of UEU Street, stating that the design of
the property " shallow lots, no alleys or provision for parking and the relation of
the RE" Street property to that on the side streets, indicated that commercial de-
velopment would be improper. He stated that he feels "Ell Street is undergoing a
transition and that the conditional use permit procedure-could be used to help resolve
this problem through control by the city over the uses. He feels consideration must
be given as well to whether such a permit would "open the doom' to uses with more
commercial characteristics.
There being no further comment, the hearing was closed®
It was moved by Member Stevenson and seconded by Member Guyer that the application
for conditional use permit for an art gallery and antique shop at 171 "E" Street be
denied for the reason that the characteristics of the use are not reasonably compatible
with the uses in the surrounding area. The motion carried by the following vote, to-vit:
AYES: Members Stevenson, Weakland, Stewart, Adams and Guyer
NOES: Member Harmstead
ABSENT: Member Sparling
VARIANCES
PUBLIC HEARING Bollenbacher-Kelton - 1100 Industrial Boulevard Setback Reduction
The application was read requesting a reduction in setback along Montgomery Freeway
from ten feet to three inches. Planning Director Fretz submitted a plot plan of the
area showing the location of the proposed cabana-type structure to serve as a wind«
break for the swimming pool. He explained that the property has double frontage and
that the Zoning Ordinance provides for a 10 foot setback on one of the streetso

Mr. Swanner, representing Bollenbacher and Kelton, presented an artist's sketch of
the.proposed shelter' stating that it will also serve to screen the pool from motorists
on the freeway.
There being no further comment, the hearing was closed.
It was moved by Member Adams and seconded by Member Stevenson that the application for
reduction in setback along Montgomery Freeway from 10 feet to zero feet be approved,
based on the following:
1. The area is 'zoned M-2 and a zero setback has been established on other
industrially zoned property in Chula Vista.
2. Without the variance, the property owner is deprived of use of a considerable
portion of his property.
3. The property adjoins a freeway right-of-way and it does not appear that
adjacent property, which is owned by the applicant, will be affected.
The motion carried by the following vote, to,-Wit:
AYES.- Members Adams, Guyer, Stevenson, Weakland, Stewart and Harmstead
NOES: none
ABSENT: Member Sparling
SUBDIVISIONS
Seaview Estates No. 5 Final Map
Planning Director Fretz submitted the final map of Seaview Estates No. 5 and stated
that conditions of the tentative map have been or will be complied with before final
approval of the City Councils
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried
that the Planning Commission recommend to the City Council approval of the final map
of Seaview Estates No. 5, subject to compliance with all conditions of the tentative
maps
Halecrest Estates, Unit B - Final Map
Planning Director Fretz submitted the final map of Halecrest Estates, Unit B, stating
that the map proposes 45 foot radius cul-de-sacs in the subdivision, rather than
50 foot radius cul-de-sacs® He stated that the resulting travel-way will be the same
and that the Engineering Department recommends approval.
It was moved by Member Guyer$, seconded by Member Harmstead and unanimously carried
that the Planning Commission recommend to the City Council approval of the final map
of Halecrest Estates, Unit B. with 45 foot radius cul-de-sacs, subject to compliance
with all conditions of the tentative map.
MISCELLANEOUS
Zoning Discussion - Pylant Annexations

Planning Director Fretz stated that he had not completed his studies on land use in
the area and the Commission continued the matter to the next meeting,
Zoning Discussion - Third and UK"
Planning Director Fretz .submitted a map showing property cuts and existing zoning
west of Third Avenue at "K" Street.
It was moved'by Member Stevenson, seconded by Member Adams and unanimously carried
that a public hearing be set for December 7, 1959, for consideration of rezoning from
R-1 and M-2 to C-2, property on the north and south sides of "K" Street, west of Third
Avenue, as shown on map.
Field Survey Data
Mr, Fretz reported that the tabulations have been received on the field survey con-
ducted for the purpose of preparation of a master plan. He submitted figures showing
percentages of existing land uses as compared to existing zoning and explained htw!;
this information would be used in studies for a master plan,
League of California Cities Convention
The Commission discussed the value of attending the League meetings and requested
that a letter be prepared for the City Council thanking them for the opportunity
and reporting upon points of special interest to the Commission,
ADJOURNMENT
It was moved by Member Harmstead, seconded by Member Guyer and unanimously carried
that the meeting adjourn, sine die.
